A Selection Model For Power Plant Project Delivery Method (화력발전소 발주방식 비교를 통한 적정 발주방식 선정 모형)

  • With the electricity industry structure reformation of the government in April, 2001, Korea Power Electric Corporation was divided in to Korea water power nuclear power and 5 thermal power plant. After, various delivery method is introduced and applied for active profit creation according to the competition between each development companies for the public company privatization. However, the current situation does not satisfy the project participant by selecting the delivery method without reflecting the business goal and project characteristics of power plant construction business. The objective of this study is to research the influencing factors that should be considered to select the delivery method in thermal power construction business and develop a standard of selection of appropriate delivery method through questionnaire and interviews to establish a model to select the delivery method that fits the business goal of the subject of delivery. In the future, if the delivery method selection model suggested in this study is applied, it is expected to select the appropriate delivery method of power plant construction business by effectively reflecting the business goal, characteristics and demand of the delivery subject, and characteristics of the construction business apart from the existing customary practices that decided the delivery method dependent on the subjective and experience based judgement.

Development of a Business Support System by Phase for Delivering Construction Management Contract in the Government Civil Project (공공토목사업 CM 발주를 위한 단계별 업무지원 시스템 구축)

  • Recently, the MLTM (Ministry of Land, Transport and Maritime Affairs) has announced CM business guidelines, because it is expected that the CM deliveries are going to be increased for a civil engineering industry with enforcement of the CM at Risk. In this trend, The CM business guideline, which is currently announced, is for the steps after the CM contract. However, the practical business guideline from a planning phase for the CM delivery to a selection phase of a CMr (Construction Manager) is essential for public construction projects including the civil engineering projects that the frequency of the CM deliveries is not sufficient. Therefore, this study established a standardized process model from the planning phase for the CM delivery to the selection phase of the CMr. study configured a business breakdown structure for CM delivery. A prototype system for supporting the CM delivery was also developed, and a practical operability was verified by a case evaluation based on the developed system. Hence, it is expected that this study will be utilized as a supporting system of the CM delivery business for public clients, which have not sufficient cases of the CM delivery.

  • Procurement System for Korean construction industry has mainly been controlled by the complicated regulatory system which has been recognized as unflexible and remotely separated from the global standard. This has been identified by many Korean construction experts as one of the main reasons that hamper the Korean construction industry becoming the global leader. One commonly discussed regulatory system is the compulsory multiple contracting system that has been enforced for a long time. According to the Korean governmental contracting law 68-3, all construction projects cannot be divided into separate contracting packages with a few exceptions. Exceptions stated in the law include construction activities related electrical, Information communication, fire-fighting, and cultural assets which all are governed by the separate laws/acts controlled by the different governmental bodies. This research is to closely investigate multiple prime contracting system that has been compulsory in Korean construction industry and to provide policy recommendations to these restrictions. Although, there has been a long history of this compulsory contracting system, this study attempted to provide objective analysis on current status of the system as well as global standard on the issue. This study suggests main considerations when considering different contracting system such as rights of owners, flexibilities of regulatory systems, and efficiencies of conducting a construction project. It is envisioned that recommendations from this study, if accepted by the regulatory bodies, would improve the Korean construction contraction system by making it more compatible with global standard. Moreover, these would help making the Korean industry more effective in terms of regulatory restrictions.

  • Performance-based Project Delivery System(PPDS) is one of Project Delivery System that when owner ask for performance than constructor feel free to choose materials, technology, an engineering method. PPDS rank higher position than Performance Warranty Contract and Technical Proposal Bid. This study aims to propose Improvement Idea for PPDS that based Housing Performance Grading Indication System. 'Request-performance Checklist' is used as communication means(between owner and constructor) and a kind of corroborative facts make the procedures achievement of project like contract easier.

Determining Decision-making Factors for the Selection of Contract Methods in Public Construction (공공공사의 발주방식선정을 위한 의사결정요인 연구)

  • The procurement of public construction, which has been selected mainly on the basis of the work experience of a department of public agencies that award construction contracts or those in charge of ordering, has not been executed through an objective selection process considering the construction types or characteristics. Thus, as a preliminary study on developing a model for the selection of contract methods, this study intends to analyze and present the key factors affecting the selection of procurement methods in public construction. Through a literature review on the existing methods, foundational factors were first presented, based on the analysis of these factors, the final influence factors were proposed. As a result, 6 factors contractor's characteristics, the environment of the construction market, relevant organization, the characteristics of a project, costs, and responsibility factors were determined, and 14 sub-factors were selected. The factors presented in this study will be used as base data for developing a decision making support model for the selection of contract methods in public construction.

