신용장통일규칙(UCP600)상 양도에 관한 연구 - 보증신용장통일규칙(ISP98)과의 비교를 중심으로 - (A Study on the Transfer of Letter of Credit in the UCP600 - Focusing on Comparing with Transfer of drawing rights in the ISP98 -)

  • This study primarily concerns the transfer of letter of credit. A transferable credit is a credit that clearly specifies it is 'transferable' and may be made available in whole or in part to second beneficiary by the request of the first beneficiary. the transfer of the credit is available where the seller as a middleman in intermediate trades purchases from domestic and international supplier. The purpose of this study is to examine the transfer of letter of credit in the UCP600. Having recognized the differences, the study analyzes the transfer of letter of credit under the UCP600 in comparison to those under the ISP98. The ISP98, like the UCP600, stipulates for the requirement of transfer, the number of transfer, conditions of transfer, the replacement of the name of first beneficiary.

BPO의 제도적 고찰과 그 주요 시사점에 관한 연구 (A Study on the Institutional Review and Main Implications under a Bank Payment Obligation)

  • 본 연구는 현재 시행되고 있는 BPO에 대해 제도적 차원에서 주요 쟁점으로 중심으로 신용장 제도와 비교하여 고찰하였다. BPO는 은행간의 약정이기 때문에 지급의무의 이행, 확인, 양도 등에 있어서 신용장제도와 차이를 보이며, 또한 유의해야 할 점이다. BPO은 기본적으로 기능 면에서 신용장과 유사하지만, 별개의 독립적인 제도로 운용되며 정보기술과 데이터를 기반으로 한다. 신용장을 포함한 전통적인 제도 보다는 더 효율적이며 비용 효과적이다. 따라서 전통적인 제도에 대한 전자적 대안으로 보여진다. 본 연구는 선행 연구를 중심으로 이미 발표된 BPO 관련 연구와 자료 등을 통하여 문헌 연구하였다.

수출보험사기 방지를 위한 우리나라 수출신용보증제도 개선방안: O/A 매입방식을 중심으로 (A Study on the Methods for the Prevention of Fraud in Korean Export Insurance in the Context of Export Credit Guarantee Schemes under O/A Negotiation)

  • This study explores how to prevent the fraudulent export financing and its subsequent export insurance fraud in relation to O/A negotiation. Under the traditional letter of credit(L/C) transactions, the banks, as a negotiation bank, can extend trade financing to the exporters through negotiation of draft and/or shipping documents. Under the O/A transaction scheme, however, bank cannot ascertain existence of trade performance and it is much riskier to extend an advance financing to the exporters before the buyer sends confirmation of debt. In O/A negotiation. some exporters tried to fraud banks by falsifying the shipping documents and the size and gravity of this fraudulent export financing were huge. Therefore, this study examines the banking process in O/A-based trade financing, documents examination process, the negotiation of instruments, treatment of trade financing in export credit guarantee, most importantly, explores what could be the criteria for appropriate treatment of account receivable to insure the safe transfer of account receivable. To maximize the benefit for optimum trade financing, the Bank of Korea established several Trade Finance Rules (refers to "BOK Rules") requiring that commercial banks should maintain optimal credit limits(so called, 'the principle of optimal loan') to extend the trade finance. The K-sure post-shipment credit guarantee programs and short-term export insurance program(EFF)can also facilitate 'the principle of optimal loan' principle.

추심결제(D/P, D/A)방식에서의 위험관리에 관한 연구 (A Study for risk management on Documentary Collection(D/P, D/A) Payment)

  • According to globalization and localization of world economics international trade payment method was also changed. A traditional payment was Letter of Credit basis, however it is being increased to various methods such as remittance, documentary collection(D/P, D/A) and open account. In order to acquire a secure export payment, exporters prefer to L/C basis which is guaranteed by a reliable bank. However, the L/C should bear a security so that importers would rather documentary collection than L/C. The reasons for the preference of collection payment rather than L/C are a low commission cost, the conversion of buyer's market from seller's market due to severe competition in the world market, transaction increase between main office and branches and a right to control the goods until executing the payment by exporters. Besides of them, collection payment can handle safer and faster than open account basis. However, the collection payment has a risk which it isn't guaranteed by bank for the payment so that I would suggest countermeasures to minimize the payment risk utilizing the collection basis as follows; using export credit insurance system, a large domestic credit report provider such as D&B for absolutely fresh and new information, a collection proxy service for overseas deferred credit and suggestion specifying to order B/L not straight one on consignee in order to transfer the right of ownership with endorsement without problem.

  • 본 연구는 현재·시행되고 있는 BPO의 디지털 프로세스와 그 지급에 있어서 제도적 관점에서 기존 제도와 비교·분석하였다. BPO는 기능 면에 있어서 신용장과 유사하지만, 전자적 환경을 기반으로 한 은행 간의 지급약정이기 때문에 그 운용에 있어서는 전통적인 제도와는 많은 차이가 있다. 즉 BPO 거래에서의 책임과 의무, 지급 매카니즘, 거래당사자의 역할, 신용장의 확인과 양도 등에 있어서 많은 차이를 보이고 있다. 그러나 BPO는 정보기술을 기반으로 운용되기 때문에 더 효율적이며 비용 효과적이다. 본 연구는 BPO의 선행 연구를 기반으로 이미 발표된 BPO 관련 연구와 자료 등을 중심으로 문헌 연구하였다.

