  • Recent Discussions on Third-Party Funding (TPF) in the forums of UNCITRAL, ICSID, and ICC are making different levels of progress towards finalizing the rules. However, they also have similarities in dealing with legal issues related to TPF, such as definitions, disclosure, allocation of costs, and security for costs. International treaty tribunals have dealt with TPF issues, too. When it comes to the standing of funded claimants, the tribunal in Ambiente v. Argentina did not accept the argument that claimants were controlled by the TPF provider. Concerning the scope of the disclosure, the tribunal in Tennant v. Canada ordered the disclosure of the TPF arrangement. As for the allocation of costs, the tribunal in Kardassopoulos v. Georgia noted that there is no reason why a TPF agreement should be treated differently than an insurance contract. Regarding the security for costs, the tribunal in South American Silver v. Bolivia considered the mere existence of a third-party funder as not an exclusive factor to determine costs in the earlier stage of the proceedings. Lastly, relating to TPF as a ground for annulment, the tribunal in Teinver v. Argentina declined the respondent's argument that the TPF agreement was the vehicle of fraud.

Some Proposed Indices of Structural Regeneration of Secondary Forests and Their Relation to Soil Properties

  • Studies that relate the structure of tropical regrowth vegetation to soil properties are generally lacking in the literature. This study proposes three indices for assessing the structural regeneration of secondary forests. They are: (1) the tree diameter class, (2) the plant life form and (3) the woody/herbaceous plants ratio indices. They were applied to assess the regeneration status of forest regrowth vegetation (aged 1-10 years), derived savanna regrowth vegetation in south western Nigeria, and to secondary forests in different stages of succession in Columbia and Venezuela, Bolivia, Mexico in South and Central America and semi-arid savanna in Ethiopia and seasonal deciduous forest successional stages in India. In all the cases, the indices increased with increasing age of regrowth vegetation and hence, with increasing structural complexity of regenerating vegetation. The tree diameter class index increased from 32.1% in a 9-year secondary forest to 69.0% in an 80-year-old secondary forest in Columbia and Venezuela and from 0.4% in a 1-year fallow to 20.9% in 10-year regrowth vegetation in southwestern Nigeria. In semi-arid savanna in northern Ethiopia, the woody/herbaceous plants ratio index increased from 18.1% in a 5-year protected grazing enclosure to 75.1% in 15-year protected enclosure, relative to the status of 20-year enclosure. The indices generally had correlations of 0.6-0.90 with species richness and Simpson's/Margalef's species diversity, implying that they are appropriate measures of ecosystem development over time. The proposed indices also had strong and positive correlations with soil organic carbon and nutrients. They are therefore, significant indicators of fertility status.

브라질 Mato Grosso do Sul 주에서의 유칼리나무 식재계획(植栽計劃)을 위한 농장토지이용구분(農場土地利用區分)에 관한 연구(硏究) - 원격탐사기술(遠隔探査技術)과 지리정보(地理情報)시스템(GIS)의 적용(適用) - (Farm Land Use Classification for the Planning of Planting of Eucalyptus Spp. at Mato Grosso do Sul of Brazil Using Remote Sensing and Geographic Information System)

