산업안전 분야에서의 PL사고유형 분석 (Analysis on the Case of PL Accident in the Area of Industrial Safety)

  • The PL(Product Liability) Law has been going into effect in Korea since July 2002. Accordingly, a company's responsibility for customers who are damaged by the defect in the product safety has been gradually strict and imposed burden on management. Not only general consumers but also labors who work with machine in the field of production are included in the concept of victim of the PL Law. That is to say, when a worker is damaged by the defect of machine he can institute a PL lawsuit more aggressively, not just get the industrial accident compensation as usual, only if not his own fault but the defect of machine used in the course of production can be demonstrated. This paper intends to present suggestions to PL prevention of manufacturing companies of industrial machine through the case research of PL accidents in the area of industrial safety.

  • Tooth related factors such as palatoradicular groove can be one of the causes for localized periodontal destruction. Such pathological process may result in apicomarginal defect along with inflammation of pulp. This creates challenging situation which clinician must be capable of performing advanced periodontal regenerative procedures for the successful management. This case report discusses clinical management of apicomarginal defect associated with extensive periradicular destruction in a maxillary lateral incisor, along with histopathologic aspect of the lesion.

  • In the construction industry, construction management system using information technology has been applied diversely to increase productivity. Although IT device such as PDA, RFID, Barcode, wireless network and web camera has been introduced in construction site, the usage of these device is restricted, because these cause engineer to do additional work. The suggested process using Digital Pen in this study, which can lessen engineer's additional work, get defect data promptly. Also accumulated data is utilized effectively for analyzing construction site. The purpose of this study is to introduce Digital Pen System as a means of construction data acquisition for improving productivity.

  • 공동주택의 가치와 품질, 관리에 대한 요구와 관심이 증가하면서, 2000년대 이래로 입주자에 의한 권리주장이 하자분쟁으로 나타나, 꾸준히 증가하여 왔다. 이에 본 연구에서는 하자소송판례를 통해 균열 쟁점의 비용적 특성을 알아보기 위하여, 하자보수비용 중 77%를 차지하고 있는 균열하자보수비에 대한 세부쟁점을 분석하였다. 또한, 각 세부 쟁점에 대한 하자보수 비용의 구성 및 하자보수방법에 따른 비용의 차이 등을 분석하였다. 그 결과, 허용균열폭의 인정여부에 따라 균열보수비용의 차이가 발생함을 확인할 수 있었고, 보수보강방법을 표면처리, 충전식, 주입식 공법 중 어느 것을 선택하느냐에 따라 비용 차이가 크게 발생함을 알게 되었다. 한편, 도장방법에 따른 하자보수비용의 차이도 상당한 것으로 나타났다.

공공건설사업 하자에 대한 수급인의 책임에 대한 연구- 민법과 국가계약법령의 비교를 통하여 - (A Study on the Contractor's Liability for Defect in Public Construction Project - through comparing Civil Law with Government Contract Law -)

  • 공공건설사업은 국가경제에서 막대한 영향을 미치며, 투입되는 인력도 다양하다. 그리고 공공건설사업이 복잡해지고 다양해짐에 따라 하자발생 가능성이 매우 높다. 그러나 수급인이 부담하는 하자에 대한 책임을 민법과 국가계약법령에서 채무불 이행책임과 하자담보책임으로 이원화하고 있음으로 인해 해석내용이 다양하며, 실제 건설현장에서는 하자책임에 대한 해석이 불분명함으로 인해 분쟁의 요인이 되고 있다. 따라서 본 연구에서는 하자책임과 관련하여 해외의 동향을 살펴본 후, 우리나라 민법 및 국가계약법령의 하자책임 및 그와 관련된 문제점을 살펴보고, 하자에 대한 수급인의 책임정립방안을 제시하고자 한다. 본 연구 결과 도출된 공공건설사업의 하자에 대한 수급인의 책임 정립방향을 요약하면 다음과 같다. (1) 하자 발생시 하자에 대한 책임을 불완전이행으로 인한 채무불이행책임으로 일원화하여 수급인에게 적용하는 것이 바람직하다. (2) 손해배상의 범위는 보수비의 과다 및 하자의 중요성을 고려하여 결정해야 한다. (3) 소멸시효의 기준이 되는 하자책임시점은 계약이행중에는 기성검사이후부터 불완전이행으로 인한 채무불이행책임을 부담시키고 있으므로, 기성검사를 완료한 날부터 기산할 수 있다. (4) 현행 계약이행보증제도의 하자보수책임을 제외하고 계약이행도중 기성검사를 완료한 부분에 발생하는 하자를 담보하기 위하여 유보금제도를 도입해야 할 것으로 판단된다.

