Review for the Enactment of Anti-Terrorism Law in China: Comparing it to those in the USA, Britain and Germany (중국의 반(反)테러리즘법 제정을 위한 검토: 미국.영국.독일과 비교하여)

  • China has vast land, variety of people, religions and cultures. China has faced terrorism threat from the struggles of people, religions and resources. The 11thStanding Committee of the National People's Congress of China decided to strengthen the anti-terrorism action on October 29, 2011. This study compared, analyzed and estimated the counter-terrorism laws of the USA, Britain and Germany thinking about the China's anti-terrorism decision. The counter-terrorism laws of the USA, Britain and Germany are largely composed of previous prevention of terror and oppression of it later. They enacted the laws both for people and property. They also rearranged the power and role of governmental institutes on counter-terrorism. The contents of the counter-terrorism laws are specific, detailed and systematic. But the anti-terrorism law of China has restriction on the power and roles for previous prevention and oppression of terrorism, handling of people and property. This study reviewed the foreign countries' counter-terrorism laws and the way to connect the regulations on terrorism crimes of the revised Chinese criminal law and the anti-terrorism decision, when they enact the anti-terrorism laws in China in the future.

  • A sudden change of social structure makes the nations have experienced terrorism to establish an anti-terrorism law and associate with international agreements to protect themselves from terrorism. Korea is exposed to terrorism as it has grown in stature by holding the international occasions and has been easy to travel abroad since 1980. Korea regulates the terrorist by a guideline which was established in 1982 by the presidential instruction and other criminal law. However, the majority of people doubt the propriety of overinterpretation of the law and punishment for terrorism. To cope with the situation strongly, it is better to establish an anti-terrorism law to block terrorism and apprehend the terrorist beforehand. Also we should realign an anti-terrorism organization that should be organized by the type of terrorism. In addition, we can expect to avoid waste of a budget and human efforts if we introduce terrorism warning system and face with each stage of situation. Lastly it is possible to prevent terrorism if we build up preventive actions along with the local residents.

  • Purpose: This study aims to apply the counter terrorism policy in pertain to malicious drone abuse and the croweded public places in South Korea. And, to improve counter terrorism protection measure, this study suggests an adoptation of Anti UAV technology into counter terrorism related regulation. Method: Compared to nations' operations of counter terrorism prevention and protection activities with the South Korean gov, problems and limitations are suggested. Results: Anti UAV technology could not be applied for Multi-user facilities by any law due to the limitation, so that it is required to amend counte terrporism related policies and law. Conclusion: This study intends to identify various protection methods against UAV threats. To reduce the risk of UAV, the law of public safety and counter terrorism should be promoted and reinforced for the first.

  • China is defending the terrorist crime through the Anti-Terror Law and anti-terrorism criminal legislation. China's Anti-Terror Law and the Criminal Code Amendment (9), which were promulgated in 2015, provide legal grounds for preventing and hurting ever-growing terrorist crimes. In particular, China's amendment to the Criminal Code (9) is designed to rigorously enforce the legal framework for terrorist crimes, protect prejudicial rights that might be violated by serious terrorist crimes, and protect the penalties for terrorist crimes. However, China's anti-terrorism legislation still has drawbacks such as lack of systematicity, limited regulatory boundaries, and lack of rigorous penalties for the establishment of anti-terrorism legislation. To counter this, China's anti-terrorism legislation must strictly regulate the legal system of terrorist crimes, secure penalties, and prescribe anti-terrorism laws as professional chapters.

  • On the one hand, the 4th Industrial Revolution provides a positive opportunity to build a new civilization paradigm for mankind. However, on the other hand, due to the 4th Industrial Revolution, artificial intelligence such as 'Goggle Alpha Go' revolutionized and even the human ability was replaced with a 'Silicon Chip' as the opportunity to communicate decreases, the existence of human beings is weakened. And there is a growing concern that the number of violent crimes, such as psychopath, which hunts humans as games, will increase. Moreover, recent international terrorism is being developed in a form similar to 'Psychopathic Violent-Crime' that indiscriminately attacks innocent people. So, the probability that terrorist organizations abuse the positive effects provided by the Fourth Industrial Revolution as means of terrorism is increasing. Therefore, the paradigm of aviation terrorism is expected to change in a way that attacks airport facilities and users rather than aircraft. Because airport facilities are crowded, and psychopathic terrorists are easily accessible. From this point of view, our counter terrorism system of aviation has many weak points in various aspects such as: (1) limitations of counter-terrorism center (2) inefficient on-site command and control system (3) separated organization for aviation security consultation (4) dispersed information collection function in government (5) vulnerable to cyber attack (6) lack of international cooperation network for aviation terrorism. Consequently, it is necessary to improve the domestic counter terrorism system of aviation so as to preemptively respond to the international terrorism. This study propose the following measures to improve the aviation security system by (1) create 'Aviation Special Judicial Police' (2) revise the anti-terrorism law and aviation security law (3) Strengthening the ability respond to terrorism in cyberspace (4) building an international cooperation network for aviation terrorism.

