Conceptualization of Defense Industrial Security in Relation to National Security (국가 안보와 연계한 방위산업 보안 개념 정립)

  • In order to protect the advancement of defense technology that has a tremendous e?ect on both the national security and the economy, the Republic of Korea established the Defense Technology Security Act in 2015. As the new enactment brought changes to the landscape of the defense industry and defense industrial security, a new examination of the concept of the defense industrial security has now become necessary. Even after taking into consideration the undisclosed nature of defense industrial security research, and the fact that only the limited number of firms participates in the subject matter, scientific studies related to the topic have not been active. However, with the new enactment of the Defense Technology Security Act, it is necessary to expand the scope of security and to redefine the concept of defense industrial security. In this paper, we analyzed the research works on related technology protection policies and our environment of the defense industry in order to conceptualize defense industrial security. The established concepts are expected to provide a systematic way to protect the confidential and defense technology.

Development Direction of Maritime Manned-Unmanned Systems through Measurement of Combat Effectiveness against Major Threats on Sea Lines of Communication (해상교통로 상 주요 위협별 전투 효과 측정을 통한 해양 유·무인 복합체계 발전방향)

  • In this study, assuming that the maritime manned-unmanned systems, which will be used as the main force of the ROK Navy in the future, conducts its sea line of communication(SLOC) protection operations, the combat effectiveness against major threats was measured, and through this, the development direction of the manned-unmanned systems was suggested. Multi-criteria decision-making techniques such as Delphi and AHP were used to measure combat effectiveness, and the AHP survey was conducted on 40 naval officers, including 25 senior officers who are well-understood in the combat effectiveness of the weapons system and MUM-T. As an evaluation index for measuring combat effectiveness, the OODA loop was set as the main attribute, followed by Observe(0.358), Orient(0.315), Act(0.217), and Decide(0.110). The combat effectiveness of each major threat in SLOC, the lowest alternative, was measured to be 1.68 times higher than the response to maritime conflicts in neighboring countries and 3.61 times higher than the response to transnational threats. These results are expected to support rational decision-making in determining the level of technology required for acquisition of marine manned-unmanned systems and establishing operational plans for naval forces.

A Study on Streamlining the Legal Framework for the Efficient Management of Protection and Security of the Government Complexes (정부청사의 효율적 방호·보안관리를 위한 법령체계 정비방안에 대한 소고)

  • The executive authority of the Ministry of Public Administration and Security on the 'management of security of the government complexes' is not sufficiently secured only with the organization law, the Government Organization Act. It is needed to establish an administrative actions law, an individual law that sets detailed contents and limitations of the executive authority to be stipulated. The current regulation, Regulation on the Management of the Government Complexes which is a Presidential Decree, is a legal decree that lacks a legal basis. The decree does not match with the current constitutional framework and raises the issue of its legality. The regulation may have the characteristics as a public property management law so far as it stipulates such matters as supply and maintenance management for the complexes, acquisition and disposition of complexes, facilities management of complexes, etc. However, the regulation includes high authority actions by an administrative organization, such as facilities security and order maintenance including restriction and control of access. This makes the regulation have the characteristics of a public property policy act as well. To supplement the legal framework for this situation, it is needed to level up some of the provisions relating to protection and security management to the level of an act as they stipulate high authority actions by an administrative organization. Other matters in the Regulation on the Management of the Government Complexes such as provisions relating to supply and allocation of complexes, etc. may be maintained as they are. In addition, the protection officers (general service official) does not own legal authority and have limitations on securing the capability to deal with the situations on implementing the on-site protection duty. Therefore, it is needed for the protection officers to secure protection duty-related authority by stipulating in a law. The main contents of the law on the protection and security of the government complexes may be those matters providing reservations on the implementations of laws. These may include the limitation of rights of and charging obligations on the people such as restricting the actions of personnel in the complex, rights and obligations of protection personnels relating to their duties, use of weapons, training of protection personnel, penal provisions, etc. These legal reservations should be included in an individual act.