  • 전자상거래의 도입으로 인하여 전신송금환(T/T)${\cdot}$우편송금환(M/T)${\cdot}$송금수표(D/D)와 같은 단순송금방식(Remittance), 현금결제방식(COD)과 서류결제방식(CAD), 지급인도조건(D/P)${\cdot}$인수인도조건(D/A)과 같은 추심 결제방식, 신용장(Letter of Credit)방식 등 기존의 무역결제수단이 신용카드(Credit Card), 전자화폐(Electronic Cash), 전자자금이체(EFT; Electronic Fund Transfer), 무역카드(TradeCard), SWIFT의 전자신용장(Electronic L/C), 볼레로 시스템 등의 전자결제시스템으로 전환되었다. 이에 본고는 대표적 전자무역결제시스템인 볼레로와 무역카드를 비교${\cdot}$분석함으로써 이들 시스템의 활용가능성을 모색하고자 하는 것이다.

해상화물운송장을 활용한 전자무역문서의 글로벌 유통 전략에 관한 연구 (A Study on the Global Transmission Strategies of e-Trade Documents using Non-Negotiable Sea Waybill)

  • The purpose of this study is to propose a new mechanism for the global transmission of electronic trade documents and to promote them using it. Trade settlement methods are changed from L/C bases to non-L/C bases and in particular, the telegraphic transfer is dramatically increased since mid 1990. But the status of transmission of electronic trade documents still rely on the letter of credit and bill of lading. So it need to change the process of transmission of electronic trade documents utilizing non-negotiable sea waybill instead of bill of lading. In this study, I pointed out two problems as obstacle factors in global transmission of electronic trade documents. First is the system connection problem between domestic and foreign banks and second is the electronic right transfer problem in the bill of lading. Electronic bill of lading has already been made, but are not used and e-Nego has also not been activated under the above issues. Therefore, it should be solved previously the above problems for the global transmission of electronic trade documents under the letters of credit. However, in transactions of transfer, it does not need the inter-bank connection and also does not occur the electronic right transfer problem of bill of lading if using the non-negotiable seaway bill instead of bill of lading. In this paper, I recommend the global transmission strategies of e-trade documents using the non-negotiable sea waybill in transactions of transfer. Hopefully, I expect the activation of global transmission of e-trade documents through the utilization of electronic non-negotiable sea waybill as suggested by this study.

무역거래에서 송금(T/T)방식의 결제 위험성에 영향을 미치는 요인분석 (Empirical Study on Determinants of T/T Payment Risk in International Trade)

  • L/C(Letter of Credit) is a common payment term designed to prevent credit risk in international trade. However, most companies prefer T/T (Telegraphic Transfer) payment due to its time and cost efficiency. According to related statistics, more than 70% of international trade contracts are based on T/T rather than other payment terms. The time required from the export negotiation to the completion of the export transaction and collection in international trade is very long. In this process, disputes related to settlement are continuous, so caution should be exercised. Therefore, whether or not the export payment is recovered in a timely manner is the core issue of trade transactions for exporters. The purpose of this study is to identify problems that cause delayed payments during settlement by the remittance (T/T) method, which can lead to settlement risk, in order to investigate those factors which can lead to delays in payments and increased risk as well as to determine ways to prevent such factors in advance. According to empirical findings, trading experience, transaction duration, and contract contents can be important determinants in terms of payment delays. Industry uniqueness and market uncertainty were found to be in opposition to the hypothesized relationships. The results of this study will be useful for trading companies to reduce their payment risk.

혼합결제방식에서 수입화물선취보증서 발행은행의 보증책임 범위 (The Range of Guarantee Responsibility by an Issuing Bank of Letter of Guarantee under Mixed Settlement Method)

  • 본 연구는 선하증권이 발행된 국제무역거래에서 화물이 서류보다 일찍 도착하여 원본 선하증권 없이 화물을 인도 받기 위해 국제적으로 통용되고 있는 상관행인 수입화물선취보증서를 기존 연구와 다른 관점에서 고찰하고자 한다. 혼합결제방식 하에서 발행된 수입화물선취보증서의 보증책임 범위를 판례를 통해 분석하고 국제적인 상관행으로 자리잡고 있는 수입화물선취보증서의 원활한 활용을 위한 다음 두 개의 대안을 제언한다. 첫째, 혼합결제방식을 이용한 경우, 수출업자는 상업송장을 발행함에 있어 결제방식의 결제대금을 각각 분리해서 발급해야 수입화물선취보증서의 보증책임 한도에 대한 명확한 의사표시가 이루어질 수 있을 것이다. 둘째, 수입화물선취보증서의 발행은행은 보증서 발행의 보증책임 범위를 명확히 하기 위해 기존 양식에 책임한도를 제한한다는 취지의 문구를 추가한 새로운 수입화물선취보증서 양식의 구축이 필요하다.