  • 본 연구는 브라질의 서부에 있는 Mato Grosso do Sul 주의 Jangada 농장과 Jamaica 농장에 유칼리나무 식재계획(植栽計劃)을 원활히 추진하기 위해 인공위성사진을 이용하여 식생분류(植生分類) 및 토지이용구분(土地利用區分), 경사도(傾斜度) 및 영구자연보존지역(永久自然保存地域) 등을 분석한 결과이다. Mato Grosso do Sul 주의 서쪽에 위치하는 이 지역은 볼리비아와 파라과이의 국경근처에 있기 때문에 지정학적(地政學的)으로 매우 중요하다. 또한 물품수출이 파라과이강을 통해서 아르헨티나의 수도인 부에노스아이레스 까지 도달될 수 있고 브라질의 남동지역과 안데스산맥에 연한 국가들을 연결하는 국도(國道)와 철도(鐵道)가 존재한다. 농장의 산림(山林) 피복지역(被服地域)의 일차해석을 위한 기초로서 Radambrasil프로젝트 SF-21 Campo Grande로부터 얻은 식생지도가 사용되었고, 그 이후에 현장조사(現場調査)가 수행되었다. 최초의 이미지해석이 이루어진 후에 사용급과 토지점유에 대한 개념정의가 이루어 졌으며 스펙트럼분류가 행해졌다. Jangada 농장과 Jamaica 농장에 있어서 산림지역 Savanna와 초원지역 Savanna가 전체 총면적의 68% 정도를 차지하고 있다. 현재로서 만족한 연구결과에도 불구하고 이미 이루어진 평가결과(評價結果)에 기초하여 프로젝트 발전을 위한 수정(修正)과 보완(補完)이 요구된다. 특히 토양(土壤)과 지형(地形)을 포함해서 환경인가에 대한 상세한 분석이 병행되어야 할 것이다.

한반도 미기록 외래식물 좀갯드렁새와 갯드렁새의 분류학적 실체 (New Record for Alien Plant of Diplachne fusca subsp. uninervia and a Taxonomic Identification of D. fusca subsp. fascicularis in Korea)

  • 경기도 김포시 및 인천광역시 강화군 일대에서 미기록 외래식물 좀갯드렁새[Diplachne fusca subsp. uninervia (J. Presl) P.M. Peterson & N. Snow]가 발견되었다. 이 분류군은 아메리카 원산이며, 여러 나라에서 외래식물로 보고되었다. 국내에서 외래종으로 먼저 보고된 갯드렁새[D. fusca subsp. fascicularis (Lam.) P.M. Peterson & N. Snow]와 근연종이며, 모종인 D. fusca의 종하분류군이다. 좀갯드렁새는 소수, 포영 및 호영의 길이가 짧고 까락이 없는 특징으로 구별된다. 소수의 길이가 짧아 국명을 좀갯드렁새로 신칭하였다. 주요 형질에 대한 도해와 기재, 검색표를 제시하였다. 갯드렁새의 이전 학명인 D. fusca (≡Leptochloa fusca)은 형태적으로 D. fusca subsp. fascicularis와 상이하다. 갯드렁새의 학명을 기준표본, 원기재문, 최근의 논문들을 근거로 D. fusca (≡L. fusca)에서 D. fusca subsp. fascicularis으로 변경한다.

Solanum acaule 색소체 유전자형 선발을 위한 특이적 분자마커 개발 (PCR-based markers to select plastid genotypes of Solanum acaule)

  • 볼리비아 유래의 4배체 감자 야생종 중 하나인 Solanum acaule는 서리, 감자역병, 감자바이러스X, 감자바이러스Y, 감자잎말림바이러스, 감자걀쭉병, 선충 등에 대한 저항성과 같이 감자의 신품종 육성에 매우 유용한 형질들을 가지고 있어 감자 육종에 많이 이용되고 있다. 그러나 이러한 유용 형질들을 재배종 감자에 전통적인 교잡에 의해 도입하는 것은 야생종과 재배종 간의 서로 다른 EBN에 따라 매우 제한적이다. 따라서, 이러한 생리적 장벽을 극복하기 위해서는 체세포융합을 이용할 수 있는데, 육종에 활용할 적절한 체세포융합체를 선발하기 위해서는 적절한 분자마커의 개발이 필수적이다. 이에, 본 연구에서는 앞서 차세대 유전체 기술에 의해 완성되어 보고된 S. acaule의 엽록체 전장 유전체 정보를 기반으로 이를 다른 8개의 Solanum 종의 엽록체 전장 유전체 정보와 비교를 통해 S. acaule 특이적인 분자마커를 개발하였다. S. acaule의 엽록체 전장 유전체 총 길이는 155,570 bp였으며, 총 158개의 유전자로 구성되어 있었다. 전체적인 구조와 유전자의 구성은 다른 Solanum 종들과 매우 유사하였고 12종의 다른 가지과에 속해 있는 종과의 계통수 분석에서 다른 Solanum 종과 매우 가까운 유연관계를 가지는 것을 확인하였다. S. acaule의 엽록체 전장 유전체와 다른 7개 Solanum 종의 엽록체 전장 유전체 다중 정렬의 결과로 각각 4개와 79개의 S. acaule 특이적인 InDel 및 SNP 영역이 확인되었으며, 이 정보를 이용하여 각각 1개씩의 InDel 및 SNP 영역 유래의 PCR 기반의 분자마커를 개발하였다. 본 연구의 결과는 S. acaule의 진화적 측면에서의 연구와 S. acaule를 이용한 감자품종 육성 연구에 기여를 할 수 있을 것이다.