Interrelationship Analysis between Causal Factors of Construction Defect Using Association Rule Mining

  • Construction defect which can causes economic damage such as schedule delay, cost overrun is a considerably important factor in construction industry. In general, a construction defect features a difficulty to find out causes precisely because it occurs when several interrelated causes combine. Yet, studies have tried to understand the interrelationships between factors are limited. In addition, despite of a tremendous amount of construction data, it's not still enough to analyze them, but tends to depend on experience or know-how of practitioners. Thus, it is necessary to identify underlying causes in influential factors by utilizing related data. This paper analyses Interrelationships between causal factors using Association Rule Mining to discover root causes of construction defects. Confidence and Lift that can be used for presenting the interrelationships of the causes were extracted from 1241 cases in 30 projects in Korea. It is expected that this paper allows the construction managers to discover key factors and make right decisions to reduce occurrence of construction defects. Furthermore, analysis of interrelationships can improve understanding of structural patterns of construction defects.

  • 사물인터넷을 기반으로 실시간으로 소화기 주변의 상태와 화재 발생 여부, 소화기의 상태를 확인할 수 있는 웹 시스템과 화재 알림을 받을 수 있는 애플리케이션을 구현한다. 해당 시스템의 목표를 명확하게 정하고 구조를 상세히 정의함으로써 개발 도중 일어나는 오류를 최소화한다. 또한, 스마트소화기에 대한 요구분석과 설계, 구현 단계에서 제품 결함을 찾아내고 그 원인을 분석하여 결함을 줄이는 방법을 제안한다. 제안하는 연구를 통해 IoT 기반의 스마트 소화기에 대해 결함관리 신뢰성을 확보할 수 있다.

초고층 주상복합 건물의 하자 발생 유형 및 분석 연구 (The analysis of defects types and patterns in high-rise residential buildings)

  • Recently, public interest in housing defects, such as construction errors, occupiers' complaints, faults in production, and so on, is increasing. In addition, the construction requirements of high-rise residential buildings have increased, due to the higher prices of urban areas, especially in metropolitan areas. While previous research has focused on the defects occurring in apartment housing complexes, research has not been carried out on the defects occurring in high-rise residential buildings. In this paper, the defects patterns and characteristics of high-rise residential buildings are examined and analyzed and a defect management plan is then suggested. In order to do this, we collected the defects data of high-rise residential buildings recorded by 2,299 of 2,327 occupants. The defect occurrence rate (DOR) in the residential area is 98.8%. The frequency rate of defect occurrence over the total defect occurrence since building completion is 63.28% during the first year, 24.63% (second year), 6.88% (third year), 2.27% (fourth year), and 2.53% (fifth year). The result of correlation analysis between work types showed that there is a relationship between the built-in furniture and electronics (F&E) and painting works, and the F&E and masonry works, such as marble finishing. We expect that this research will assist in the efforts to decrease the number of defects in high-rise buildings.

  • According to the South Korean Ministry of Land, Infrastructure, and Transport, instances of defect dispute resolutions, primarily between construction contractors and apartment occupants, have been occurring at an annual average of over 4,000 cases since 2014 to the present day. To address the persistent issue of disputes between contractors and occupants regarding construction defects, it is crucial to use customer sentiment analysis to improve customer rights and guide construction companies in their efforts. This study presents a methodology for effectively managing customer complaints and enhancing feedback analysis in the context of defect repair services. The study begins with collecting and preprocessing customer feedback data. Semantic network analysis is used to understand the causes of discomfort in customer feedback, revealing insights into the emotional sentiments expressed by customers and identifying causal relationships between emotions and themes. This research combines text mining, and semantic network analysis to analyze customer feedback for decision-making. By doing so, defect repair service providers can improve service quality, address customer concerns promptly, and understand the factors behind emotional responses in customer feedback. Through data-driven decision-making, these providers can enhance customer rights and identify areas for construction companies to improve service quality.
