출생 전 생명에 대한 민사법적 고찰 (Study of the Civil Liability for Unborn Life)

  • Owing to the development of Biotechnology, the involvement of humans in life before birth has been increasing. This means the need for the protection of unborn life takes on new importance. The respect for life and human beings which is based on fundamental constitutional principle should still be respected under civil law. This study examines how methods of respect for life are embodied in civil liability law. In particular, it enunciates the protection of unborn life within time-flow. Lastly, it studies the instruments of the civil liability law and the extent of protection for a fetus from the process of fertilization of an ovum by a sperm, development into an embryo and implantation. Especially, it looks into when and how the subject of the right changes. Besides, it critically scrutinizes the opinions of leading case lawyers and the Constitutional Court which conclude that, in order for a fetus to become the subject of Damage law, it is required to be born alive to comply with precedent. Furthermore, it suggests an alternative interpretation theory.

  • In this paper, we derive the optimal input-constrained control law which minimizes predictive control objective function subject to input constraints. In order to obtain the closed form of control law, three suboptimal methods are proposed and evaluated by simulation.

PI 형 도갈법칙을 가지는 가변구조 제어 (A variable structure controller with a PI-type reaching law)

  • We propose a VSC(Variable Structure Controller) with a PI-type reaching law. In General, conventional VSCs with a reaching law including a discontinuous term have the chattering problem, and thus the system may be unstable due to the disregarded high frequency dynamics in the modeling process. To resolve this problem, the PI-type reaching law is proposed in this paper. The proposed reaching law makes it easy to determine the reaching dynamics as well as the reaching time by utilizing the 2nd-order system analysis. Furthermore, since the discontinous term is not involved in the reaching law, the chattering is considerably reduced. To show the effectiveness of the proposed scheme, the stability of the proposed system is proved by Lyapunov method and the computer simulations are performed for the Ball Balance System.

여성 결혼이민자의 가족관계가 삶의 만족에 미치는 영향 (The Effects of Family Relationship of Women Immigrants on Satisfaction with life)

  • This study was done to investigate the effects of family relationship on satisfaction with life in women immigrants. The participants were 346 women immigrants in S city, Chungnam province. The data were collected through self-reported questionnaires which were constructed to include such scales as satisfaction with life and family relationship. First, satisfaction with family relationship ranked in order of couple, parents-in-law, and brothers-in-law and sisters-in-law. Second, as the women immigrants were younger, and their wedding time was shorter, satisfaction with couple was higher. Third, when women immigrants were between 20 and 30 years old in age, and between 2006 and 2010 in wedding year, satisfaction with parents-in-law were higher. Fourth, when women immigrants were between 20 and 30 years old in age, and 2006 and 2010 in wedding year, satisfaction with brothers-in-law and sisters-in-law were higher. Fifth, satisfaction with life was higher for women immigrants with younger age, lower educational level, and shorter residence and wedding time. Sixth, curve term more accounted for relationship between satisfaction with parents-in-law and life. Seventh, significant predictors influencing satisfaction with life were satisfaction with couple, and brothers-in-law and sisters-in-law.

초음속 고등훈련기 가로-방향축 모델역변환 비행제어법칙 설계 (Lateral-Directional Dynamic Inversion Control Applied to Supersonic Trainer)

  • The modern version of aircrafts is allowed to guarantee the superior handing qualities within the entire flight envelope by imposing the adequate stability and flying qualities on a target aircraft through the various techniques of flight control law design. Generally, the flight control law of the aircraft in service applies the various techniques of the verified control algorithm, such as dynamic inversion and eigenstructure assignment. The supersonic trainer employs the RSS(Relaxed Static Stability) concept in order to improve the aerodynamic performance in longitudinal axis and the longitudinal control laws employ the dynamic inversion with proportional-plus-integral control method. And, lateral-directional control laws employ the blended roll system of both beta-betadot feedback and simple roll rate feedback with proportional control method in order to guarantee aircraft stability. In this paper, the lateral-directional flight control law is designed by applying dynamic inversion control technique as a different method from the current supersonic trainer control technique, where the roll rate command system is designed at the lateral axis for the rapid response characteristics, and the sideslip command system is adopted at the directional axis for stability augmentation. The dynamic inversion of a simple 1st order model is applied. And this designed flight control law is confirmed to satisfy the requirement presented from the military specification. This study is expected to contribute to design the flight control law of KF-X(Korean Fighter eXperimental) which will proceed into the full-scale development in the near future.

