유럽법제에서 형평성 원칙에 따른 표준계약조건의 유효성에 관한 소고 (A Study on the Principle of Equilibrium in Standard Terms Contract in European Law)

  • In English Law it seems that it is essential to apply the principle of equilibrium in the contract, however, it does not seemed to apply as the general rule of the principle of contract. Especially it seems that English Court didn't pay attention to the principle of equilibrium in 18th century. If one of the party do not appeal the equilibrium of the contract, it does not make any difference even today. However the Court may cancel or withdraw the construction of contract between the parties where the principle of equilibrium is damaged by fundamental problems like just-price. In French Law it seems that they have more wide definition of the principle of equilibrium. The French Court may consider that the application of good faith is the performance of condition of the contract between the parties and has no power to relieve of one party of his expressed obligations or warranty. In German Law, it seems that the principle of good faith is fundamental to take into account interest of the parties. They may agree to supply information or not to interfere with a commercial agent regarding performance and maintenance of the contract.

  • Continually having growed up overseas construction market for new Nuclear Power Plant(NPP), the exports of Korean Reactor emerges as the key task of National Nuclear Business. The objective of this study is to strengthen the competitiveness of Korean Reactor through the improvement of Construction Project Contract & Delivery System for NPP. This study suggests the method for increasing Korean Reactor's competitiveness of exports by analyzing the business environment of foreign market and comparing Contract & Delivery System between domestic and foreign.

A Delphi Study on the Price Escalation Clause in a Construction Contract

  • The purpose of this study is to suggest policies to improve the price escalation system in a construction contract through a Policy Delphi technique. The Delphi, including two times questionnaires and a group discussion, was conducted by joining 14 experts. Also, the escalation provisions of various countries were examined. Results of the Delphi showed that the minimum fluctuation rate for price escalation was desirable at a level of 3%. To compute the fluctuation rate, calculating the price fluctuation of overall articles was more desirable than using price indices. A bidding date was more reasonable as the initial date of change in price. Losses caused by price change should be shared between contractor and owner; therefore a deduction rate should be introduced in price escalation. Meanwhile, overhead and profit should be adjusted in proportion to the fluctuation rate; but advance payment or the delayed construction amount should be deducted from the adjusted amount.

  • Risks, uncertainties, and associated cost overruns are critical problems for construction projects. Cost contingency is an important funding source for these unforeseen events and is included in the base estimate to help perform financially successful projects. In order to predict more accurate contingency, many empirical models using regression analysis and artificial neural network method have been proposed and showed its viability to minimize prediction errors. However, categorical factors on contingency cannot have been treated and thus considered in these empirical models since those models are able to treat only numerical factors. This paper identified potential factors on contingency in transportation construction projects and evaluated categorical factors using the one-way ANOVA statistical method. Among factors including project work type, delivery method type, contract agreement type, bid award type, letting type, and geographical location, two factors of project work type and contract agreement type were found to be statistically important on allocating cost contingency.

  • This paper presents a system called a Cash-flow based Construction Scheduling Optimization (CfSO). The existing CPM is biased on schedule and cost management. For a profitable and successful project management, the cash-flow which occurred actually by contractual conditions should be considered in the project scheduling. Therefore, this study provides a method to estimate the amount of a cash-flow occurred periodically by integrating the terms of contract into scheduling. The proposed methodology is implemented as a system prototype in Microsoft Excel. CfSO helps a site manager as a decision-maker to establish a optimized project scheduling and decide profitable contractual conditions against a construction owner.

  • In the course of studying the design of securing the 100-year-long durability of 100 years the subway structure according to the requested service by the Seoul Metropolitan Subway Construction Headquarters, we analyzed 14 construction sites adopting the durability design in subway line No. 9 and concluded as follows: 1. When comparing with 158, the environment index presented for securing 100-year-long durability of subway structure in subway line No. 9, the index of durability was verified as 159.7$\~$179.8 2. When examining the increase value of durability index, we verified that the constructors didn't make various choices in method but they employed the uniformly selected system. 3. Under consideration of the bid form, the construction under bid contract in bulk gave the impacts on the construction cost with attention to selection of the durability index, while the construction under alternative contract in bid adopted uniformly the standard presented by the ordering party.

  • Currently, there is insufficient research on the construction management performance since the CM system was introduced in Korea. For successful completion of construction projects, active use of construction mangers on projects is necessary by introducing construction management to the projects. In view of this, this study analyzed the annual CM performance from 1996 to 2013 but for the past 5 years from 2009 to 2013, a detailed analysis was carried out. For different sectors, CM performances were divided into public and private sectors, for project types, construction, civil and others, for project phases, pre-design, design, construction and post-construction phases, for contract types, sole and joint contract types, for project scale, the amount of the projects was taken into consideration and they were divided into large, medium and small scales and for the types of projects, they were divided into, shops, department stores, shopping centers, hospitals, government buildings, hotels, accommodation facilities, factories, buildings for workshops, office buildings, stadiums, playgrounds, schools and other construction types and all the data divided into such categories was analyzed. The results in this study can be used as a basic reference for studies in analysing construction management performances.

