Financial Regulation and R&D Investment (금융규제와 R&D 투자 - 자기자본, 금리 및 업무영역 규제를 중심으로 -)

  • In this study, we made a critical review on the regulatory policies in financial sector of Korea, analysed their effects on the firm's innovation, and suggested some policy implications. Many innovation researchers and policy makers expected that such a liberal system of regulation would lead Korea's national innovation system to the quantum leap. Our analyses of financial regulations show, however, that changes of regulatory systems (deregulation for interest rate) in the last decade did not always promoted the firm's innovation. The firms now encounter Basel II, and since it could cause bipolarization between R&D performing firms, it is necessary to add complementary policy such as collateralization or netting. Finally, simple empirical anlysis shows that the trend of universal banking may affect R&D investment positively.

예금보험(預金保險)과 은행규제(銀行規制)의 필요성(必要性)

  • 자율화와 경쟁여건의 조성을 통해 금융효율성제고(金融效率性提高)를 추구할 때 금융제도의 안전성과 예금자 보호를 위 한 제도적 장치로서 예금보험제도(預金保險制度)에 대한 고려가 병행되어야 한다. 그러나 은행의 위험에 대한 예금보험제공자와 은행사이에 정보(情報)의 비대칭성(非對稱性)이 존재하기 때문에 공정한 변동보험료제도의 실시가 불가능할 때에는 도덕적 위험문제를 피하기 어렵다는 부작용이 발생한다. 예금보험제도의 유용성을 인정하고 동제도의 목적을 충실히 수행하기 위해서는 도덕적(道德的) 위험(危險)의 억제가 중요하며 그 수단으로 은행규제(銀行規制)가 경제적 타당성을 갖게 된다. 기본적인 규제의 형태로는 적정자본금(適正資本金) 규정(規定), 업무영역(業務領域)의 제한(制限), 탄력적(彈力的)인 수신금리규제(受信金利規制)가 되어야 한다. 현재의 자율화 과정을 고려할 때 규제의 효율성면에서는 위험분담사고에 기초하는 적정자본금 규정이 주된 규제수단이 되어야 할 것으로 고려된다.

Study on Legal Regulations for Utilization of Drone in Private Security (민간경비에서 드론 활용과 법적 규제에 관한 연구)

  • Recently, drone applications have been expanded not only in the military and security fields but also in daily life such as commercial and sports, and there is also a growing interest in using drone for private security work. This study focuses on the discussion on the use of drones in private security, drones regulation in the related laws such as the Private Security Act and the Aviation Safety Law, and major issues in accepting the Private Security Act. First, it focuses on the scope of private security work as defined by the Private Security Act, focusing on the use of drones as surveillance, information gathering, guidance and warning services, evacuation services, search and related material transport services, respectively. Second, the related laws for the use of drones in private security work include the Private Security Act and the Aviation Safety Act. However, the Private Security Act does not prescribe the current drones and the use of drones is regulated by Aviation Safety Act. Third, it is necessary to adjust the qualifications and authority range of security guards in the Private Security Act, to accept the drones as a type of security equipment, and to consider how countermeasures against threat types using drones should be accepted in the Private Security Act.