21세기 국제경쟁질서와 공정사회의 고찰: 미국, EU, 일본, 한국을 중심으로 (International Competition Order and Fairness Society for 21st Century: Focusing on the USA, EU, Japan, and Korea)

  • 본 논문은 21세기 전 지구촌의 국제경쟁질서와 공정사회의 달성을 위한 새로이 제기되고 있는 이론, 정책, 제도와 법체제의 대안을 고찰하였다. 특히, 우리는 세계화에서 새로운 자유무역질서와 공정사회로서의 시장촉진과 공정거래를 위한 국제수준의 경쟁질서와 경쟁법체제의 기준을 연구하지 않으면 안 된다. 본 논문에서는 첫째, 세계무역기구(WTO)에서 새로운 자유무역의 공정거래를 위한 경쟁질서와 공정사회의 역사성과 기본적인 규범을 연구하였으며 둘째로, 새로운 세계화정책에서 비경쟁행위의 규제체계와 시장경쟁촉진을 위한 상거래유형과 법체계의 윤곽을 연구하였다. 더욱이, 우리는 WTO에서 경쟁질서와 공정사회를 저해하는 요인을 현실적 카테고리에서 연구하였다. 셋째로, 미국-EU와 한국-일본의 경쟁질서와 경쟁법의 적용범주 및 적용사례를 연구하였다. 끝으로, 본 논문은 21세기 최적의 국제경쟁질서와 공정사회의 달성관점에서 다양한 새로운 이론, 정책, 제도와 경쟁법의 연구를 토대로 새로운 대안과 시사점을 제시하였다.

School Zone Automobile Accidents in Republic of Korea: Comparative Law Analysis on Criminal Responsibility of the Driver

  • In 2019, a child died by a school zone traffic accident in Asan, Chungcheongnam-do, the Republic of Korea. Just after the accident, under the name of the "Minsik Law", the Road Traffic Act and the Specific Crime Aggravated Punishment Act were partially revised and went into effect in Korea on March 25, 2020. The new Korean law providing for harsh penalties is designed to reduce automobile accidents in school zones. However, the penalties under the new law seems to be unconstitutionally and unduly harsh. Under the new law, a negligent driver who kills a child at a school zone could be sentenced to indefinite imprisonment, or imprisonment for 3 years or more. The criminal responsibility of a negligent driver at a school zone is the same as serious intentional felonies such as rape, robbery, abandonment resulting in death. Also, even in the case of a school zone accident, if an accident driver complies with the speed limit and other traffic laws and it is impossible to avoid the accident, the driver should not be punished. So, in order to meet the principle of proportionality, the new Korean law should be revised again. In order to find out the appropriate level and punishment method for drivers who cause accidents in school zones, this thesis will compare and analyze the laws of Korea with those of the United States, Germany, and Japan. This paper also reviews the decision of the Constitutional Court of the Republic of Korea in February 2023 that the "Minsik Law" was constitutional. Based on these analyses, this thesis seeks the direction and amendments to properly revise Korean law. In addition, this thesis is intended to present exemplary measures to improve the school zone safety.

