제조물책임법에 대응하기 위한 시스템 구축에 관한 연구 -중소기업을 중심으로- (A Study on System Construction to the Product Liability Law-with focus on a small & medium business)

  • 2002년 제조물책임법(PL)을 시행하여 소비자가 제조물을 생산하고 판매하는 기업에 대하여 제품의 결함에 따른 손해배상을 청구할 수 있도록 하는 제도적 장치를 마련하였다. 그러나 최근 가습기 살균제 사건 등으로 인해 기업의 제조물책임 강화와 소비자 피해구제를 위한 집단소송제도, 징벌적배상제 도입을 위하여 제조물책임법 개정안 등 현재, 12여건의 관련 법안이 국회에 발의되어 있으나 정작 법안의 이해 당사자인 중소기업의 62.6%는 이에 대해 잘 알고 있지 못한 것으로 나타났다고 하고 있다. 많은 기업들이 PL 방어대책(Product Liability Defense : PLD)으로 문서작성 보관의 적정화, 관련업자와의 책임관계의 명확화, PL 보험의 가입 또는 배상자금의 확보 등으로 대비하고 있으나 이와 같은 대비책은 제품의 설계와 제품의 안전성을 고려한 부분에 대하여 한계점을 느끼게 한다. 이에 본 연구는 먼저 PL의 명확한 개념과 대응방안에 대해 살펴보고 PL 시스템과 개별 경영시스템 간의 관련성을 파악하고 제조물책임법에 대비한 PL 대응시스템을 기업의 개별경영시스템에 통합하고 보다 제품의 안전에 중점을 둔 개별경영시스템 모델을 제시하고자한다. 이 같은 연구목적에 따른 결과는 중소기업의 PL법 대응을 위한 합리적 대응방안으로 평가 받을 것으로 기대된다.

일개 S상급종합병원 내 직종별 직무만족에 미치는 영향요인 비교 -허즈버그의 동기 및 위생요인 중심으로 (Comparison of Factors Influencing Job Satisfaction by Occupation in S Tertiary Hospital -Focused Herzberg's Motivation and Hygiene Factors)

  • 병원은 전문적인 기술을 가진 사람들이 모여서 구성된 특수한 조직이다. 다양한 직무 분야와 사회적 관심 분야의 변화로 직업의식 및 직무만족에도 많은 변화가 있을 것이고, 조직이 지속적인 성장을 하기 위해서는 이를 효율적으로 잘 관리할 필요가 있다. 직종별 직무만족에 미치는 영향요인을 분석함으로써 효율적인 운영방안에 필요한 자료를 제공하고자 한다. 2015년 4월 1일부터 4월 15일까지 서울 소재 일개 S상급종합병원에 근무하고 있는 직원(할당표본 400명)을 대상으로 하였다. 영향요인별 타당도와 신뢰도 분석을 실시하였고, 전반적인 직무만족과 영향요인에서 보건직이 가장 만족 수준이 높은 것으로 나타났다. 직무만족 영향요인 분석에서 의사직은 성취감, 보수, 근무환경, 간호직은 성취감, 보수, 직무안정성, 보건직은 성취감, 근무환경, 행정직은 성취감, 대인관계, 근무환경, 직무안정성이 영향을 미치는 것으로 나타났다. 이는 동기요인뿐만 아니라 위생요인에서도 직무만족에 영향을 미치는 유의미한 관계임을 확인할 수 있다. 본 연구결과를 토대로 직무에 대한 만족도를 높이기 위해서는 동기요인과 위생요인 모두를 고려해서 체계적인 관리가 필요하다고 판단된다.

산업재해 근로자의 생활만족도에 미치는 영향 요인에 관한 연구 (A Study on the Factors Influencing on Life Satisfaction of Industrially Injured Workers)

  • 본 연구는 산업재해 근로자의 심리사회적요인, 경제적요인, 건강관련요인이 생활만족도에 미치는 영향을 분석하는데 그 목적이 있다. 이를 위해 본 연구는 근로복지공단의 산재보험패널조사 2014년 발표한 제1차 자료를 분석하였다. 전체 조사대상자 가운데 연구목적에 부합하는 산업재해 근로자 2,000명에 대한 유효한 자료를 추출하였으며 통계적으로 분석한 결과는 다음과 같다. 산업재해 근로자의 생활만족도에 영향을 미치는 요인으로는 심리사회적 요인으로 자기효능감, 자아존중감, 노년준비정도가 유의하게 영향을 미치는 것으로 나타났다. 경제적 요인으로 경제적 활동상태, 사회경제적 지위가 유의하게 영향을 미치는 것으로 나타났다. 건강관련요인으로 주관적 건강상태, 타인의 도움 정도가 유의한 영향을 미치는 것으로 나타났다. 그리고 모델의 설명력은 34%였다.

