2014년 주요 의료판결 분석 (Review of 2014 Major Medical Decisions)

  • 법원은 2014년에도 의료와 관련된 의미 있는 판결들을 선고하였다. 법원은 수술 시 의료기구를 본래의 용도와 달리 사용하던 중 부러진 경우 이로 인한 사고에 의료진의 과실을 추정하였고, 설명의무와 관련하여 안전성이 검증되지 않은 수술을 시행하는 경우 설명의무 위반과 부작용 발생 사이의 인과관계를 인정하여 전손해배상이 인정될 수 있다는 점, 미용수술의 경우 일반적인 의료행위에 비하여 설명의무의 대상이 확대되어야 하는 점, 예상할 수 없는 범위에까지 설명의무를 인정할 수는 없는 점 등을 판시하였다. 또한 법원은 환자의 자기결정권과 의사의 진료의무 사이에 충돌이 발생한 경우 자기결정권 행사의 요건과 한계를 제시하였으며, 자동차보험계약이란 자동차사고와 관련된 배상 책임은 보험회사가 부담하기로 하는 계약이므로 비록 의료법에 위반되어 설립된 사무장 병원이라 하더라도 환자를 치료하고 보험금을 수령하는 것은 불법행위에 해당하지 않는다고 판시하였다. 의료기관 자체가 부당한 경제적 이익을 얻었을 뿐 의료기관 종사자들이 별다른 이익을 얻지 않은 경우, 리베이트 수수를 금지하는 의료법에 따라 의료기관 종사자들을 처벌할 수 없다는 견해를 밝힌 판결도 눈에 띈다. 그리고 법원은 업무정지처분을 받은 의료기관을 폐업하더라도 같은 장소에서 같은 운영자가 새로이 의료기관을 개설하는 경우 처분의 효과가 미친다고 판시하였고, 의사가 스스로 개설한 의료기관 외에서 진료행위를 할 수 있는 요건에 대하여 판시하였으며, 의료법을 위반한 혐의로 유죄 판결이 확정되기 전에는 이를 이유로 행정처분을 할 수 없다고 판시하였다.

경기 북부 지역 초등학교 영양사의 식자재 공급관리에 대한 인식도 및 실천도 (Elementary School Dietitian's Awareness and Performance of Food Supply Management in Gyeonggi North Province)

  • The principal objective of this study was to assess dietitian's awareness and performance with regard to food suppliers' selection guidelines and purchase guidelines for the receipt of safe food materials. A questionnaire was administered to 203 dietitians working at an elementary school in Gyeonggi North province, and 190 responses were ultimately returned. Excluding responses with incomplete answers and significant missing data, 161 responses(79.3%) were ultimately utilized for data analysis. We determined that meat/poulty and seafood were purchased mainly by manufacturer's branch(59.8% and 78.3%), and processed food and kimchi were generally purchased by producer's cooperatives(47.7% and 44.9%). 78.3% of the contracts were made via informal purchasing and the frequency of contracts was less than 3 times per year(53.4%). Market studies were conducted individually(54.7%), and by group(47.2%). Dietitian and parents volunteered(50.3%) or dietitians, and school and foodservice staffs(45.3%) participated - together in receiving and inspection. School contracted with $4{\sim}5$(39.1%) and $6{\sim}8$ food suppliers(29.8%). Dietitians(42.3%) or school councils(40.2%) evaluated food suppliers once per semester(60.2%). The majority of dietitians(96.3%) conducted sanitary education for food suppliers once per semester (68.3%). All 13 guidelines which were usually used to evaluate food suppliers were thought to be important(more than 4) based on a 5 scale(1: never important, 5: very important). Among them, 'sanitary storage status of food products(4.85)', 'have a chill car(4.83)' and 'proper control of refrigerator, freezer and storage room(4.81)' were the most crucial guidelines. As dietitians evaluated food supplier's-observances of 13 guidelines, 'have a chill car(4.89)', 'hold medical examination of employees(4.89)' and 'hold liability insurance for handling product(4.80)' were fulfilled relatively well. The guidelines for conducting education for their employees(4.45) and keeping their establishment and equipment sanitary(4.79) were important, but were not observed well(3.39 and 3.37). Additionally, the difference between the importance and the observance score of the 'HACCP certificate' were fairly significant(4.44 and 3.54). Dietitians tended to report that purchasing management related to the removal of foodborne illness factors(4.71), return confirmation(4.50) and purchase specification(4.32) were important. The difference between importance and performance was highest in the process of changing food suppliers when the contracts were violated more than three times. Dietitian's age, education work experience and employment type had no observable effects on how important they considered purchase management to be, but their work experience significantly affected performance in terms of the removal of foodborne illness factors(p<0.05). As supplier management is the most critical factor, it is clearly desirable to educate suppliers at specialized training centers and to supervise suppliers in accordance with the established sanitary guidelines.