유대교 미쉬나 나쉼(Nashim)의 기독교교육을 위한 적용 방안 (The Study on the Application for Christian Education by Nashim, Jewish Mishna)

  • 연구 목적 : 본 연구의 목적은 유대교 미쉬나 나쉼(Nashim)의 기원과 텍스트를 분석하고, 교육신학적인 측면에서 고찰하여, 기독교교육에 적용할 방안을 제시하고, 특히 여성의 결혼생활과 관련된 인권 문제를 분석하는 데에 있다. 연구내용 및 방법 : 연구의 목적을 달성하기 위하여 연구내용을 첫째, 미쉬나 나쉼의 기원과 텍스트를 분석하기 위하여 미쉬나 나쉼이 편집되기까지의 역사적 과정을 살펴보고, 미쉬나 나쉼의 텍스트의 내용을 분석하기 위해 연구자의 관점에서 7개 마섹콧을 먼저 결혼관계법, 이혼관계법, 약혼관련법, 간음관련법, 서원과 서약 관련법으로 나누어 텍스트를 정리하고, 그 내용을 살펴보았다. 둘째, 미쉬나 나쉼(Nashim)을 교육신학적으로 분석하기 위해 먼저, 결혼관계법으로 시형제 결혼제도와 혼인의 순결제도, 이혼 관계법, 약혼 관계법, 간음 관련법, 서원과 서약 관련법으로 나누어 분석하였다. 셋째, 미쉬나 나쉼을 기독교교육에 적용하기 위한 방안은 결혼생활교육, 이혼예방교육, 서원과 서약을 위한 교육으로 나누어 분석하였다. 결론 및 제언 : 본 연구의 결론은 다음과 같다. 첫째, 그리스도인 가정을 이루기 위한 결혼 교육이 필요하다. 둘째, 그리스도교의 측면에서 이혼 예방교육이 필요하다. 셋째, 영적으로 건전한 서원교육이 이루어져야 한다. 넷째, 참 그리스도인으로서 살아가기 위한 건전한 서약교육이 필요하다. 결과적으로 한국 사회는 아직 가부장적 권위 의식이 뿌리 깊게 깔려 있으며, 양성평등 의식도 여전히 뒤처진 실정이다. 이것은 교회 내에서 여성 차별과 비하, 이혼과 재혼에 대한 금기, 성 역할에 대한 고정관념 등이 여전히 존재하고 있으며, 그리스도교가 해결 대안을 제시해야 된다.

Guidance Law for Near Space Interceptor based on Block Backstepping Sliding Mode and Extended State Observer

  • This paper proposes a novel guidance law based on the block backstepping sliding mode control and extended state observer (ESO), which also takes into account the autopilot dynamic characteristics of the near space interceptor (NSI), and the impact angle constraint of attacking the maneuvering target. Based on the backstepping control approach, the target maneuvers and the parameter uncertainties of the autopilot are regarded as disturbances of the outer loop and inner loop, respectively. Then, the ESO is constructed to estimate the target acceleration and the inner loop disturbance, and the block backstepping sliding model guidance law is employed, based on the estimated disturbance value. Furthermore, in order to avoid the "explosion of complexity" problem, first-order low-pass filters are also introduced, to obtain differentiations of the virtual control variables. The stability of the closed-loop guidance system is also proven, based on the Lyapunov theory. Finally, simulation results demonstrate that the proposed guidance law can not only overcome the influence of the autopilot dynamic delay and target maneuvers, but also obtain a small miss distance.

Performance analyses of RHLQG/FIRF controller

  • In this paper we analyze the RHLQG/FIRF optimal.contol law presented in [4,5] in order to stabilizes a stochastic linear time varying systems with modeling uncertainty. It is shown by the frequency domain analysis that the RHC is robuster than the LQ control law. Explicit LTR procedures are given to improve the robust performance of RHLQC/FIRF cotrol law. Using the mismatching function technique [8], we propose an LTR method which makes the RHLQG/FIRF controller recover the feedback properties of the R.HC law. Also we compare the LTR performance of the RHLQC/FIRF via simulation with conventional LTR methods.
