The Devices for Improvement against the Precedents about unfair Transactions in the Security Industries (경비업계에 있어서의 불공정거래의 사례 개선방안)

  • The area of security service has been maintaining the high growth curve annually by improving security consciousness from increase of the income and the progress of public services's level by the accomplishment in the info-communication field, recently the demand for unmanned security system is extended form commercial purposes into public offices and individual's houses. In addition to, the possible distance of offering services is scheduled to magnify. At the period when security company's influence has been becoming significant, the injustice transaction is the serious factor which obstructs the development of security companies. Therefore, it is urgent thing to devise counterplans to extirpate injustice transactions. There are the legalistic approaches of the breakthroughs against injustice transactions. One thing is settling the standard of the judgment and the other is renovating the provision of injustice transactions. Utilizing the principles of the fair competitions and importing self-obedience programs within the range of trade actions which is permitted by law, acted as the system approach. Moreover, there are such three things which can achieve mutual balances as establishing the range of the permitted action toward business corporations, applying spontaneously the fair competition principles and introducing the system of standard agreements. Gong further, this can establish order of security service areas and control them. Besides, it is possible for every organizations to make and operate the system appropriately by importing the self-observance system.

IP Sharing Router Debate: On the struggle between network and terminal (IP공유기 논쟁: 네트워크와 단말기 사이의 분투와 종결)

  • Internet users want to use IP sharing routers for reducing their cost and managing their terminals easy. Network service providers(NSPs) forced their subscribers pay extra charges to use extra terminal like IP router, since 1998 in Korea. The NSPs asserted that IP sharing routers would harm their networks or would impose extra load on their networks, but they were unable to prove their assertion. Users and manufacturing companies insisted on the legitimacy of IP routers, because the IP router is a kind of terminal for end-users, and as such, the right of selection of an IP router belongs to the user. The interest in and beliefs of the relevant social groups about IP router will be deduced through their interpretation. It draws the technological frame of two social groups, NSPs and IP router-manufacturing companies. The rough struggle between two social groups come from their frames. The article shows how society constructs a particular information technology.

The relationship between the major market-based media and the government in Korea (한국의 민주화와 미디어 : 정부와 시장 주류 미디어의 관계)

  • This study attempts to examine the relationships between the major market-based media and the government after closing military regime era, 1961-1987. After the military regime was collapsed, while the mass media in Korea obtained independence and autonomy from government, they have been confronted with the terrible competition not so much comparatively as before. The watchdog role in the traditional liberalism, which is regarded as normative relationship between the media and the government would be transformed in accordance with the market condition and the maturity of democracy. Thus, the watchdog metaphor has been variously deviated in rower-centered society; lap dog, guard dog, attack dog. liberalists argue that the primary democratic role of the media is to art as a public watchdog overseeing the state. Social democrats, however, criticize them as simplistic conception which could be only applied to the government. They argue that the media should be seen as a source of redress against the abuse of all forms of power over others; the home, the economy, and the civil society. The lap dog view is that the media is overwhelmingly dependent on the established power structure contrary to the watchdog. While the guard dog perspective is a means to preserve the power structure alarming with playing 'conflict role', the attack do8 aims to the private interest of the media in intruding into the politics. The attack dog perspective by T. Patterson could be composed of the interpretive style of report, the game schema report over the policy schema in the election, and the negativism against politics and government. The market-dominant press has been likely to transform from lap-guard dog into attack-guard dog. In Roh Tae Woo government(1988-1992), while the press was a lessened lap-guard dog before three parties merger in 1990, after merger the press had been transformed as the reinforced lap-guard dog because this merger entailed joint, party-to-party negotiations, and the formation of the new party preceded by dissolution of the ruling blot. In the early stage of Kim Young Sam government(1993-1997), the press has kept in pace with the reform movement drive-forced by the government. However, the press withdrew the support of Kim's reform in reaching the level of threat to ruling bloc. The press coalesced only circumstantially with government and was interested in preserving some margin of independence. The failure of Kim's reform proved the political muscle of the press in post-autho-ritarianism. In the middle stage of Kim Dae Jung government (1998-) that resulted in the shift of power structure as once-opposition party leader, the stress has been a manifested attack-guard dog owing to the anti-cold war policy, the realignment policy of power, and the minority-base of Kim's government. The press has endeavored to hold political communication within limits relatively less threatening to the established order.