요양종결 이후 산재근로자의 취업기간 분석 (An Analysis on the Employment Duration of the Workers Injured in Industrial Accidents)

  • 1998~2000년에 신규로 장해등급이 판정된 남성 산재근로자를 대상으로하여 산재보상 수급자 데이터베이스와 고용보험 피보험자 데이터베이스를 결합함으로써 취업력(labor history)을 재구성하였다. 이 자료에 기초한 분석 결과에 따르면, 먼저 원직장복귀가 산재근로자의 주요한 직장복귀 경로이며 고용유지에도 유효하였던 반면, 요양종결 이후의 취업자들은 상대적으로 높은 이직률을 보였다. 그리고 직장복귀자의 약 6할은 이직을 경험하는 것으로 나타났으며, 이직자 가운데 77%는 이전 직장의 취업기간이 1년 미만이었다. 한편 다중위험모형을 이용한 취업기간 분석에서 사업장 규모가 작을수록 그리고 비자발적 이직의 경우에는 직업탐색기간이 길수록 산재근로자의 취업기간이 짧아진다는 사실을 확인하였다. 뿐만 아니라 요양종결 이후의 첫 직장에서 일자리를 유지하는 기간이 길수록 이후의 취업과 고용유지에도 긍정적인 효과를 보였다.

A Policy Intervention Study to Identify High-Risk Groups to Prevent Industrial Accidents in Republic of Korea

  • Background: The objective of this study is to identify high-risk groups for industrial accidents by setting up 2003 as the base year and conducting an in-depth analysis of the trends of major industrial accident indexes the index of industrial accident rate, the index of occupational injury rate, the index of occupational illness and disease rate per 10,000 people, and the index of occupational injury fatality rate per 10,000 people for the past 10 years. Methods: This study selected industrial accident victims, who died or received more than 4 days of medical care benefits, due to occupational accidents and diseases occurring at workplaces, subject to the Industrial Accident Compensation Insurance Act, as the study population. Results: According to the trends of four major indexes by workplace characteristics, the whole industry has shown a decreasing tendency in all four major indexes since the base year (2003); as of 2012, the index of industrial accident rate was 67, while the index of occupational injury fatality rate per 10,000 people was 59. Conclusion: The manufacturing industry, age over 50 years and workplaces with more than 50 employees showed a high severity level of occupational accidents. Male workers showed a higher severity level of occupational accidents than female workers. The employment period of < 3 years and newly hired workers with a relatively shorter working period are likely to have more occupational accidents than others. Overall, an industrial accident prevention policy must be established by concentrating all available resources and capacities of these high-risk groups.

사업장 무작위 선정 및 불시측정 방식을 통한 작업환경측정제도 신뢰성 제고 방안 (An improvement plan for a workplace monitoring system through random selection of workplaces and unnoticed measurement inspection)

  • Objectives: The Ministry of Employment and Labor's enforcement programs, such as workplace monitoring inspection, are one of the major public efforts to protect worker's health. Therefore, a more effective inspection method is required for workplace monitoring, which is helpful for controlling health hazards in the workplace. Methods: For this study, we investigated the related safety and health laws, regulations, and inspection guidelines from the USA, Japan, and Korea. We also analyzed the provisions of industrial safety and health acts, which are related to enhancing the reliability of workplace monitoring. We applied the process of opinion convergence through an experts meeting for our research. Results: We proposed an efficient inspection scheme for workplace monitoring that includes how to select companies(mainly randomized inspections by using a workplace measurement database and workers' compensation insurance database), how to proceed with the inspection process(mainly unannounced visits), and who should carry out this project. Conclusions: We conclude that our proposal for the inspection of workplace monitoring could be a very effective tool for reducing the numbers of companies that do not undertake workplace monitoring and could produce reliable monitoring results.

유아교사의 안전인식과 유아교육기관의 안전교육 실태 (A Study of the Actual Condition of Safety Education in Early-childhood Educational Institutions and Teacher's Safety Recognition)

  • The purpose of this study is to emboss the importance of safety education by recognizing the instructor's thoughts on safety and the prevention of safety accidents of early-childhood through the examination, analysis of the education site of safety at early-childhood education facilities. The subject of this were 120 early-childhood teachers in the Jeonbuk areas. The data were collected using questionaries and analyzed by the statistical methods of frequencies. ANOVA with SPSS pc program. The research questions were as follows; 1. What is the understanding of early-childhood teachers on safety recognition? 2. Is there a difference in the understanding of the teacher on safety and the management of the education curriculum on safety education that is being taught at early-childhood education facilities? The main results and solutions of this study were as follows: 1. In order for early-childhood teachers to teach safety education in early-childhood education facilities, they must join a safety mutual aid association or join an insurance policy to furnish an appropriate compensation system. Also, safety education must be systematically taught at a $social{\cdot}national$ level so that teachers and young children can have an understanding on safety under the support and concern of early-childhood education facilities and administration authorities. 2. Results on the comparison of the understanding of safety education and management of actual education of teachers on the actual conditions of the education curriculum of safety education show that although teachers are aware of most items of safety education but the actual education was not being taught. This means that although the teachers are aware of the importance of safety education, the actual education is not being taught.

