This study reviews international discussions about the trade-labor linkage and examines the labor chapters of FTAs enforced by the US and the EU from a comparative perspective. Since early 1990s, starting from the NAFTA, the US has included forceable labor provisions in its FTAs and this trend continues to the TPP which was concluded in October 2015. On the other hand, the EU's labor provisions in its FTAs have been composed of promotional elements on labor rights based on cooperations and dialogues. These different features of labor provisions in the US and European FTAs are mainly due to the motives of the FTAs of the US and the EU respectively as well as their domestic situations with regards to domestic law and institutional set-ups. The coordination of labor provisions involves a long-term institutional as well as regulatory convergence which triggers not only economic but also social changes, compared to a relatively short-term effect of tariff elimination. For Korea which has been a FTA partner country both with the US and the EU, it is significant to keep the different characteristics in the labor provisions in mind, particularly in the process of its implementation. Concerning the implementation of Korea-US FTA, it might be problematic if Korean law and its regulatory practice on labor-management relations do not comply with that of the US. The Korea-EU FTA case can also have an indirect impact on Korea's labor laws since it stipulates in its provisions that both parties should have discussions not only within each government but also with the civil communities including NGOs. Thus, Korea should pay more attention to the true meaning in labor provisions of both FTAs in order to promote its firms to be equipped with the right labor-management system in their operations abroad.

ACI 318 (1999) defines three types of moment frames: Ordinary Moment Resisting Concrete Frame (OMRCF), Intermediate Moment Resisting Concrete Frame (IMRCF), and Special Moment Resisting Concrete Frame (SMRCF). OMRCF is the most popular type of moment frame in mild seismic zones that requires the least detail and design requirements. This study focuses on the seismic performance of Ordinary Moment Resisting Concrete Frames (OMRCF) designed only for gravity loads. For this purpose a 3-story OMRCF was designed in compliance with the minimum design requirements in ACI 318 (1999). An one third 3 story specimen was made and tested. For scaled model, the similitude law of true replica was applied. The specimen was loaded with quasi-static reversed cyclic lateral loading. The overall behavior of OMRCF is quite stable without abrupt strength degradation. It is found that tested frame has the base shear strength larger than the design base shear for seismic zone 1, 2A and 2B calculated using UBC 1997.

Stress-strain curves based on Ramberg-Osgood and Hollomon relations are strongly dependent upon the regressed range of strain. This work investigates mathematical expressions of true stress-strain curves of metallic materials. We first observe the variation of yield strength, strain hardening exponent and stress-strain curve with regressed range of stain. Based on sectional regression and expression using one or two parameters, we propose an optimal strain range for which yield strength and nonlinear material behavior are quite appropriate.

Dunong(鈍翁), Yun-Ji had born by a concubine, and his dream didn't come true for the restraint of his social position, so he tried to train younger men. His writings still remain 4 volumes of "Dunongyeonsocheonjimundap" and "Dunongdongmongmundap(鈍翁童蒙問答)", which may be called its primer. "Dunongyeonsocheonjimundap" is written in question-and-answer form between Chal-Hye-Ja(察慧子) who has a meager knowledge and Sim-Gyeong-Ong(心耕翁) who search for the truth. It is progressed from the law of nature to human's cultivation of the mind so as to reconfirm the recognition of the unity between the heaven and human beings and lead the interpretation and practice of the metaphysical proposition. It is characterized by making use of metrical compositions to induce plain tone of argument. "Dunongdongmongmundap", whereas, uses archaic writings to describe natural science including astronomy to the beginners. Dunong's scholarship is characterized by these: He explained the metaphysical propositions by approaching usual things including oriental medicine practically; He comprised the Confucian concepts intensively to examine the Oriental studies closely; He groped for the outlooks on the world of taking serious view of human being or human body. And his medical thought is characterized by these: He attached importance to the theory of viscera and bowels based on yin-yang and five phase theory; He suggested the concrete yin-yang theory with a viewpoint of qi-blood theory; He considered the concept of 'six' only as mutual rooting of yin and yang and five visceras and six vowels, and denied the traditional six qi concepts; He explained the ghost theories of the metaphysics based on the yin-yang theory to analogize points of sameness between the oriental medicine and the metaphysics; He emphasized restore yang theory. Therefore, we can say that he regarded the human body as small heaven-earth and grafted the abstract propositions into the actuals so as to put the metaphysical propositions in practice.

