방사선 치료용 영상 장치 지침서 작성을 위한 실용적인 고려사항 (Practical Considerations in Preparing an Institutional Procedure of Image Guided Radiation Therapy)

  • Cone Beam CT (CBCT)와 On Board Imaging (OBI)를 비롯하여 최근에 개발되고 있는 방사선 치료용 영상 장치(Image Guided Radiation Therapy, IGRT)의 사용으로 방사선 치료가 더욱 정확해지고 있다. 점차 사용 범위가 넓어지면서 표준치료법으로 자리잡았고 앞으로 사용하는 기관과 빈도가 더 늘어날 것으로 전망한다. IGRT는 그러나 안전하고 용도에 맞게 사용할 때만 효능을 볼 수 있다. 이를 위해 IGRT를 임상에 적용하기 전에 장치의 특성을 이해하고 병원의 임상 요구에 적합한 지침서를 미리 만들 필요가 있다. QA 프로그램과 환자가 받을 추가 선량에 대한 고려도 미리 준비해둘 필요가 있다.

군진의학 연구에서 인간대상 연구윤리 (Ethics Involving Human Subject Research in Military Medicine)

  • The goal of the military medicine is not as same as that of the civil medical practice, and consequently the characteristics of military biomedical researches have their own uniqueness. In front of the prerogative of national defense, some of the human rights ordinarily ensured in normal researches with human subjects are not to be fully guaranteed. The hierarchic system of the military would complicate the issue when the soldiers are enrolled as human subject for the research. Some researches could be classified as a military secret, therefore, the confidentiality issues need to be well addressed. Institutional Review Board and review procedure should be modified for the military purposes. So, it is necessary to establish the appropriate regulatory system for the military biomedical researches with human subject to manage the complicated issues involved in them.

우리나라 의료기관 Institutional Review Board의 취약한 연구 대상자 관련 표준운영지침서 운영 현황과 윤리적 고찰 (An Ethical Consideration on the Standard Operating Procedure Operation Status and the Ethical Review of the Vulnerable Research Subjects of Institutional Review Board, a Medical Institution in Korea)

  • Purspose: The purpose of this study is to examine the meaning and definition of vulnerable subjects in clinical trials in light of domestic and international regulations and guidelines, to analyze the contents of standard operation procedures (SOPs) among advanced general hospitals in Korea that conduct clinical trials, and to examine deliberation procedures for operation plans. Methods: The study examined how vulnerable research subjects were defined and described in related regulations and the classification of vulnerable research subjects presented in the IRB/HRPP SOPs of 18 clinical trial institutions, including 11 AAHRPP-accreditated general hospitals in Korea, as well as the operation of the IRB deliberation. Results: Among all domestic and international regulations and guidelines, only the The Council for International Organization of Medical Sciences (CIOMS) guidelines explain why vulnerability is related to judgments on the severity of physical, psychological, and social harm, why individuals are vulnerable, and for what reasons. However, the classification of vulnerable subjects by institutions differed from the classification by the International Conference on Harmonization-Good Clinical Practice (ICH-GCP). A total of the 16 institutions classified children and minors as vulnerable research subjects. 14 institutions classified subjects who cannot consent freely were classified as vulnerable subjects. 15 institutions classified sujects who can be affected by the organizational hierarchy were classified as vulnerable subjects. Subjects in emergency situations were regarded as vulnerable research subjects in 8 of institutions, while people in wards, patients with incurable diseases, and the economically poor including the unemployed were categorized as vulnerable research subjects in 7, 4, and 4 of institutions, respectively. Additionally, some research subjects were not classified as vulnerable by ICH-GCP but were classified as vulnerable by domestic institutions 15 of the institutions classified pregnant women and fetuses as vulnerable, 11 classified the elderly as vulnerable, and 6 classified foreigners as vulnerable. Conclution: The regulations and institutional SOPs classify subjects differently, which may affect subject protection. There is a need to improve IRBs' classifications of vulnerable research subjects. It is also necessary to establish the standards according to the differences in deliberation processes. Further, it is recommended to maintain a consistent review of validity, assessment of risk/benefit, and a review using checklists and spokeperson. The review of IRB is to be carried out in a manner that respects human dignity by taking into account the physical, psychological, and social conditions of the subjects.

상사중재에 있어서 당사자자치의 역할 (A Study on the Role of Party Autonomy in Commercial Arbitration)

  • This paper is to research on the role of party autonomy in the decision of applicable law for the arbitral proceeding, arbitral award and arbitration agreement, in the decision of the place of arbitration, in the composition of arbitration tribunal, and the choice of arbitral proceedings. The principle of party autonomy is fundamental to arbitration in general and to international arbitration in particular. Generally the tenn of party autonomy is used as the autonomy of the parties to decide all aspects of an arbitration procedure subject only to certain limitations of mandatory law. Party autonomy permits the parties to a commercial arbitration to choose the laws and make the rules which govern the arbitral proceedings. Party autonomy allows the parties freedom to choose the applicable laws for the arbitral proceeding and the place of arbitration. Party autonomy is recognized in relation to the choice of law for the merits of the dispute as well as for the arbitration agreement and the arbitration procedure. On the basis of the recognition of party autonomy in international treaties, national legislation and court decisions, arbitral practice has generally accepted and enforced party autonomy both regarding the procedure and the applicable substantive law. All modern institutional rules of arbitration follow that line. Today it is recognized by national legislators all over the world to the effect that the jurisdiction of national courts can be excluded by arbitration agreement and that the parties may choose the law applicable to arbitral proceedings. Limits on party autonomy are imposed by mandatory provisions of international or national law or of institutional arbitration rules regarding the procedure. Mandatory laws at the place of the arbitration or under any procedural law chosen by the parties may restrict party autonomy. These mandatory laws usually take the form of public policy considerations in the arbitration. Limitations on party autonomy have been reduced more and more, and the trend of modern national as well as international legislation on arbitration leans clearly in the direction of a maximum of party autonomy.

