본 연구는 가맹본부의 과도한 통제로 인하여 가맹점사업자가 독립적 사업자가 아닌 피용자로 전환될 수 있음을 시사한 Williams v. Jani-king of Philadelphia Inc. 사건을 고찰하였다. 이 사건에서 법원은 가맹점사업자의 지위를 판단하기 위해 계약상 가맹본부가 행하는 통제의 성격이 유일하고 명백한 증거라고 판단하였으나 계약상 내용뿐만 아니라 실질적으로 가맹본부가 가맹점 사업자에게 행사는 통제의 정도도 함께 고려되어야 할 필요성이 있다. 또한 계약상 통제의 성격을 판단함에 있어 그 기준이 명료하지 않기 때문에 가맹점사업자의 지위 판단이 상황에 따라 달라질 수 있으므로 기존의 가맹사업상 내제된 통제와 그 이상의 일상적인 관리상 통제로 구분하여 가맹점사업자의 지위를 판단하는 것이 적절할 것이다.

수주산업이라는 건설업의 특성상 일반 건설업체는 기본적으로 수주 물량을 스스로 계획할 수 없으며, 연간 수주물량의 변동폭이 커 장비나 인력을 상시 고용하는데 한계를 가진다. 따라서 전문 건설업체와의 수직적 분업 관계를 통해 위험을 분산시키고 생산의 효율성을 높이고자 하는 의도 하에, 일반적으로 하도급에 의한 생산구조를 형성하고 있다. 이러한 생산구조에 따라 외주관리가 프로젝트의 성공적인 완수에 미치는 영향이 큼에도 불구하고, 그간 대다수 건설업체들은 효율적인 조직협력 관계를 이루지 못하고 있다. 이에 본 연구에서는 일반 전문건설업체간 조직협력의 현 실태를 파악하고 보완사항을 발굴하여 개선방안을 모색하고자 한다. 본 논문은 예비적 차원의 선행연구로서 협력업체의 현황조사를 바탕으로 그 원인을 고찰해 보고자 한다. 분석 결과 건설 산업의 협력에 대한 현 실태는 외형적인 협력조직 구성에 머물고 있으며 생산협력에 대한 효율적인 조직 활용을 못하는 것으로 나타났다. 전문건설업체는 수주 물량 확보를 위한 발판으로 협력업체로 등록을 하고 있었으며 생산향상을 위한 실질적인 협력행위가 거의 없는 수준이었다. 이에 건설업체간 조직협력의 각 단계에서 건설 생산성향상과 경제적 가치의 창출을 위한 생산협력의 해결방안이 요구된다.

우리나라의 건설산업은 전체 사업을 총괄하는 종합건설사업자가 발주자로부터 도급받아 세부공종을 담당하는 전문건설사업자에게 시공을 맡기는 계층적 구조로 이루어져 있는 경우가 많다. 이러한 구조에서 전체 공사에 대해 종합건설업자가 관리하고 책임을 지지만, 직접적으로 공사에 관여하는 자는 개별 전문공사업자이므로, 이들의 시공 능력과 관리 능력에 따라 시설물 등의 품질과 안전성이 달라지게 된다. 공사를 발주받는 자와 실제 시공하는 자가 달라서 발생할 수 있는 품질과 안전 문제를 해결하기 위해서는 일정 금액 이하의 공사에 한해서는 발주받는 자가 직접시공하도록 하는 것이 필요하며, 이를 위해 도입된 제도가 건설시공직접의무 제도이다. 이와 같이 해당 제도는 부실공사와 위험전가를 방지하기 위해 도입되었지만, 국내 건설산업의 특성과 제도적 한계, 현실적 문제점으로 인해 다양한 문제점을 안고 있는 제도이므로 이를 법적, 제도적으로 개선할 필요가 있다.

The corrosion problem of rebar is a world wide concern of every engineer engaged in reinforced concrete business, clients, engineers construction contractor and maintenance organizations, all alike. Research and development of new systems, materials, and design concept of rebar corrosion is actively progressing world wide. We have to open our mind and change the paradigm so that creative and active approach will make all of us beneficial.

"United Nations Convention on Contracts for the International Carriage of Goods Wholly or Partly by Sea" was passed in July 3, 2008. on September 23, 2009 signing ceremony was held in Rotterdam. The system of maritime performing party is a special system in the transport convention, and constitutes an integral part of the Convention. Maritime performing party system is not the first system which brings in the carrier's independent contractor, but it is the most comprehensive and thorough one. It unified the duty of carrier's independent contractor in the maritime segment, and it is also an important progress in the developing process of international maritime legal system. There are some differences between the maritime performing party and China's current related system, i.e, the port maritime performing party and the intermediate performing party are included in the maritime performing party, and they can enjoy the carrier's exception clause and limitation of liability.

This research investigates the effect of the antecedents (i.e. specific investment, opportunistic behavior, communications, uncertainty, interdependence, power imbalance, shared value, and flexibility) that influence the trust and commitment of domestic apparel manufacturers toward contractors as well as the effect of trust and commitment on firm performance and relationship satisfaction. A total of 128 apparel manufactures participated in this study. Factor analysis, Cronbach's alpha coefficient, and path analysis were conducted for the statistical analysis. Specific investment, communication, shared value, and flexibility had a positive effect on trust; however, opportunistic behavior had a negative effect. Interdependence, shared value, and flexibility had a positive effect on commitment; however, power imbalance and uncertainty had a negative effect. Trust did not exert an effect on commitment in this research; however, trust and commitment had a positive effect on firm performance; in addition, trust and commitment had a positive effect on relationship satisfaction. The findings offer insight on how to better manage apparel manufacturer-contractor relationships to ensure success.

The study focuses on analysing situation of disasters and characteristics in construction process which the technical construction firms accomplish. Besides, the study aims at the role and responsibilities of technical construction firms in construction safety. It is found out by a questionnaire and interviews in this study that safety control and management have a key role to prevent accidents in construction projects. Based on the result of the research, it is concluded that institutional improvement and support strategies are suggested and that additional to the support of the government and institutions in charge of the field of construction safety the effort of the first contractor, the second contractor and the laborer it is also important.

고도성장기를 지난 한국경제와 한국기업은 더 큰 도약을 이끌 새로운 패러다임을 고민해야 하는 시점이다. 최근 일반건설업과 전문건설업의 상생이 중요한 화두로 떠오르는 시점에서 상생협력의 특징과 내용 그리고 수준을 평가하는 중요한 과제이다. 본 논문의 목적은 일반건설업체와 전문건설업체간의 상생협력에 대한 수준평가를 위해 활용될 수 있는 상생협력 평가 항목을 개발하는데 있다. 본 연구에서는 건설산업과 타 산업 분야의 상생협력 3개 사례를 중심으로 상생협력평가항목을 개발하고 제안하였다.
