  • The construction supervisors of the public companies are usually responsible for process management, quality management, safety management, and many other various tasks that occur during construction project. Public companies such as Korea Highway Corporation have developed a framework and manual for management and supervision of construction projects. But, there has been the change of business environment such as increase of private investment project and the introduce of construction management system recently. It has been necessary for construction supervisor to streamline the current project management system in the owner's aspect in order to cope with the expected new challenges. Accordingly, this research has been investigated and analyzed the operation system between Korean supervisor and foreign supervisor in their public corporation. This research has suggested the advanced project management in their public corporation. Especially, this study has proposed the construction management manual for supervisors such as inspectors training, supervisors construction manual, and supervisors training road map.

  • Construction Management is the overall management of the project as construction manager and the owner are united together. Construction manager's role is to conduct the overall or partial construction administration in the 'design, bid, build' process, in the owner's interests with maintaining technical neutrality. Construction manager is becoming one of new professionals in the building process and the contract defines their roles and the range of services, so high level of ethnics are required. This study suggests the legal status of the construction manager and the ethnic standards and the ethnic's characteristics. In conclusion, firstly, the legal characteristics of the administration of construction management are the delegations contract, the responsibility of negligence and the duty of due diligence, abided by the contract that ties between the owner and the construction manger. Secondly, the administerial characteristics of the construction management are the role of mediator, the service of professional technology, accountability to the owner and publicness. Thirdly, due to these characteristics, as a professional, the standard of ethnic assessment for the construction project manager are intention, act and result, so with the relation to that, morality, deontology and consequentialism have been suggested in this study.

공공공사 입낙찰제도의 현황과 효율적 운영 방안 -최저가낙찰제를 중심 으로-

  • 입낙찰제도의 효율적 운영은 건설산업의 발전과 산업구조 선진화를 위한 정부 정책의지 실현에 있어 핵심적인 요소가 된다. 본고에서는 현행 입낙찰제도 중 가장 큰 논란이 되고 있는 최저가낙찰제도를 대상으로 그 시행성과와 실태를 짚어보고, 그 개선방향과 효율적 운영방안을 제시하였다. 실태분석 결과, 현행 최저가낙찰제도의 핵심적인 문제는 지나친 저가낙찰로 인한 건설업체의 수익성 악화와 부실공사의 우려이며, 이는 건설업계의 차원을 넘어 국가와 공공의 이익에 있어서도 위험요소로 적용할 가능성이 크다. 그러나 건설산업의 선진화 관점에서 볼 때, 최저가낙찰제라는 제도 자체는 많은 긍정적인 가능성을 가지고 있는 제도이다. 따라서, 최저가낙찰제가 정착되기 위해서는 단기적으로는 실효성 있는 저가낙찰 방지대책의 조속한 수렵이 필요하며, 장기적으로는 최저가낙찰제가 제 기능을 발휘할 수 있도록 보증제도 개선, 발주자의 역량 강화 등 건설산업 전반에 걸친 제반 여건들을 정비해 나가야 할 것이다.

Guidelines for Provisional Sum in Public Construction Projects (국내공공공사의 잠정금액(Provisional Sum) 집행기준)

  • Recently, the term 'Provisional Sum(PS)' has been used in domestic public construction projects especially for civil works. Nevertheless, the guideline for PS has not been clearly stipulated in contract documents or construction-related laws. Due to these ambiguous contract situations, disputes between owners and contractors are surely expected to settle down PS in construction projects. This paper focused on suggesting a guideline to settle down PS in these ambiguous contract situations. The guideline suggested in the paper is expected to be used as a reasonable method to settle down PS avoiding nonproductive disputes about PS in construction projects

이슈 & 이슈 - 시설공사 물품구매 발주 관행 개선

  • 국민권익위원회는 지난 11월 1일 공공기관이 물품구매와 관련한 계약을 할 때 생길 수 있는 불합리한 관행을 개선하기 위해 '물품구매 계약의 합리성 제고 방안'을 마련하여 관계 부처인 기획재정부 및 행정안전부에 제도개선을 권고했다. 권익위는 '국가를 당사자로 하는 계약에 관한 법률 시행령'에 시설공사와 물품구매 등에 대한 정의 규정을 신설하는 등의 발주방식 판단기준을 마련할 것을 권고했다. 또한 시설공사를 물품제조나 구매로 발주하지 못하도록 입찰공고 시에 발주방식 준수의무를 '정부 입찰계약 집행기준'과 '지방자치단체 입찰 및 계약집행 기준'에 포함하는 방안도 제시했다. 아울러 공사나 물품, 용역 등 계약 목적이 겹치거나 혼합될 경우에는 주된 목적으로 발주방식을 결정하도록 하는 내용을 계약법에 신설하는 방안도 권고안에 포함했다. 국민권익위 관계자는 "이번 개선안이 수용되면 물품구매계약 과정에서 발생하는 불합리한 관행 및 제도가 개선되어 물품구매 계약의 합리성이 제고될 것"이라고 밝혔다.