Adaptation of New Institutional Theory in Shariah Governance Practice, Structure and Process

  • Purpose: The study aims to delineate Shariah Governance Framework (SGF) by applying the components of New Institutional Theory (NIT) to provide an understanding of how Islamic banks theoretically influence Shariah Governance (SG) practice, structure, and process. Design/methodology/approach: As it is a conceptual paper, this paper has prepared based on an analytical approach to show how such institutions could provide a more effective system concerning the contents, procedures, and practices for the multiple users in the SG process of Islamic banks. Findings: The paper critically explores the adoption of NIT to develop SGF with its existing practice, structure, and procedure. Utilizing NIT, a proposed theoretical framework has developed for exploring the SG through its major components, i.e., 'isomorphism' and 'legitimacy'. It is stated that NIT can offer a useful framework by which homogenous structures, comprising guidelines, standards, and practices become recognized and authorized as a satisfactory standard corporate exercise. Thus, the proposed theoretical framework would be beneficial in understanding and exploring the SGF. Conclusion: The application of this SGF could help to justify the key dimensions of NIT with its overall formation, function, and practices that might also help to attain legitimacy.

환경영향평가 주민참여의 제도적 문제점과 내용분석 (A Study on Public Participation in Environmental Impact Statement: Focused on Systematic Aspects and Content Analysis)

  • This paper examined public participation in the final Environmental Impact Statement(EIS) in terms of institutional procedures and content analysis. By reviewing EIS Draft Manual and related laws and regulations, seven problems were identified in the system. The content of public participation in 14 EISs were analyzed by a developed protocol, most results of which were similar to the identified seven problems. In conclusion, this paper suggested that the systematic problems should be improved to activate more efficient public participation.

도시철도역 시설의 피난에 대한 제도적 한계점 분석과 가이드라인 (Analysis of Institutional Limitations on Evacuation of Urban Railway Station Facilities and Guidelines)

  • 본 연구는 도시철도 지하역의 '피난' 및 '소방'에 관련한 제도적 현황을 분석하여 현행 도시철도 지하역에서의 '피난'에 대한 제도적 한계점을 도출하여 이를 바탕으로 건축공간적 측면에서의 가이드라인을 제안하고자 하였다. 연구의 결과 다음과 같은 점이 도출되었다. 첫째, 유사 기준이 개별법령에 분리 제정되어 기준 파악이 어렵고 서로 이원화되어 있기 때문에, 도시철도에 한정하여 도시철도 이용객의 이동 동선에 따라 머무는 공간을 표준화하여 규정할 필요가 있다. 둘째, 열차 이용을 위해서는 반드시 '티켓팅' 이라는 특수한 절차를 고려해야 하며 대합실과 승강장 사이에 피난안전구역, 피난계단에 대한 규정이 필요하다. 마지막으로 지하 30m이상 깊이의 대심도에서 승강장이 있는 경우, 현행 건축법과 유사한 기준에 따라 피난층을 설치하도록 할 필요가 있다.

안보형사법제도의 바람직한 개선방향 제시 - 안보사례분석을 중심으로 - (A Study on procedure of Criminal Cases related to the Security)

  • 오늘날 주요 선진국들은 신안보 현실에 부응하여 형사특례 도입 등 관련 법제를 강화하고 있는 추세이다. 이러한 형사특례 절차를 마련하고 있는 것은 안보와 관련된 수사에서는 피의자의 인권이라도 어느 정도 제한할 수밖에 없다는 판단에서 출발한 것이다. 즉, 간첩, 테러 등 안보사범에 대해서 수사 절차를 다르게 적용하는 것은 개인적 보호법익보다는 국가의 법익과 사회적 법익을 우선으로 고려하여 어느 정도 한도에서는 감청을 허용하고 영장주의 예외를 허용하고 증거인멸과 더 큰 테러와 간첩행위에 의한 국가적 손실을 예방하기 위해 변호인 접견권을 제한하거나 테러 혐의자의 가택이나 사무실을 폭넓게 수색하도록 허용하고 있다. 이와 같이 안보사범의 처리에 있어 형사절차의 개선과 강화는 매우 중요하다. 하지만 우리나라는 선진국과 같이 예비와 음모죄를 강화하거나, 내수사 단계에서의 수사여건을 개선하는 등 적극적 노력보다는 일반 형사범의 처벌과정과 거의 차이가 없음을 알 수 있다. 이러한 분위기가 지속된다면 최근의 신안보 현실에서 국가적 위협요인에 대하여 효과적으로 대응하기 어렵다. 이를 개선하기 위해서는 선진국의 안보법제도를 고려하여 우리의 상황에 적절한 형사절차 등의 특례조항을 도입해야 한다. 이 논문에서는 국내 안보사례 분석을 통해 안보형사법제의 개선방안을 논의해 보았다.

  • At present, the necessity of new design guidelines, evaluation and operation system for school facilities are on the rise according to re-edition of school curriculum in Korea. Moreover, it is necessary to procedure of the design, an institutional device and an ex post facto evaluation system for school facilities as a public building with the space planning that is suitable for various situations, which are able to collect users' various demands and opinions. Under the present situation, England has introduced and operated DQI system for the users' participation design of its. The present study will derive the meaning DQI system of England and how to operate it, and percuss the possibility of the application of design procedure of the education facilities in Korea.
