A Study on the Beginning Point of Secondary Compression in Consolidation Theory (압밀이론에서 2차 압축 적용 시점에 관한 연구)

  • To improve the problem that the settlement curve of the consolidation theory of Terzaghi does not match well with the actual settlement curve, we included a secondary compression settlement and analyzed it by varying the beginning point and then obtained the following results. The current methods of calculating the compression index from the  log𝜎 curve and the coefficient of consolidation from the time-dependent settlement curve for each consolidation pressure proved that the final settlement amount will be consistent after a long time, but the actual settlement amount will always be smaller than the predicted settlement amount during the settlement progress stage. The consolidation factors estimated by the curve fitting with the condition that the secondary compression begins in the second half of the primary compression showed similar values to the consolidation factors estimated by the curve fitting for the primary compression only, and the settlement curves were in better agreement throughout the compression. It showed different values, showing low validity. It can be inferred that secondary compression acts from the point when a significant portion of the excess pore water pressure is dissipated, and the loading stress begins to have more influence on the skeletal structure of the soil. Analysis results show that secondary compression begins at the range of 91 % to 98 % on the average degree of primary consolidation.

Analysis of the Legal Effect of Settlement Agreements Prepared in Medical Litigation Following Plastic Surgery in Korea

  • Background Settlements between doctors and patients provide a solution to complicated disputes. However, some disputes may be renewed as a result of negligence by both parties. The purpose of this study was to review the legal issues that may potentially arise during the preparation of settlement agreements and to propose a list of requirements for ensuring the effectiveness of these settlement agreements. Methods Data from 287 civil cases concerning aesthetic surgery that took place between 2000 and 2015 were collected from a court database in South Korea. Factors that influenced the effectiveness of settlement agreements were analyzed. Results Among the 287 court precedents, there were 68 cases of covenant not to sue. Eighteen cases were dismissed because the settlement agreements were recognized as effective, and 50 cases were sent forward for judgment on their merits because the agreements were not recognized as effective. The types of surgery and types of complications were classified by frequency. We evaluated the geographical distribution of the precedents, the settlement timing, and the effectiveness and economic impact of the settlements. We found that there was no statistically significant relationship among these factors. Four major factors that made a settlement agreement legally effective were identified, and the data showed that fee-free reoperations were not considered by the court in determining the compensation amount. Conclusions When preparing a settlement agreement, it is advisable to review the contents of the agreement rather than to take the preparation of a settlement agreement per se to be legally meaningful.

A Study on the Applicability of Hyperbolic Settlement Prediction Method to Consolidation Settlement in the Dredged and Reclaimed Ground (준설매립지반의 압밀침하에 대한 쌍곡선 침하예측기법의 적용성 연구)

  • Applicability of hyperbolic settlement prediction method to consolidation settlement in the dredged and reclaimed ground was assessed by analyzing results of centrifuge tests modelling self-weight consolidation of soft marine clay. From literature review about self-weight consolidation of soft marine clays located in southern coast in Korea, constitutive relationships of void ratio - effective stress - permeability and typical self-weight consolidation curves with time were obtained by analyzing centrifuge model experiments. For the condition of surcharge loading, exact solution of consolidation settlement curve obtained by using Terzaghi's consolidation theory was compared with results predicted by the hyperbolic method. It was found to have its own inherent error to predict final consolidation settlement. From results of analyzing thc self-weight consolidation with time by using this method, it predicted relatively well in error range of 0.04~18% for the case of showing the linearity in the relationship between T vs T/S in the stage of consolidation degree of 60~90 %. However, it overestimated the final settlement with large errors if those relation curves were nonlinear.

A Study on the Crises and Reforms of World Trade Organization Appellate Body (WTO 상소기구의 위기와 개혁방안에 대한 연구)

  • The dispute settlement mechanism of the World Trade Organization (WTO) is in great peril. The Appellate Body has ceased to function last December as the United States has blocked the appointment of new Appellate Body members since 2017. The focus of this study is on the examination of US's discontent on the Appellate Body and various efforts to reform the Appellate Body. In a recent report, the US Trade Representative raises its concerns on the Appellate Body including 90 days mandatory deadline, transitional rules for outgoing Appellate Body members, scope of appeal, advisory opinions, precedent, recommendation, and overreach without offering any viable solutions. Some of WTO members and experts proposed several Appellate Body reform measures but agreement between WTO members is unlikely in a foreseeable future. Alternative dispute settlement mechanisms should be seriously considered such as interim appeal arbitration arrangements, separate dispute settlement mechanisms for trade remedies, unilateral retaliatory measures without WTO authorization. Rules-based multilateral dispute settlement system is imperative to small open economies like Korea. The Korean government should actively participate in Appellate Body reform discussions with other WTO members to keep the WTO dispute settlement system from collapsing.

Settlement Reduction Effect of Advanced Back-to-Back Reinforced Retaining Wall

  • In order to constrain the railway roadbed settlement which causes track irregularity, and thus threats running stability and ride quality, advanced Back-to-Back (BTB) reinforced retaining wall was numerically analyzed as railway roadbed structure. This study is intended to improve conventional Back-to-Back reinforced retaining wall as the technology which would reduce the roadbed settlement in a way of constraining the lateral displacement of its prestressed vertical facing and inducing arching effects in roadbed (backfill) placed between masonry diaphragm wall and vertical facing. As a result of numerical analysis, it was found that the roadbed settlement was reduced by 10% due to the prestressed vertical facing and embedded masonry diaphragm wall of the advanced Back-to-Back reinforced retaining wall system.