The current criminal procedure law stipulates that dismissal cause this has to be true when the dismissal judgement. Fisheries Agreements among Korea, China, and Japan, for the effective management of fisheries resources and protection of fisheries disputes, have been processed in a manner to conclude interim arrangements those are effective prior to the final demarcation of the maritime delimitation which often requires much time to settle among the relevant states, Based on this understanding, Korea, China, and Japan, had proceeded their mutual fisheries agreement ; and, two fisheries agreements, between Korea-Japan and China-Japan, have already entered into force on 22 January 1999 and on 1 June 2000, respectively. Lastly fisheries negotiation between Korea and China has been concluded in order to make it effective on 30 June 2001. As Korean fisheries have already experienced the impacts after the entry into force of Korea-Japan Fisheries Agreement, it is inevitable that the likewise will also be true for the Korea-china Fisheries Agreement. The results of fisheries negotiation should minimize the loss by ensuring Korean flagged vessels' fishing rights to the maximum level in the counterpart's waters, and to maximize our counterpart's loss by restricting its vessels' fishing rights to the minimum level in our waters. However, such goals are almost unreachable in an intergovernmental negotiation. On this ground, regardless of the results, the negotiation is highly criticized from all the interested realms of the society. First, this study reviews the negotiation process ana subject matters of the fisheries agreement, and then evaluates the disputed items issued by academic, political, and industry areas in an international law and fisheries perspective. After the entry into farce of fisheries agreement, various activities should be accommodated as future tasks, such as the adjustments of the domestic fisheries structure, the reorganization of the resource management based fisheries structure, the construction of EEz large surveillance system, and the construction of the multilateral fisheries cooperation system Through an earlier implementation of those tasks, the Korean fisheries will be better prepared in minimizing the predicted impacts once the Korea-China Fisheries Agreement becomes effective.

Global commerce is apparently here to bind Korean firms as well as Koreans. The advertising, buying and selling of goods and services recognizes no borders. As a result, enforcing territorially based trademark rights has become ever more challenging. Remote trademark owners who peacefully coexisted in a time before the internet and increasing globalism are now bumping heads. The internet also has made it easier for unscrupulous operators to deceive consumers and divert customers from established businesses by misappropriating trademarks on web-sites and in domain names. U.S. federal courts have been willing to help American businesses halt trademark infringements that reaches outside the United States. This is particularly true for e-business, via the internet, and the trend toward enforcement seems to be in favor of the trademark owner. This article discusses this trend as well as the extraterritorial enforcement of trademark rights by U.S. courts under the Lanham Act. It also offers suggestions for protecting valuable trademark rights worldwide. This paper will contribute to global Korean firms and Koreans who carefully read arguments in this valuable literature.

GRB100205A is a Gamma Ray Burst (GRB) which is suspected to be at redshift z=11-13 due to its very red H-K color($(H-K)_{vega}=2.1{\pm}0.5$). We observed a field centered at GRB100205A with Wide Field Camera (WFCAM) at United Kingdom Infrared Telescope (UKIRT) in Hawaii, in order to search a quasar that could be located around the GRB. The images were obtained in J, H, and K filters covering a square area of $0.78deg^2$. Our J-, H-, and K-band data reach the depths of 22.5, 22.1, and 21.0 mag (Vega) at $5{\sigma}$, respectively. Also using z-band image observed by CFHT, we find 8 candidates that have colors consistent with a quasar at z=11-13(non-detection in z-, J-band and $(H-K)_{vega}$ > 1.6). However, the shallow depths of J-, H-band are not enough to verify their true nature. Instead, we identify many red objects to be old or dusty galaxies at $z{\geq}3$. The number density of such objects appears about twice or more than that of the field of Cosmological Evolution Survey (COSMOS) and Ultra Deep Survey (UDS) of UKIRT Infrared deep sky survey (UKIDSS). On scales between 0.18' and 15' the correlation function is well described by a power law with an exponent of ${\approx}-0.9$ and this implies that those objects are like galaxies. It is interesting that many red galaxies exist in the region where the GRB was detected.

The ultimate goal of this research is to establish the movement rights of people with physical disabilities. To achieve this goal, the authors have investigated the regulation and restrictions of physical facilities to guarantee the movement rights and investigated how well these facilities were constructed. The authors then have analyzed and compared the results. The purposes of this research are as follows. First, the authors investigated and analyzed the present conditions of selected public facilities to propose improvement measures for the disabled, pregnant and seniors so that they could actively participate in cultural activities as normal people do. Second, the designs resulting from this research are provided so as to be helpful to disabled people in everyday life, which is different from previously conducted research. Third, the authors have selected facilities with outdoor areas to differentiate the results from those reported recently through research conducted on indoor buildings. The final step of this research is to provide basic design data on outdoor areas to establish true movement rights for the disabled. According to these research findings, the shortest moving distance cannot be guaranteed only by establishing facilities that follow the Article 3 law about guarantee of convenience improvement for the disabled. If the movement path is not regulated, the facility standards may not exist in one part and the part itself may become obscured and the distance could become longer than necessary. Accordingly, for real movement rights the movement path should be guaranteed not to be violated by other obstacles. The results of this study offer convenience when moving within the outdoor space of cultural facilities by providing direct information for the disabled. The value of this study is that it is the first study on movement rights and movement paths for people with physical disabilities.

The most important thing of the License Test System in Japan is the method of test rule and test section. Then the training systems of the security agent have been very impressive rule and the system for security agent. Today, the market of the security industry in Korea have been going to develop and extend to the future industry. The assignments that are leaved to security industry in Korea must be that the improvement of the License & Training System of Security Agent in Korea should be made effort by the security industry and the public section that looks like the police.
