Research on the Effectiveness of Protecting Utility Model with China's Patent Evaluation Report (실용신안 권리보호에 대한 중국 특허권평가보고서제도의 유효성 연구)

  • China's utility model as a supplement to the invention patent, has short application duration, fast authorized speed, and has the same exclusive rights with patents, so companies can quickly dominate the market. But the utility model does not need to carry out substantive examination, so has lower stability, high frequency of invalid to accepted, so compare with the invention patent, difficult to be protected. In order to actively encourage the small and medium-sized enterprises to promote their inventions, and protect domestic patents, China established a protection policy of patent evaluation report for the utility model rights, especially the patent evaluation report can be used as evidence in a patent infringement trial, to provide judicial remedies for utility model patentee and the party of patent disputes. Many experts believe that the establishment of patent evaluation report system can improve the stability of the utility model patent right, and when the defendant request for invalidation of the patent right in the defense period, if there is no novelty, creativity lost or no other reason has not led to the stability of patent right given in a patent evaluation report of the utility model patents, the court may not suspend the trial, without having to wait for the Patent Reexamination Board makes the patent invalid declaration decisions, can improve the efficiency of the judicial process, accelerate the patentee's time. However, in practical patent infringement, the patent evaluation report system and invalidation system are in conflict. In this paper, through the analysis of the current China utility model system and compared with the South Korean utility model system, review the role and character of the patent evaluation report system, and through the actual cases of the utility model patent infringement litigation, analysis possible variates from the decision of patent evaluation report, to find out the reason of the patent evaluation report system being in conflict with the invalidation system, and research on the effectiveness for protecting Utility Model with China's Patent Evaluation Report.

  • Forecasting of emerging technology plays important roles in business strategy and R&D investment. There are various ways for technology forecasting including patent analysis. Qualitative analysis methods through experts' evaluations and opinions have been mainly used for technology forecasting using patents. However qualitative methods do not assure objectivity of analysis results and requires high cost and long time. To make up for the weaknesses, we are able to analyze patent data quantitatively and statistically by using text mining technique. In this paper, we suggest a new method of technology forecasting using text mining and ARIMA analysis.

  • This study conducted a patent analysis to explore the trend of technology development in the field of smart car security. As a result of the analysis, it was confirmed that along with the growth of the smart car market, the development of smart car security related technology is also increasing. In particular, as related technology development has been rapidly taking place in recent years, it has been confirmed that competition among leading smart car countries and major companies is also expanding due to the commercialization of smart car. This study is meaningful in that it examines trends related to smart car security through quantitative analysis using patent data and presents implications accordingly.

  • In this research, we would like to understand the measures to be taken in the event of a patent dispute by Chinese companies that are growing rapidly and competing with Korean companies in the global market, at a time when the fusion and compounding technology are accelerating. For this reason, the patent dispute countermeasures shown in the previous research were derived through deep interviews with experts, and a questionnaire survey was conducted with patent practitioners of Chinese companies. As a result of the analysis, the importance of cross licensing, patent invalidation proceedings, proceedings through collaboration with other companies, royalty payments, and patent invalidation proceedings in the case of a patent dispute in the Chinese industry is high. Shown. The results of this study provide practical guidelines to help corporate patent practitioners understand the best course of action in the event of a patent dispute, respond in a timely manner, and save time and money. It seems that it can be done.

A Study on the Effect of Patent Management Activities on Firm Outcome : The Case of Korean Product Manufacturing Firms (특허경영활동이 기업 경영성과에 미치는 영향에 관한 연구 : 국내 의료기기 제조 기업을 중심으로)

  • Patent management activities are considered to play a key role for technology-based firms under the recent knowledge-based economies. This is because intellectual property, including patents, can act as a system for continuous profit generation by protecting firms' products, processes and services. In Korea, healthcare industry is now regarded as one of the promising next generation industries. Despite the promise of healthcare industry, Korean healthcare product manufacturers are faced with turbulent business changes, such as market opening. Even though there are various industrial studies on the effect of patent management activities on firm outcome, previous studies have hardly paid attention to Korean healthcare product manufacturing firms. For this reason, this study identifies the effect of patent management activities, such as patenting activeness, technical excellence and cooperation degree, on firm outcomes, including financial profitability and firm growth, with respect to the Korean healthcare product manufacturers. In this study, we located 86 Korean healthcare manufacturing firms from KORCHAMBIZ and DART, and then collected the data of their patenting activities and outcomes between 2001 and 2013. By applying factor analysis and regression analysis, our empirical study found that firms' patenting activeness has the significant positive relationship on firms' financial profitability, and firms' patenting activeness and technical excellence have the significant positive relationship on firms' financial growth. Our study is an initial attempt to identify the effect of patent management activities on firm outcome within Korean healthcare product manufacturing industry, and thus its results can be used as the basis to formulate national policies for Korean healthcare product industry.

