The article considers the state of legislation that regulates the use of public methods of obtaining information by authorized state bodies. The correlation of public investigative (search) actions with operative-search measures as concepts denoting the application of public methods of obtaining information has been studied. In addition, it argues the need for more detailed delineation and legislative regulation of public investigative (search) actions and operational and investigative measures at the legislative and departmental levels. The purpose of the article is to analyze certain provisions of the Law of Ukraine "On operational and investigative activities" to identify inconsistencies in the content of the text of the law in order to correct and prevent ambiguity in the theory and practice of law enforcement.

The article examines the stage of verification of a crime report from the standpoint of the need for its legislative regulation. Moreover, it investigates the international experience in this field. The existing procedural models are described in detail on the example of the neighboring and faraway countries. An analysis of the provisions of the current criminal procedure law of Russia and foreign experience allowed the authors to identify existing problems in the implementation of departmental control and prosecutorial supervision at the stage of verifying a crime report. The aim of the study is to develop theoretical provisions and recommendations regarding the implementation of departmental procedural control and prosecutorial supervision over the activities of the investigator during the verification of reports of crimes, based on the study of experience, both in Russia and in a number of countries of the near and far abroad, which could find their reflection in law enforcement practice, as well as aimed at improving the current criminal procedure legislation. The authors substantiated the theory that a detailed examination of the foreign procedural foundations of checking a crime report will allow us to form the most suitable model for checking a crime report for our state, taking into account all possible features and successfully implement it into the current criminal procedural law of the Russian Federation.

The purpose of this study was to analyze the trends in the studies on safety education of infant-early childhood teachers in order to provide basic data for a variety of studies in the field of child education. We consulted a total of 59 dissertations and journals articles on the safety education of infant-early childhood teachers published from 2008 to 2018. Our results were as follows: First, we found that the largest number of studies concerned safety awareness, followed by status and awareness, safety actions, safety education analysis, safety accidents and countermeasures, emergencies, development of programs, and teacher education. Second, we found that the most popular targets were child-care of teachers, followed by teacher-trainees, and center directors. Third, among the types of studies, we found that investigative quantitative studies were the most prevalent, followed by correlational studies, qualitative studies, and experimental studies. In terms of methods of gathering data, we found that questionnaires were the most commonly used, followed by qualitative studies, literature reviews, qualitative/quantitative studies, and quantitative literature reviews.

변사사건에 있어 경찰의 현장 초동조치 활동은 사고를 줄일 수 있고 사인을 밝히는 데 결정적인 역할을 한다. 부적절한 현장조치는 중요한 증거의 멸실을 가져오게 되고 이로 인해 또 다른 사고를 불러오던가, 사인(死因)을 규명하는 데 어려움이 뒤따르거나 급기야는 사인을 규명하지 못하는 낭패를 가져올 수도 있다. 이런 점을 감안하여 현장에 임하는 경찰관들이 어떠한 의식을 가지고 있는지 알아보기 위해 지구대 경찰관 300명과 형사 100명을 대상으로 설문조사를 실시 분석하였다. 그 결과 최초 범죄현장에 출동한 경찰관들이 범죄현장 보존 및 관찰, 주변상황에 대한 조치능력이 뒤떨어질 수 있는 가능성이 있는 것으로 나타났다. 구급대원이 피해자 구호를 위하여 범죄현장을 출입하는 경우와 신문, 방송기자 등의 무분별한 출입으로 인한 현장훼손 등 문제가 대두되므로 신임교육과정에서부터 지금보다 더 비중 있는 사례위주 교육과 현장조치 요령에 대한 다양한 교육 프로그램을 개발, 상황에 맞는 세분화되고 체계적인 단계별 실무교육이 필요하며, 선진국에서 볼 수 있는 범죄현장의 엄격한 현장통제 방안을 구축하여야 할 것으로 판단된다. 경북도내에서 지난 5년간 발생한 변사체는 매년 타살, 자살, 과실 및 재해사 등은 증가하고 있는 것으로 분석되었고, 변사체의 사인을 규명하기 위한 부검은 부검기관과 부검의의 절대 부족 등의 사유로 지난 5년간 부검을 실시한 변사체가 연평균 13%(1,237건)에 불과한 데 비해 단순 검시 처리한 변사체는 87.3%(8,496건)에 달한다는 점은 억울한 죽음을 밝히지 못할 가능성이 있다는 점을 나타내는 것이기도 하다. 그러므로 우선 경찰의 부검비 예산의 현실화가 이루어져야 하고 장기적으로는 법의학, 해부병리학 등 부검의의 양산 정책의 일환으로 정부의 과감한 투자가 있어야 한다. 또한 비전문가인 검사가 부검을 지휘하도록 되어 있어 비능률은 물론 국민들의 불만을 초래하는 검시제도인 형사소송법 222조(변사자의 검시)도 현장에 임하는 의사(검시관)와 사법경찰관의 판단으로 신속한 검시(부검 포함)를 할 수 있도록 법개정이 이루어져 사인을 규명하는 데 지장이 없도록 하여야 할 것이다. 경찰은 국민의 생명, 신체, 재산과 인권을 보호하며 억울한 죽음이 없도록 하기 위해 다각적인 노력을 하고 있지만 이는 복잡한 현 사회구조에 비추어 볼 때 경찰 단독만의 힘으로는 부족하다. 따라서 관계기관 단체, 사업주는 물론이고 일반 국민들도 안전의식을 가지고 대비하는 것이 필요하며 각종 사고와 범죄시에는 발생단계부터 보다 더 폭넓은 국민적 협조가 이루어질 때에 재해사, 사고사가 줄게 될 것이며 범죄관련 죽음에 대해서는 사인을 규명하고 범인을 검거함으로써 억울한 죽음을 줄일 수 있어 죽은 자에 대한 보호가 제대로 이루어질 것으로 기대된다.

최근 과학교육에서는 실생활에서 발생하는 여러 문제나 위험에 대해서 과학적으로 인식하여 대응할 수 있는 '과학적 참여와 실천' 역량을 기를 수 있는 수업이 강조되고 있다. 본 연구에서는 초등 예비교사들이 설계한 '과학적 참여와 실천' 수업의 특징을 살펴보기 위하여, 예비교사들이 작성한 교수학습 과정 안을 분석하고 시사점을 도출하였다. 이를 위해, 2022 개정 과학과 교육과정 초등학교 3~4학년군에 제시된 '소음'과 관련한 성취기준에 대해서 예비교사들이 설계한 교수학습 과정안을 수집하고, '문제 인식', '자료수집 및 분석', '실행 및 공유' 관점에서 나타나는 특징을 분석하였다. 연구 결과, 초등 예비교사들이 설계한 교수학습 과정안에서는 '문제해결형', '탐구형', '조사형', '행동촉구형' 활동이라는 4가지 특징이 도출되었다. 이렇게 도출된 4가지 특징들은 다양한 수업의 맥락에 따라 2~3가지 특징이 함께 결합되기도 하고, 한 수업에서 한 가지 특징만 나타나는 경우도 있었다. 이러한 결과를 토대로, 초등학생을 위한 과학적 참여와 실천 수업을 설계하는 교사들을 조력하기 위한 시사점을 교수학습 방법적 측면과 교사교육적 측면으로 나누어 논의하였다.
