The U.S. Contract Law Defenses in Consumer Arbitration Agreement (소비자중재합의의 미국계약법상 항변)

  • This paper investigates the consumer arbitration practices In the U.S. The key issue in consumer arbitration is how to protect the individual consumers from the loss of their legal rights stemming from the arbitration agreement with the business. In the U.S., the major legal doctrines to protect individual consumer include the voluntary-knowing-intelligent doctrine, unconscionability doctrine, and void contract. Even though the US courts are favorable to the enforceability of arbitration agreement, they strictly apply the contract law theories in deciding the existence of arbitration agreement, providing a strong common law protection for the consumers in arbitration. However, the practices for protection of consumers in arbitration in Korea are not mature yet. If consumer arbitration is widely adopted into B to C contracts, a protective measure for individual consumer can be found in the Act of Clause Regulation providing that the business has duty to explain the relevant clause in the adhesive contracts.

  • Research on the Development of EPUB SCP(Secure Content Protection) Technical Specification and International Standardization has been carried out as a R&D project granted by the Korea Copyright Commission since 2014. The research aims to build a standard framework for the EPUB DRM(Digital Rights Management) based on the Readium LCP(Licensed Content Protection) and KS EPUB DRM specifications, to develop element technologies for the framework, and to standardize it as an IDPF(International Digital Publishing Forum) industrial standard. One of the essential features of the EPUB DRM developed though this study is to support the lending model of the digital library. This paper introduces LSD(License Status Document) specification which is a DRM license management protocol for the digital library lending process, and also represents a model which can automatically test the implemented entities of the LSD specification, test scenarios and test materials.

  • The major factors for the information protection to prepare for the change of the EC environment are found to be the construction of internet cyber-mall, the consumer-protecting regulations and the private information and system security regulations. The standards and methods of the their judgement is also important factors and are believed to attract the consumers' interest about the assessment of the internet cyber-mall and eventually serve the rights and interests of the consumers. The technology-level for the business transaction, the research and development of its technology and putting it into practical use are also found to be significant factors.

Copyright Protection using Encryption of DCT Coefficients and Motion Vector in Video Codec of Mobile Device (모바일 기기내의 비디오 코덱에서 DCT 계수와 움직임 벡터의 암호화를 이용한 저작권 보호)

  • With widespread use of the Internet and improvements in streaming media and compression technology, digital music, video, and image can be distributed instantaneously across the Internet to end-users. However, most conventional Digital Right Management are often not secure and fast enough to process the vast amount of data generated by the multimedia applications to meet the real-time constraints. In this paper, we propose the copyright protection using encryption of DCT coefficients and motion vector in MPEG-4 video codec of mobile device. This paper presents a new Digital Rights Management that modifies the Motion Vector of Macroblock for mobile device. Experimental results indicate that the proposed DRM can not only achieve very low cost of the encryption but also enable separable authentication to individual mobile devices such as Portable Multimedia Player and Personal Digital Assistants. The performance of the proposed methods have low complexity and low increase of bit rate in overhead.

  • 멀티미디어 콘텐츠를 저작, 생성, 전달을 통해 최종 소비에 이르기까지 콘텐츠를 보호하고 안전하게 다루기 위해 MPEG-21 IPMP(Intellectual Property Management and Protection)가 표준을 정의하고 있으며 현재 FCD(Final Committee Draft) 단계까지 표준화가 이루어졌다. 우리는 MPEG-21 IPMP에서 규정한 FCD규격에 따라 멀티미디어 콘텐츠와 그에 대한 저작권을 보호 관리하는 시스템을 개발하였다. 제안한 MPEG-21 기반 REL및 IPMP 보호 관리 시스템은 크게 보호 관리 메타데이터 생성부, 통합 제어 관리부, 디지털 아이템 암호화부, 네트워크 인터페이스부의 4부분으로 구성된다. 이 시스템은 먼저 라이센스 서버를 통해 MPEG-21 REL(Rights Expression Language) 규격에 맞는 라이센스 정보가 담긴 문서를 파싱하는 기능을 가지며 오디오 또는 비디오 워터마크가 적용된 멀티미디어콘텐츠에 대해 MPEG-21 IPMP 기반의 메타데이터를 생성하고 보호 관련 REL및 IPMP 메타데이터와 멀티미디어 콘텐츠를 Remuxing 하여 전송되며 멀티미디어 콘텐츠 및 하나의 패키징된 DID는 암호화하여 최종 소비자에게 전송한다.

  • With the realization that the police's personal information gathering activities can violate the authority to decide one's information guaranteed by the Constitution, many people are interested in the legal terms of the police's information gathering and handling. The police's personal information gathering activities imply both the purpose of public welfare and order and the risk of violation of basic rights of citizens, their effective balance is critical. In this respect, this study reviews the principle of proportion as a principle of control of personal information gathering and handling (police intelligence activities) by state to discuss its implications on legislation.

  • This paper described the contents of the WTO (world trade organization) SPS (world trade organization) Agreement and trends in the WTO SPS provisions such as equivalence, localization, transparency, and risk assessment. The purpose of the WTO SPS agreement is to promote international trade by preventing arbitrary and unreasonable use of SPS measures, which are the rights of a country for the protection of human health and animal and plant health, and by abolishing the non-tariff barriers. To this end, the requirements for implementing the SPS measures taken by the importing country are restricted to those that can scientifically prove to be inevitable for SPS protection. The major provisions in WTO SPS agreement were elaborated to promote international trades. When trade-restricted SPS measures such as prohibition of imports are made, a scientific basis should be provided. Therefore, it is essential to provide scientific evidence based on risk analysis to protect people's health from potentially harmful imported foods.

  • Electronic Copyright Management System is the technical solution to protect copyright and to manage the distribution of digital contents in network environment. This paper examined the theoretical plane of Electronic Copyright Management System and analyzed the characteristics and the protection technologies of some of the commercial systems. And this paper investigated the essential protection technologies and payment systems that is needed to develop and manage the successful system in the future. Finally this study suggested the fundamental function model of Electronic Copyright Management System.

Key Management Server Design in Multiuser Environment for Critical File Protection

  • In enterprise environments, file owners are often required to share critical files with other users, with encryption-based file delivery systems used to maintain confidentiality. However, important information might be leaked if the cryptokey used for encryption is exposed. To recover confidentiality, the file owner must then re-encrypt and redistribute the file along with its new encryption key, which requires considerable resources. To address this, we propose a key management server that minimizes the distribution of encryption keys when critical files are compromised, with unique encryption keys assigned for each registered user to access critical files. While providing the targeted functions, the server employs a level of system resources comparable to that of legacy digital rights management. Thus, when implemented in an enterprise environment, the proposed server minimizes cryptokey redistribution while maintaining accessibility to critical files in the event of an information breach.

  • The importance of Digital Rights Protection technologies, especially the forensic marking, is getting larger and larger as the demand for the digital contents is increased. But the technologies for the evaluation of forensic marking is not set up properly due to the conflicts between interested parties and technical difficulties. Therefore to evaluate the performance of forensic marking objectively, image and video modification items/levels and evaluation criteria are essential. This paper suggests the quantitative system for evaluating the performance of forensic marking objectively. By providing the opportunity to evaluate the Digital Rights Protection product in objective and quantitative manner, forensic marking industry can expedite its technology development and consumer can get objective and universally validated performance result. It is expected this technology could help revitalizing the related industries and help expediting the development of forensic mark technologies.
