The Legal Issues of Nagoya Protocol and Related Proposals for Korea (나고야 의정서의 법적 쟁점과 우리나라 입장에 관한 제언)

  • The Nagoya Protocol will enter into force on 12 October, 2014 during the period of UNCBD COP12 which will be held in Pyeongchang, Korea. In this circumstance, it is essential to analyze other countries' legislations and find various related issues. Based on that analysis, Korea can set its course for related policies and also improve its own legislations. EU and China were selected as comparison countries since EU is one of the leading countries trying to establish an international environmental law system and China is regarded as a model country representing LMMC (Like-Minded Mega-diverse Countries) in the world. Based on this study, it is highly recommended for Korea to assert the need for dispute resolution between private and government parties and also trilateral co-management of trans-boundary genetic resources and related traditional knowledge among Korea, China and Japan. In addition, Korea also needs to improve its legislation towards integrating the management and control of genetic resources.

A Study on Legal Limitations of Teachers' Right for Expression (초.중.고교 교원의 정치적 표현과 제한법리에 관한 탐색적 연구: '시국선언' 관련 판례를 중심으로)

  • This study examined how the Korean courts have made a balance between rights of school teachers' expression and the public interests derived from regulating their rights for expression in related cases. Under the Korean laws such as National Public Service Law and the Law on Assembly and Demonstration, school teachers are considered as civil servants and basically not allowed to assemble to demonstrate for their own interests. The analysis revealed that in 24 cases from a total of 31 teacher-related court cases, teachers were found guilty in violation of related laws. In deciding whether the teachers' participation on anti-government assembly was guilty or not, the courts put an emphasis on public purpose of their expression, the degree to which their expressions affect the society, and specific contents of their expression. Conclusively, it was found out that in applying the related law, Korean courts tend to overweigh the public interests, rather than the teachers' right to express.

Verification of Similitude Law for 1g Shaking Table Tests through Modeling of Models (모형의 모형화 기법을 이용한 1g 진동대 실험을 위한 상사법칙의 유효성 검증)

  • A series of shaking table model tests were performed to verify the validity of similitude law, which is suggested by lai (1989) to simulate the dynamic behavior of soil-fluid-structure system for is shaking table tests. In the tests, the similitude law suggested by lai was applied to determine the length and the time scaling factors. Also, the steady state concept was used in determining the density of model backfill soil, which is a key factor in simulating the development of excess pore pressure during shaking. The similitude law was verified by checking whether three different sizes of quay walls show the identical behavior or not. The similar responses of acceleration, excess pore pressure and horizontal displacement of walls were obtained far the small and large models. However, the medium model showed larger responses than those of the small and large models because of the resonance between the frequency of input acceleration and the natural frequency of the wall system. In addition, the vertical displacement and rotational angle of the walls became larger with the increase of model size.

  • In this article, the Medical Act, the Emergency Medical Act, Act on remedies for injuries from medical malpractice and mediation of medical disputes were reviewed and interpreted based on the Civil Act. In the health and medical field, there are various laws that reflect changes in the medical field due to the development of health and medical technology, and their revision is very frequent. And the legislation has become very complicated. They contradict each other or require interpretation. In this situation, a person must take considerable care not to violate the law. In many cases, specific guidelines or authoritative interpretation are required to apply the law. Even guidelines and authoritative interpretations often conflict with civil law. In this article, errors in the legal text related to health care were found. In addition, it found a case that contradicts the civil law perspective in interpretation. Thus, it was confirmed that civil legal thinking was necessary to legislate, interpret, and apply health care-related laws.

  • This thesis presents the 'Information and the Library' curriculum and the roles of teacher-librarians. Related to 'The School Library Promotion Law', this thesis presents the effects teacher-librarians instruct 'Information and the Library' curriculum to the school libraries, and the challenges related to this curriculum. This thesis contains the role and work of three kinds of staff in the school library. implementation of primary and secondary 'Information and the Library' curriculum for information literacy instruction in the school libraries, the effects by 'Information and the Library' curriculum. and challenges of 'Information and the Library' curriculum. Conclusively, teacher-librarians should accomplish their own instructional activities with 'Information and the Library' curriculum in the school curricula as differentiated work from librarians.

A Feedback Linearization Control of Container Cranes: Varying Rope Length

  • In this paper, a nonlinear anti-sway controller for container cranes with load hoisting is investigated. The considered container crane involves a planar motion in conjunction with a hoisting motion. The control inputs are two (trolley and hoisting forces), whereas the variables to be controlled are three (trolley position, hoisting rope length, and sway angle). A novel feedback linearization control law provides a simultaneous trolley-position regulation, sway suppression, and load hoisting control. The performance of the closed loop system is shown to be satisfactory in the presence of disturbances at the payload and rope length variations. The advantage of the proposed control law lies in the full incorporation of the nonlinear dynamics by partial feedback linearization. The uniform asymptotic stability of the closed-loop system is assured irrespective of variations of the rope length. Simulation and experimental results are compared and discussed.

  • This paper considers a robust adaptive stabilization problem for a class of uncertain nonlinear systems which include an unknown virtual control coefficient, an unknown constant parameter, and a time-varying disturbance whose bound is unknown, We propose a new estimator for an un-known virtual control coefficient and present a robust adaptive backstepping design procedure which results in a smooth state feedback control law, a new two-dimensional parameter update law, and a $C^1$ Lyapunov function which is positive definite and proper.

A Novel Scheme for Sliding-Mode Control of DC-DC Converters with a Constant Frequency Based on the Averaging Model

  • A new scheme for sliding-mode control (SMC) of DC-DC converters with a constant switching frequency is proposed. The scheme is based on the averaging model and the output signal of the controller is $d^+$ or $d^-$ instead of the on or off signal of a direct sliding-mode (SM) controller or the continuous signal d = $u_{eq}$ of an indirect SM controller. Two approaches using the new scheme are also proposed and the design procedures for a buck converter are given in detail. The first approach called constant $d^+$ and $d^-$ SMC is simple, cost effective and dynamically fast. In order to improve the dynamic characteristics of the reaching phase and to alleviate chattering, the second approach called reaching law SMC is also presented. Analyses and simulation results demonstrate the feasibility of the proposed scheme.

  • Recently, China & Japan have expanded their responding ADIZ(Air Defence Identification Zone) to implement each Government's maritime policy and to project their Air Power in preparation for maritime provocation & contingency, especially over the piled area where East Asia countries have claimed to have maritime jurisdiction one another. So this is to guide the Development Option for Korea Air Defence Identification Zone to cope with the maritime intentions of the neighboring countries, considering the international law for ADIZ, the maritime policy and the maritime sovereign & jurisdiction area of the Republic of Korea, etc.
