Philippine Democracy and Constitutional Engineering: Power Sharing, Accountability, Effectiveness and Stability (필리핀 민주주의의 헌정공학: 권력공유, 책임성, 효율성, 안정성)

  • This study examined the constitutional engineering of the Philippine democracy in terms of power sharing and accountability, and the effectiveness and stability of the Philippine democracy as a result were assessed. Based on the analysis, the nature of the present Philippine democratic system since 1986 was brought to light. This study argues that the system of power sharing between the President and the congress in the Philippines tends to serve for negotiating political interests among the power elites rather than functioning in a constructive way. And the public accountability system is not functioning as it was designed to do. Due to the defects the Philippine democracy continuously suffers the lack of political effectiveness and stability. Despite of the problem, the reason not to break down the system would be the fact that the system served for the oligarchic power elites to circulate and recreate the political power exclusively. The direction of the Philippine constitutional engineering should be weakening the present traditional elite dominated political system, and strengthening the chances of political participation from the various classes. Some concerned people suggested the constitutional change to parliamentary system in order to strengthening party politics, and federal system to cope with the problems of regional conflicts, but such efforts failed repeatedly due to the conflict of political interests. Considering the present circumstance, it would be advisable to reform political party law and election system in the direction of strengthening political party system, and to expand the scope of local government system in the direction of devolving the centralized political power.

Efficacy of Herbal Medicine as an Adjunctive Therapy of Chemotherapy for Cervical Cancer: A Systematic Review and Meta-analysis

  • This study aimed to evaluate the efficacy of herbal medicine (HM) combined with chemotherapy (CT) for cervical cancer. Ten electronic databases including Pubmed, Cochrane library, Embase, Korean databases, and Chinese medical databases were systematically searched up to October 2019. All randomized controlled trials with HM combined with CT to treat cervical cancer were included. A total of 21 trials were included for analysis. Compared to the control group, HM combined with CT group significantly increased tumor response (complete and partial response) (risk ratio [RR] = 1.24, 95% CI: 1.15-1.33, p < 0.00001) and Karnofsky performance score (standardized mean difference [SMD] = 1.71, 95% CI: 1.41-2.01, p < 0.00001). Also, HM combined with CT group remarkably reduced CT toxicity. In Conclusion, our study suggests that HM might be a potential option for cervical cancer to enhance curative efficacy and reduce CT toxicity.

Analysis of the Statistical Techniques and Errors in the Field of Sasang Constitution Researches: from 2011 to 2015 (최근 5년간(2011~2015) 사상체질분야 논문의 통계기법 분석 및 오류에 관한 연구)

  • Objectives This study was to identify the types of errors in the statistical analysis and trends of previous reported papers that used various statistical techniques.Methods We have selected 118 original articles for statistical review from the OASIS(http://oasis.kiom.re.kr) and the Pubmed(http://www.pubmed.gov) in the field of Sasang constitutional medicine. Published year was restricted from 2011 to 2015.Results 1. The ANOVA(25.72%) was the statistic of choice overall, followed by the chi-square test(21.74%), regression analysis(14.13%), t-test(11.59%), and etc. 2. By examining the errors of the statistical methods, there were 42(59.2%) thesis with errors among 71 thesis using ANOVA, 19(31.7%) thesis among 60 thesis using chi-square test, and 35(89.7%) over 39 thesis using regression analysis.Conclusions To improve the quality of Sasang Constitution, the participation of statisticians in research design will reduce the significant errors in statistical interpretation of the results.

A Pilot Study on the Association between Iris parameters and 8 Constitutional Medicine : Retrospective Chart Review (8체질과 홍채 지표간 연관성 예비연구 : 후향적 차트 리뷰)

  • Objectives: The purpose of this study was to investigate the usefulness of some iris parameters in predicting the 8 constitution Methods: From November 2012 to February 2018, we retrospectively reviewed the medical records of 171 patients who were visited to the Korean Oriental Clinic. We conducted a stepwise binary logistic regression analysis to find the association between Iris parameters and 8 constitutional Medicine. Results: Automic Nerve Wreath Ration (ANWR) was larger and toxic radii was longer in Earth and Wood constitutions than Metal and water constitution. ANWR was larger and pupil are ratio(PAR) was smaller in Wood constitutions than Earth constitutions. And others did not show significant results. Conclusions: This study suggests that the relationship between some of the iris parameters and 8 constitution was significant, but more accurate follow-up study is needed.

