Passenger's Right to Compensation in relation to Delayed Flights - From the perspective of EU case law - (운항지연에 따른 승객의 보상청구권 - EU 및 프랑스 판례를 중심으로 -)

  • Regulation (EC) No 261/2004 ("Regulation") is a common rule on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights. In some recent cases of European nations, passengers sued the air carrier in order to obtain monetary compensation under Article 7(1) of the Regulation. Some courts dismissed the actions on the grounds that, unlike denied boarding or cancellation of the flight, the Regulation provides no compensation in relation to delayed flights. However, Court of Justice of the European Union(CJEU) ruled that Regulation 261/2004 must be interpreted to mean that passengers whose flights are delayed have a right to compensation in cases when the loss of time is equivalent to, or is in excess of three hours - where the passengers eventually reached their final destination three hours or more later than the originally scheduled arrival time. It is true that a strict interpretation of the regulation would suggest that passengers whose flight has merely been delayed are not entitled to compensation. They should only be offered assistance in accordance with the Articles 6 and 9. Nevertheless, the Court recognized the same right to the same compensation for passengers of flights delayed by more than three hours as that explicitly provided for passengers of cancelled flights. On the one hand, the Court bases this ruling on the recitals of the Regulation, in which the legislature links the question of compensation to that of a long delay, while indicating that the Regulations seek to ensure a high level of protection for passengers regardless of whether they are denied boarding or their flight is cancelled or delayed. On the other hand, the Court interprets the relevant provisions of the Regulation in light of the general principle of equal treatment. Furthermore, the Court delivered a ruling that the loss of time inherent in a flight delay, which constitutes an inconvenience within the intention of Regulation No 261/2004 and which cannot be categorized as 'damage occasioned by delay' within the meaning of Article 19 of the Montreal Convention, cannot come within the scope of Article 29 of that convention. Consequently, under this view, the obligation under Regulation No 261/2004 intended to compensate passengers whose flights are subject to a long delay is in line with Article 29 of the Montreal Convention. Although the above interpretation of the Court can be a analogical interpretation, the progressive attitude of the Regulation and the view of Court forward to protect passengers' interest is a leading role in the area of international air passenger transportation. Hopefully, after the model of the positive support in Europe, Korea can establish a concrete rule for protecting passengers' right and interest.

  • The purpose of this study is to examine the effect of Employee Value Proposition (EVP) on job satisfaction and organizational loyalty. As a result, the study clarifies the hotel's EVP system in addition to examining the relationships among EVP, job satisfaction, and organizational loyalty by generating theocratical and practical application related to those behaviors. Using a sample drawn from full-time workers in hotel, total 379 participants were included in the analysis. The study tested the hypothesis by using a structural equation modeling approach. The analysis results show that EVP has significant influence on job satisfaction and organizational behavior. However, job satisfaction does not influence organizational loyalty.

  • The purpose of this study is to review the current state of the transformational leadership and LMX approach to the study of leadership. Leadership research has witnessed a shift from traditional transactional models to a new genre of theories of transformational and charismatic leadership and LMX. Transformational leadership theories offer the promise of extraordinary individual and organizational outcomes. Leaders motivate followers to perform beyond expected levels by activating higher order needs, fostering a climate of trust, and inducing them to transcend their self-interest for the organization's sake. Numerous investigations point of the robustness of the effects of such leadership on individual and organizational outcomes such as job satisfaction, organizational commitment, and performance. LMX theory suggests that leaders do not use the same style in dealing with all subordinates, but rather develop a different type of relationship or exchange with each subordinate. These relationships range from those that are based strictly on employment contracts to those that are characterized by mutual trust, respect, liking, and reciprocal influence. LMX has been positively related to job satisfaction, productivity, and career progress of managers and negatively related to turnover and employee grievances. In conclusions, effective leaders link achievement of organizational goals to follower fulfillment of self-development goals, with the former advancing the latter.

The Realities and Problems of Master Teacher System in China (중국 특급교사제(特級敎師制) 운영실태 분석 및 시사점)

  • Along with concerns about deteriorating social and economic status of teachers around the world, Master Teacher System(MTS) has been considered as one of the alternatives to transform teaching profession into a more attractive job. In this study, the conditions and problems associated with the MTS in China is analyzed to draw implications for South Korea, which recently legalized the MTS. Research framework including four research questions is developed based on the controversies surrounding MTS of South Korea. The main findings show that the MTS in China was introduced to improve teachers' social and economic status along with the quality of prospective teachers. A very small number of master teachers are selected through rigorous standards including longer service period. They are given additional monetary and non-monetary compensations in return for their teaching-learning leadership and responsibilities. As highly respected educators, they enjoy the lifelong benefits, although they are annually evaluated. It is evident that the MTS has contributed to improving the attractiveness of teaching profession in China. Nevertheless, there are many problems associated with selection standards and methods of master teachers, their roles, compensation, evaluation and terms of service. Recent criticism due to changing circumstances surrounding education in China makes the MTS more questionable. Based on the findings, major implications for future directions of MTS of South Korea are drawn and suggested.

