In the inner turn key constructions the problems of uniform types are repeatedly occurred, and, especially, many problems happen up to the stage of pre-construction(from a bid to a contract) owing to the specialties of the turn key constructions. So the claim factors of the Korean turn key constructions were abstracted through the literature searches, the site document examinations, the case studies and the interviews with the experts. When the technicians meeting the interior turn key constructions for the first time and working here now are well acquainted with only these factors, many claims will be prevented. By analysing the degree of claims by claims factors through the questionnaires to the experts about the abstracted factors and surveying the amount of the claims through the case studies, what factors exerted how much of influence on the claims was tested and analyzed. Proposing the response devices to the factors affecting the claims much led the technicians in charge of internal turn key constructions to the prevention and the proper solution of the site claims.

With the 4th industrial revolution, many advanced information technologies are being applied to the area of construction engineering and project management. These applications are usually focusing on design, construction and operation stage and are producing many meaningful fruits. Even though these studies are very important for the development of the construction industry, this study insists that the other stage perspective such as construction business also should be emphasized. Because business phase has significant impacts on the success of a construction project as well as design, construction and operation phase. So, this study reviewed the intelligent-approach papers in planning and marketing, estimation and bid, contract and claim, and project financing fields. This study provides some insights such as values, difficulties, limitations and future directions of business intelligence application.

In the bidding stage of turn-key based plant construction contracts, owners provide design and performance basis for contractors instead of giving design drawing. To win the bid for a plant construction, the contractors should be obliged to satisfy and ensure owners'requirements such as design and performance basis in a plant construction project, In other words, owners imposes technical risk of the design to the contractors by specifying responsibility for the analysis and verification of the plant construction. Thus, it is very important that contracters make accurate and realistic basic design plan in a short period of time. To deal with such a situation, we propose a systems engineering approach for the analysis and management of the technical risk. Specifically, we first: 1) Analyzes technical risk related with the plant design information for the bidders, followed by 2) Developing stakeholder requirements for the basic engineering design, and 3) System requirements for dealing with technical risk. Also, in this paper, we proposed converting method from MOE(Measure of Effectiveness) to MOP(Measure of Performance) in the risk analysis. To show the effectiveness of the proposed method, we carried out a case study.

건설산업의 환경은 대형화, 전문화의 추세와 공사이행기간의 증가와 건설공사의 입찰에 있어서 중요한 리스크 요인과 불확실 요인이 존재하게 되었으며 하도급자의 판단오류 및 인식부족은 이윤감소 혹은 적자를 초래하게 되며, 이는 결과적으로 하도급자에게 재정적 부담을 주게된다. 따라서 입찰단계에서의 리스크요인에 의한 공사예비비 산정을 예측하고 계약의 합의와 이행 과정에서 하도급자의 목표이윤 확보를 고려한 입찰단가를 산정하는 것은 매우 중요하다. 이러한 취지에서 본 연구는 하도급자의 공종별 사례로 선정하여 입찰금액 산정에 미치는 리스크에 대한 중요도가 공사비에 미치는 영향정도를 기초로 하여 분석하고, 이를 바탕으로 하도업자의 합리적인 입찰전략을 수립하는 기초자료로 활용하는데 있다.

The purpose of this paper was to explore delay avoiding measures and strategies. The paper was based on previous work of authors on finding delay causes. Firstly, the paper has discussed about delay avoidance measures prescribed by the previous work. As the previous study identified five main causes of construction delays, various measures and strategies to overcome those delay problems have been discussed in sequence in the last sections. Major delay prevention strategies are: involving stakeholders in the project decisions, outreach program, realistic time and resource estimation, try to adjust the triple constraints of time, cost and scope, ensure fair and complete disclosure of information at an early stage of the construction project, contractor, itself should inquire about patent design errors prior to submitting its bid, owner should include in its contract with the consultant an indemnity (protection) clause etc.

