노무관리 - 건설 일용근로자의 포괄임금계약 관행 적정성 논란

  • 현행 건설일용근로자의 포괄임금 계약에 대한 대법원의 판결과 고용노동부의 지침이 변경되어 혼란이 야기되고 있다. 고용노동부는 지난 8월 8일 건설 일용근로자의 포괄임금제 업무처리 지침을 변경하고 일선 사업장에 시정 지시 공문을 발송하고 있다. 새로 변경된 건설 일용근로자의 포괄임금제 업무처리 지침은 일당제 일용근로자의 고용형태를 두 가지로 구분하여 일급에 포함되었다고 볼 수 있는 수당과 그렇지 않은 수당을 명시하고 있다. 일급에 포함되었다고 볼 수 없는 수당의 경우 해당 근로수당을 포함하여 체결된 근로계약이 부적정하다는 입장이며, 이에 따라 일당제 일용근로자를 사용하고 있는 사업장에 시정지시를 하고 있다는 것이다. 그러나 현행 판례 및 행정해석, 기존 고용노동부의 지침은 제수당을 미리 합산한 일정금액을 지급하기로 하는 포괄임금 계약을 인정하고 있다. 이처럼 판례와 고용노동부의 지침이 서로 다르고, 새로 변경된 고용노동부의 지침을 반영하는 새로운 판례가 아직까지 나오지 않았기 때문에 사업장에서는 사례별로 유연한 대응이 필요하다.

Development of a Systemized Flying Net for Safety Improvement in Architectural Building Construction (건설 공사의 안전성 향상을 위한 충돌방지형 시스템 플라잉넷의 개발)

  • Flying net should be installed on every 3 or 4 construction floor from 8m above ground according to the rule. In the apartment housing construction, flying net installation work has been recognized the most dangerous work among the whole works because a small mistake of labors might make their death accident. Sub-contractors specialized in flying net have been developing various flying net types. However, most works of installing flying net as working with the developed system are performed outside the apartment housing, so that the risk of fall in works of installing supports and unfolding net is still high. Furthermore, as using the previously developed flying net labors might bump into the frame or the wire rope for supporting so that it makes secondary accidents. The objective of this research is to produce the proto-type of anti-collision flying net system based on the result of problem analysis on the installation and detachment process and suggest the improved anti-collision flying net system, which is able to improve safety and field applicability by conducting field experiment and analyzing performance.

A Rating Method for the Estimation of the Additional Overhead Expenses incurred by Schedule Extension in Public Construction Projects (공공건설공사의 공기연장에 따른 추가간접비 산출을 위한 요율방식 제안)

  • In domestic public construction, disputes are increasing due to differences among stakeholders regarding contract price adjustment. In particular, the actual cost-plus fee for overhead costs due to the schedule extension cannot be agreed upon at the administrative phase, and most of them seek judicial judgment. Thus, this study aims to propose a 'sufficiently satisfactory' alternative to reach an agreement before disputes in order to minimize disputes related to the calculation of additional overhead costs. To this end, this study proposes three alternatives based on the rate method. Firstly, when calculating additional overhead costs, it is not calculated as an actual cost-plus-fee method, but as a rate compared to direct labor costs among net direct costs. Secondly, the calculated indirect labor costs are compensated for up to the legal maximum of legal limit costs such as general management costs, profits and so on. Thirdly, it reflects overhead costs increased or decreased due to change orders. Risks were analyzed by collecting expert opinions on the proposed methods and applying actual cases. Finally, as a result of investigating the level of consensus for each stakeholder, it was confirmed that all stakeholders could agree regardless of the size of the company. The result of this study is expected to as a useful tool among stakeholders in the construction fields that can be able to easily agreed upon.

  • About 93$\%$ of domestic teal estate construction firms registered as the end of 2001 recorded net profits of only less than 500 million won(including firms in the red) for the term. As a result of having analyzed the ratios of sales costs and the structural ratios of sales costs for the past 10 years, it was found that there have been great changes in structural ratios of sales costs. Material costs and labor costs have gradually decreased, but outsourcing costs of processing have greatly increased. In order to find activity points which are fundamental to cost control, the methods of new activity based cost management have been pursued. The characteristics of real estate construction industry lie in the fact that contract prices (sales in) are fixed and amounts of profits differ depending on the use of costs. In order to create maximum profits from fixed contract prices, the new activity based cost management has been proposed. The control of operation budgets and management costs is designed to control their schedules and expenses in different respects. Operation budgets ate executed with specific activities and management costs are controlled as a form of material costs, labor costs, out sourcing costs and expenses which are details of expenditure. In order to execute them by using the methods of new activity based cost management, first of all, we have to analyze what activity drivers ale and how much added values such activities can create. It is considered as a method of cost management which is necessary far the survival management of real estate construction industry.

  • Crack sealing is a maintenance procedure that is commonly used to reduce pavement degradation. If cracks in pavements are not sealed, surface water penetration can reduce the strength of the sub-base layers, which can result in increased deflections of the pavement. Reduced strength of the sub-base also accelerates the deterioration of the surface, due to development of greater cracking and potholes. Crack sealing is performed to reduce water and debris penetration, thereby helping to maintain pavement structural capacity and limiting future degradation. The process of sealing cracks in pavements is however dangerous, costly, and labor-intensive operation. Labor turnover and training are increasing problems related to crack sealing crews, and as traffic volumes increase. Automating crack sealing can reduce labor and road user costs, improve work quality, and decrease worker exposure to roadway hazards. The main objective of this research is to develop an automated system for sealing cracks in pavement. Extension of the algorithms and tools presented in this research is also recommended for future study.

  • As buildings become larger, higher and more complex in most construction sites, construction projects have to deal with transportation of more materials, labor and equipment, necessitating more use of construction equipment. Notably, in the high-rise building and plant construction projects mobile cranes are adopted more frequently among different types of construction machinery, which also results in serious industrial accidents relating to the use of crane. To reduce serious industrial accidents involving cranes, researches on its stability is in need. The research herein aims to study how to select sling and lug of mobile crane and review its stability. The research outcomes herein will make considerable contributions to selecting mobile cranes efficiently and ensuring their stability.

Time Series Analysis and Development of Forecasting Model in Apartment House Cost Using X-12 ARIMA (X-12 ARIMA를 이용한 아파트 원가의 변동분석 및 예측모델 개발)

  • The construction cost index and the forecasting model of apartment house can be efficient for evaluating the validness of the fluctuating price, and for making guidelines for construction firms when calculating their profit. In this study the previous construction cost index of apartment house was improved, and the forecasting model based on X-12 ARIMA was developed. According to the result, during the last five years the construction cost, excluding labor expense, has risen approximately to 22.7%. And during next three years, additional 16.8% rise of construction cost is expected. Those quantitative results can be utilized for evaluating the apartment house's selling price in an indirection, and be helpful to understand the variation pattern of the price.