Determination of optimum gamma ray range for radiation mutagenesis and hormesis in quinoa (Chenopodium quinoa Willd.)

  • Quinoa (Chenopodium quinoa Willd.) is one of the ancient crops cultivated in the Andes region at an altitude of 3,500-4000m in Chile and Bolivia from 5000 BC. It contains a large amount of protein, minerals and vitamins in comparison with other crops. The cultivation area has been increasing worldwide because of its excellent resistance to various abiotic stress such as salinity, drought and low temperature. ${\gamma}$-Ray radiation of high dose is often used as a tool to induce mutations in plant breeding, but it has a deleterious effect on organisms. However, the radiation may have a positive stimulatory effect of 'hormesis' in the low dose range. This experiment was carried out to investigate the optimum dose range for creating the quinoa genetic resources and to investigate the hormesis effect at low dose on the quinoa. This experiment was performed for 120 days from November, 2016 to February, 2017 in the greenhouse of Gyeongsang National University. ${\gamma}$-Ray radiation was irradiated to seeds at 0 Gy, 50 Gy, 100 Gy, 200 Gy, 300 Gy, 400 Gy, 600 Gy, 800 Gy and 1000 Gy for 8 hours. (50 Gy) using the low level radiation facility ($Co^{60}$) of Cooperative Research Institute of Radiation Research Institute, KAERI. Fifty seeds were placed on each petri dish lined with wet filter paper and germination rate was measured at a time interval of 2 hours for 40 hrs. The length of the root length was measured one week after germination. Each treatment was carried out in 3 replicates. The growth of seedlings were investigated for 10 days after transplanting of 30 day-old seedlings. The plant height, NDVI, SPAD, Fv/Fm, and panicle weight were measured. The germination rate was highest at 50Gy and 0Gy and the rate of seeds treated with 400Gy or higher rate decreased to 25% of the seeds treated with 50Gy. The emergence rate of seedling in pot experiment was higher at the dose of 200 Gy, 300 Gy and 400 Gy than at 0 and 50Gy. However, the rate was lower at strong radiation higher than 600Gy at which $1^{st}$ leaf was not expanded fully and dead due to extreme overgrowth at 44 days after treatment (DAT). The highest value of panicle weight was observed at 50Gy (6.15g) and 100Gy (5.57g). On the other hand, the weight at high irradiated dose of 300Gy and 400Gy was decreased by about 55% compared to low dose (50 Gy). NDVI measurement also showed the highest value at 50 Gy as the growth progressed. SPAD was the highest at 400 Gy and showed positive correlation with irradiation dose except 0 Gy. Fv/Fm was high at 50 Gy up to 30 DAT and no difference between treatments was observed except for 400 Gy from 44 DAT. The plant height was the highest in 50Gy during the growing period and was higher in the order of 50Dy, 100Gy, 0Gy, 200Gy, 300Gy and 400Gy in 88 DAT. In this experiment, the optimal radiation dose for hormesis was 50Gy and 100Gy, and the optimal radiation dose for mutagenesis seems to be 400 Gy.