작업관련성 근골격계질환과 사회심리적 요인 (Work-related Musculoskeletal Disorders and Psychosocial Factors)

  • Work-related musculoskeletal disorders (WMSDs) have been the most common health problem covered by worker's accident compensation insurance for several years in Korea. Korean government has strengthened related regulations since 2003. People looked forward to decreasing the incidence and prevalence of WMSDs. At first, the expectation could be realized. However, we were bumped against to limit at present. The authors think it is due to the negligence of psychosocial factors for WMSDs. Many researchers reported that the various psychosocial factors were associated with WMSDs or symptoms. Job demand, social support, job satisfaction and decision latitude are the major risk factors in job stress aspect. Work pressure, lack of rest, qualified workload, workload variability and monotonous job are the significant risk factors in work context of work organization. Employment flexibility, downsizing, lean production, contingent work and pay for by the piece are also the risk factors in an organizational context. Furthermore, these risk factors are associated with each other across different dimensions of work organization. Suggestive possible pathways between these risks and WMSDs have been taken note of increasing muscle strain or ergonomic stress and of a cognitive aspect. The authors suggest these risk factors could explain the limitation of the regulation system for WMSDs. In conclusion, the strategy to manage psychosocial factors is the one of the essential approach to prevent WMSDs.

Disability Evaluation of the Pain : The Present and Prospect in Korea

  • Objective : Pain has long been regarded as a subjective symptom. Recently, however, some regard a type of intractable chronic pain as a disease. Furthermore, chronic persistent pain becomes a cause of permanent impairment (PI) In 6th edition, the American Medical Association (AMA) Guides has rated the pain as a PI. In Korea, pain has been already been rated as a PI. Here, we examined the present status and the prospect of disability evaluation for the pain in Korea. Methods : Pain can be rated as a PI by the Workmen's Compensation Insurance Act (WCIA) and Patriots and Veterans Welfare Corporation Act (PVWCA) in Korea. We examined the definition, diagnostic criteria and grades of the pain related disability (PRD) in these two acts. We also examined legal judgments, which were made in 2005 for patients with severe pain. We also compared the acts and the judgments to the criteria of the 6th AMA Guides. Results : The PRD can berated as one of the 4 grades according to the WCIA. The provisions of the law do not limit the pain only for the complex regional pain syndrome (CRPS). The PRD can berated as one of the 3 grades by the PVWCA. If there were objective signs such as osteoporosis, joint contracture and muscle atrophy corresponding to the CRPS, the grade is rated as 6. When the pain always interferes with one's job except easy work,the grade is rated as high as 5. In Korea, judicial precedents dealt the pain a sa permanent disability in 2005. Conclusion : Although there were no objective criteria for evaluation of the PRD, pain has been already rated as a PI by the laws or judicial precedents, in Korea. Thus, we should regulate the Korean criteria of PRD like the AMA 6th edition. We also should develop the objective tools for evaluation of the PRD near in future.

생산직 여성근로자의 직무스트레스와 근골격계증상이 건강관련 삶의 질에 미치는 영향 (The Effects of Occupational Stress and Musculoskeletal Symptoms on Health-Related Quality of Life in Female Labor Workers)

  • Objectives: The objectives of this study were to investigate female labor workers' occupational stress and musculoskeletal symptoms and to identify the effects of their occupational stress and musculoskeletal symptoms on their health-related quality of life. Methods: A survey was conducted through direct interviews using a musculoskeletal symptoms questionnaire, the Korean Occupational Stress Scale(KOSS), and the Short-Form 36-Item Health Survey(SF-36). Subjects were 112 female labor workers in three factories in D city who were selected by convenience sampling. Results: Factors significantly affecting health-related quality of life were found to be: occupational stress(${\beta}$=-.36); degree of pain, with medium pain(${\beta}$=-.31) and extremely severe pain(${\beta}$=-.24); duration of pain, with more than 1 week-less than 1 month(${\beta}$=-.25) and more than 6 months(${\beta}$=-.16); frequency of pain, with once per 2-3 months(${\beta}$=-.22); responses to pain such as medical leave, use of worker's compensation insurance, task change, etc.(${\beta}$=-.16), and Slightly difficult(${\beta}$=-.16) versus Not hard at all. These variables demonstrated that health-related quality of life is 48%(F=11.72, p<.001) in female workers. Conclusions: To improve female labor workers' health-related quality of life based on the above results, occupational health managers should reduce the workers' occupational stress, develop and apply health interventions regarding musculoskeletal symptoms, prevent the early onset of musculoskeletal symptoms, and protect and promote the workers' health.
