Effectiveness and Balance of Compulsory and Voluntary Safety Certification of Industrial Machines and Devices (산업용 위험기계·기구 의무 및 임의 안전인증의 효과 및 균형)

  • This study first focuses on the quantitative evaluation of both compulsory and voluntary safety certification of industrial machines and devices. Based on the results of statistical analysis, effectiveness of those safety certifications were confirmed. In order to reduce both the frequency and the strength of industrial accidents associated with industrial machines and devices, major target of safety regulations needs to be shifted from users to manufacturers. Adjustment of industrial machines and devices which are subject to compulsory safety certification and implementation of risk assessment are further suggested. As for the voluntary certification, reestablishment of the concept of voluntary safety certification and balance between compulsory and voluntary certifications is discussed. Voluntary safety certification is further suggested as a mean to manage safety of industrial machines and devices which are not subject to any safety regulations.

An Analysis of Satisfaction on the Essential Curriculum: Focusing on J University Case (교양필수 교과목에 대한 만족도 분석: J대학 사례를 중심으로)

  • In this study, we examined the satisfaction level of J university's compulsory liberal arts subject with quantitative research. The results quantitative research are as follows. First, men are more interested in creative thinking, college life guidance and career path design than girls. Second, the level of satisfaction with the required liberal arts subject by grade was found to be without a statistical significant difference. Third, the satisfaction level of each line of learning was shown in the order of natural engineering, health and welfare, physical fitness, and humanities. The satisfaction level of the lines of learning was found to vary. Fourth, The satisfaction level of each campus was found to vary. The results of this study could be used as basic data to improve the college liberal arts curriculum, especially the compulsory liberal arts curriculum.   • The Chinese Geography Standards for Senior Secondary Schools(trial) was released in 2003. The Standards put forward some changes for senior geography education, the changes in geographical education are reflected explicitly and implicitly by the textbooks. The purpose of this descriptive study was to review of the improvement of Chinese senior geography education by analyzing contents organization and coherence of the new standards-based geography experimental textbooks. The results of study are as follows. The textbooks adopts a student-centered approach through the way of 'more chapter topics with slimmed contents' and by introducing four type activities, geographical inquiries. These student activities are implicity encourages students' active acquisition of geographical knowledge what they have learned in their real lives. The organic coherence of the textbooks' contents rests on the compulsory and the elective subject relating to diversification of the learning areas. The organic coherence between the compulsory and the elective subject rests on diversification of the learning areas. More, looking at the arrangement of the four basic concepts(population, resource, environment, sustainable development) among the textbooks, it was imbalanced by subject.

A STUDY ON THE LIMITS OF ARBITRATION AGREEMENT (중재계약의 한계에 관한 소고)

  • Though the arbitration agreement is a means to resolve disputes autonomously in essence, the Principle of Parties Autonomy and the Principle of Free Contracting can not be applied infinitely without any limitations but subject to the Public Policy and the Compulsory Provisions as established by an interested country. Such principle of law is applied to international arbitration agreements as well, but their validity should be determined by different standards from those in domestic arbitration agreements, in consideration of their internationality. The essential effect of arbitration agreement is to exclude from the jurisdiction of State courts. Depending upon definition of the legal nature of arbitration agreement, the range and contents of the effect of such agreement will vary. Whether State courts can intervene in claims related to Compulsory Provisions is an issue at the level of legislation policy which can not be easily concluded. But, the applicability of Compulsory Provisions can not serve as an imperative ground to deny the eligibility of claims for arbitration, so far as such claims can be disposed of by the parties. On the other hand, it is reasonable to view the arbitration agreement as a substantive contract in its legal nature enabling the authority for dispute resolution to be delegated to arbitrator, so that the Principle of Parties Autonomy can be widely applied throughout the arbitration procedure as well as with other legal acts on private laws. With this, the parties can enjoy an arbitration award appropriate for characteristics of a specific arbitration agreement, thus resulting in facilitating the use of arbitration procedure for international trade activities. To conclude, the Public Policy and the Compulsory Provisions as limitations on arbitration agreement should be applied to such an extent that they can protect States basic moral faith and social order.

