Comparative Study of Security Services Industry Act and Police Assigned to Special Guard Act - Focused on special guards and police assigned to special guard duty - (경비업법과 청원경찰법의 비교 연구 특수경비원과 청원경찰을 중심으로)

  • Police Assigned to Special Guard Act was legislated in 1962 to solve issues regarding the protection of various staple industrial installations, and in 2001, the Security Services Industry Act was revised to establish an effective security system for important national facilities. Thereby the Special Guards System was instituted. The current law has two parts, with the Police Assigned to Special Guard System and Special Guards System, and many scholars have actively discussed the appropriateness of the integration of both systems to solve problems caused by a bimodal system. However, in spite of these discussions taking place in the academic world, the idea of unification lost its power when the guarantee of status regulation was established for the police assigned to special guard. Strictly speaking, police assigned to special guard is a self-guard, and a special guard is a contractual guard. So, both of them have pros and cons. Thus, it would be desirable to give a legal, constitutional guarantee for both systems by strengthening each of them and making up for the weakness of each of them rather than trying to unify police assigned to special guard and special guard. To begin this process, we need to revise unreasonable legal provisions of Security Services Industry Act and Police Assigned to Special Guard Act as below. First, since the actual responsibilities of special guards and police assigned to special guard duty are the same, we need to make the facilities which they use equal. Second, legal provisions need to be revised so that a special guard may perform the duties of a police officer, according to the Act on the Performance of Duties by Police Officers, within the facility that needs to be secured in order to prevent any vacancy in the guarding of an important national facility. Third, disqualifications for the special guards need to be revised to be the same as the disqualifications for the police assigned to special guard duty. Fourth, it is reasonable to unify the training institution for special guards and for police assigned to special guard duty, and it should be the training institution for police. On-the-job education for a security guard needs to be altered to more than 4 hours every month just like the one for police assigned to special guard duty. Fifth, for a special guard, it is not right to limit the conditions in their using weapons to 'use of weapon or explosives' only. If one possesses 'dangerous objects such as weapon, deadly weapon, and so on' and resists, a special guard should be able to use their weapon against that person. Thus, this legal provision should be revised. Sixth, penalty, range of fines, and so on for police assigned to special guard duty need to be revised to be the same as the ones for a special guard. If we revise these legal provisions, we can correct the unreasonable parts of Security Services Industry Act and Police Assigned to Special Guard Act without unifying them. Through these revisions, special guards and police assigned to special guard duty may develop the civilian guard industry wholesomely under the law, and the civilians would have a wider range of options to choose from to receive high quality security service.

A Study on Changes in Media Report of Police Assigned for Special Guard Using Big Kinds

  • The objective of this study is to present the academic implications and developmental direction of the police assigned for special guard system through big data analysis on the objective and macroscopic viewpoint of the media. As research method, this study conducted the analysis on 'police assigned for special guard' and the analysis of related words that would visualize the keywords highly related to keyword trend and news. Also, after dividing the period into the 1990s, 2000s, and 2010s, the number of relevant articles in each period was drawn for understanding the flow. In the results of this study, the perception of media report of police assigned for special guard was about the recruitment of police assigned for special guard, and relevant events/accidents, which showed the coexistence of positive interest in the recruitment of police assigned for special guard and negative image of events/accidents related to police assigned for special guard. As a result, however, the necessity and demand for police assigned for special guard are increasing. Thus, the police assigned for special guard should be engaged in work after carefully thinking of its role in charge of ethical responsibility and safety as an axis for maintaining the national safety and social order.

A Review on the Legal rights and obligation from the legal status of registered security guard (청원경찰의 법적 지위에 따른 권한과 의무)

  • Registered security guards carry out police duties as civilian police who are in charge of security service, and so they have a two-fold status: a civilian in terms of a social standing and a policeman in the way that they execute the authority of security. The problem caused by this legal position is that their legal rights and obligation can be unclear in the task-action and working relationship. This paper attempts to study their functions, rights, and legal duties through the interpretation of the related positive law so as to reveal the problems that may spring from this ambiguous status of registered security guards. This endeavor illuminates their legal status specified in the positive law in and around the Act on the police assigned for special guard, observing their functions and the legal duties in the pursuit of their tasks, and ending up pointing out the problems of the positive law. As a result of research work, the most significant problems, even if multifarious, are the avoidance of the state reparation in the responsibility for the illegal behavior in connection with their operation; the unconstitutionality of the disciplinary punishment regulation originated from the entrust with full powers; the imperfection of the rules about the cooperative ties with the police; the possibility of human rights abuse caused by the ban on the labor dispute; the equality problems from the dual pay system; and the inadequacy of the codes about the recruitment qualification and method. This research is intended to help achieve the purpose of the security of national critical facilities through the smooth execute of duties as well as the protection of the guards' rights. Besides, the key focuses posed in this paper are worthy of being developed more accurately through the following researches.