Patient Attitudes and Considerations in Decision toward Participation in Clinical Trials of Chronic Diseases (만성질환 임상시험 참여 대상자의 금전적 보상에 대한 태도와 참여결정 시 고려사항)

  • Background: We investigated the impact of financial compensation on patients' decision of participation in clinical trials and the related factors with patients' attitudes and considerations. Methods: A survey questionnaire was placed from October 31 to November 16, 2017 to the subjects who were enrolled in the trials of chronic diseases. Patients' socio-demographic characteristics were collected and the potential reasons for participating in the trials were assessed using 5-likert scores. Results: Sixty eight of 110 respondents (61.8%) indicated to participate clinical trials regardless of financial compensation. The differences were found between patients who were unwilling to participate without compensation and those who were willing to participate regardless of compensation in mean ages (43.9 years vs. 52.0 years, p<0.05), marital status (married, 47.6% vs 79.4%, p<0.01), religions (yes, 45.2% vs 67.6%, p<0.05) and monthly income (${\geq}3$ million won, 19.0% vs 45.6%, p<0.01). The potential reasons for participation in the trials between two groups were doctor's suggestion (52.4% vs. 77.9%, p<0.01), the expectation of health improvement (54.8% vs. 73.5%, p<0.05), the types and numbers of procedure (33.3% vs. 16.2%, p<0.05) and the duration of clinical trials (59.5% vs. 27.9%, p=0.001). In regression analysis, the monthly income of ${\geq}3$ million won (odd ratio, OR=3.221, p=0.026,) and the duration of trials (OR=0.290, p=0.017) were related to the group with the willingness to participate regardless of compensation. Conclusion: This stady showed that more than half of study subjects would participate in the clinical trials of chronic diseases regardless of financial compensation.

An Exploratory Study of Privacy Issues and Concerns in the Digital Convergence Environment (디지털 컨버전스 환경에서의 프라이버시 이슈와 프라이버시 침해 우려)

  • Collection and use of personal information have enabled firms to improve their value propositions by offering personalization. On the other hand, they have caused widespread concerns by consumers that their privacy is invaded. Because previously distributed personal information can be integrated and utilized to offer more personalized services, those concerns may be intensified with the progress of the digital convergence environment. In this study, factors for privacy invasion and their impact on the privacy concerns are suggested. Then, an empirical study is conducted to examine some of the suggestions. From the analysis, several results are derived. First, as more personal data are collected, secrecy and autonomy concerns increase exponentially rather than steadily. Second, as targeting accuracy is improved, greater secrecy and autonomy concerns are expressed by consumers, but less seclusion concerns. Finally, monetary reward such as coupons can reduce seclusion concerns when targeting accuracy is high. Based on the results, implications for managing consumer privacy concerns are provided under digital convergence environment.

The Effects of Work Environment of Staff in Group Home for the People with Disabilities on their Job Satisfaction (장애인 공동생활가정 종사자의 업무환경이 직무만족에 미치는 영향)

  • This study analyzed how work environment of staff in group homes on their job satisfaction targeting 148 persons. As a result, this study found that the staff recognize challenge and role ambiguity at the level which is above level ranging from 3.08 to 3.61 points with respect to 6 subdomains of work environment, but showed a relative vulnerability regarding comfortability, monetary reward, role conflict and workload as below average ranging from 1.80 to 2.73 points. Results of multiple regression analysis show that challenge and role ambiguity exert a significant influence on their job satisfaction. The above results suggest that it is necessary to provide staff with an opportunity for self-development and challenge by specifying service standards for social rehabilitation teachers in work environment and strengthening group home support system in various ways, enhancing support or advocacy necessary for solving problems.

Amounts of Responding Times and Unreliable Responses at Online Surveys (온라인 조사의 응답오차에 대한 연구 : 설문 응답 시간과 응답 성실성의 관계)

  • While online surveys are considered to be the viable alternative to face-to-face and telephone surveys, many clients express a strong concern about the possibility of unreliable responses. Given this concern, survey experts hypothesize that amounts of time on responding can represent the extent to which respondents fill out the questions with sincerity. This study examines this hypothesis using data from an online survey sample of 1.052. Results strongly suggest that while "long time" informants are reliable, "short time" informants are not. Those in the short time group spend only 2.4 seconds per question and show very different patterns of responses to 49 Likert -typed questions. Logistic regression results imply that these unreliable respondents are interested in monetary gifts and maybe as a result, participate in surveys much more frequently. In conclusion, we provide some implications of these results to the quality of online surveys.

Effects of Smartphone Applications on Physical Activity in College Students: A Randomized Controlled Trial (스마트폰 걷기 어플리케이션 효과성 검증: 무선통제연구)

  • This study tested the effectiveness of commercialized smartphone apps in improving walking activities among college students. 66 participants were randomized into each of four groups that was used different behavior change strategies: monetary rewards app, goal setting and feedback app, gaming app, and self-monitoring control group. 45 participants who completed the experimentation was included in data analysis. Repeated measures ANOVA resulted in statistically significant time by groups interactions in recorded step counts, self-reported completed plans and self-reported walking activities scores. The Goal-setting and feedback group and the gaming group resulted in increase in both step counts and completed plans. The results were discussed in the framework of behaviorism.

A Survey of Regulations on Smishing and Mobile Micropayment and a Research of Regulations and Laws for Reducing Monetary Damages in Mobile Micropayment (스미싱 제도와 소액결제 제도의 현황 조사 및 소액결제 피해를 줄이기 위한 법·제도 연구)

  • With the rapid increase in mobile device users, there are many cyber attacks using SMS messages to infect the mobile device. The monetary demage from those attacks are also increasing. Since those demage are generally related to mobile micropayement systems, we study the details of the incidents on smishing and mobile micropayment. We have identified several limitations of current regulations and laws of them. Thus, we propose new regulations and laws to reduce the financial demage from simishing and to strengthen the security and responsibility of the mobile network operator, payment gateway, and content providers who are participating in the structure of a mobile micropayment systems, such as a regulation for information security evaluation system, several laws for compensation of financial demage within mobile micropayement system.
