  • Software license agreements, to be useful in the mass market, could not be individually negotiated, and had to be standardized and concise. The software license agreement needs to be presented to the licensee-users in a fashion that would allow for mass distribution of software, also for it to enforceable, that would draw the users' attention to the terms and conditions under which the publisher allowed the use of the software. These needs have been accomplished, with or without fail, through so called the "shrink-wrap licenses" Shrink-wrap licenses purpose to transfer computer softwares to their users by defining the terms and conditions of use of the software without implicating the "first sale doctrine" of the Copyright Act. These shrink-wrap licenses have become essential to the software industry. However, in USA, the law applicable to these licenses has been unclear and unsettled. Courts have struggled to develop a coherent framework governing their enforceability. Meanwhile, the National Conference of Commissioners on Uniform State Laws ("NCCUSL") in USA promulgated the Uniform Computer Information Transaction Act ("UCITA") governing contracts for computer information transaction on July 29, 1999. One clear objective of UCITA was to settle the law governing the enforceability of shrink-wrap licenses. In these respects, this paper first introduces the various forms that shrink-wrap licenses take(at Part II. Section 1.), and explains the main advantages of them(at Part II. Section 2.) Here it shows how shrink-wrap licenses value themselves for both software publishers and users, including that shrink-wrap licenses are a valuable contracting tool because they provide vital information and rights to software users and because they permit the contracting flexibility that is essential for today's software products. Next, this paper describes the current legal framework applicable to shrink-wrap licenses in USA(at Part III). Here it shows that in USA the development of case law governing shrink-wrap licenses occurred in two distinct stages. At first stage, judicial hostility toward shrink-wrap licenses marked such that they were not enforced pursuant to Article 2 of the Uniform Commercial Code. At second stage, courts began to recognize the pervasiveness of shrink-wrap licenses, their indispensability to the rapidly expanding information technology industry, and the urgent need to enforce such licenses in order to maintain low prices for consumers of computer hardware or software, resulting in the recognition of shrink-wrap licenses. Finally, in view of the importance of UCITA, this paper examines how it will affect the enforceability of shrink-wrap licenses(at Part IV). The drafters of UCITA, as well as the scholars and practitioners who have criticized it, agree that it validates shrink-wrap licenses, provided certain procedural protections are afforded to purchasers. These procedural protections include the licensee end-user must (i) manifest his assent to the shrink-wrap license, (ii) have an opportunity to review the shrink-wrap license, (iii) have a right to return the product without costs.

  • Porous pavements are recommended as a Low-Impact Development (LID) method which is a strategy to develop a water cycle as close to a natural state as possible, and to solve the urban impervious surface problems. Porous pavements can yield a solution if it provides a more permeable surface with extra space to contain extra water from building roofs. But there are few applications in Korea because of a lack of recognition and experience. Highway engineers are mainly concerned about the infiltration of water into pavement structures. They worry about the weakening of the asphalt mixture and subgrade, and freezing during the winter season due to the infiltration of water. Meanwhile, hydrological experts doubt the effects of the amount of water to control during the flooding season, and environmental experts prefer a non-point pollution treatment system established beside highway. In this study, from reviewing the history and the body of literature about porous pavements, conclusions regarding the most advanced technologies were made. First, traditional thickness designs can be used for porous pavement, no extra distresses was found by weakening and freezing during the winter season. Second, hydrological design can be made by controlling the thickness of the pavement and the outlet of water. Third, the treatment efficiency of non-point pollution of porous pavements is not worse than any other method. Importantly, it's a more eco-friendly solution because of its lower requirement for de-icing agents.

  • The purpose of this study was to investigate factors of perception by inpatients of the Dental Hospital institutions about exposure to radioactivity at the time of radioactive examination, providing basic information for making educational materials aimed to change their perception. Most of those patients, 65.5.0% responded that CT was a type of radioactive examination bringing highest exposure to radiosensitivity. Most of the subjects, 56.1% said that a body part most vulnerable to exposure to radiosensitivity was the genital gland at the time of radiosensitivity examination. And most of the participants, or 26.3% responded that they obtained information about radiation from TVs or newspapers. Among the surveyed patients, men were higher in scores for factors of the perception of radiation such as recognition of radiation, harmfulness of radiation, psychological state at the time of radioactive examination, prevention of exposure to radioactivity and necessity of radiation that women were, with statistically significant differences between the two groups. These findings suggest that it is urgently needed to develop an education program which helps patients better perceive exposure to radioactivity and that radiologists should be very careful to reduce the does of that exposure. If patients better perceive radiation, they would be less anxious and less exposed to radioactivity when receiving the radioactive examination.

