Legislation Trend Referring to Burden of Proof in Medical Malpractice Lawsuit (의료과오소송 입증책임 관련 입법의 동향)

  • Nowadays it is important for us to resolute medical disputes. Because a high incidence of medical accidents may be brought about according to many chances of treatment in the operation of health insurance and increasing concern of patient health. Patients and medical doctors have plenty of difficulty in uncomfortable treatment circumstances of a high incidence of medical accidents. It is especially desirable that our society should prevent medical accidents and resolute speedy, fairly and rationally the happened medical disputes. Many legislations were suggested to resolute medical dispute. But legal issue points stress only speedy medical dispute resolution procedure and don't compromise fair and professional procedure. Accordingly these legal arguing points had not been accepted by the National Assembly and people. If the speedy resolution of medical dispute was demanded to solve unsafe treatment circumstances, it is necessitated that the legislation containing legal issue points to procedure is enacted. Of course the interest of patients and doctors to legal issue points must be balanced. Because an arguing points to the reversal of proof burden is consisted of the entity judgement in connection with setting the basis of resolution of medical dispute, the legislation to these is checked carefully.

  • During the negotiation and resolution of delay and disruption disputes on construction projects, the use and misappropriation of float, and the question of float ownership, are considered to be a major concern to those involved. Most practitioners and authors are of the opinion that it is an issue that should be clearly defined and addressed within the provisions of the contract. However, the terms "float" or "ownership of float" are rarely mentioned (if at all) in most of the standard forms of Australian construction contracts, giving little guidance to those involved as to how this issue should be addressed. In October 2002 the United Kingdoms Society of Construction Law (SCL) published a Delay and Disruption Protocol (the Protocol) that contains a suggested approach to the issue. The aim of this research was to obtain an Australian opinion of the suitability of the SCL's Delay and Disruption Protocols suggested approach to the issue of float and ownership of float for use by the Australian construction industry. Qualitative interviews were carried out with Australian construction industry experts experienced in the administration, negotiation, and resolution of delay and disruption disputes to obtain their opinions of the suitability of the SCL's proposed approach. Results indicate general confusion and uncertainty as to how the issue of float and float ownership should be addressed in general, with the SCL's approach adding further to that confusion.

  • This study focuses on the operating requirements of multi-resolution modeling(MRM) in training war-game model and proposes solutions for major issues of multi-resolution interoperation between Combat21 model and tank multi-purpose simulator(TMPS). We study the operating requirements of MRM through interviews with defense M&S experts and literature surveys and report the various issues that could occur with low-resolution model Combat21 and high-resolution model TMPS linked, for example, when to switch objects, what information to exchange, what format to switch to, and how to match data resolutions. This study also addresses the purpose and concept of training using multi-resolution interoperation, role of each model included in multi-resolution interoperation, and issue of matching damage assessments when interoperated between models with different resolutions. This study will provide the common goals and directions of MRM research to MRM researchers, defense modeling & simulation organizations and practitioners.

  • The past two decades were mainly devoted to model validation and computer code verification against global corium experiments, code application to reactor situations, and investigation of the role of melt properties in steam explosion energetics. Corium data were essentially provided by JRC-Ispra in the FARO and KROTOS facilities and by KAERI in the TROI facility. Verification of code applicability to reactor situations was performed essentially in the frame of the international OECD/SERENA programme. The paper makes a synthesis of the findings made during the above-mentioned period and expresses a personal view of the author with respect to the progress made and expected for the resolution of the steam explosion issue for light water reactors.

A Study for Hostage Crisis and It's Effective Resolution (인질사건의 실태 및 대처방안)

  • This is a study on hostage crisis and effective resolution of the crisis. First, we surveyed the theoretical guidance for our study: definition, patterns, of hostage crisis; psychology of hostage-takers. And we explores a great variety of hostage crisis cases to develop principles and methods for negotiation and subjugation. We suggest, throughout this study, some action program to be developed, as follow: First, we need to broaden and deepen the understanding on the issue of hostage-crisis by expanding educational opportunity on the issue, while raising hostage negotiators. Second, information sharing system among hostage management related offices, and complete training for SWAT team are required. Third, when a hostage-crisis is raised, police enforcement must corporate with mass-media in a way of close manner. Fourth, in a critical hostage crisis, the commander should appear on site for effective command. Lastly, the top-priority for the commander who is in charge of the crisis should be put on the security of hostage and hostage-taker, as well.