  • On December, 1996, Construction Management(CM) was introduced in Korean construction industry due to its managerial efficiency proven in the international construction industries. However, It have had serious problems with many regulations, standards, manuals and details of practices considering its constituents and industry conditions. Especially, there were controversial points in the CM fee estimate; difference between the fee on the owner's view point and that from contractor's that impedes appropriate CM services. Therefore, this paper is to analyze public construction projects into Cm fee calculation such as fee as a percent of construction cost, cost plus fixed fee and contract price, and analyzed what is irrationality and why irrationality is made. So it makes a contribution to a study on standards for paper CM fee calculation.

법령과고시 - 정부시설공사 계약예규 개정

  • 기획재정부와 행정안전부는 계약 예규를 개정하고 지난 4월 2일부터 시행에 들어갔다. 기획재정부는 이번 계약예규 개정을 통해 등록기간 3년 미만 업체가 공동수급제에 참여할 경우 만점기준을 완화했고, 1억 이상 3억 미만 전문공사의 경우 만점기준이 발주금액에 대한 '3년 실적의 1/2배 이상'에서 '평가면제'로, 3억 이상 50억 미만 전문공사의 경우 '3년 실적의 2배 이상'에서 '1/2배 이상'으로 평가방법을 완화했다. 또한 발주기관에서 공공공사 예정가격을 산정할 경우 반드시 최신 표준품셈을 사용하도록 의무화했으며, 적정 노무비 보장 심사 강화 방안으로, 최저가낙찰제 공사에서 업체가 제출한 노무비가 발주기관에서 산정한 노무비의 80% 미만일 경우 탈락된다. 기획재정부는 이번 개정으로 시공경험이 부족하지만 기술력 등이 우수한 신설 중소 업체가 공공공사에 참여할 수 있는 기회가 늘어날 것으로 기대하고 있으며, 최저가낙찰 시 과다한 노무비 삭감 등으로 인한 건설 근로자 소득감소 및 내국인 건설업 기피 등을 막을 수 있을 것으로 기대하고 있다. 한편 행정안전부는 이번 계약예규 개정을 통해 지방자치단체 입찰 및 계약관련 예규를 현행 11개에서 2개로 통합했고, 지자체가 발주하는 50억원 이상~100억원 미만의 공사의 경우 참가자격 적격심사 항목 중 자산회전율 평가를 삭제했으며, 신용평가 등급을 완화해 지방 중소기업들의 입찰 참가 기회를 확대하기로 했다.

  • In the wake of increased concerns on reduction of greenhouse emission which started with United Nation's Framework Convention on Climate Change (UNFCCC) and Kyoto protocol, Korean government is making various efforts under the represented slogan "Low Carbon, Green Growth". Therefore, it is inevitable that construction industry also follow the Korea government's slogan and the international trend in environmental problems. This study identified several main construction materials and equipments of civil construction projects and suggested a environmental cost estimation method and related estimation standards (Public and private owners are distinguished). A case analysis of a real road construction project is also performed and characteristics according to the owner type is compared. This study analyzed the environmental impact to total construction cost variations. In the result, public owner required 11~16% of extra budget and private owner required 19~22% of extra costs. This study is limited in consideration of environmental factors and carbon trading prices.

Conceptual Cost Estimating System Development for Public Apartment Projects (공공아파트 프로젝트 기획단계 공사비 산정시스템 개발)

  • At the conceptual phase of a construction project, estimated construction cost is very important as it significantly influences the owner's decision-making. Accurate cost estimating, in the early stage of a public construction project, serves as a critical factor because initial decision-making effects the final cost of a construction project. However in the cases of Korean public apartment projects, excluding a few of the public owners, there is a problem in properly estimating construction cost due to the lack of construction cost estimating system. Thus, this research developed a public apartment cost estimating system using case-based reasoning that was suggested by a previous research with 66 cases of Korean public apartment projects. Based on the system experiments involving 19 public officers and 10 cases of Korean public apartment projects, the effectiveness of the system in terms of estimation accuracy and user-friendly was confirmed. As a result, the developed system has an error range of 1.47% to 13.74% and mean of 6.15%. In addition, the system was evaluated that it could greatly improve the current estimation task of public officers. Consequently, the results of this research can be used as a foundation for a technological advance in estimating construction cost and improving the accuracy and consistency of construction cost estimation.

  • On March, 2013, the Government announced the Multiple Prime Contract method will be expanded in public building construction projects. The applying multiple prime contract method has been immersing issue among all stakeholders of construction project. The owner conducts the role of a general contactor as well as owner's original responsibility while construction works being executed by specialty contractors. If the owner has not experience of project management, it should be bring about increasing management cost due to the interface problems among prime contractors. With this reason, it is difficult to administrate the multiple prime contract. So far there has been no methodology of predicting management cost in the multiple prime contract. Therefore, this study aims to enable the operation of efficient multiple prime contracts by developing a model to predict their management costs.