  • 'Flight safety zone' means a zone that the Minister of National Defense designates under Articles 4 and 6 of the Protection of Military Bases and Installations Act (hereinafter 'PMBIA') for the safety of flight during takeoff and landing of military aircrafts. The purpose of flight safety zone is to contribute to the national security by providing necessary measures for the protection of military bases and installations and smooth conduct of military operations. In this case, when the state set and used the flight safety zone, the landowner claimed restitution of unjust enrichment against the country. This article is an analysis based on the existing legal theory regarding the legitimacy of plaintiff's claim, and the summary of the discussion is as follows. A person who without any legal ground derives a benefit from the property or services of another and thereby causes loss to the latter shall be bound to return such benefit (Article 741 of the Civil Act). Since the subject matter is an infringing profit, the defendant must prove that he has a legitimate right to retain the profit. The State reserves the right to use over the land designated as a flight safety zone in accordance with legitimate procedures established by the PMBIA for the safe takeoff and landing of military aircrafts. Therefore, it cannot be said that the State gained an unjust enrichment equivalent to the rent over the land without legal cause. Expropriation, use or restriction of private property from public necessity and compensation therefor shall be governed by Act: provided, that in such a case, just compensation shall be paid (Article 23 (1) of the Constitution of The Republic of KOREA). Since there is not any provision in the PMBIA for loss compensation for the case where a flight safety zone is set over land as in this case, next question would be whether or not it is unconstitutional. Even if it is designated as a flight safety zone and the use and profits of the land are limited, the justification of the purpose of the flight safety zone system, the appropriateness of the means, the minimization of infringement, and the balance of legal interests are still recognized; thus just not having any loss compensation clause does not make the act unconstitutional. In conclusion, plaintiff's claim for loss compensation based on the 'Act on Acquisition of and Compensation for land, etc. for Public Works Projects', which has no provision for loss compensation due to public limits, is unjust.

Acquisition of Thermotolerance in Transgenic Orchardgrass Plants with DgHSP17.2 Gene

  • To develop transgenic orchardgrass (Dactylis glomerata L.) resistant to high temperature, the recombinant DgHSP17.2 gene was introduced into orchardgrass plants using the Agrobacterium-mediated transformation method and expressed constitutively under the control of the CaMV 35S promoter. The results of genomic DNA PCR and Southern analysis showed a DNA band and hybridization signal on agarose gel and X-ray film in transgenic orchardgrass plants harboring the recombinant DgHSP17.2 gene, but a DNA band and hybridization signal were not observed in the wild type and empty vector control plants. The same result was also obtained in RT-PCR and Southern blot analysis, and these transgenic orchardgrass plants did not show any morphological aberration both in the culture bottle and soil mixture. When leaf discs cut from transgenic orchardgrass plants with recombinant DgHsp17.2 gene were exposed to lethal temperature (heat treatment at $60^{\circ}C$ for 50 min), 60-80% of the leaf discs showed only damage symptoms, but non-transgenic leaf discs showed a lethal condition. These results indicate that the DgHsp17.2 gene may act as a protector from heat stress in plants.

A Study of the Strengthening Legal Deposit Collection of the National Library of Korea (국립중앙도서관 납본수집력 강화방안 연구)

  • The legal deposit for the national library in all countries is the most important mean for acquiring the country's off-line and on-line publications. Because of many limitations of legal deposit system, however, the National Library of Korea does not properly collect the useful materials produced or manufactured in Korea. In order to solve this problem, the author analyzed the status of collection development by legal deposit and estimated the total amount of domestic publications. Based on the these results, author suggested five plans for strengthening the national collections in terms of the provisional 'deposit law', the further development and complementary of current legal deposit regulations (guidelines and standards), desirable amendments of the legal deposit provisions in library act, reasonable division of the deposit targets, and optimization strategies of acquisition scope by material types.

  • Modeling and simulation technology is being used in various fields. Especially in the field of military, Simulation-Based Acquisition (SBA) is recognized as a essential policy. To effectively carry out SBA, modeling and simulation techniques should be applied in the whole life-cycle for the weapon system development, and the framework and tools which can help the rapid component development and reusability are needed. In this research, we use the simulation framework based on modeling formalism for enhancement of reusability and a GUI-based modeling environment for rapid M&S component development. The Proposed framework can act as plug-in components on the basis of XML-based object model, so that the flexible design is possible for the change of the model and simulation structure. In addition, our methods are effective to implement the functions for supporting simulation such as the model data logging and communication with external systems. In this paper, we describe an architecture and functions for the framework and tools.