Bibliographic Study on Dongeuisasangchobongueonbimangrok (동의사상초본권비망록(東醫四象初本卷備忘錄)의 문헌적 고찰)

  • Objectives Dongeuisasangchobongueonbimangrok(DSCB) is a 8-paged material which was written in calligraphy. Although Dongeuisusebowonsasangchobongueon(DSSC) was regarded as a manuscript of Dr. Jema Lee, and the prescriptions of DSCB were very similar to those of DSSC, there are few DSCB-related prescription studies until now. The purpose of this study is to perform a precise comparative study between two manuscripts and to make the difference and commonness clear. Methods A comparison of the components, amounts of the herbal medicine, and treatable diseases of each prescription was carried out. Results DSCB contained a total of 41 prescriptions, including 15 for Taeeumin, 12 for Soeumin, 14 for Soyangin, and 34 prescriptions(82.9%) were the same with DSSC. There was one missing component in 2 prescriptions, and the rest generally had the same component and the treatable diseases, but there was a slight difference in amounts of the herbal medicine between two manuscripts. There were a total of seven kinds of prescription, including 2 for Taeeumin, 3 for Soeumin, and 2 for Soyangin, recorded only in DSCB. Conclusions As this manuscript is valuable that shows his initial prescription thoughts of Dongmu Jema Lee along with DSSC, the understanding Lee's prescription is needed to be studied through cross-review with DSSC and DSCB.

Reconsideration on the Origins, Changes, and Constructive Principle of Taeeumjowi-tang (태음조위탕(太陰調胃湯)의 기원(基源), 변천과정(變遷過程) 및 구성원리(構成原理) 재고(再考))

  • Objectives This paper was aimed to review the preceding research on the origins, changes and constructive principle of Taeeumjowi-tang.Methods We reviewed Jema Lee's original works including Dongyisusebowon and relevant books to analyze Taeeumjowi-tang-related items. To compensate insufficient evidence of literature, we also refocued physiological and pathological pecularities of Taeeumin and relevant symptomatology.Results and Conclusions 1) The origins of Taeeumjowi-tang should be Mahwang-tang, Saengmaek-san, Seokchangpowonji-san, and Gondam-san. 2) Taeeumjowi-tang went through Saengmaek-san, Sanyakhwawi-jeon, Bopyesaengmaek-tang, Gilgyungsaengmaek-san, and Bopyewon-tang before it was built as the final version. 3) Taeeumjowi-tang consists of a) big blue lilyturf (麥門冬) and Omija (五味子) which are directly of help to exhale and disperse qi-fluid of Lung, b) balloon-flower (桔梗) which helps circulation of qi-fluid from Head to Lung, c) adlay (薏苡仁) and dry nut (乾栗) which are directly of help to raise up qi-fluid of Wiwan, d) ephedra (麻黃) which helps circulation of qi-fluid from Wiwan to skin, e) calamus (石菖蒲) which directly helps the psychological function of Ear, and f) radish seed (蘿葍子) which slightly eliminate the excessive function of Small intestine, treating Wiwanhan symptomatology in Taeeumin.

A Review on Constitutional Discordance Adjudication of the Constitutional Court to Total Ban on Abortion ('낙태죄' 헌법재판소 헌법불합치 결정의 취지와 법률개정 방향 - 헌법재판소 2019. 4. 11. 선고 2017헌바127 전원재판부 결정에 따라 -)

  • Even after the Constitutional Court decided on August 23, 2012 that the provisions of abortion were constitutional, discussions on the abolition of abortion continued. The controversy about abortion is not only happening recently, but it has already existed since the time when the Penal Code was enacted, and it shares the history of modern legislation with the Republic of Korea. Legislators whom submitted amendment while insisting upon the eradication of abortion in the process of enacting criminal law at that time, presented social and economic adaptation reasons as the core reason. From then on, the abolition of abortion has been discussed during the development dictatorship, but this was not intended to guarantee women's human rights, but it was closely connected to the national policy projects of "Contraception" and "Family Planning" of the Park's dictatorship. Since then, the enactment of the Mother and Child Health Law, which restrictively allow artificial abortion, was held on February 8, 1973, in an emergency cabinet meeting that replaced the legislative power after the National Assembly was disbanded. It became effected May 10th. The reason behind the Mother and Child Health Law that included legalization of abortion in part was that the Revitalizing Reform at that time did not allow any opinion, so it seem to be it was difficult for the religious to express opposition. The "Maternal and Child Health Law" enacted in this way has been maintained through several amendments. It can be seen that the question of maintenance of abortion has been running on parallel lines without any significant difference from the time when the Penal Code was enacted. On August 23, 2012, the Constitutional Court decided that the Constitutional Opinion and the unonstitutional Opinion were 4: 4. However, it was decided by the Constitution without satisfying the quorum for unconstitutional decision of the Constitutional Court. This argument about abolition of abortion is settled for the the time being with the decision of the constitutional inconsistency of the Constitutional Court, and now, the National Assembly bears the issue of new legislation. In other words, the improved legislation must be executed until December 31, 2020, and if the previous improved legislation is not implemented, the crime of abortion (Article 269, Paragraph 1, Article 270 of the Criminal Code) Article 1 (1) will cease to be effective from 1 January 2021. Therefore, in the following, we will look into the reason of the Constitutional Court's constitutional discordance adjudication on criminal abortion(II), and how it structurally differs from the previous Constitutional Court and the Supreme Court. After considering key issues arised from the constitutional discordance adjudication(III), the legislative direction and within the scope of legislative discretion in accordance with the criteria presented by the Constitutional Court We reviewed the proposed revisions to the Penal Code and the Mather and Child Health Act of Korea(IV).