  • Using switches and sensors informing the current on or off state, this paper suggests a sleeping control and remote monitoring system that not only can recognize the sleeping situations but also can control for keeping an appropriate sleeping situation remotely, And we show an example that this system is applied to the healthcare sleeping mat, Our system comprises the following 3 parts: a part for detecting the sleeping situations, a part for extracting sensing data and sending/receiving the relating situated data, and a part controlling and monitoring the all of sleeping situations. In details, in order to develop our system, we used the touch and pressure-sensitive sensors with On/Off functions for a purpose of the first part, The second part consists of the self-developed embedded board with the socket based communication as well as extracting real-time sensing data. And the third part is implemented by service modules for providing controlling and monitoring functions previously described. Finally, these service modules are implemented by the TMO scheme, one of real-time object-oriented programming models and the communications among them is supported using the TMOSM of distributed real-time middleware.

  • This is an analytical study on Munheongak (文獻閣) and it's catalogue. The major objective of the study is to get a recognition of Munheongak under the culture of Sukjong (肅宗) period in Korean library history. Most of early studies made on such a category have been concentrated on Jiphyunjeon (集賢殿), Hongmungwan (弘文館), Kyujanggak(奎章閣) and their backgrounds. In this study, the author has invest gated Kungwolji (宮闕志), Munheongakseomg (文獻閣書目) and other materials related to this subject. The findings of the study can be summarized as follows: 1. Munheongak was established by king Sukjong in the 26th year of his reign. According to some records of Kungkwolji, the reason of establishment of the library was to arrange the collection in the Sango (相庫) consisted of various kinds of materials. In case of books, most of them turned out to be Korean books. 2. Munheongak was sited to the estern side of Kyunghyundang (景賢堂), which was located on the Kyungdeokgung (慶德宮). After Youngjo (英祖) the place was called Kyungheuigung (慶熙宮) so as to avoid the name of the precedent king. But these days, both the buildings are not to be found. 3. After its establishment, the library could not play the role as a library because of the then political situation and sectionalism. During the period of the revival of the learning from Youngjo till Jeongjo(正祖) the function of the library was in a stagnant state. Kyujanggak played the part in its place. 4. Referring to the collection management, the Munheongakseomog is equipped with 101 titles, 2,525 volumes, which are arranged by means of the traditional Chinese classification system. 5. The classification scheme is based on the traditional Chinese classification system which might divide all subjects into four categories such as: Confucian classics division, Historical documents division, Master's division, and Collection of literature division. Some illustrations reveal that the classification system was directly influenced by Seogoseomg (書庫書目) : the influence reflected in the classes for the translated literature and writings, poems, genealogy about kings, etc. But some subdivisions such as a class of Annals, Historical Epcerpts were omitted in the classification scheme, which did not strike the balance in the system in terms of the present theory of classification. Most of bibliographical descriptions were also influenced by Seogoseomog but some elements were partly omitted. 6. The special feature of the collection building is the absence of books in Collection of literature division except only three kinds of books in examining the Munheongakseomog. Since this is rather a comprehensive study for such aspects as historical backround, catalogue, and cultural environment of Munheongak and its related record, it is advised that further and additional research should be made.