Study on the Emerging Technology-Product Portfolio Generation Based on Firm's Technology Capability (기업 보유역량 기반의 잠재 유망 기술-제품 포트폴리오 도출에 관한 연구)

  • This research aims to propose a systematic approach to identify emerging technology-product portfolio for small and medium enterprises (SMEs). Firstly, operational definition of emerging technology for SMEs is presented. Secondly, research framework is suggested and case study to show usefulness of the newly proposed framwork is analyzed. In detail, reference patent set which represent company's capabilities and business area are constructed. The research constructs patent data set for bibliometric analysis using reference patent set and citing patents to 2nd level. Clustering (expert judgement) and keyword based bibliometric approach are used. Then, cluster activity index (AI) and relevance index (RI) comparing with reference patent set are estimated. With emerging technology-product portfolio using AI and RI, a firm can identify emerging technology-product area and monitoring area.

Social network analysis of keyword community network in IoT patent data (키워드 커뮤니티 네트워크의 소셜 네트워크 분석을 이용한 사물 인터넷 특허 분석)

  • In this paper, we analyzed IoT patent data using the social network analysis of keyword community network in patents related to Internet of Things technology. To identify the difference of IoT patent trends between Korea and USA, 100 Korea patents and 100 USA patents were collected, respectively. First, we first extracted important keywords from IoT patent abstracts using the TF-IDF weight and their correlation and then constructed the keyword network based on the selected keywords. Second, we constructed a keyword community network based on the keyword community and performed social network analysis. Our experimental results showed while Korea patents focus on the core technologies of IoT (such as security, semiconductors and image process areas), USA patents focus on the applications of IoT (such as the smart home, interactive media and telecommunications).

Exploring Technology Development Trends and Discovering Technology Convergence Opportunities in the Digital Twin using Patent Information (특허정보를 활용한 디지털 트윈 기술 동향 분석 및 기술융합기회 발굴)

  • Digital twin is considered as a key technology of industry 4.0, thus being essential for the future of industrial production. Despite the significance, a systematic analysis of its technological landscape is lacking. This study aims to investigate the technological development trends and newly emerging technological convergence opportunities in the domain of digital twin by exploiting patent information derived from U SPTO. For this purpose, this study visualized and predicted the convergence dynamics among patent classification codes by adopting patent co-classification analysis and link prediction approach. The findings show that the number of digital twin-related patent applications has increased significantly since 2018. The CPC code G06F showed the highest eigenvector centrality, while G05B was characterized by highest betweenness centrality. According to the predictive model, 41 novel links were revealed, acting as potential technology convergence opportunities. These links were then categorized into 11 different domains. The most dominant category was "digital data processing and artificial intelligence", which could play a foundational role in the diffusion of digital twin technology. The presence of digital twin technology is dominant in manufacturing, but its applications are expected to expand, including "climate change", "healthcare" and "aerospace engineering". The derived insights can support R&D managers and policy makers in formulating R&D strategies and directing future R&D investment decisions.

  • As the domestic animation industry is shrinking, it is time to actively respond to changes in new technologies and animation production methods. From 2016 to 2020, through patent information registered in the United States, China, and Korea in the field of animation technology, applicants who are the subject of technology were analyzed and technical policies and strategies pursued by applicants in each country were reviewed. China registered the most patents, so the technical activity index was high, and the US family patent size was high. As a result of positioning analysis, the U.S. market expansion influence decreased over time, China's technological activity gradually increased over time, and Korea's technological activity and family patent size decreased. Reflecting China's rise as the world's largest animation producer, Korea should also develop a policy to support animation.

  • Technology analysis is to analyze technological data such as patent and paper for a given technology field. From the results of technology analysis, we can get novel knowledge for R&D planing and management. For the technology analysis, we can use diverse methods of statistics. Time series analysis is one of efficient approaches for technology analysis, because most technologies have researched and developed depended on time. So many technological data are time series. Time series data are occurred through time. In this paper, we propose a methodology of technology forecasting using the dynamic time warping (DTW) of time series analysis. To illustrate how to apply our methodology to real problem, we perform a case study of patent documents in target technology field. This research will contribute to R&D planning and technology management.