Assessment of quantitative structure-activity relationship of toxicity prediction models for Korean chemical substance control legislation

  • Objectives For successful adoption of legislation controlling registration and assessment of chemical substances, it is important to obtain sufficient toxicological experimental evidence and other related information. It is also essential to obtain a sufficient number of predicted risk and toxicity results. Particularly, methods used in predicting toxicities of chemical substances during acquisition of required data, ultimately become an economic method for future dealings with new substances. Although the need for such methods is gradually increasing, the-required information about reliability and applicability range has not been systematically provided. Methods There are various representative environmental and human toxicity models based on quantitative structure-activity relationships (QSAR). Here, we secured the 10 representative QSAR-based prediction models and its information that can make predictions about substances that are expected to be regulated. We used models that predict and confirm usability of the information expected to be collected and submitted according to the legislation. After collecting and evaluating each predictive model and relevant data, we prepared methods quantifying the scientific validity and reliability, which are essential conditions for using predictive models. Results We calculated predicted values for the models. Furthermore, we deduced and compared adequacies of the models using the Alternative non-testing method assessed for Registration, Evaluation, Authorization, and Restriction of Chemicals Substances scoring system, and deduced the applicability domains for each model. Additionally, we calculated and compared inclusion rates of substances expected to be regulated, to confirm the applicability. Conclusions We evaluated and compared the data, adequacy, and applicability of our selected QSAR-based toxicity prediction models, and included them in a database. Based on this data, we aimed to construct a system that can be used with predicted toxicity results. Furthermore, by presenting the suitability of individual predicted results, we aimed to provide a foundation that could be used in actual assessments and regulations.

Molecular and biochemical characterization of hemoglobinase, a cysteine proteinase, in Paragonimus westermani

  • The mammalian trematode Paragonimus westermani is a typical digenetic parasite, which can cause paragonimiasis in humans. Host tissues and blood cells are important sources of nutrients for development, growth and reproduction of P. westermani. In this study, a cDNA clone encoding a 47 kDa hemoglobinase of P. westermani was characterized by sequencing analysis, and its localization was investigated immunohistochemically. The phylogenetic tree prepared based on the hemoglobinase gene showed high homology with hemoglobinases of Fasciola hepatica and Schistosoma spp. Moreover, recombinant P. westermani hemoglobinase degradaded human hemoglobin at acidic pH (from 3.0 to 5.5) and its activity was almost completely inhibited by E-64, a cysteine proteinase inhibitor. Immunohistochemical studies showed that P. westermani hemoglobinase was localized in the epithelium of the adult worm intestine implying that the protein has a specific function. These observations suggest that hemoglobinase may act as a digestive enzyme for acquisition of nutrients from host hemoglobin. Further investigations may provide insights into hemoglobin catabolism in P. westermani.

Study on the Appropriate Method Applying Gross Tons for Compensation for Damage of Coastal Fisheries in Case of Boat Change (연안어업의 어업손실보상시 어선대체로 인한 톤수변경의 경우 타당한 톤수적용 방안에 관한 연구)

  • Costal fisheries use small boat. The boats are frequently substituted with newly made boat or proper boat. When the boat which is substituted with another one after the fixed date for compensation is estimated for fisheries loss by public project, it is matter that which boat is the object for estimating average catch of fish. There are three ways in practical business. They are based on the date of spot probe, the date of conference for compensation and fixed date for compensation. In case of applying the first and the second ways, as the object of compensation is not fixed, there is problem that estimated result can be changed depending on changing boat tons even after the date of spot probe and the fixed date for compensation. Most of all, these ways are against Attached Form No.4 of the Enforcement Ordinance of Fisheries Law which regulate to calculate average catch of fish applying result of fishery for retroactively counted 3 years from the year before the year in which administrative measure day is. The other side, in applying boat tons based on the fixed date for compensation, estimated result of compensation will not change even boat substituted after the fixed date for compensation. Even though applying tons based on the fixed date for compensation, a problem still remains. If the boat get bigger after the fixed date for compensation, the then boat size must be applied for calculating average catch. But the boat get smaller, the changed boat size must be applied. Because changed small boat would be damaged less than the previous boat. And decrease in catch by changing boat into small one is not due to the project but due to the personal responsibility. This will help to increase objectivity and reliance on the compensation result. As the other objects are fixed based on the fixed date for compensation in the Act on Acquisition and Compensation of Land and Others for Public Project, it can be balanced with other object.