A Study on Security Performance of Registered Security Guards in the Government Buildings (정부청사 청원경찰의 보안성과에 관한 연구)

  • The purpose of this study is to analyze the influence which affects security performance of registered security guards hired by government buildings via job engagement so that basic data can be provided to improve their security performance. To accommodate this study, a survey was conducted from November 26th to December 27th, 2019 through the cooperation of registered security guards working in government buildings in Seoul, Gwacheon, Daejeon, and Sejong. A total of 234 survey sheets were collected and 28 sheets out of them had missing data or incomplete data so a subsequent total of 206 survey sheets were used in this analysis. SPSS 23.0 was applied making use of the collected data for frequency and descriptive statistics analysis, trustworthiness analysis, exploratory factor analysis, and correlation analysis. By applying AMOS 23.0, a means to examine the structural relation between organization, job engagement, and security performance were able to be analyzed. The result of this study is as follows. First, it was found that organizational justice gives a meaningful positive (+) influence on job engagement for registered security guards. Second, it was found that job engagement for registered security guards gives them a meaningful positive(+) influence in their security performance. Third, it was found that organizational justice does not give any meaningful influence on security performance directly. Fourth, organizational justice does not give any meaningful influence on security performance directly but it gives meaningful positive(+) influence on security performance via job engagement as it takes the role of full mediation variable. Based on the results, in order to maximize security performance of registered security guards, this study recommends that government building administrators to try their best to propose to the National Assembly a proposition for Police Assigned for registered security guards Act to be legalized in order to improve the leveling system of registered security guards so that registered security guards can have more job engagement.

  • Endless criminal act has serious effect on safety of the nation and lives of the citizens and it is causing major disorder in ruling of the nation and the society. Also internet generalization in public put country's information foundation on the latest trend on the other hand, due to lack of security concept, cyber crime is on the rise such as hacking and viruses. But with various crime occurrence and increased desire for safety of citizens, there is limit to provide high quality public security service with just police force and equipments. To solve the problems, advanced crime prevention system, not on the nation's level but on the private level was activated private security business some time ago. And now it has its firm place as a corresponding existence with crime prevention capability of police force. Still private security industry of Korea has relatively many weak points when compared with advanced countries and it should be backed up with improvement of the law and the system.

Perceptions of the Security Management at Critical Facilities in South Korea: College students' attitudes toward increasing demand for security personnel and the alternatives to police (공공부문 정규직 전환 및 의무경찰제도 폐지에 따른 보안산업 변화에 대한 인식)

  • With the government policy on converting contract workers to full-time employees, there have been significant changes about the security personnel at the nation's critical facilities, including the National Assembly Building and airports. Moreover, the scheduled disbandment of the conscripted police force in 2023 has raised concerns about security management at different government agencies. To examine the college students' perceptions on the possible alternatives to fill the expected security gap, 234 undergraduate students of security management and protection in the Seoul metropolitan region were surveyed. Particularly, a comparative analysis was conducted on the legal bases and supervision, the employment types and salaries, and the scopes of responsibility and authority of suggested alternatives were compared. The results showed that utilization of private police forces was thought to be the most effective option. Based on the research findings, the university departments should develop and maintain a quality curriculum to educate their students to be prepared security professionals with a focus on emergency response capabilities and martial arts, including the courses on private police law and emergency rescue and cardiopulmonary resuscitation (CPR).

A Study on the Improvement Measures for Training of Special Security Guard (특수경비원 교육훈련의 개선방안에 관한 연구)

  • Currently, the security operations in nation's key foundations in Korea are performed by private police and special security guard in accordance with the Private Police Act and Security Business Act, respectively. In 1960s, The Korean Government introduced the private police system in terms of the national security issues, but it was just a hurriedly-set plan on the basis of Japanese Sunsa system as by that time there was no such system revitalized. However, the special security guards could offer wider range of security services including those of the private police with the enactment and revision of the Security Business Act 1976 and April 2001, respectively. Moreover, the expectations and interests rose over the special security guards in nation's key foundations after 9.11Terror Event in the U. S. 2001. However, as we investigated the current education/training system for the special security guard, we found that such education/training which is not activating the specialty of special security guard will not respond to the social demands. Special security guard owns its own characteristics other than those of general security guard as they are in service in nation's key foundations. Thus, the effcient management and training for the special security guard is the most important matter for the safety and security of nation's key foundations. Therefore, the well-educated special security guard through the reorganized and specialized education/training for the protection of nation's key foundations is expected to offer qualitatively improved security services.

  • This paper aims to draw practical measures for the Protection of the Rights of the private security guards. The results of the analysis, and presents the legal definition if need be introduced for the protection of private security guards right, are as follows. First, it must be established in Private Security Act the basic provisions that assure the economic status of the private security guards. Secondly, there is a need to clearly define the scope of authority of private security guards. Third, there is a need to clarify the scope of physical force or power in the regulations relating to the duty of the private security guards. This provision during the "displayed its power", there is a possibility that is too arbitrary interpretation, it must be deleted. Fourth, it must be established by weighting penalties for assault of a private security guards. Finally, Private Security Act and the Petition Police Act has a difference in personality and the purpose of the enactment. So it is not desirable to be directly applied to private security guards the provisions that apply to the petition police.

  • Recently in the condition of increasing of cruel-hearted crime, it is limited to keep the community safe by only police force and expanding role of private security is required. But current private security law and relation law have many delimitations. So reinforcing of Private security capabilities is needed and several measures are required. Integration of private security law and private police guards is the foundation of rule introduced of specific rights of private guards. Also authority of the private security should be ruled in private security law to prepare the conditions of performed guard duties. In relation to this, questioning of a suspicious person by a patrolman should be granted to the private security. Strengthening authority of private security can be helpful in preventing crime and policing.

  • The basic legislations regulating the private security in Korea are Private Security Business Act and Private Policeman Act. But this dualistic system of private security causes difficulties in unity and efficiency of private security operation and makes it complicated to supervise each personnel with effect. Besides despite similar service and duty, there is all the difference between private security guard and private policeman in regard of social position, pay, authority, and so on. Therefore it is suggested that the two Acts should be unified and the united private security act should be enacted. Legislating new private security act will lead to considering the detail legislative definition on qualification of personnels and business range.