시공간 분석을 이용한 외래 의료이용의 지역적 차이 분석 (Regional Disparity of Ambulatory Health Care Utilization)

  • 본 연구는 시공간분석을 이용하여 주요 만성질환인 고혈압, 당뇨병, 관절증과 총의료이용에 있어 지역별 외래의료이용 차이를 살펴보았다. 분석자료는 보건복지부와 한국보건사회연구원에서 발간하는 1996, 1999, 2002, 2005, 2008년 환자조사 자료를 이용하였으며 분석방법으로는 베이지안 계층적 시공간모형(bayesian hierarchial spatio-temporal model)을 이용하였다. 이때 지역의 공간적 상관성은 convolution CAR 모형을, 시간적 상관성은 Ornstein-Uhlenbeck 방법을 적용하여 분석하였다. 분석결과 질환별로 의료이용에 있어 지역적 차이가 존재하였다. 총의료 이용의 경우 시 군지역보다 대도시인 구지역에서 높은 상대위험비를 보인반면, 만성질환인 고혈압, 당뇨병, 관절증은 총의료이용과는 달리 강원도, 충청남북도, 전라남북도, 제주도 등 농어촌 지역에서 전국평균보다 높은 의료이용(상대위험비)을 보였다. 특히 고혈압은 부산경남 해안가 지역과 강원, 경기, 경북, 충청남도, 전북 등에서 높은 의료이용을 보였고, 관절증은 경기, 강원 일부와 충북, 충남, 전북, 전남, 경북, 경남지역 등에서, 당뇨병은 경기, 서울, 부산, 전라남북, 충청일부 지역에서 상대적으로 높은 의료이용을 보였다. 본 연구는 기존 연구와는 달리 공간적, 시간적 상관성을 고려함으로써 지역단위 분석시 공간적, 시간적 상관성을 고려하지 않음으로써 발생하는 통계적 오류를 최소화하였다.

3차 병원에 입원한 교통사고환자의 평균 재원기간과 조기퇴원시의 수입증대효과 분석연구 (Analyses on the Mean Length of Stay of and the Income Effects due to Early Discharge of Car Accident Patients at General Hospital)