Evaluation of Size Effects of Shallow Foundation Settlement Using Large Scale Plate Load Test (대형 평판재하시험을 이용한 얕은 기초의 침하에 대한 크기효과 평가)

  • This paper addresses the size effect of shallow foundation settlement in very dense weathered granite soil commonly encountered in bridge foundation. Load-settlement curves measured from the plate load tests of 5 different plate sizes in 2 sites were analyzed. The test results showed that the ground beneath the plate was considered not to reach the failure state and the settlement continuously increased proportionately as load increased. The result implies that settlement would govern the stability or serviceability of foundation on very dense weathered soil. The size effect is expressed as a relationship of subgrade reaction modulus to the size of plate. Compared with the previous relationships, the size effect in this result was more prominent and indicated that settlement prediction using the previous method could possibly underestimate the settlement of foundation in dense weathered granite soil.

Analysis of surface settlement troughs induced by twin shield tunnels in soil: A case study

  • This paper analyzes the ground surface settlements induced by side-by-side twin shield tunnels bored in sedimentary soils, which primarily consist of sand with clay strata above the tunnel crown. The measurements were obtained during the construction of twin tunnels underneath the Incheon International Airport (IIA) located in Korea. The measured surface settlement troughs are approximated with Gaussian functions. The trough width parameters i and K of the settlement troughs produced by the first and second tunnel passings are determined, along with those for the total settlement trough. The surface settlement troughs produced by the first shield passing are reasonably represented by a symmetric Gaussian curve. The surface settlement troughs induced by the second shield tunnel display marginal asymmetric shapes at selected sections. The total settlement troughs are fitted both with a shifted symmetric Gaussian function and the superposition method utilizing an asymmetric function for the incremental trough produced by the second tunnel. It is revealed that the superposition method does not always produce better fits with the total settlement. Instead, the shifted symmetric Gaussian function is overall demonstrated to provide more favorable agreements with the recordings. Therefore, the shifted symmetric Gaussian function is recommended to be used in the design for the prediction of the settlement in clays caused by twin tunneling considering the simplicity of the procedure compared with the superposition method. The amount of increase in the width parameter K for the twin tunnel relative to that for the single tunnel is quantified, which can be used for a preliminary estimate of the surface settlement in clay induced by twin shield tunnels.

Load-Settlement Characteristics of Concrete TOP-BASE Foundation on Soft Ground (팽이기초공법(Top-Base Method)의 하중-침하량 분석)

  • A new foundation type which is called Top-Base method has been used frequently in engineering practices in Korea. In this study, the settlement behavior of concrete Top-Base foundation on soft ground is investigated since the consolidation settlement of the embedding depth and the effect of footing dimensions are not included in current Korean criterion (2007). To obtain detailed information, the model tests of the Top-Base foundation are performed using the PLAXIS 3D finite element analysis. It is shown that in-situ measurements and finite element analysis of the behavior of foundations indicate that consolidation settlement is reduced up and bearing capacity of the foundation increases up to 50%~100%, compared to the primary non-treated ground. Based on this study, it is found that the Top-Base foundation prevents the lateral deformation of soft ground and reduces its negative dilatancy to the surface settlement, and that the foundation creates rather uniform stress distribution under it to increase its bearing capacity. It is also found that the total settlement of Top-Base foundation was highly dependent on the consolidation settlement and footing configurations.

  • Previous settlement prediction method based on settlement monitoring such as hyperbolic, monden method were developed under instantaneous loading condition and have restriction to be applied to soft ground under ramp loading condition. In this study, settlement prediction method under ramp loading was developed. New settlement prediction method under ramp loading considers influence factors of consolidation settlement and increase accuracy of settlement prediction using field monitoring data after ramp loading. Large consolidation tests for ideally controlled one dimensional consolidation under ramp loading condition were performed and the settlement behavior was predicted based on the monitoring data. As a result, new prediction method is expected to have great applicability and practicability for the prediction of settlement behavior.

An Analysis of the Operation of the WTO Dispute Settlement System for the first four and a half years (WTO 분쟁해결제도(紛爭解決制度)의 운영사례분석(運營事例分析))

  • This article analyzes the state-of-play of WTO dispute settlement for first four and a half years. Remarkable points found on this analysis are as follows: First, the Quad consisting of the United States, the European Community (EC), Canada and Japan has participated in the WTO dispute settlement mechanism more frequently than any other WTO member. Second, among developing country members some leading countries such as Korea, Brazil and India have relied actively upon the mechanism to claim and defend their rights and obligations under the WTO rules. Third, bilateral dispute settlements generally have been preferred to multilateral dispute settlements by the panel or Appellate Body. Fourth, observation of the Appellate Body proceedings well shows WTO members' strategy to use every process available to them. Fifth, the provisions of GATT 1994 have been most frequently invoked by the members. GATS and TRIPS Agreement disputes are mainly involved in developed countries, in particular the U.S. and the EC. Sixth, very high winning ratio in the panel and Appellate Body process indicates that complaining parties review the possibility to get favorable rulings even before referring to the Dispute Settlement Body (DSB) and prepare for the case very thoroughly. Seventh, roughly speaking, disputes were settled within two or three years. Therefore, seeking bilateral dispute settlement can be more advantageous to a complaining party than referring to a panel or an arbitrator because of low costs and short time period in dispute settlement. Finally, the DSB approved retaliatory actions for winning complaining parties against the defending parties who had rejected implementation of its rulings and recommendations. In conclusion, it can be said that the WTO dispute settlement mechanism has been operated very successfully for the first four and a half years. It is hoped that continued study on state-of-play of WTO dispute settlement mechanism will be contributory to improved national interest of Korea.
