Study on Development of Korean Unmanned Systems through Analysis of U.S. Unmanned Systems Policy (미국의 무인체계 정책 분석을 통한 한국의 무인체계 발전에 관한 연구)

  • This study presents a method to efficiently advance the Republic of Korea's Unmanned Systems through the analysis of the development of the U.S. Unmanned System Policy. After the occurrence of the September 11 attacks, the U.S. developed Unmanned Systems as a part of RMA and became the leader in this area. The system went through numerous trials and errors during the development and acquisition. From these experiences, the U.S. had embodied Unmanned Systems acquisition methods by establishing Unmanned Systems Development Guidance and DoD Autonomy Community of Interest in 2012. In addition, as diverse unmanned programs started to proceed, it promoted Core Technology development sharing and simplification of functions of the Unmanned Systems to exclude budget-wasting elements such as duplication of programs. The Republic of Korea must politically build a collaborative system between industry/academia/research institute/military and apply evolutionary development strategies from the first step of the development of the Unmanned Systems the future Game Changer. In operations, concepts of the Manned/Unmanned Systems complex operation should be established and intelligent S/W, Open System, and Cyber Security technologies to materialize them developed.

  • In modern international law, the absence of legal definition regarding drone(Unmanned Aerial Vehicle) has made legal scholars work on an typical analogy between aircraft codified in the international document and drone. The wording of the Convention on International Civil Aviation is limited to two categories of aircraft, such as civil aircraft and state aircraft, whereas military aircraft is not legally defined. As such it is, the current practices of the State regarding the drone flight over foreign territory have proven a hypothese that drone is being deemed as military aircraft. Principal usage of drone lies in reconnaissance and surveillance mission as well as so-called targeted killing, which is prohibited if the killing is treacherous. Claimed war against terrorism, however, is providing a legal rationale that targeted killing is not treacherous, and that the targeted person is not civilian but combatant. In such context, armed attack of drone is deemed legal and justified. Consequently, such attack is legal in the general context of the war. The rules that govern targeting do not turn on the type of weapon system used, and there is no prohibition under the laws of war on the use of technologically advanced weapons systems in armed conflict so long as they are employed in conformity with applicable laws of war. Drones may present interesting new challenges because of their sophistication and the technological advantage they convey to their operators.

A Study on the infringement of privacy of unmanned aircraft : Focusing on the analysis of legislation and US policy (무인항공기의 사생활 침해에 대한 법적 대응 : 미국 정책.입법안 분석을 중심으로)

  • An unmanned aerial vehicle (UAV), commonly known as a drone and also referred to as an unpiloted aerial vehicle and a remotely piloted aircraft (RPA) by the International Civil Aviation Organization (ICAO), is an aircraft without a human pilot aboard. ICAO classify unmanned aircraft into two types under Circular 328 AN/190. Unmanned aircraft, which is the core of the development of the aviation industry. However, there are also elements of the legal dispute. Unmanned aircraft are manufactured in small size, it is possible to shoot a record peripheral routes stored in high-performance cameras and sensors without the consent of the citizens, there is a risk of invasion of privacy. In addition, the occurrence of the people of invasion of privacy is expected to use of civilian unmanned aircraft. If the exposure of private life that people did not want for unmanned aircraft has occurred, may occur liability to the operator of unmanned aircraft, this is a factor to be taken into account for the development of unmanned aircraft industry. In the United States, which is currently led by the unmanned aircraft industry, policy related to unmanned aircraft, invasion of privacy is under development, is preparing an efficient measures making. Unmanned aircraft special law has not been enforced. So there is a need for legal measures based on infringement of privacy by the unmanned aircraft. US was presented Privacy Protection Act of unmanned aircraft (draft). However Korea has many laws have been enacted, to enact a new law, but will be able to harm the legal stability, there is a need for the enactment of laws for public safety of life. Although in force Personal Information Protection Law, unmanned aerospace, when the invasion of privacy occurs, it is difficult to apply the Personal Information Protection Law. So, it was presented a privacy protection bill with infringement of privacy of unmanned aircraft in the reference US legislation and the Personal Information Protection Act.

  • Nowadays, major advanced countries in aviation technology are putting their effort to develop commercial and civil Unmanned Aircraft System(UAS) due to its highly promising market demand in the future. The market scale of commercial and civil UAS is expected to increase up to approximately 8.8 billon U.S. dollars by the year 2020. The usage of commercial and civil UAS covers various areas such as remote sensing, relaying communications, pollution monitoring, fire detection, aerial reconnaissance and photography, coastline monitoring, traffic monitoring and control, disaster control, search and rescue, etc. With the introduction of UAS, changes need to be made on current Air Traffic Management Systems which are focused mainly manned aircrafts to support the operation of UAS. Accordingly, the legislation for the UAS operation should be followed. Currently, ICAO's Unmanned Aircraft System Study Group(UASSG) is leading the standardization process of legislation for UAS operation internationally. However, some advanced countries such as United States, United Kingdom, Australia have adopted its own legislation. Among these countries, United States is most forth going with President Obama signing a bill to integrate UAS into U.S. national airspace by 2015. In case of Korea, legislation for the unmanned aircraft system is just in the beginning stage. There are no regulations regarding the operation of unmanned aircraft in Korea's domestic aviation law except some clauses regarding definition and permission of the unmanned aircraft flight. However, the unmanned aircrafts are currently being used in military and under development for commercial use. In addition, the Ministry of Land, Infrastructure and Transport has a ambitious plan to develop commercial and civil UAS as Korea's most competitive area in aircraft production and export. Thus, Korea is in need of the legislation for the UAS operation domestically. In this regards, I personally think that Korea's domestic legislation for UAS operation will be enacted focusing on following 12 areas : (1)use of airspace, (2)licenses of personnel, (3)certification of airworthiness, (4)definition, (5)classification, (6)equipments and documents, (7)communication, (8)rules of air, (9)training, (10)security, (11)insurance, (12)others. Im parallel with enacting domestic legislation, korea should contribute to the development of international standards for UAS operation by actively participating ICAO's UASSG.