증권업(證券業)의 규모(規模)와 범위(範圍)의 경제성(經濟性)에 대한 실증분석(實證分析) -한국(韓國)과 일본(日本)의 비교연구(比較硏究)-

  • 본(本) 연구(硏究)에서는 우리나라 증권산업(證券産業)에 있어서 규모(規模) 및 범위(範圍)의 경제성(經濟性)의 존재여부를 실증분석하였다. 이것을 일본(日本)의 경우와 비교하면 우리나라에서도 증권업(證券業) 규모(規模)의 경제성(經濟性)이 대체로 존재하며 대규모(大規模)보다는 중(中) 소규모(小規模)에서 뚜렷이 시현되는 것으로 나타났다. 그러나 업무범위(業務範圍)의 경제성(經濟性)의 존재는 통계적으로 유의(有意)하게 입증되지 않으며 다만 자금(資金)이나 신인도면(信認度面)에서 유리한 입장에 있는 대형사(大型社)가 인수주선업무에 있어서 비교우위(比較優位)를 보였다. 분석기간이 증권산업(證券産業)의 고도성장기였기 때문에 단기적인 효율성(效率性)을 극대화하기 어려웠다는 점과 각종 제도적(制度的) 규제(規制)로 인해 증권회사(證券會社)들이 효율에 입각한 업무다변화(業務多邊化)를 적극적으로 추진하는 데 제약이 있었다는 점 등이 고려되어야 하겠지만 우리나라 증권사(證券社)가 내부경영(內部經營)의 효율성면에서 개선의 여지가 있음을 시사하고 있다. 본(本) 연구(硏究)의 이러한 잠정적 결론에도 불구하고 규모(規模) 및 범위(範圍)의 경제성(經濟性)에 대한 정밀한 분석이 증권업(證券業)뿐만 아니라 타금융업(他金融業)에 대해서도 시도되어야 할 것이며 이러한 연구들은 증권산업(證券産業) 업무영역조정(業務領域調整)을 포함한 제반 정책결정에 기여할 수 있을 것이다.

  • ln this paper, we showed Web-based Integrated Safety, Health and Environment management system(WISHE) in gas industry, which was inspired from the integrated gas safety management system. Using the object oriented information flow to analysis basic modules of safety, health and environment, we made web-based, which enables us to access system anywhere, integrated system and its modules that can meet various laws and rules. This system also can reduce man power and management cost.

A practical analysis approach to the functional requirements standards for electronic records management system (기록관리시스템 기능요건 표준의 실무적 해석)

  • The functional requirements standards for electronic records management systems which have been published recently describe the specifications very precisely including not only core functions of records management but also the function of system management and optional modules. The fact that these functional requirements standards seem to be similar to each other in terms of the content of functions described in the standards is linked to the global standardization trends in the practical area of electronic records. In addition, these functional requirements standards which have been built upon with collaboration of archivists from many national archives, IT specialists, consultants and records management applications vendors result in not only obtaining high quality but also establishing the condition that the standards could be the certificate criteria easily. Though there might be a lot of different ways and approaches to benchmark the functional requirements standards developed from advanced electronic records management practice, this paper is showing the possibility and meaningful business cases of gaining useful practical ideas learned from imaging electronic records management practices related to the functional requirements standards. The business cases are explored central functions of records management and the intellectual control of the records such as classification scheme or disposal schedules. The first example is related to the classification scheme. Should the records classification be fixed at same number of level? Should a record item be filed only at the last node of classification scheme? The second example addresses a precise disposition schedule which is able to impose the event-driven chronological retention period to records and which could be operated using a inheritance concept between the parent nodes and child nodes in classification scheme. The third example shows the usage of the function which holds or freeze and release the records required to keep as evidence to comply with compliance like e-Discovery or the risk management of organizations under the premise that the records management should be the basis for the legal compliance. The last case shows some cases for bulk batch operation required if the records manager can use the ERMS as their useful tool. It is needed that the records managers are able to understand and interpret the specifications of functional requirements standards for ERMS in the practical view point, and to review the standards and extract required specifications for upgrading their own ERMS. The National Archives of Korea should provide various stakeholders with a sound basis for them to implement effective and efficient electronic records management practices through expanding the usage scope of the functional requirements standard for ERMS and making the common understanding about its implications.

  • Klaus Schwab's discussion on the Fourth Industrial Revolution provides a framework for predicting the direction of legal technology development. Technological convergence, which has emerged as the core concept of the Fourth Industrial Revolution has a significant effect on legal technology. In particular, various new technologies, such as legal chatbots and platforms, are being introduced to enhance efficiency and accessibility in the legal field. However, legal technology is still in its early stage, with institutional improvement needed to vitalize the industry. In this paper, we first specify the concept and classification of legal technology in Chapter 2, followed by trends and limitations in Chapter 3 and ways of vitalizing legal technology in the future in Chapter 4. To invigorate legal technology development, it is necessary to put in place legal regulatory measures that stipulate the active disclosure of legal data, such as precedents, and make free use of such measures. In the law, many issues, such as the safety of artificial intelligence, personal information protection, and ethical standards, will be discussed in the future. Therefore, via this paper, we hope to promote the formation of social consensus and prepare countermeasures, such as legislative measures.