  • This study attempts to encourage the development of a rehabilitation delivery system as a substitute service for hospitalization such as a community based intermediate facility or home health care. We need substitute services for hospitalization to curtail the length of stay for inpatients due to car accidents. It focused on developing an estimation for early discharge based on a detailed statement of treatment from medical records of 109 inpatients who were hospitalized at General Hospital in 1997. This study has three specific purposes: First, to find the mean length of stay and mean medical expenditure. Second, to estimate the mean of early discharge from the mean length of stay. Third, to analyize the income effect per bed from early discharge. In order to analyze the length of stay and medical expenditure of inpatients the author conducted a micro and macro-analysis with medical expenditure records. To estimate the early discharge we examined with a group of 4 experts decreases in the amount of treatment after surgery, in treatments, in tests, in drug methods. We also looked their vital signs, the start of ROM exercise, the time removel, a patient's visitations, and possible stable conditions. In addition to identifing the income effect due to an early discharge, the data was analyzed by an SPSS-PC for windows and Excell program with a regression analysis model. The research findings are as follows: First, the mean length of stay was 47.56 days, but the mean length of stay due to early discharge was 32.26 days. The estimation of early discharge days was shown to depend on the length of stay. The longer the length of stay, the longer the length before discharge. For example, if the patient stayed under 14 days the mean length of stay was 7.09 while an early discharge was 6.39, whereas if the mean length of stay was 155.73, the early discharge time was 107.43. The mean medical expenditure per day of car accident patients was found to be 169,085 Won, whereas the mean medical expenditure per day was shown to be in a negative linear form according to the length of stay. That is the mean expenditure for under 14 days of stay was 303,015 Won and the period of the hospitalization of 15 days to 29 days was 170,338 Won and those of 30 days to 59 days was 113,333 Won. The estimation of the income effect due to being discharged 16 days was around 2,350,000 Won with a regression analysis model. However, this does not show the real benefits from an early discharge, but only the income increasing amount without considering prime medical cost at a general hospital. Therefore, we need further analysis on cost containments and benefits incending turn over rates and medical prime costs. From these research findings, the following suggestions have been drawn, we need to develop strategies on a rehabilitation delivery system focused on consumers for the 21st century. Varions intermediate facilities and home health care should be developed in the community as a substitute for shortening the length of stay in hospitals. In home health care cases, patients who want rehabilitation services as a substitute for hospitalization in cooperation with private health insurance companies might be available immediately.

대학생의 한방의료에 대한 인식 정도 조사 (Survey of University Students' Perception Degree of Korean Medical Care)

  • Objectives : The purpose of the present study is to grasp and provide basic data necessary for the establishment of korean healthcare policies in future. Methods : A questionnaire developed by the author was distributed to 299 students of D University located in Busan and collected thereafter from March 5 to June 1, 2012. Statistical processing of the data obtained was conducted using the SPSS WIN IBM 20.0 program to indicate outcomes in frequencies and percentages. Results : The results of the survey are as follows. 1. The number of students who were mainly using korean hospitals/clinics was 6(2.0%). The most important factor in selecting korean medical institutions was 'medical technology'. 2. The treatment that was received the most frequently and the most reliable at korean medical institutions was acupuncture. The most frequent reason for taking korean medicine was 'prescriptions tailored to constitutions' and the most frequent reason for avoiding korean medicine was 'high prices'. 3. There was few number of students who knew that car insurance coverage for traffic accidents include treatment at korean clinics. and who knew about 'permitted standard herbal medicine', 'the use of disposable needles', 'wild ginseng pharmacopuncture'. 4. Among items necessary for the development of korean medicine, 'treatment technology with fast and high effects' was the most frequently selected. Conclusions : University students' preference for and perception of korean medicine were shown to be very low. It is considered that public relations should be reinforced to implant correct perception of korean medicine in university students who will be major users of hospitals and clinics.

남성 판매사원의 정장스타일에 대한 시각적 평가 (Visual Evaluation about Formal Style of Salesmen)

  • This study provides the basis far salesman to present formal style in suggesting Good-Bad formal style as well as in examining a meaning structure and valuation differences of visual valuation. Stimulus pictures has been chosen consequently 76 pieces through the preliminary inquiry who are working at department store, franchise salesman, car salesman, insurance staff and other salesmen. The tool for visual valuations about suit style is composed of 7 points of Likert type by making 21 questionnaires from the preliminary study. Collecting data is 512 pieces are used to analyse. The duration to collect data was from August 5th to 20th in 2004 and SPSS statistics package program has been used. At first, main factors according to the visual valuation of formal style are Attractiveness, Having abilities, Uncomfortableness. In second, Good formal style shows more attractive and looks having more abilities than Bad formal style and less uncomfortable. In third, in the relations of Good-Bad formal style and demographics, there is meaningful differences according to gender, age, job, salary. In fourth, in the relations of a purchase purpose and visual valuations of formal style, for Good-Bad valuation, the first impression is the most important factor and it is likely to be related to the purchase purpose, on the other hand, the purchase purpose has related to impression the most. It has presented that Good-Bad valuation and purchase purpose have an influence on the factor of Attractiveness.