  • The Convention on International Interests in Mobile Equipment and the Protocol to the Convention on International Interests in Mobile Equipment on Matters specific to Aircraft Equipment were adopted on 16 November 2001 at a diplomatic conference held in Cape Town under the joint auspices of UNIDROIT and ICAO. The entry into force of the Cape Town Convention and Protocol have occurred on 1 March 2006. The Cape Town Convention and Protocol provides an international legal regime for the creation, perfection and priority of security, title retention and leasing interests in aircraft equipment, which will be underpinned by an international registry. The purpose of this paper is to explain the objectives and principles of the Cape Town Convention and Protocol, to review the provisions relating to the international interests in aircraft equipment and international registry for their protection under the Cape Town Convention and Protocol, and to discuss the Issues on Korea's accession to the Cape Town Convention and Protocol. As the anticipated results of this paper, it will contribute to facilitate the financing of the acquisition and use of aircraft equipment of high value or particular economic significance in an efficient manner, and to save very large sums of money annually in financing charges, also the international interests in aircraft equipment will be recognized and protected universally.

  • The present study began from the criticism that the discussions related to the existing digital media have focused on the technical productivity and effectiveness to focus on the positive perspective. Therefore, this study will concretely confirm the dangers that may be caused by digital media and confirm the overall risk perception for digital media such as the user's opinions for risk evaluations and risk management for such dangers. As a result of making the digital convergence media, the smart phone, as the detail study subject, the 17 risk types including the 'risks of financial dimensions, risks of social-cultural dimensions, risks of individual dimensions and risks of pathological dimensions' were classified. Furthermore, the users appeared to highly evaluate the seriousness and possibilities of risks as a result of analyzing the risk-factor per each risk type(risk magnitude ${\times}$ development possibility). Next, it appeared that the users did not have high degree of reliability for the government in the aspects of countermeasures and prevention of risks and appeared to highly evaluate their expectation and liability for their individual roles. If the seriousness and development possibilities, the evaluations for liability, preventative measures and post-management methods for the risks of smart phones can be thoroughly analyzed and applied, it will be able to expand them as significant political countermeasures that can reduce the risks of other digital media in the future.

Reviewing Classification Scheme of Timber Assets for the National Accounting in Korea (국부통계 산출을 위한 입목자산 분류기준의 정립)

  • Due to the low productivity in timber harvesting, economic values of forest resources have been rarely validated in Korea. Since the Korea Forest Service provided a statistic of the timber assets for the survey of the 4th National Accounting (1998), no more statistics or measurements have been provided. Further, it becomes an issue that there is no clear standard to classify timber assets into produced or non-produced assets. In this research, we intended to provide a reasonable standard that enables one to classify timber assets either in produced or non-produced assets. For this purpose, articles in the '1993 System of National Accounts (SNA)', which presented definitions and scopes of biological assets, were scanned. The articles related to timber assets in the Korean version of SNA were compared with those in the original version of SNA that were proposed by UN. The results show that the Korean version of SNA seems to have much emphasis on natural occurrence or plantation for the classification standard, while its original version rather focus on the existence of direct control, responsibility, and management by institutional units. According to the original version of SNA, naturally occurring assets, which were basically classified into non-produced assets, were treated as being cultivated and classified into the produced asset when they (or their growth) were under the direct control, responsibility, and management of institutional units. Therefore, a guidance was presented to renew the Korean version of SNA and to innovate the classification standards for timber assets.