클레임의 발생원인과 예방에 대하여 많은 연구들이 수행되어 왔으나, 개선방안 혹은 제도개선, 대응방안 등에 대한 연구가 대부분이었다. 특히, 잠재되어 있는 클레임에 대한 구체적인 내용들을 정리하고, 예방을 위한 실무적인 연구는 미흡한 실정이다. 그러므로 향후 발생할 수 있는 클레임에 대해, 그 중 설계단계에서 잠재될 가능성이 큰 원인들을 사전에 검토 및 재확인하여 클레임을 예방할 수 있는 수단이 부족하다. 본 연구에서는, 클레임이 발생되는 시기가 대부분 시공단계이지만 클레임의 원인은 설계단계에서 발생하는 점에 착안하여, 설계단계에서 잠재된 클레임 예방을 위하여 설계단계의 설계서 등을 포함한 계약문서를 중심으로 연구를 수행하였다. 클레임의 근거서류를 준비하고, 관련법규의 적용규정을 확인하면서 클레임 발생원인을 짚어볼 수 있는 체크리스트를 개발하였다.

국내 건설수주 규모는 2013년 91.3조원에서 2021년 총 212조원으로 특히 민간부문에서 크게 성장하였다. 국내외 시장 규모가 성장하면서, EPC(Engineering, Procurement, Construction) 프로젝트의 규모와 복잡성이 더욱 증가되고, 이에 프로젝트 관리 및 ITB(Invitation to Bid) 문서의 위험 관리가 중요한 이슈가 되고 있다. EPC 프로젝트 발주 이후 입찰 절차에서 실제 건설 회사에게 부여되는 대응 시간은 한정적일 뿐만 아니라, 인력 및 비용의 문제로 ITB 문서 계약 조항의 모든 리스크를 검토하는데 매우 어려움이 있다. 기존 연구에서는 이와 같은 문제를 해결하고자 EPC 계약 문서의 위험 조항을 범주화하고, 이를 AI 기반으로 탐지하려는 시도가 있었으나, 이는 레이블링 데이터 활용의 한계와 클래스 불균형과 같은 데이터 측면의 문제로 실무에서 활용할 수 있는 수준의 지원 시스템으로 활용하기 어려운 상황이다. 따라서 본 연구는 기존 연구와 같이 위험 조항 자체를 정의하고 분류하는 것이 아니라, FIDIC Yellow 2017(국제 컨설팅엔지니어링 연맹 표준 계약 조건) 기준 계약 조항을 세부적으로 분류할 수 있는 AI 모델을 개발하고자 한다. 프로젝트의 규모, 유형에 따라서 세부적으로 검토해야 하는 계약 조항이 다를 수 있기 때문에 이와 같은 다중 텍스트 분류 기능이 필요하다. 본 연구는 다중 텍스트 분류 모델의 성능 고도화를 위해서 최근 텍스트 데이터의 컨텍스트를 효율적으로 학습할 수 있는 ELECTRA PLM(Pre-trained Language Model)을 사전학습 단계부터 개발하고, 해당 모델의 성능을 검증하기 위해서 총 4단계 실험을 진행했다. 실험 결과, 자체 개발한 ITB-ELECTRA 모델 및 Legal-BERT의 앙상블 버전이 57개 계약 조항 분류에서 가중 평균 F1-Score 기준 76%로 가장 우수한 성능을 달성했다.

건설사업의 대형화, 잡화, 전문화 추세에 따라 사업목표를 효과적으로 달성하기 위한 전문적이고 체계적인 관리의 필요성과 함께 그동안 진행된 CM의 가시적, 긍정적 효과로 인하여 CM용역의 발주가 점차 늘어나고 있는 추세이다. CM의 발전을 위해서는 기획단계부터의 CM 적용, 현실적인 CM 대가산정 기준 정비, 사업참여주체들의 인식전환, CM 자격 인증화를 통한 전문화 유도 등에 대한 제도적 방안이 마련되어야 한다. 그러나, 사업 추진 단계별 CM업무 수행 상 예상치 못한 현실적인 문제점들이 도출되고 있으며 이에 대한 대책이 요구되고 있다. 본 연구에서는 대학로 복합문화 공간의 건설사업관리 수행 중 기획단계를 배제한 CM입찰단계, 설계단계, 공사계약단계, 시공단계의 CM적용 사례를 요약하여 실무적용상의 문제점과 이에 대한 각각의 개선방안을 제시하여, CM제도의 성공적 정착 및 발전을 위한 방향을 제시하였다.