Arbitration Agreement through Standardized Terms and its Validity (약관을 통한 소비자중재합의와 그 유효성)

  • Recently, there have been discussions about the necessity of consumer arbitration such as ADR. The debate has progressed, because this area of arbitration has expanded into the press and medical fields. However, there is not an act for regulating consumer arbitration in South Korea. Thus, this issue has been deliberated at UNCITRAL Working Group III. The core issue of this deliberation is the validity of consumer arbitration. Especially if a pre-dispute arbitration agreement is contracted online, it progresses by using standardized terms; therefore it is possible that the Standardized Terms Regulating Act judges the relevant terms. This thesis consists of the following: First, concepts and categories of arbitration agreements. These include arbitration agreement, pre-dispute arbitration agreement, and arbitration agreement through standardized terms. Second, the validity of the above agreements will be discussed. There are three positions concerning their validity: affirmative as de lege ferenda, negative, and restrictively negative. Similar discussions concerning German law and cases would be helpful to specify and compare the issue. When a consumer arbitration agreement is contracted through standardized terms, it is necessary that the required formality of the agreement has been satisfied, before the effect of the agreement may be regulated by the German Civil Code.

Multi-resolution Fusion Network for Human Pose Estimation in Low-resolution Images

  • 2D human pose estimation still faces difficulty in low-resolution images. Most existing top-down approaches scale up the target human bonding box images to the large size and insert the scaled image into the network. Due to up-sampling, artifacts occur in the low-resolution target images, and the degraded images adversely affect the accurate estimation of the joint positions. To address this issue, we propose a multi-resolution input feature fusion network for human pose estimation. Specifically, the bounding box image of the target human is rescaled to multiple input images of various sizes, and the features extracted from the multiple images are fused in the network. Moreover, we introduce a guiding channel which induces the multi-resolution input features to alternatively affect the network according to the resolution of the target image. We conduct experiments on MS COCO dataset which is a representative dataset for 2D human pose estimation, where our method achieves superior performance compared to the strong baseline HRNet and the previous state-of-the-art methods.

Super Resolution Fusion Scheme for General- and Face Dataset (범용 데이터 셋과 얼굴 데이터 셋에 대한 초해상도 융합 기법)

  • Super resolution technique aims to convert a low-resolution image with coarse details to a corresponding high-resolution image with refined details. In the past decades, the performance is greatly improved due to progress of deep learning models. However, universal solution for various objects is a still challenging issue. We observe that learning super resolution with a general dataset has poor performance on faces. In this paper, we propose a super resolution fusion scheme that works well for both general- and face datasets to achieve more universal solution. In addition, object-specific feature extractor is employed for better reconstruction performance. In our experiments, we compare our fusion image and super-resolved images from one- of the state-of-the-art deep learning models trained with DIV2K and FFHQ datasets. Quantitative and qualitative evaluates show that our fusion scheme successfully works well for both datasets. We expect our fusion scheme to be effective on other objects with poor performance and this will lead to universal solutions.

  • The Brownian motion or Wiener process, as the physical model of the stochastic procedure, is observed as an indexed collection random variables. Stochastic procedure are quite influential on the confinement potential fluctuation in the quadrupole ion trap (QIT). Such effect is investigated for a high fractional mass resolution Δm/m spectrometry. A stochastic procedure like the Wiener or Brownian processes are potentially used in quadrupole ion traps (QIT). Issue examined are the stability diagrams for noise coefficient, η=0.07;0.14;0.28 as well as ion trajectories in real time for noise coefficient, η=0.14. The simulated results have been obtained with a high precision for the resolution of trapped ions. Furthermore, in the lower mass range, the impulse voltage including the stochastic potential can be considered quite suitable for the quadrupole ion trap with a higher mass resolution.

  • The resolution issue of various soil moisture prediction parameters such as wetness index and curvatures is addressed. The sensitivities of various index are discussed on the base of the statistical aspects. The statistical analysis of three flow determination algorithms on the DEM is performed. The upslope area associated with SFD algorithm appear to more sensitive than the parameters of the other algorithms(MFD, DEMON). The wetness index shows relatively less variation both in resolution and the calculation Procedures.
