항공기사고와 사고조사에 관한 법적 제 문제에 대한 고찰 (A Study on the Legal Issues relating to the Aircraft Accident and its Investigation)

  • 항공기사고는 그 사고의 특성상 전손성, 순간성, 손해의 거액성, 지상 종속성, 국제성 등을 특정으로 하고 있다. 이러한 항공기사고는 발생하지 않아야 하겠지만 일단발생하였다 하면 대량의 인명피해와 엄청난 재산상의 손실을 가져오게 되므로 정확한 사고원인 규명을 통한 사고의 재발을 방지하기 위한 철저한 대책이 요구된다. 또한 이러한 사고조사를 통한 항공사고의 원인 규명은 항공운송인의 책임을 결정지우는 결정적 요소가 될 수 있는 점에서 독립적이고 전문적인 기관에 의해서 객관적으로 수행될 것이 요구된다. 이와 관련 우선 법적으로 문제가 되는 것은 항공기사고의 정의와 그 범위, 국제민간항공조약과 그 부속서의 효력문제, 조사과정에서의 용의자에 대한 인권침해의 가능성과 용의자의 자기부죄거부의 특권, 조사권의 관할문제와 경합문제, 재판관할, 사고조사보고서의 내용과 그 공개범위의 문제, 사고조사보고서의 소송에서의 증거로서의 채택여부와 효력문제 등으로 많은 법적문제점이 있다. 항공사고조사는 사고원인을 정확히 규명하여 사고의 재발을 방지하는 데 그 목적이 있으므로 이러한 사고조사결과의 소송에서의 이용문제는 고의 또는 과실로 인한 항공운송인의 책임유무와 그 소재파악 등 실체관계를 파악하는 최소한에 그쳐야 할 것이며 형사사법적으로 이용되어서는 아니 될 것이다. 현재 우리나라의 경우 이러한 항공사고조사를 위한 기구로 사고조사위원회가 설치되어 있지만 그 전문성과 독립성에 있어 문제가 있다고 보여진다. 이리하여 정부에서는 독립적이고 객관적으로 항공사고조사 업무를 수행할 수 있도록 현행 "항공법" 에서 항공사고조사 분야를 "항공사고조사에 관한 법률(안)" 로 분법하여 이를 보강하는 작업을 추진중에 있으나 여전히 동 위원회가 건교부 산하에 있고 그의 운영도 건설교통부령에 의하도록 함으로서 그 독립적인 지위에 문제가 있다고 본다. 따라서 새로운 법률에 의하여 탄생되게 되는 사고조사위원회는 인적 물적으로 철저하게 독립성과 전문성이 보장되는 방향으로 입법되어져야 할 것이다.

국내 항공사고조사를 위한 항공사고 통합 데이터 관리시스템의 프로토 타입 개발 (Development of Integrated Data Management Prototype System for Aviation Accident and Incident Investigation)

  • 본 논문에서 국내 항공사고조사를 위한 통합 데이터 관리 시스템 프로토타입 개발을 제안한다. 최근 항공사고 조사 장비의 발전에 따라 사고조사 시스템은 다양한 형태의 jpg, avi, 및 wav 파일 자료들을 수집 및 관리해야한다. 하지만 ECCAIRS 시스템의 경우 항공사고 조사 시 발생하는 다양한 자료를 관리하기 위한 별도의 데이터베이스를 구축하고 있지 못한 상황이며, 국내 항공사고 관리시스템 역시 동일한 문제점을 가지고 있다. 따라서 본 논문에서는 해외 주요 국가의 항공사고보고서 시스템을 분석하고 국내 환경에 적용할 수 있는 방안을 마련한다. 통합 데이터 관리시스템 프로토타입을 통하여 기존 자료와 최근 조사한 자료를 입력을 통하여 성능을 확인하였다. 이 결과를 이용하여 최종 통합 데이터 관리시스템의 완성을 위한 기초 자료로 활용할 예정이다.

  • It is true that Aircraft accident investigation organization of Republic of Korea does not have independent role structurally and administratively. Also, in the event of an aviation accident it does not take the appropriate response and post-institutional measures for victims and their families support. With aware of this fact and to improvement this research paper present approach direction and suggestion of issues and implications for those by researching the operational practices of the United State's Victim Family support.

교통사고의 분석과 문제점 - 경주시 인왕동 사고를 중심으로 - (An Investigation of the Car Accident in Kyongju)

  • In a car accident in Kyongju, each of the two occupants insisted that he was not driving the car. The accident was investigated to determine who the driver is through careful review of the collision report, the statements of accident and witness, photographs taken at the scene, and the expert report of the National Institute of Scientific Investigation. The accident was reconstructed based on the physical principles, injuries of occupants, damages of the involved vehicles and their final stops. A mistake was found in the expert report.