  • The selection of the reasonable project delivery system (PDS) is crucial for a successful performance of a project, which means to achieve project objectives. Furthermore, the project performance has been tightly related to the selection of PDS appropriate to pertinent project characteristics. In this context, the ministry of finance and economy of Korea launched two new project delivery systems called "Best Value Contract (Design-Bid-Build)" and "Bridging Contract (Design-Build)" in October of 2007 by revising enforcement ordinances of "Act on Contracts to Which the State is a Party". For efficient operation of the new project delivery systems, this paper suggested a PDS selection model which supports decision making of the reasonable PDS for a pertinent project by assessing characteristics of the public construction projects, both quantitatively and qualitatively. In addition, a PDS performance evaluation model was proposed in order to get feedback on the result of the PDS selection and the operation for the succeeding project. The standard models suggested in this paper might be used as a tool to support the decision making of the public organizations.

  • 공사대금에 대한 압류나 가압류가 이루어진 경우 하도급대금 직접 지급 가능 여부와 관련한 논란에 대해 사업부가 가능하다는 판결을 내려 주목된다. 전주지방 법원 제2민사부 (재판장 조현욱 판사)는 "기성금의 청구일자보다 제3 채권자의 압류나 가압류일 자가 앞선다고 하더라도 직접지급합의서가 제3채권자의 압류나 가압류보다 먼저 작성됐다면 발주자는 하도급대금을 수급사업자에게 직접 지급해야 한다"고 판결했다. 3개의 전문건설업체가 전주국도유지건설사무소를 상대로 '하도급대금을 직접 지급해 달라'고 청구한 소송에서 재판부는 "발주자가 하도급대금을 수급사업자에게 직접 지급하기로 발주자,원사업자,수급사업자 간에 합의한 경우에는 '그 합의한 때' 발주자의 원사업자에 대한 대금지급채무는 소멸된다'며 이같이 판결했다. 이번 판결이 하도급거래공정화에 관한 법률 제14조 제 2항에서 규정하고 있는 '발주자의 원사업자에 대한 대금지급채무의 소멸시기'가 '수급사업자가 하도급대금의 직접 지급을 요청한 때'가 아닌 '발주자,원사업자,수급사업자 간에 직불을 합의한 때'임을 분명히 한 것이어서 하도급대금 직불에 미온적이었던 발주기관들의 관행을 개선시키는 계기가 될 것으로 예상된다.

  • 공공부문의 정보화 사업의 중요성에도 불구하고, 공공기관의 정보시스템을 효율적으로 발주 ${\cdot}$ 관리할 수 있는 체계가 정립되어 있지 못할 뿐만 아니라, 정보화사업은 계획 ${\cdot}$ 심의 ${\cdot}$ 사업기획 ${\cdot}$ 사업발주 ${\cdot}$ 사업관리 ${\cdot}$ 성과평가 동의 일련의 발주체계의 전문성 미흡으로 발주자의 사업수행상의 어려움뿐만 아니라 이를 실질적으로 수행하는 수주업체에도 커다란 영향을 미치고 있어 발주기관과 수주업체간의 절차상의 문제발생 사업결과에 대한 책임 한계 불분명 둥으로 법적인 문제가 발생되고 있다. 또한, 국가, 공공기관 등은 모든 사업의 절차가 법과 제도에 근거하여 수행되고 있는데 소프트웨어 등 지식기반사업의 경우에는 법과 제도가 사업의 특성을 반영하지 않아 S/W사업 수행에 어려움이 상존하고 있어, 기술적인 발주 ${\cdot}$ 체계 개선과 더불어 법 ${\cdot}$ 제도의 개선이 요청되고 있다.

  • In this paper, we propose a new ordering model for the mixed parts transportation problem with multi-items based on the depot system. Order scale are used as decision parameters instead of order point for ordering multi-items. Finally we test the model with simple example and show computational result that verifies the effectiveness of the model.

법령과 고시 - 분리발주 허용 대상 구체화, 발주기관 재량권 대폭 인정

  • 기획재정부는 공사의 분할 분리발주 관련규정 등을 정비하고 최저가낙찰제 확대유예 등의 내용을 담은 국가계약법 시행령 개정안을 지난 11월 8일 입법예고 했다. 이 법안은 20일 동안 업계 의견을 수렴한 후 법령안 심사 및 차관 국무회의 등을 거쳐 공포될 예정이다. 이번 국가계약법 시행령 개정안은 그동안 대한설비건설협회가 전사적으로 추진해 온 분리발주 법제화와 최저가낙찰제 연기 방안을 담고 있어 건설업계의 관심이 집중되고 있다. 분할 분리발주 규정은 분리발주가 보다 활성화 될 수 있도록 대상을 구체화했으며, 사업의 계획단계부터 분리발주 가능 여부를 판단토록 개선됐다. 또한 300억 이상에서 100억 이상으로 확대될 예정이던 최저가낙찰제 확대 방안은 오는 2015년까지 2년간 유예되고 최저가낙찰제 대체 방안으로 종합심사제가 제안되는 등 정부의 입 낙찰제도 개선 방향의 가닥이 잡혔다.