한국형 자동차사고 심층조사 자료의 필요성 및 활용방안 (The Importance and Utilization Plan of Database Based on Actual Accident Investigation System in Korea)

  • Developed countries are operating an in-depth database in motor vehicle crashes nationwide. They do not rely solely on the police investigation reports that are responsible for motor vehicle crashes in each country but are developing into a useful database by expanding the categories of data through more indicators addition. In Korea, after implementing comprehensive measures to reduce traffic accident deaths in 2013, the medical centers participated in establishing the actual accident investigation system, which was called as the Korean In-Depth Accident Study (hereinafter KIDAS). This KIDAS database included more in-depth indicators as the types of accidents, types of vehicles, the injury severity, adequacy of safety devices, seating position of passengers. Although there are difficulties in establishing an actual accident investigation system including data collection due to various restrictions, if the system can cooperate with each other such as medical centers, insurance companies, police, fire and rescue services, towing companies, and car repair shops in the future, It would be expected to contribute to the development of safer vehicle, treatment system and traffic safety policy that lower the injury severity of occupant in the event of a motor vehicle crashes.

자율주행자동차 정면충돌평가방안 마련을 위한 국내 정면충돌사고 심층분석 연구 (An In-depth Analysis of Head-on Collision Accidents for Frontal Crash Tests of Automated Driving Vehicles)

  • The seating postures of passengers in the automated driving vehicle are possible in atypical forms such as rear-facing and lying down. It is necessary to improve devices such as airbags and seat belts to protect occupants from injury in accidents of the automated driving vehicle, and collision safety evaluation tests must be newly developed. The purpose of this study is to define representative types of head-on collision accidents to develop collision standards for autonomous vehicles that take into account changes in driving behavior and occupants' postures. 150 frontal collision cases remained by filtering (accident videos, images, AIS 2+, passenger car, etc…) and random sampling from approximately 320,000 accidents claimed by a major insurance company over the past 5 years. The most frequent accident type is a head-on collision between a vehicle going straight and a vehicle turning left from the opposite side, accounting for 54.7% of all accidents, and most of these accidents occur in permissive left turns. The next most common frontal collision is the center-lane violation by drowsy driving and careless driving, accounting for 21.3% of the total. For the two types above, data such as vehicle speed, contact point/area, and PDOF at the moment of impact are obtained through accident reconstruction using PC-Crash. As a result, two types of autonomous vehicle crash safety test scenarios are proposed: (1) a frontal oblique collision test based on the accident types between a straight vehicle and a left-turning vehicle, and (2) a small overlap collision test based on the head-on accidents of center-lane violation.

대화식 데이터 마이닝 기법을 활용한 자동차 보험사의 인입 콜량 예측 사례 (A Case Study on Forecasting Inbound Calls of Motor Insurance Company Using Interactive Data Mining Technique)

