  • It is an social issue that is various claim related on the defect of apartment house. The cost of defect repair is the most important matter that residents dispute constructers with the huge time wasting and cost loss. For resolve the matter of defect claim, it must to be analyze to the cost property that study and find to pending issue about the cost of defect repair. Therefore this study is investigated the cost property of defect repair relation on correlation analysis and regression analysis around the judgement cost. Consequently, cost of the judgment is associated with cost of the accusation and cost of the defect repair, is recognizable as them that is closely connected. Meanwhile, the more time of take effect and time of lawsuit increase, the more cost of the judgment decrease by draw the regression equation. On the contrary, there are same aspects in the case on the cost of the accusation and cost of the defect repair.

  • Defect dispute has been a continuous claim that concerning a apartment building. However, objective standard of judgment is inadequate to solve defect dispute. Furthermore, it need to scientific evidence that composited standard of judgment. This evidence has a necessary to collect a data for a long time and systematically analyze. Therefore, it need to develop smart information management system, in this study, it review user-oriented condition as swot analysis.

초음파 감쇠율의 차가 결함판정에 주는 영향 (The Effects of the Difference of Ultrasonic Damped Rate on the Judgment of Defects)

  • In this study, on automatic ultrasonic testing system is used to detect defects of flawtest specimen. We study the effects of the difference of ultrasonic damped rate of the different materials on the judgment of defects. The results indicate that the difference of sensitivity compensating quantity is 2dB, and the judgment is correct over $90\%$ when a specimen is judged as a defect when it exceeds third grade.

  • 본 연구는 다양한 어셈블리 부품의 용접부 내부결함을 검사하기 위한 초음파 탐상 장비 개발에 관한 것이다. 본 연구에서는 초음파 탐상을 위하여 시스템의 모션제어 S/W, 초음파 송수신기 제어, 결함 판정 기준 설정 등의 계측 S/W 등이 설계되었으며, 양품과 불량품의 비교분석을 하기 위하여 용접결함 불량품 샘플워크 등도 제작되었다. 이와 같은 구성으로 이루어진 시스템을 통하여 어셈블리 부품 용접부의 결함 위치 및 깊이에 대한 자동검사 기능을 수행할 수 있었으며, 종전에 전문가에 의해 이루어졌던 용접부의 내부결함에 대한 판단을 시스템이 수행하도록 하였다.

  • There has been a defect dispute of apartment building in Korea. The defect dispute is complicated by main issues and details of dispute. It is yet to be solved. Meanwhile, a judge does not a inspection and analysis, but, related field expert who contracted professional engineer does. As a result, defect consulting report that an important judgment is used in a defect dispute. Therefore, this study does research on structure of defect consulting report. A defect consulting report has same items, irrespective of a defect consultant as a result that check 7 indexes about 10 cases. It has different structure's details depending on each defect consultants. And, it inserts new detail or deletes existing detail, does not show clear distinction.

  • A defect dispute surrounding an apartment building is in constant trouble, a defect consulting is necessary that objective and impartial for solving a defect. The defect dispute about a defect lawsuit is conducted in the order that filling of lawsuit, consulting order, defect inspecting, estimating a repairing cost, writing a consulting report, submitting a consulting report, and decision by court. Of these, a step of defect inspecting is extensively investigated an occurred defect that each defect index and type from each part and place. At this time, it is collected of many data and created many information. For this, it need to organize and manage. The study is a modeling of field investigation work process that second phase of defect inspecting step. A literature study is defined a work until level 2. This study is defined the work until level 3 to 4. In addition, the modeling can do for using a job name, a place to job, a job to do, and a person concerned about defect consulting case. The modeling is expected a contribution of improving a defect consulting process and systematizing a judgment standard.

Analysis of Consulting Reports on Defect Disputes in Apartment Building

  • The main processes involved in a defect dispute are consulting, reviewing, and finally judging as an arbiter. This process of defect consulting produces a defect consulting report, but business practices and standards of judgment will differ among consultants, and have many problems. This study reviews the structure of a defect consulting report and considers the structure's problem, which is that it is not standardized. To achieve this, data of sixteen defect consulting report were collected involving defect lawsuit cases before or after 2010. The structure and index of the defect consulting reports were then reviewed, and the results are as follows. As for a structure based on fourteen index, there are suitable that judge a outline, a cost estimate data and a consulting work item by a consulting standard. Furthermore, analysis by each common parts and private parts is considered as appropriate about consulting items and estimate by standard. However, consulting item in construction progress and responsibility period for security that related on a cause and a responsibility of defect need to complement. Meanwhile, the first thing of issues are connected a defect consulting is urgent a standardization for a defect type.

  • 공동주택 하자소송에서는 다양한 쟁점사항이 있고, 이들을 정리하면 현행 법률적 판정체계가 된다. 본 연구에서는 선행연구에서 수행된 사항을 검토하여, 하자소송의 단계에 따라 법률적 관점의 판정체계를 정리하였다. 채권양도, 제척기간의 기산일, 하자보수종결합의 등이 관련된 주요 쟁점 사항이다. 한편, 이에 대한 최근의 판례자료를 검토하여 판정체계의 논리를 증명할 수 있었다. 이를 통해 다음의 사항을 개선 및 보완토록 제안하였다. 우선 기존 쟁점에 대해서는 채권양도과정의 체계화와 하자담보 보증보험제도의 개선이 필요하다. 또한, 비 계약사항에 대한 하자담보책임관계와 손해배상 경감률의 산정 및 임대 후 분양 전환시 기존 하자종결관계를 체계화해야 한다.

  • 2020년 6월 11일 대법원은 대상 사건에 대해 계약특수조건에서 정한 하자보수 보증기간이 지났다고 하더라도 원고가 피고에게 불완전이행으로 인한 채무불이행책임을 주장할 수 있다는 원심의 판단을 정당하다고 판결하였다. 그러나 우리나라 민법학에서 하자담보책임에 대한 제척기간과 채무불이행책임에 대한 소멸시효의 경합이 인정되고, 제척기간과 소멸시효는 법리상 각각의 목적을 가지고 있으므로, 이 둘은 상호 연관 관계에 있음을 전제로 조화롭게 중용하여 판단되어야 한다. 대상 판결이 일반화될 경우 도급계약에서의 하자담보책임에 관한 약정은 더이상 존재할 이유가 없다. 본 연구는 하자담보책임과 채무불이행책임에 대한 일반론 및 선행판례 연구를 통해 대상 판결을 고찰하고, 대상 판결이 일반화될 경우 발생 가능한 문제점 도출하였다. 또한 현실적인 모델을 바탕으로 실무적 개선방안으로 도급계약 약정상 하자담보책임기간의 현실화하고 그 성격의 규정을 명문화할 것을 제시하였다.

  • There are main issues of defect type that condensation, concrete crack and noise in apartment buildings. Especially, according to the Apartment Defect Dispute Mediation Committee in Korea (ADDMC) at Ministry of Land Infrastructure and Transport in Korea (MLIT), condensation defects are great importance (14 percent) on whole number of reported cases of faults from 2015 in Korea. Most condensation defects have many different causes that take a toll on the resident's life and space. So it is very important to early detection and repair. For preventing the condensation in apartment buildings, there are building codes in Korea such as 'Standard of Method and Judgment for Apartment defect of investigation, Repair cost Estimate'. This research aims to study on the improvement of preventing the condensation aforementioned korea standard. Types and characteristics (opaque wall, windows, doors) of cause of occurrence and existing state condensation defect is analyzed from evaluation of real application 100 case in 2015 ADDMC data.