건설공사 대가지급방식의 의사결정 영향요인에 관한 연구 - 미국 연방조달규정에 따른 미국 국방성의 정액계약과 실비정산계약을 중심으로 - (A Study of the Influencing Factors for Decision Making on Construction Contract Types : Focused on DoD Construction Acquisitions with Firm Fixed Price and Cost Reimbursable in FAR)

  • 본 연구는 2008년부터 2022년까지 미국 국방성 육군공병대 건설발주데이터 2,406건에 대하여 미국 연방조달규정 16.104 등에 따른 12개 영향요인과 대가지급방식을 중심으로 한 건설계약유형과의 상관관계를 분석하였다. 본 연구는 독립변수인 12개 영향요인을 4개 특성 영역별로 각각 3개씩의 영향요인으로 그룹화하였다. 데이터셑의 모든 계약유형은 정액계약(FFP)와 실비정산계약(CRC)의 2개 유형으로 분류 후 각각 종속변수로 설정하였다. 연구 결과 대부분의 미국 국방성 발주 건설계약유형은 정액계약이 대다수를 차지하는 것으로 나타났다. 로지스틱 회귀분석 및 AHP 기법을 활용한 전문가 설문조사결과에 따른 상대적 중요도 분석 결과 일반적으로 알려진 바와 같이 과업의 불확실성 및 과업의 복잡성과 같은 독립변수는 실비정산계약의 가능성을 증가시키는 것으로 나타났다. 시장 내 업체의 수는 실비정산계약과 정액계약간의 의사결정에 영향을 미치는 것으로 나타났다. 한편 AHP분석결과 상위 3개 영향요인, 즉 비용회계기준의 적합성, 과업의 긴급성 및 비용 분석 결과의 p값은 이항 로지스틱 회귀분석 결과 0.05를 초과하여 특히 대가지급방식을 중심으로 한 건설계약유형의 의사결정에 영향을 미치는가에 대한 유의미한 결론을 내릴 수 없었다. 이는 전문가 설문조사의 응답자 중 대부분이 주한미군기지이전사업의 경험을 갖고 있다는 사실에 일정부분 기인한다고 보인다. 더 나아가 건설계약의 영향요인은 일반적으로 알려진 상식과는 달리 작용하는 것으로 일부분 관찰되었다. 결론적으로 대가지급방식을 중심으로 한 건설프로젝트의 계약방식 의사결정을 위해서는 본 연구에서 제시한 4개 영역 12개 영향요인에 대한 고려가 필수적이라고 할 수 있다.

  • 최근 국내 건설시장의 축소와 수주경쟁의 심화로 인하여 많은 건설기업들이 이에 대한 대안으로써 해외건설 시장에 진출하고 있다. 그러나 해외건설 프로젝트에서는 국내 건설 프로젝트와 책임과 권한의 범위가 다른 다양한 프로젝트 주체가 참여하고 있으며, 프로젝트를 둘러싼 수행환경 및 계약관행이 국내 건설 프로젝트와 다르기 때문에 다양한 리스크 요인이 존재하고 있다. 특히 해외건설 프로젝트의 문제가운데 하나가 Nominated Sub-Contracting (NSC)로 알려진 영국과 영국연방국가에서 사용되어지고 있는 하도급계약이다. 본 논문은 영국과 아시아지역 영연방 국가의 JCT약관, SIA약관, HKIA약관, PAM약관의 비교를 통해 NSC제도와 차이점을 소개한다. 또한 NSC계약의 채용 거부와 계약 해지와 관련된 약관항목분석을 통해 NSC제도의 유형을 분류한다.

  • 건설공사를 수행하는 도중에 건설분쟁을 거의 필연적으로 발생하고 있다. 이러한 건설분쟁이 발생하게 되면 계약당사자들은 심각한 어려움에 처해질 수 있다. 발주자의 경우 시공자가 청구하는 비용을 제대로 지급하지 않을 경우 부실공사로 이어지지 않을까 염려하게 되고, 시공자의 경우 추가공사를 했는데도 제대로 대가를 받을 수 없는 것이 아닌지 염려하게 되는 현상이 발생하게 된다. 이러한 문제를 해소하기 위해서는 건설분쟁이 발생하였을 때 장기화시키는 것이 아니라 조속히 우선 해결하도록 할 필요가 있고, 이에 본 연구에서는 공공건설사업에서 ADR(DAB: Dispute Ajudication Board))의 적용방안을 제시하였다.