A Comparative Study on Subject-Matters and Unit Allotment for Fisheries High School in Korea and Japan (실업계(實業系) 고등학교(高等學校) 교과(敎科) 편제(編制)와 단위(單位) 수(數)의 한(韓)·일(日) 비교(比較))

  • The results of this study were summarized as follows : 1. In the field of general subjects, the compulsory courses are composed of 10 courses(14.3%) in 9 subjects and show only one course in one subject in Korea, while those in Japan are composed of 11-12 courses(18.3-20.0%) in 8 subjects and present each level course of primary and deepening in course. 2. In the field of general subjects, the elective courses are composed of 60 courses(85.7%) in 12 subjects in Korea, while those in Japan are composed of 48-49 courses in 8 subjects. 3. In the field of specialized subjects, the compulsory courses for streams have 3 courses(10.7%) in Korea, while those in Japan have 4 courses (16.7%) 4. In the field of specialized subjects, the compulsory courses for departments are composed of 2-4 courses in Korea, while specialized courses for departments are composed of 4 courses in Japan. 5. In the field of general subjects, unit allotment of the compulsory courses requires the completion of 70 units (37.2%) out of total 188 units(excluding extracurricular activites) in Korea, while that in Japan requires the completion of 70-90 units(38.9-50.0%) out of total 180 units (excluding extracurricular activites). 6. In the field of general subjects, unit allotment of the elective courses requires the completion of 12-36 units(6.4-19.2%) out of total 188 units in Korea, while that in Japan requires the completion of30-50 units(16.7-27.8%) out of total 180 units. 7. In the field of specialized subjects, unit allotment of the major courses requires the completion of more thar 82 units in Korea, while that in Japan requires the completion of more than 60 units, so that the units of the complusory courses for stresms of both of the countries tend to show many differences and diversity in both zone and school. Based on these results, the research concluded that the Fisheries High Schools in the two countries make up nearly similar curricula, while in Japan general subjects carry more extensive choice of courses and higher unit allotment is provided for general subjects than in Korea. It was also concluded that the curriculum for vocational education in Japan intends to develop spontaneous, creative, and soft personalities for job. This study suggests that Fisheries High School curriculum in Korea needs to be improved to give students more opportunities for course selection and to help students adapt themselves to various kinds of job groups.

  • Surgical anatomy is an important and fundamental aspect for all surgical procedures. Anatomy provides a surgeon with the basic and in-depth knowledge that is required and mandatory when performing an operation. Although this subject might be tedious and routine, it is compulsory and should not be overlooked or neglected to avoid any possible postoperative complications. An aggressive and hasty operation without anatomic considerations might cause adverse effects that are irreversible even though a surgical anatomy of the nose is quite simple.

  • The Purpose of this paper is to suggest directions for the future education of Library management. For this purpose, some theoretical backgrounds are traced based on the historical events, the standards provided by international and national organizations, and theories suggested through researches. And the percentages of library management subjects in the curricula of ten Library and Information Science Departments are calculated divided by compulsory and elective ones, along with the contents analyses of a few textbooks in the field. The hypotheses to be tested are as follows: 1. The American postgraduate library education was introduced into Korea as an undergraduate course. So the importance of the subject of library management was recognized as in America, and the numbers of subject Would have been increased, and the contents detailed. 2. The contents of the subject taught would not have changed much since its introduction. It means that they will be almost the same as those were prevalent in the United States of America in the 1950s, when the American education was brought into Korea. The hypotheses can be accepted as being true. Based on the conclusions, some suggestions, including the teaching of the subject should be directed more towards management aspects rather than administrative ones, are provided.