정전기 화재·폭발 위험성평가 및 사고조사에 필요한 발생원인 변수 도출 (Derivation of Cause Variables necessary for Electrostatic Fire/Explosion Risk Assessment and Accident Investigation)

  • Static-electricity-induced fires and explosions persistently occur every year, averaging approximately 80 and 20 cases annually according to fire statistics provided by the National Fire Agency and industrial accident statistics provided by the Ministry of Employment and Labor, respectively. Despite the relatively low probabilities of these accidents, their potential risks are high. Consequently, effective risk assessment methodologies and accident investigation strategies are essential for efficiently managing static-electricity hazards in fire- and explosion-prone areas. Accordingly, this study aimed to identify the causal variables essential for accident investigations, thereby facilitating risk assessments and the implementation of effective recurrence prevention measures to mitigate static-electricity hazards in fire-and explosion-prone regions. To this end, industrial accident statistics recorded over the past decade (2012 to 2021) by the Ministry of Employment and Labor were analyzed to identify major fire and explosion incidents and related industrial accidents wherein static electricity was identified as a potential ignition source. Subsequently, relevant investigation reports (63 cases) were thoroughly analyzed. Based on the results of this analysis, existing electrostatic fire and explosion risk assessment techniques were refined and augmented. Moreover, factors essential for investigating electrostatic fire and explosion disasters were delineated, and the primary causal variables necessary for effective risk assessments and scientific investigations were derived.

  • It is necessary to develop highly sophisticated Modeling & Simulation (M&S) system for the scientific investigation of marine accident causes and for the systematic reproduction of accidental damage procedure. To ensure an accurate and reasonable prediction of marine accidental causes, such as collision, grounding and flooding, full-scale ship M&S simulations would be the best approach using hydrocode, such as LS-DYNA code, with its Fluid-Structure Interaction (FSI) analysis technique. The objectivity of this paper is to present three full-scale ship collision, grounding and flooding simulation results of marine accidents, and to show the possibility of the scientific investigation of marine accident causes using highly sophisticated M&S system.

A study on maritime casualty investigations combining the SHEL and Hybrid model methods

  • This paper reviews the analysis of a given scenario according to the Hybrid Model, and why accident causation models are necessary in casualty investigations. The given scenario has been analyzed according to the Hybrid Model using its main five components, fallible decisions, line management, psychological precursors to unsafe acts, unsafe acts, and inadequate defenses. In addition, the differences between the SHEL and the Hybrid Model, and the importance of a safety barrier during an accident investigation, are shown in this paper. One unit of SHEL can be linked with another unit of SHEL. However, it cannot be used for the analysis of an accident. Therefore, we must use an accident causation model, which can be a Hybrid Model. This can explain the "How" and "Why" of accident, so it is a suitable model for analyzing them. During an accident investigation, the reason we focus on a safety barrier is to create another safety barrier or to change an existing safety barrier if that barrier fails. Hence, the paper shows how a sea accident can be investigated, and we propose a preventive way of avoiding the accident through combining the methods of different models for the future.

  • The Lion Air JT610 accident in Indonesia in October 2018, along with the Ethiopian Airline ET302 accident in March 2019, is an significant aircraft accident that detects defects of the B737MAX aircraft. Shortly after the accident, the FAA prohibited operation of the aircraft. This action has affected the market environment of airlines and aircraft manufacturers around the world. In October 2019, Indonesian Traffic Safety Committee released an accident investigation report for Lion Air JT610, which concluded that the causes of the accident were MCAS design defects, lack of education and training, and errors in the repair process. This paper summarizes the flight control system of the B737MAX aircraft, the causes of the accident based on the final accident investigation report, and provides considerations for aircraft design and retrofit.

한국형 교통사고 심층조사 DB 체계 구축에 대한 연구 (A Study on the Construction of the Database Structure for the Korea In-depth Accident Study)

  • The accident statistics use the data from police accident reports and statistics. Although the official accident statistics are useful, they provide very limited information about how accidents occur, the cause of the accident and the injury mechanisms. This limitations could be overcome by carrying out the in-depth accident study and analysing investigations, collecting more detailed information. Meanwhile a net of in-depth investigation teams are operating worldwide, such as NASS (National Accident Sampling System) and CIREN (Crash Injury Research and Engineering Network) in US, OTS (On the spot investigation) in UK. In this study, the database structure and variables of Korea in-depth accidents investigation system would be proposed through considering the database structure of GIDAS (Germany In-Depth Accidents Study). GIDAS is one of the best system on the in-depth accident study system in the world. GIDAS was established in 1999 as a cooperation project between Federal Highway Research Institute of Germany (BASt) and research association on automotive engineering of German Car Industry(FAT). The iGLAD (Initiative for the Global Harmonization of Accident Data) was also considered to introduce into the database variables of Korea in-depth accident study. Current police reports were compared with GIDAS and iGLAD. To collaborate of the Worldwide in-depth accident data, this paper proposed that the database of Korea in-depth accident study would be introduced the structure of GIDAS and the core variables of iGLAD. Harmonization of the structures and core variables of Korea in-depth accident study will be better than the making unique ones. The database structure and core variables of KIDAS(Korea In-Depth Accident Study) introduced of GIDAS and iGLAD.

민수용 헬리콥터의 사고 비교분석 (The Relative Analysis of the Civil Helicopter Accident)

  • The safety should be primarily considered for air vehicle, such as helicopter, which is not easy to cope with when out of order or loss of control that followed catastrophe. The U.S National Transportation Safety Board (NTSB) investigated and analyzed for 34 years rotorcraft accidents that occurred from 1963 through 1997. This paper handles intensively the relative investigation and analysis of recent 10 years domestic civil helicopter accidents to those of the United States in order to increase the safety of helicopter transportation and to consider the main design parameter before we develop Korean Civil Helicopter. To understand the overview of civil turbine helicopter accident, it uses the NTSB's accident investigation results and the overall accident trend for U.S civil single and twin turbine engine helicopter according to category, cause, activity, and phase of operation.
