교통사고 발생은 도로 여건이나 운전자 의식 등의 문제로 발생할 수 있으나 운전자 상호간 또는 운전자와 보행자 사이의 지켜야할 사항을 규정하는 교통법규를 위반할 경우 차량 또는 보행자의 교통사고 노출 가능성이 높아져 교통사고로 이어지는 경우도 상당부분 발생한다. 따라서 교통안전 선진국에서는 이러한 메커니즘의 교통법규 준수율을 높이기 위해서 교통법규를 위반하는 운전자들이 경제적으로 부담을 느껴 "교통법규 준수"라는 행동을 선택할 수 있을 정도의 수준으로 교통법규 위반 범칙금을 책정하고 있으며, 경제가 발전 할수록 범칙금 수준도 향상 시키고 있는 실정이다. 반면, 우리나라는 국민 정서 문제를 앞세워 지난 20년간 교통법규 위반 범칙금 수준을 크게 향상시키지 않았다. 따라서 본 연구는 운전자의 교통법규 준수율을 높일 수 있는 방안에 대하여 경제논리를 적용하여 효율적 교통법규 위반 범칙금 수준을 책정하는 방안을 도출하였다. 속도위반 및 신호위반 등 교통사고와 연관성이 높은 교통법규 사항에 대하여 운전자의 "법규 위반" 또는 "법규 준수"의 행동 선택에 있어서의 기대효용을 수치화 하여 현재 운전자가 기대하는 "교통법규 위반시 단속기대 확률"을 유지할 경우 적정 범칙금 수준과 현재의 범칙금 수준을 유지할 경우 "효율적 단속기대 확률" 등 두 가지의 교통정책 방안을 제시하였다.
Risk of loss is a term used in the law of contracts to determine which party should bear the burden of risk for damage occurring to goods after the sale has been completed, but before delivery has occurred. Under the Uniform Commercial Code (UCC), there are four risk of loss rules, in order of application. First, it is agreement that is the agreement of the parties controls. Second, the breaching party is liable for any uninsured loss even though breach is unrelated to the problem. Hence, if the breach is the time of delivery, and the goods show up broken, then the breaching rule applies risk of loss on the seller. Third, the delivery by common carrier other than by seller is necessary: Risk of loss shifts from seller to buyer at the time that seller completes its delivery obligations; If it is a destination contract, then risk of loss is on the seller; If it is a delivery contract, then the risk of loss is on the buyer. Fourth, if the seller is a merchant, then the risk of loss shifts to the buyer upon buyer's receipt of the goods. If the buyer never takes possession, then the seller still has the risk of loss. This paper discusses problems of risk of loss under the American law. Specifically, this paper focuses on the interpretation of UCC sections and analysis of various cases. By comparing, also, UCC and Korean law, the paper proposes some implications of risk of loss issues for Korean law.
본 연구의 목적은 법학전문도서관의 기존사례 분석을 통하여 공간구성 특성을 조사, 규정하고 교육이념에 부응하는 법학전문도서관 특성을 반영한 계획안의 제시함으로서 법학전문도서관의 계획요소 및 디자인을 제안하고자 하였다. 법학도서관의 공간구성특성을 요약하면 (1) 접근성을 고려한 진입층의 공간구성 (2) 열람공간 이용자 중심의 열람실 공간구성 (3) 교육 및 연구 공간과 열람실의 연계성을 고려한 공간 구성으로 법학도서관의 특성을 규정할 수 있다. 이러한 결과를 토대로 한 법학도서관 설계 시 다음과 같은 디자인 쟁점사항을 도출하였다. 진입층 공간구성은 교육의 장소로서의 이용행태, 접근성과 연계성의 측면을 고려하여 공용공간과 함께 열람공간을 계획하여야 한다. 이용자 중심의 열람실과 서고의 공간구성이 계획되기 위한 방법으로는 일반열람실 또는 지정 도서실이 진입공간과 직접 연계되는 계획이 이루어 져야 된다. 교육 및 연구 공간과 열람실이 유기적으로 연결되어야 함에 따라서 코어를 중심으로 교육 및 연구 공간과 열람실을 수직적으로 연계하여 열람실과 교육 연구 공간의 연계성을 높이는 동시에 외부에서의 접근성도 고려한 계획이 되어야한다.
이 연구는 우리나라와 일본의 학교도서관법 제정의 배경과 경과를 살펴보고 학교도서관법의 구성요소를 비교하고 분석한 것이다. 한국과 일본의 학교도서관법은 정부입법이 아닌 의원입법으로 제정되었다. 그리고 정부기관이 아닌 NGO 활동이 학교도서관법 제정에 크게 기여하였다. 학교도서관법 구성요소 중 공통되는 요소는 목적, 정의, 국가의 책무, 설치, 업무, 인적자원, 협력망, 교육 등이다. 학교도서관 업무는 한국의 경우 학교도서관의 교육적 기능에 중점을 두고 있고, 일본은 도서관자료의 수집, 정리와 여러 가지 행사 개최 등 학교도서관의 기본적인 업무에 중점을 두고 있다. 학교도서관의 인적자원은 한국의 경우 사서교사, 실기교사, 사서 중에서 아무나 둘 수 있도록 하고 의무규정이 아니라 임의규정으로 되어 있는데 비하여 일본은 사서교사와 학교사서로 구분하고 있다. 학교도서관의 시설과 자료에 대한 규정은 한국은 자세하게 규정되어 있으나 일본은 시설과 자료에 대한 규정이 없다. 학교도서관의 교육은 한국의 경우 독서교육과 정보이용교육을 실시하고 학교의 교육과정 운영계획에 포함시키도록 하고 있으나 일본은 도서관 이용지도 만을 실시하도록 규정하고 있고 독서교육에 대한 내용은 제외되어 있다.