The Contents Analysis of Ocean Environment of Textbooks for Fisheries and Marine High School students (수산·해운계 고등학교 교과의 해양환경 내용분석)

  • The aims of this study are to analysis about the contents associated with the ocean environment compared 17 special-subject textbooks to 2 common-subject textbooks, and to make some proposals for construction of contents. The results of it are as follows; 1. Only 17 books among 36 textbooks taught by the fisheries and marine high schools are contained to some contents related with ocean environment. The contents associated with the ocean environment take possession of 90%, 62% each of total pages in the textbooks, 'ocean pollution' and 'ocean environment'. 2. Of compulsory texts, namely, 'general fisheries', 'general ocean' and 'information treatment of fisheries-marine', the former 2 books are composed of 4.5%, 36.2% each relating with ocean environment. But the last one is nothing. 3. Therefore, even a little contents of ocean environment and its conservation, it is necessary to add as the reasonable rate to the characteristics of each book in 36 special-subject textbooks. 4. And also it is shown that the common-subject textbooks,'ocean science', ' earth science I' and 'earth science II', are composed of 35.7%, 10%, 16.7% each. So we'd like to recommend that the contents of ocean pollution and environmental conservation have to add more.

A Contractual Study on the Clinical Trial of Medicine (의약품 임상시험의 계약적 일고찰)

  • This thesis has studied about the legal characteristic of injection of the trial drug, the position of the pharmaceutical firm as a contractor of the clinical trial, the possibility of compulsory performance of consistent injection of the trial drug, and the damage claim caused in the process of the clinical trial from the viewpoint of protecting the trial subject in the clinical trial. According to court's judgement in the United States, the lawsuit of the trial subject, although the trial subject had expected consistent injections, was dismissed because there was no direct contract between pharmaceutical and trial subject. However, Helsinki Declaration prescribe the medical research as follows. 'All patients who participated in the research should be able to use the best precaution, diagnosis, and treatment proved by the final outcome of the research'. The trial subject is entitled to demand only the pharmaceutical firm which developed and provided the trial drug, and the pharmaceutical firm has the obligation to supply the trial drug to the trial subject. Therefore, it would be not enough to protect the trial subject if the pharmaceutical firm which makes the trial drug is ruled out. In addition, especially, in case the trial drug has a constant effect with the aim of treatment, if the injection of the trial drug is suddenly stopped, the trial subject would not have the benefit of treatment by the trial drug. In this case, the best remedy against the damage is to urge a constant injection of the trial drug. Thus, in certain case, it is reasonable to consider that the pharmaceutical firm has the obligation to supply the trial drug to the trial subject constantly, and it is also necessary to compel it through effective means in case the pharmaceutical firm do not fulfill its obligation to supply the trial drug. However, as an essential prerequisite for the assertion mentioned above, it should be judged under the principle of good faith considering the concrete situation, that is, what roles the pharmaceutical firm has played.

A Measurement and Comparative Analysis for Test Items Related to Informatics of High School Students in Korea and Japan (한·일 고등학생 대상으로 '정보' 관련 문항을 통한 수준 측정 및 비교 분석)

  • As the importance of informatics education has been accentuated all around the world, Japan is considering adopting 'informatics' as a subject in the university entrance examination from 2020. Under these circumstances, Informatics university entrance research group in Japan has annually conducted an 'informatics' nationwide mock test since 2013 to prepare for the time when 'informatics' is adopted as a subject in the university entrance exam and has accumulated the data which help understand the informatics education level of high school students and its trend. This study thus provided the Korean high school students with the questions which are the same as those from the informatics nationwide mock tests conducted in Japan so far in order to identify the education level of informatics among Korean and Japanese students. Overall mean scores and mean scores in each subject of Korean and Japanese students in the 2015 informatics nationwide mock tests were compared and analyzed and the gender analysis was conducted. These results will be expected to suggest the direction for the future informatics education such as adopting 'informatics' as a subject in the university entrance exam in order to be a compulsory subject in the high school curriculum that can ensure the required skills in society.