Analysis of Case Report Related with Mountain Ginseng Pharmacopuncture in Korean Medical Database (한국 논문 데이터베이스의 산삼약침 암 증례 논문 분석)

  • Objective: This paper is to investigate the current evidence and clinical effectiveness of mountain ginseng pharmacopuncture (MGP) in cancer treatment. Methods: Along with hand searches, relevant literatures were searched from Korean medical database until November 2015 without language restriction and clinical researches were selected for this review. Results: Nine articles were searched. The MGP was generally prepared in the concentration of ten percent. Also, the MGP has been used by intravenous injection much more than acupoint injection. The clinical effects were the suppression of the cancer cell growth, the improvement the quality of life, the reduction of the side effect by chemotherapy and radiotherapy. Conclusion: This analysis suggests that the MGP can be used as a single therapy or a supportive therapy with conventional therapies, which are chemotherapy or radiotherapy.

A Pattern Identification Study on the Middle-Aged Women between Sasang Constitution using DSOM (한방진단시스템 DSOM을 활용한 사상체질에 따른 폐경(閉經)전후 중년여성(中年女性)의 변증연구(辨證硏究))

  • Objectives We carried out this study to know that there is any differences on the health condition of the middle aged women between Sasang coustitution. We used Diagnosis System of Oriental Medicine(DSOM) for diagnosis and determining pattern identification. Methods This research was approved by the Dongeui University Oriental Hospital Institutional Review Board (certificate no. 2011-06). From March 2012 to October 2012, we examined Kupperman's index, the MENQOL, DSOM, and Sasang Constitution of 291 women from the general population, with ages ranging from 40 to 60 years. And we compared the results statistically by the chi-square test and F-test. Results and Conclusions We excluded 4 Taeyangin to analyze because they were few, and analyzed 287 subjects which were 53 Soyangin, 131 Taeeumin, and 103 Soeumin. 1. The pathogenic factors that showed significant differences were deficiency of qi, insufficiency of Yin, heat on the frequency of the output and deficiency of qi, heat, phlegm on the mean of pathogenic factor score. Deficiency of qi was higher in Soeumin, insufficiency of Yin and heat were higher in Taeeumin, and phlegm was higher in Taeeumin and Soeumin. Overall, Soyangin tended to be lower than others on both the frequency of the output and the mean of pathogenic factor score. 2. The middle aged women with ages ranging from 40 to 60 years tended to be dryness, kidney, damp and became to be blood-deficiency, stagnation of qi, heart easily. Soyangin was more health than others, Taeeumin tended to be heat, phlegm, insufficiency of Yang, and Soeumin tended to be deficiency of qi.

  • 1. Objectives and Methods It has been examined 703 papers of Sasang Constitution Society published from 1989 to 2007. Among them, the study methods have been classified focused on 332 papers related to clinical research and the method of constitution diagnosis and subjects have been researched to research the reality of the clinical research of Sasang Constitutional Medicine. 2. Results 1. The rest studies are the most which can not be classified by existing study method among 332 clinical studies. 2. The study of patient control group is 17 cases and the clinical experiment is one case, so highly well-grounded studies have not been performed. 3. The most method of constitution diagnosis is the constitution diagnosis by experts and by QSCC. 4. The number of constitution diagnosis method performed in the research institution is within 2. They are 254 cases(89.5%). 5. The studies which utilize more than 3 constitution methods are 22 cases and the studies that use medical rash are 7cases(31.8) 6. The 215 cases that subjects are less than 100 are the most and 100${\sim}$500 subjects are 71 cases. 500${\sim}$10000 subjects are 33 cases and more than 1000 subjects are 15 cases. 3. Conclusions Therefore, it is needed to increase the rate of highly well-grounded studies and set the standard criteria by providing constitution diagnosis guideline.