  • This paper addressed the analysis of the trend and direction of the US defense strategy based on their third offset strategy and presented the practical policy implication of ensuring the security of South Korea appropriately in the future national defense environment. The countermeasures for the development ability of advanced weapon systems and secure core technologies for Korea were presented in consideration of the US third offset strategy for the future national defense environment. First, to carry out the innovation of national defense in Korea based on artificial intelligence(AI), the long-term basis strategy for the operation of the unmanned robot and autonomous weapon system should be suggested. Second, the platform for AI has to be developed to obtain the development of algorithms and computing abilities for securing the collection/storage/management of national defense data. Lastly, advanced components and core technologies are identified, which the Korean government can join to develop with the US on a basis of the Korea-US alliance, and the technical cooperation with the US should be stronger.

  • The unmanned aerial vehicle that emerged with the 4th Industrial Revolution attracts attention not only from Korea but also from around the world, and its utilization and market size are gradually expanding. For the first time, it was used for military purposes, but it is currently used for transportation, investigation, surveillance, and agriculture. China, along with the US and Europe, is emerging as a leader in the commercial unmanned aerial vehicle market, and Korea, which has the world's seventh-largest technology in related fields, is striving to promote various technology development policies and system improvement related to unmanned aerial vehicles. Military drones will revolutionize the means of war by using a means of war called an unmanned system based on theories such as network-oriented warfare and effect-oriented warfare. Mobile equipment, including drones, is greatly affected by environmental factors such as terrain and weather, as well as technological developments and interests in the field. Now, drones are being used actively in many fields, and especially in the military field, the use of advanced drones is expected to create a new defense environment and provide a new paradigm for war.

  • Recently, the implementation & modern policy for Global Navigation Satellite System have actively been performed by USA, RUSSIA, EU & CHINA. Therefore 100+ navigation satellites will be in orbit by 2015, and the user of military and civil will benefit from the use of a total constellation of 100+ satellites. It means that the deepest dependence to GPS would be declined. In the paper, the latest technology development & implementation policy of GNSS have been analyzed. Specially, we focused on circumstance change of GNSS & application of navigation technology for modem weapon system. Finally, the application strategy of the integrated GNSS is suggested for military and civil as well.

A Study on UAV and The Issue of Law of War (무인항공기의 발전과 국제법적 쟁점)

  • People may operate unmanned aerial vehicles (UAVs or drones) thousands of miles from the drone's location. Drones were first used (like balloons) for surveillance. By 2001, the United States began arming drones with missiles and using them to strike targets during combat in Afghanistan. By mid-2010, over forty states and other entities possessed drones, many with the capability of launching missiles and dropping bombs. Each new development in military weapons technology invites assessment of the relevant international law. This Insight surveys the international law applicable to the recent innovation of weaponizing drones. In determining what international law rules govern drone use, the most salient feature is not the fact that drones are unmanned. The fact drones carry no human operator may be the most important new technological breakthrough, but the key feature for international law purposes is the type of weaponry drones carry. Whether law enforcement rules govern drone use depends on the situation and not necessarily who is operating the drone. Battlefield weapons may also be lawfully used before an armed conflict in the following situations: when initiating self-defense under Article 51 of the United Nations Charter; when authorized by the UN Security Council; when a government seeks to suppress internal armed conflict; and, perhaps, when a state is invited to assist a government in suppressing internal armed conflict. The rules governing resort to force in self-defense are found in Article 51 of the UN Charter and a number of decisions by international courts and tribunals. Commentators continue to debate whether drone technology represents the next revolution in military affairs. Regardless of the answer to that question, drones have not created a revolution in legal affairs. The current rules governing battlefield launch vehicles are adequate for regulating resort to drones. More research must be undertaken, however, to understand the psychological effects of deploying unmanned vehicles and the effects on drone operators of sustained, close visual contact with the aftermath of drone attacks.

Space Economy, Ecosystem Strategies for LEO 5G-NTN Space Communications (우주경제, LEO 5G-NTN 우주통신 생태계 전략)

  • The latest global issues are the Space economy and low-orbit Space communication. 3GPP announced Release 17 standardization in June 2022, and in this regard, the United States prepared a strategy to enhance the competitiveness of the low-orbit 5G-NTN Space industry, and create an ecosystem at the national level in March 2023. Global smartphone semiconductor manufacturers have announced the development and verification results of standard-based chip technology, and satellite communication operators are launching low-orbit 5G-NTN Space communication services and rate products through convergence between terrestrial communication networks. This study diagnoses the current status of Korea's low-orbit 5G-NTN space communication ecosystem. We present our ecosystem creation strategy in terms of fair competition in the market, the service legal system, and the national R&D governance system.