  • It is a general recognition that more serious criminal acts in a certain area of society should be given more serious condemation than the same general crimnal act. In particular, considering the purpose of the medical treatment and the trust relationship between the doctor and the patient, the sexual violence by doctor in medical field can not be placed on the same line as that of the general public. But the special legislation to solve this through criminal legal sanctions is not desirable. The basic principle of criminal law ist ultima ratio, so the principle of supplementality. It means to try to solve by all possible means and finally to enter with punishment. A flat and hasty Reaction without the considering of the speciality of medical treatment will cause serious cracking in that area. In addition, it will not be able to expect desirable results in legal practice by breaking down the legal system. Rather, administrative regulation is more efficient than punishment sanctions. But the best way is autonomous control by members of the medical area. Penalties in criminal law must make an enterance at the last, and administrative regulation should be timely intervene in specific situations through diversification. In conclusion, state interventions should be farthest in order to proceed to autonomous control of medical area.

  • This study was performed to delineate the relationship between lifestyle and nutritional risk factors associated with hypertension in representative middle-aged Korean population. Hypertension in this study is defined as hypertensive ($SBP{\geq}140mmHg\;or\;DBP{\geq}90mmHg$) adults without recognition of a disease state before a health exam. With data from the 1998 and 2001 National Health and Nutritional Survey, nutrient intakes of 6,112 adults, 40-64 years of age were calculated using food composition database and matched with health examination records by individual ID. After excluding those with extreme intake values, the number of final subjects included in the analysis was 5,200 (male 2,458, female 2,742). Using logistic regression method, socio-demographic data, lifestyle factors, and nutrient intakes were analyzed. Risky factors for hypertension revealed in this study were age, sex, BMI over 23, waist circumference, alcohol intake of more than 16g (male) or 8g (female). Regarding nutrient intakes, the intakes of highest quartile for energy (${\geq}2363.0kcal$) and protein (${\geq}90.2g$) were significantly associated with higher risk of hypertension after adjusting for age, sex, and other socio-demographic factors (OR=1.312(1.046-1.711), OR=1.488(1.194-1.854), respectively)). Although high intakes of sodium (${\geq}6604.0mg$) and phosphorus seemed to be risk factors of hypertension also before energy adjustment (OR=1.278(1.034-1.581), OR=1.280(1.024-1.600), respectively), only high intakes of energy and protein remained significant after adjustment. This study revealed that modifying risky lifestyles and dietary patterns, especially high energy intake, high protein intake, and high alcohol drinking, in middle-aged Korean adults could result in a prevalence decrease and/or prevention of hypertension.

  • The purpose of this research is to investigate the attitudes of students, who are used to study at the Library of Duksung Women's University, concerning about the loss and mutilation of books, articles and other research materials m a university library, and to take measures for preventing the library materials from being lost and mutilated. This study made the surveys of student's recognition about the immoral behaviors like larcenous and mutilating acts, the causes of such destructive works and effective preventive measures to keep library materials in good condition, including student's opinion about library services. The investigations were conducted in two times with the same questionnaire on randomly selected 480 students and 540 students of 1989 and 1994 respectively. The sample size is estimated to reach each $10\%$ of the total number of students of 1989 and 1994 in Duksung Women's University. And then, the students were divided into two groups. The one is a group that has had experiences stealing and mutilating the materials from the Library of the University. The other is another group which has done none of them. Thereafter the responses of the two groups are analyzed to compare the differences of the students' behaviors between 1989 and 1994, and thereby finding out important factors inviting the loss and mutilation and accordingly improving effective checks to deter the students from stealing and mutilating the library materials. Some of the research findings suggested in this paper are pointed out as follows: 1) The students who has experienced neither stealing nor mutilating the library materials visited the library more frequently and are more serious about such destructive behavior as stealing and mutilating. 2) The attitudes of the students about services and equipments supplied by the library are slightly different among the students who experienced such immoral activities or not. For example, the experienced students had more preference about an application of self-help duplicating machine being able to use card. 3) To prevent the students from stealing and mutilating the library materials, the non-experienced students demanded an education for them to duly recognize the public interest of the library and also suggested to keep more duplicate materials ready in the library, meanwhile, the experienced students indicated strongly such proposals as strict regulations against stealing and mutilating behaviors, having a correct understanding of costing a lot of time and money to restore the damaged materials to their original state and keeping many duplicates ready in the library. 4) It appears to be that there were different between the experienced and non- experienced students concerning causes invited stealing and mutilated behaviors. 5) Over all, the number of the non-experienced students is more increased in 1994 than that of 1989.
