ILO has contributed for seafarers to promote conditions of employment and decent work through maritime labour standards. Between 1920 and 1996, a total of 39 Conventions and 29 Recommendations concerning seafarers have been adopted, which demonstrates the import part of ILO activities devoted to seafarers' questions. But many instruments were outdated, deficient and not reflective of modern practice, many contained technical detail which discouraged ratification. the Governing Body of ILO, at its 262nd Session(March-April 1995), decided to set up a Working Party regarding the revision of maritime labour standards. This Working Party initiated its examination of maritime instruments to 273rd Session(November 1998) of the Governing Body. The review made by the Working Party has concluded that existing maritime Conventions were considered either up to date or were identified for promotion, most of which were approved by the Governing Body. Therefore, ILO started to create a single, coherent instrument embodying as far as possible all up-to-date standards of existing maritime labour convention. The Maritime Labour Convention 2006 has been adopted in February 2006. This paper aims to analyze the significance of this convention and the influence regarding to maritime labour affairs in the field of shipping industry.

The General Conference of International Labour Organization adopted the Maritime Labour Convention on 23 February 2006 in Geneva, Swiss and it is. composed of four structures of Preamble and Articles, Regulations, Code A and Code B. According, in the preparation of future enforcement, amendments to the Seamen Act, etc. and relevant regulations are needed and regarding issue of the Maritime Labour Certificate and preparation of The Declaration of Labour Compliance, relevant law and regulation for Recognized Organization and training for related persons, etc. should be established.

The International Maritime Organization(IMO) which is responsible for measures to improve the safety and security of international shipping and to prevent marine pollution from ships is a specialized agency of the United Nations. It is involved in legal matters, including liability and compensation issues and the facilitation of international maritime traffic as well. But the ROK has not been actively coping with the environment of the shipping industry because of the absence of the organization or researching bodies that specialized in the field related to IMO. Therefore this paper investigates the maritime administration system of the major countries such as the USA, japan and the UK. And particularly by conducting IMO research and responding system, this study gathers relevant materials from those countries for the comparison and analysis with the purpose of providing the ROK with the assistance in forming the responding measures in the shipping and shipbuilding industries.

But Many ILO Instruments were outdated, deficient and not reflective of modern practice, many contained technical detail which discouraged ratification and were thus ineffective. However, many issues which had become relevant were not covered by existing instruments. Therefore, the Governing Body of ILO, at its 262nd Session(March-April 1995), decided to set up a Working Party on Policy regarding the Revision of Standards. It was decided that the Working Party would examine the need for revision of all maritime Conventions and Recommendations adopted before 1985 with a view to rejuvenating and strengthening the standard-setting system. The Working Party initiated its examination of maritime instruments during 273rd Session(November 1998) of the Governing Body. The review made by the Working Party has concluded that of the maritime Conventions examined, seven of them are obsolete and should be revised, 13 should be denounced and six were considered either up to date or were identified for promotion, most of which were approved by the Governing Body. The consolidated maritime labour convention will be adopted in February 2006.

어선 안전에 관한 최초의 국제 협약인 1977 어선안전을 위한 토레몰리노스 국제협약(77 협약)을 대체한 1993 토레몰리노스 의정서(93 의정서)는 현재 그 발효요건이 충족되지 못하여 전 세계적으로 발효되지 못하고 있는 실정이다. 이에 국제해사기구(IMO)는 93 의정서의 요건을 완화하여 각 국의 비준을 촉진시킬 목적으로 "1993 토레몰리노스 의정서 시행에 관한 협정"의개발을 해당 전문위원회인 복원성, 만재흘수선, 어선안전 전문위원회의 우선과제로 추진하고 있고, 제53차 회의(SLF 53, 2011. 1월)까지 동 협정 또는 총회결의의 초안 작업을 완료하여, 최종적으로 제27차 IMO 총회(2011. 11월)에서 이를 채택할 계획으로 논의를 진행하고 있다. 따라서 이러한 국제적인 움직임에 대응하고 동 의정서의 발효에 대비하여 우리나라에 미치는 파급효과를 최소화하기 위한 활동의 일환으로 공단이 수행한 "농림수산식품부의 2010년 수산기술개발사업"인 "1993 토레몰리노스 의정서 시행에 관한 협정 개발 대응연구"의 일부로써, 본 연구는 "선박안전" 제29호 및 제30호에 게재된 "1993 토레몰리노스 의정서의 시행에 관한 IMO의 활동"에 이어 최근 IMO의 회의 결과를 담고 있다.

어선 안전에 관한 국제 협약인 1977 어선안전을 위한 토레몰리노스 국제협약 및 1993 토레몰리노스 의정서는 현재 그 발효요건이 충족되지 못하여 전 세계적으로 발효되지 못하고 있는 실정이다. 이에 국제해사기구(IMO)는 의정서 요건을 완화하는 "1993 토레몰리노스 의정서 시행에 관한 협정서 개발"을 해당 전문위원회인 복원성, 만재흘수선, 어선안전 전문위원회에서 제53차 회의('11. 01)까지 그 초안 작업을 완료하고 제27차 총회에서 이를 채택할 계획으로 논의를 진행하고 있다. 따라서 이러한 국제적인 움직임에 대응하고 동 의정서 시행에 대비하여 우리나라에 미치는 파급효과를 최소화하기 위한 활동의 일환으로써 본 연구는 그 동안 IMO에서 추진하여 왔던 활동과 그 내용을 담고 있다.

In spite of adoption of various IMO Conventions over the past, the reason why large vessel accidents related to human life and marine environment occur is that the IMO Conventions are not effectively implemented due to contravention of the conventions by flag states. In particular, the implementation of the conventions are not well being performed because some flag states having weak genuine link between them and vessels haven't set up proper personal and structural organizations in charge of maritime safety and marine environment protection. From this background, IMO Resolution A.946(23) on the voluntary IMO Member-state Audit Scheme was adopted at the 23rd Assembly in Nov. 2003 and the Scheme is expected to be executed compulsorily in 2015 through the adoption of the IMO Resolution A.1018(26) in Nov. 2009. Accordingly, this study examined outline of the IMO Member-state Audit Scheme and the Code for the Implementation of Mandatory IMO Instruments used for the audit standards of this scheme. In addition, this study reviewed the member-states' obligations and responsibilities according to the compulsory implementation of the member-state audit scheme in 2015. Based on this, this study suggested the enhancement measures for maritime education and training of maritime education institutions of the Republic of Korea to cope positively with compulsory implementation of the IMO Member-state Audit Scheme.