국제투자조약상 포괄적 보호조항(Umbrella Clauses)의 해석에 관한 연구 (Interpretation of the Umbrella Clause in Investment Treaties)

  • One of the controversial issues in investor-state investment arbitration is the interpretation of "umbrella clause" that is found in most BIT and FTAs. This treaty clause requires on Contracting State of treaty to observe all investment obligations entered into with foreign investors from the other Contracting State. This clause did not receive in-depth attention until SGS v. Pakistan and SGS v. Philippines cases produced starkly different conclusions on the relations about treaty-based jurisdiction and contract-based jurisdiction. More recent decisions by other arbitral tribunals continue to show different approaches in their interpretation of umbrella clauses. Following the SGS v. Philippines decision, some recent decisions understand that all contracts are covered by umbrella clause, for example, in Siemens A.G. v. Argentina, LG&E Energy Corp. v. Argentina, Sempra Energy Int'l v. Argentina and Enron Corp. V. Argentina. However, other recent decisions have found a different approach that only certain kinds of public contracts are covered by umbrella clauses, for example, in El Paso Energy Int'l Co. v. Argentina, Pan American Energy LLC v. Argentina and CMS Gas Transmission Co. v. Argentina. With relation to the exhaustion of domestic remedies, most of tribunals have the position that the contractual remedy should not affect the jurisdiction of BIT tribunal. Even some tribunals considered that there is no need to exhaust contract remedies before bringing BIT arbitration, provoking suspicion of the validity of sanctity of contract in front of treaty obligation. The decision of the Annulment Committee In CMS case in 2007 was an extraordinarily surprising one and poured oil on the debate. The Committee composed of the three respected international lawyers, Gilbert Guillaume and Nabil Elaraby, both from the ICJ, and professor James Crawford, the Rapportuer of the International Law Commission on the Draft Articles on the Responsibility of States for Internationally Wrongful Acts, observed that the arbitral tribunal made critical errors of law, however, noting that it has limited power to review and overturn the award. The position of the Committee was a direct attack on ICSID system showing as an internal recognition of ICSID itself that the current system of investor-state arbitration is problematic. States are coming to limit the scope of umbrella clauses. For example, the 2004 U.S. Model BIT detailed definition of the type of contracts for which breach of contract claims may be submitted to arbitration, to increase certainty and predictability. Latin American countries, in particular, Argentina, are feeling collectively victims of these pro-investor interpretations of the ICSID tribunals. In fact, BIT between developed and developing countries are negotiated to protect foreign investment from developing countries. This general characteristic of BIT reflects naturally on the provisions making them extremely protective for foreign investors. Naturally, developing countries seek to interpret restrictively BIT provisions, whereas developed countries try to interpret more expansively. As most of cases arising out of alleged violation of BIT are administered in the ICSID, a forum under the auspices of the World Bank, these Latin American countries have been raising the legitimacy deficit of the ICSID. The Argentine cases have been provoking many legal issues of international law, predicting crisis almost coming in actual investor-state arbitration system. Some Latin American countries, such as Bolivia, Venezuela, Ecuador, Argentina, already showed their dissatisfaction with the ICSID system considering withdrawing from it to minimize the eventual investor-state dispute. Thus the disagreement over umbrella clauses in their interpretation is becoming interpreted as an historical reflection on the continued tension between developing and developed countries on foreign investment. There is an academic and political discussion on the possible return of the Calvo Doctrine in Latin America. The paper will comment on these problems related to the interpretation of umbrella clause. The paper analyses ICSID cases involving principally Latin American countries to identify the critical legal issues arising between developing and developed countries. And the paper discusses alternatives in improving actual investor-State investment arbitration; inter alia, the introduction of an appellate system and treaty interpretation rules.