  • International society got a severe shock from terrorism of hostage, abduction and murder that was committed on a target of Israel athlete delegation in Munich Olympics, West Germany by Black September, a Palestine terrorism organization. Korea with 1986 Asian Games and 1988 Olympics ahead was directly and indirectly exposed to threats of North Korea's nation-support terrorism, a military provocation and a local war limited warfare. This study explores the roles of the police at the time of the National Police Headquarters with regard to counter-terrorism, and analyzed academic research trends of Studies of Counter-terrorism published by the same office between 1983 and 1990. Looking into them shows a fact firstly, that the most frequently appearing key words in common were "terrorism," "hostages," "measures," and "international," etc. Secondly, before and after 1988 Olympics, the key word "Olympics" was frequently addressed. Thirdly, looking at the difference by the year, the key word, "policies of defense and borderlands" was frequently addressed between 1983 and 1984, "terrorism against South Korea," and "civil aircraft" frequently addressed in 1985, and "corporate" in 1986. In 1987, the key word "terrorism trends" was addressed, and in 1990, "international terrorism," and "separatism" were used.

  • This research is based on the purpose of awaking the importance to publicity of terrorism prevention in the environment of neo-terrorism and presenting the direction of effective publicity activities of terrorism prevention in the counter-terrorism system. Government publicity through public media plays a significant role in promoting people's participation and improving the awareness. So, to strengthen the terrorism prevention in environmental changes of terror occurrence, active method available for people must be found as publicity method of terrorism prevention suitable for high information society. For this method, this research argued first about relationship between police organization and public as counter-terrorism system and about effective publicity methods of terrorism prevention through active erection of these relationships. This research suggested the operation method through introduction of e-CRM and etc, with ultimate purpose about maximizing the publicity effect of terrorism prevention by using as the advantage of internet these days as possible. And needs of information service activities and other administration strategies of publicity of terrorism prevention are suggested through enlarging the distribution scope of governmental counter-terrorism information materials by strengthening the national publicity activities and using media.

  • This study touches upon the challenges of globalization, in which terrorism is one of the most brutal forms of criminal violence targeting innocent people. No country is immune from terrorist attacks, and no person is immune from becoming a victim. Interest in this topic is increasing as terrorism, in all its forms and manifestations, in its scale and intensity, and in its inhumanity and cruelty, is now becoming one of the most acute and pressing problems of global importance. Legal regulations passed in Mongolia in 2004 have established a structure to prevent and detect terrorist threats. However, the country's anti-terrorism policy should be improved with respect to its global counter-terrorism strategy. Because Mongolia is a comparatively safe country in the region, the people do not consider terrorism to be a real threat. This study aims to suggest methods to quickly raise awareness and create a security culture to improve Mongolia's long-term terrorism prevention policy. In particular, the authors review Mongolia's anti-terrorism policy, focusing on legal regulations, and suggest education methods to raise terrorism awareness for the public as a primary preventive measure. The study also presents a comparative analysis and a summary conclusion by examining international legal acts, conventions on new manifestations of terrorism, the foundations of laws and regulations of Mongolia, and related research on terrorism.

  • Today, the structure of terrorist organizations in the form of a variety of network complexity are evolving. However, terrorist organization not combining randomly generated network but preferential attachment a network. So, it's research should be preceded a better understanding about the characteristics and type of terror network for a effective counter-terrorism policy of law enforcement. In addition, the appropriate response strategy have to technique establish in an era of smart media. In particular, homegrown terrorist attacks on unspecified people without boundaries of countries and regions unlike the traditional terrorism. Also, homegrown terrorism are violence and criminal activity by new various of religion, politics, philosophy. Besides the extreme members of homegrown terror networks went grow up through the evolutionary process in the age of smart media. Law enforcement agencies must identify the terrorist network at the national level. Therefore, terror networks evolving in the online space, forming a radical homegrown terror organizations have access to the network. Intelligence community track terrorist networks and to block the negative aspects of the smart media outlets should be considered.

Comparative Study on Major Nations's Related Legislation for Counter-terrorism (테러대응 관련 법제의 국가별 비교 연구)

  • As a result of comparing and analyzing the related legislation of each nation, more superior legislative systems should be made to cope with a number of terrors effectively. And also it is required to devise some concrete regulations such as the following in superior legislative systems. First, because it is hard to collect information on terrorism and watch over suspects according to Communication Privacy Protection Law. More in-depth discussion into the issue of surveillance is needed for the protection of lives and property, although public concerns of privacy are a valid point of contention. Second, it is necessary to take complementary measures on immigration as surveillance, since the current Immigration Control Law has restrictions in many ways to hinder efforts to root out terrorists. Third, under the current law on financial activities, it is impossible to block influx of terror financing. Therefore it is necessary to come up with ways of making the punishment procedures. Fourth, considering that convicted terrorists get punished under the standard procedures and precedents, it is required to clearly differentiate between what the terror acts are and what terrorist groups are. Fifth, it is necessary to make use of the private security system to enhance the security system of national facilities.