The concept of expectation rights considers 'the expectation' that the patient should be given proper medical treatment as the benefit and protection of the law, so it would be the benefit and protection of the law due to personal rights different from 'the legal principle that has the possibility to a considerable extent' being in an extension of life and body. However, the problem how the patient's expectation of medical service sets up in order to make it the benefit and protection of the law would be still left in the vague concept of the patient's 'expectation', thus, in the first place, the medical practice following formed medical standard in every particular medical institutes should be the standard because these medical services are normally within a range of the patients' expectations. In addition, it should be naturally constituted as mental profit to get the subjective circumstances such as 'the patient's expectation' to be an object, and also, different from the profit and protection of the law such as life and body that should be absolutely protected, the origin of violation behavior should be regarded simultaneously to define the denotation of expectation rights. Therefore, the expectation rights violations would be problematic in case it fails to reach the medical standard that is expected for common doctors to practice properly. This is the concept of expectation rights that gets subjective matters such as the patient's expectation to be objectivity as medical practices that can be expected by generalized abstract doctors. This standard should be defined as the minimum standard that is naturally expected for doctors to practice, different from medical standard that decides the level of doctors.
Uniform Computer Information Transactions Act (UCITA) for e-commerce in non-UCC and non-UETA transactions, promulgated in 1999. The Act Drafted by the National Conference of Commissioners on Uniform State Laws. UCITA applies to contracts to license or buy software, contracts to create computer programs, contracts for on-line access to databases and contracts to distribute information over the Internet. UCITA does not apply to goods such as television sets, stereo equipment, airplanes or traditional books and publications. Goods generally remain subject to UCC Article 2 or Article 2A. Many transactions may include more than computer information. If that transaction covers non-goods subject matter, UCITA applies only to the part of the transaction which is computer information and other law applies to the other subject matter. In the event the other subject matter is goods, UCC Article 2 or 2A applies to the goods subject matter and UCITA applies to the computer information part. UCITA is coordinated with existing Articles 2 and 2A, so coverage of each to part of the transaction will be facilitated. With respect to other subject matter (primarily services) UCC Articles 2 and 2A have worked in mixed transactions with the common law applicable to the services.

In relation to the problems on validity of the goods conformity clauses in FOB contracts, when considering Lord Wright's comments ("${\cdots}$ hence apt and precise words must be used to exclude it: the words guarantee or warranty are not sufficiently clear.") in Cammell Laird & Co Ltd v Manganese Bronze and Brass, FOB contracts are fundamentally one that seller's duty to deliver the goods is completing at the port of shipment and "principle of party autonomy" in Contract Law, I do not think that the terms implied by section 14 of the SGA and Common Law cannot absolutely excluded by the goods conformity clauses in sale contracts. Therefore, in order to exclude the implied terms, the parties must very clearly spell out this in the relevant clauses.
Licensing of information is the standard of the computer information business today. The huge bulk of vendors license their computer information products. The Uniform Computer Information Transactions Act(UCITA), therefore, does not originate licensing contracts. UCITA was developed to provide basic, recognizable default rules for the existing licensing activity that goes on and expands as commerce in computer information expands. UCITA's rules govern licensing of contracts for computer information from formation through performance, including remedies if there is a breach of contract. Included in UCITA are rules for warranties, both implied and express, and rules pertaining to risk of loss in a computer information transaction. Most of the rules in UCITA are the traditional and familiar rules of contract from the law of sales and from the common law, but adapted to the special nature of computer information licensing contracts. Freedom of contract is a dominating underlying policy for UCITA, exactly as that principle is the foundation for the law of commercial transactions, generally, and exactly as that law has served all commercial transactions in the United States and has contributed to the economic growth and health of the United States.
우리나라의 "제조물책임법" 시행 후 발생할 수 있는 문제점을 보완하기 위해 화재조사 제도의 개선이 요구된다. 본 논문에서는 제조물책임법의 이론적 배경을 바탕으로 현재 시행되고 있는 국내 외 화재조사의 특성을 알아보고 비교하여 경찰화재조사, 소방화재조사, 사설 화재감정의 기관별 화재조사의 목적과 문제점을 파악하였다. 그에 따른 개선방안으로는 첫째, 민간 사설 화재감식, 감정, 해석 업체의 필요성 둘째, 화재조사 제도의 소방, 경찰의 일원화 셋째, 대학에 화재 감정 관련학과 설립과 감정업 자격 제도 신설 등을 제안하였다.

The development of new multimedia techniques such as 3D printing is increasingly attracting the public's attention towards 3D objects. An optimized robust and imperceptible watermarking method based on Ant Colony Optimization (ACO) and Weber Law is proposed for 3D polygonal models. The proposed approach partitions the host model into smaller sub meshes and generates a secret watermark from the sub meshes using Weber Law. ACO based optimized strength factor is identified for embedding the watermark. The secret watermark is embedded and extracted on the wavelet domain. The proposed scheme is robust against geometric and photometric attacks that overcomes the synchronization problem and authenticates the secret watermark from the distorted models. The primary characteristic of the proposed system is the flexibility achieved in data embedding capacity due to the optimized strength factor. Extensive simulation results shows enhanced performance of the recommended framework and robustness towards the most common attacks like geometric transformations, noise, cropping, mesh smoothening, and the combination of such attacks.