A Study on the Qualifications of Designated Person on the Maritime Safety Act (해사안전법상 안전관리책임자 및 안전관리자의 자격요건에 관한 연구)

  • In managing shipping business, the concept of seaworthiness of the vessel has developed in accordance with the development of the shipping industry. However, despite of the development of the vessel's seaworthiness, marine accident has continuously occurred at sea. International Maritime Organization(IMO) has paid attention to the research and investigation of Human Error in shipping operations in addition to physical seaworthiness of the vessel. In 1994, IMO adopted the "International Management Code for the Safe Operation of Ships and for Pollution Prevention(ISM code)" of "SOLAS 1974" Annex, to take countermeasure against this human error. In 1999, Korea adopted the 'ISM Code' and then enacted the Maritime Safety Act (previously Maritime Traffic Safety Act). The Maritime Safety Act regulates necessary qualifications of the Human Resources of shipping companies for establishment and implementation of the safety management system. However, there has been a discrepancy between shipowners and ship management companies in interpreting the legislative texts, finally causing confusion. In this paper, I would like to examine the deficiencies in the regulation on the standard of qualifications of the Designated Person under the Maritime Safety Act and thereby suggest any possible improvements in it.

Introductions of the New Code of Fungal Nomenclature and Recent Trends in Transition into One Fungus/One Name System (균류의 새로운 명명 규약과 일균일명 체계로의 전환)

  • Nomenclatural code for fungi was dramatically modified in the 18th International Botanical Congress (IBC) held in Melbourne, Australia in July 2011. Its name was changed into International Code of Nomenclature for Algae, Fungi and Plants (ICN), which was formerly called as International Code of Botanical Nomenclature (ICBN) of the Vienna Code of 2005. The most important change for fungi is abandoning dual nomenclature and introducing one fungus/one name system (2013. 1). Since more than 10,000 species of fungal names should be renamed based on this new classification system (one fungus/one name system), it is challenging to both mycologists and taxonomic users such as plant pathologists and food scientists. Here, we introduced background, progress and future plan for its transition into one fungus/one name system. The new code is allowing electronic-only publication of names of new taxa (2102. 1) and the requirement for a Latin validating diagnosis was changed to allow either English or Latin for the publication of a new name (2011. 1). Furthermore, pre-publication deposit of key nomenclatural information in a recognized repository is mandatory in ICN (2013. 1). The aims of this manuscript are to introduce new code of fungal nomenclature and recent trends in one fungus/one name system to Korean mycological society.

Selection of Acid-tolerant and Hetero-fermentative Lactic Acid Bacteria Producing Non-proteinaceous Anti-bacterial Substances for Kimchi Fermentation (비단백질성 항균물질을 생산하는 김치발효용 내산성 Hetero 발효형 유산균주 선발)

  • Twenty-three strains of Leuconostoc species and 45 strains of Weissella species inhibiting the growth of Lactobacillus sakei, one of the most populous lactic acid bacteria in over-ripened kimchi, were isolated from kimchi in our previous study. Among these hetero-fermentative 68 strains, Leuconostoc mesenteroides CK0128, Weissella cibaria CK0633, and W. cibaria KK0797 exhibited a relatively high survival rate in MRS medium, which was adjusted to pH 4.3 using an acid mixture consisting of acetic and lactic acids, and produced a large amount of exopolysaccharides. The culture supernatants of 3 strains were fractionated by a molecular weight cutter and lyophilized. The fractions with a molecular weight smaller than 3,000 Da showed antagonistic activity against Staphylococcus aureus and Lb. sakei. The anti-bacterial substances were very stable to heat treatments ($121^{\circ}C$, 15 min) and active at acidic conditions below pH 5. ${\alpha}$-Amylase, lipase, and proteolytic enzymes (proteinase K and pepsin) did not affect their activities. These non-proteinaceous anti-bacterial substances inhibited the growth of several food pathogens.