  • 최근 고객들의 비대면 접점 서비스 이용도가 높아짐에 따라, 비대면 채널은 다양한 데이터의 분석을 통해 고객 만족도를 향상시킬 수 있는 유용한 창구로 인식되고 있다. 이러한 비대면 채널의 대표적 영역으로 콜센터를 들 수 있으며, 콜센터 운영에서 고객 만족도에 가장 큰 영향을 미치는 요소는 상담 인력의 규모인 것으로 알려져 있다. 즉, 일정수준 이상의 고객 만족도를 유지하기 위해서는 충분한 상담 인력을 확보하는 것이 관건이지만, 불필요하게 많은 인력을 확보하는 것은 인건비 측면에서 비용의 낭비를 초래할 수 있다. 따라서 부족하지도 않고 넘치지도 않을 정도의 적정 인력을 산출하는 능력은 콜센터 운영의 핵심 경쟁력으로 인식되고 있으며, 최근 콜센터에서는 적정 인력의 규모를 예측하기 위해 WFM(Work Force Management) 업무 전담 부서를 설치하고 콜량을 정확하게 예측하기 위한 노력을 기울이고 있다. 콜량 예측을 위해 현업에서 주로 사용되는 방법은 담당자의 직관에 의존하는 방법으로, 일정기간의 콜량 평균을 담당자가 주관적 판단에 의해 보정함으로써 이루어진다. 하지만 이러한 방식은 담당자의 주관적 성향에 크게 좌우된다는 한계를 갖고 있어서, 최근에는 다양한 예측 모형을 시스템화한 WFMS(Workforce Management System) 패키지가 널리 활용되고 있다. 하지만 이 시스템은 초기 도입 시 매우 고가의 구축비용이 발생하며, 신규 요인 발굴 시 이를 즉각적으로 시스템에 반영하기 어렵다는 한계점을 갖고 있다. 이를 극복하기 위해 본 연구에서는 데이터 마이닝의 대화식 의사결정나무 기법을 이용함으로써, 객관적이면서도 업무 배경 지식을 충분히 활용할 수 있는 예측 모형을 수립하고자 한다. 또한, 본 연구에서 수립한 모형의 정확성 평가를 위해, 국내 최대 규모의 한 자동차 보험사 콜센터의 4년 8개월 간의 실 데이터를 사용한 실험을 수행하고 그 결과를 제시하였다. 실험에서는 기존의 WFMS와 본 연구에서 제안하는 두 가지 모형인 대화식 의사결정나무 기반의 예측 모형, 일반 의사결정나무 기반의 예측 모형의 세 가지 모형에 대해, 다양한 오차 허용범위 하에서의 사고콜 및 고장콜에 대한 예측 적중률을 평가하였다.

제4차 산업혁명 시대의 자율주행자동차 상용화를 위한 안정적 법적 기반을 위한 법정책적 연구 - 자율주행자동차 특별법 제정(안)을 중심으로 - (The Propose a Legislation Bill to Apply Autonomous Cars and the Study for Status of Legal and Political Issues)

  • 2016년 다보스포럼에서 클라우드 슈밥이 언급한 '제4차 산업혁명'은 우리의 삶을 획기적으로 바꾸고 있으며, 그 정점에 자율주행자동차가 이 시대의 화두로 떠오르고 있다. 그러나 우리나라에서 자율주행자동차가 성공적으로 도입 및 정착되기까지는 아직 극복해야 할 과제들이 많이 있다. 특히 '인간' 중심의 법제도를 '인공지능'이 포함된 법제도로 패러다임을 변화해야 할 것이다. 자율주행자동차 시대의 안정적 운용을 위해서는 사람중심의 입법체계에 대한 획기적인 변화가 필요하다. 즉, 자율주행자동차를 운행하는 운행주체가 누구인지(무엇인지)와 일반도로에서 일반 자동차와 운행이 가능한지 여부, 교통사고 발생 시 민형사상 책임 문제, 자율주행자동차 관련 보험 문제, 개인정보수집과 이용에 관한 문제, 제3자에 의한 오남용 문제 등을 종합적이고 포괄적으로 검토해야 한다. 본 연구에서는 도로교통 관련 국내 법률, 해외 법제현황, 자율주행자동차 관련 법적 쟁점 등을 검토하여 입법론적 관점에서 자율주행자동차 운행 시 발생하는 제반 법적 문제 해결을 위한 별도의 법안 신설을 제안하며 그 법안에 대한 내용을 제시하였다.
