A Study on the Link between the Serious Accidents Punishment Act and the Enterprise Disaster Management Standard: Focused on the Serious Industrial Accidents (중대재해처벌법과 재해경감활동관리체계 연계방안 연구 - 중대산업재해 중심)

  • Purpose: This study is intended to confirm the business disruptive risk in the Serious Accidents, and propose a plan to comply with the Serious Accidents Punishment Act through the Disaster Mitigation Activity Management System. Method: Through literature review and case studies, the requirements and characteristics of each of the Serious Accidents Punishment Act, the Disaster Mitigation Activity Management System, and ISO 45001 were compared and analyzed, and implications were derived. Result: The business disruption and financial adverse effects caused by industrial accidents were identified. Based on this and by using the Disaster Mitigation Activity Management System, measures to link the documentation requirements of the the Serious Accidents Punishment Act to the Disaster Mitigation Activity Management System, and to manage the implementation records of the Serious Accidents Punishment Act's duty were derived. Conclusion: When establishing and operating the Disaster Mitigation Activity Management System, it can not only comply with the Serious Accidents Punishment Act but also contribute to maintaining business continuity and ESG management through the prevention of various disasters and the minimization of secondary damage, etc.

  • In this study, delivery workers were regarded as workers and industrial accident and serious accident prevention were studied. As a result of the study, first, it was confirmed that awareness of safety guidelines has an effect on disaster prevention and is related to reducing serious accidents. Second, among the forms of organizational culture, rational culture was shown to have a positive impact on serious accidents. Third, the moderating effect of organizational culture Rational culture, a sub-concept, was found to have a moderating effect on serious accidents. Fourth, according to the opinions of workers for disaster prevention of delivery workers, it was classified into policy part, environmental part, and worker's duty part, and the necessity of strengthening safety education and strong regulation was suggested in the policy part.

  • Purpose: This historical research was done to identify disaster nursing activities during the last 60 years through the most serious disasters during the last 60years(1945-2005) in Korea. Method: Fot the data collection, three of main daily newspaper and The Korean Nurses Association News were reviewed and nurses who were called out to the most serious disaster onsite were interviewed. Results: The nurses were positively involved for setup onsite clinic, mobile medical services, triage, CPR, and psychological support during response and recovery phase, while hardly involved during preparedness phase. Conclusion: The clarification of job description for disaster nursing and developing systematic training program should be followed.

  • Various disasters have been continuously occurred in Korea from 1990s to now. However, there is no substantial improvement against damages as compared with the past due to various reasons such as lack of fundamental recognition, ineffective response systems and widespread insensitivity to safety. More worse, new types of disasters have been frequently generated due to rapid changes in social structures and industrial development, unusual changes in weather and changes of international situations. These disasters request comprehensive countermeasures. In particular, while material damages by disasters can be recovered, the losses of precious lives cannot be recuperated in any ways. Thus, it is critical to set effective disaster medical plans. The first way to minimize damages by disasters is the prevention and the next is to set the disaster medical plans focusing on preliminarily activating the emergency medical system to rapidly rescue and take appropriate emergency medical services for casualties in the early stage when any disaster occurs. Nevertheless, no sufficient researches or references do not exist up to now. Even worse, effective emergency medical systems that play critical roles in increasing survival rates of casualties in actual disaster areas is not deployed. For the United States, the consistent countermeasure system is established in FEMA through a close cooperative system with relevant organizations for serious accidents including terrorists' attacks or natural disasters. For the emergency medical services in disasters, the disaster medical plan is set to cope with any disasters in perfect order by special area as operating the National Disaster Medical SystemESF#8 Role by FEMA. Accordingly, we need to set the extensive and integrated disaster prevention system for rapid and flexible operation against various kinds of serious accidents. This study identified overall problems in disaster control plans in Korea and suggested how to improve the emergency medical service system in disaster areas. Furthermore, it aims to prepare the basic data to set the effective emergency medical service plans when substantial casualties break out and more reasonable and systematic disaster control plans to cope with the future occurrence of serious disasters.

  • The objective of this study was to analyze the awareness, necessity, and challenges of the Serious Disaster Punishment Act within the domestic construction industry, which is subject to the legislation implemented by the government. The research aimed to propose future improvement measures. According to the findings, safety officials consider securing more young and competent domestic skilled workers, as well as improving safety management standards and workers' safety awareness, to be the most crucial factors in preventing and reducing safety accidents. Furthermore, the primary improvement plan for the Serious Disaster Punishment Act involves clarifying ambiguous provisions in the current law. Government policy support is necessary to enhance the effectiveness of the Serious Disaster Punishment Act, and revisions should focus on preventive measures that contribute to the establishment of a safe working environment.

  • 중대재해처벌법이 도입되었으나 여전히 실무적으로 정착되고 있지 못한 실정이다. 이에 공무원과 공공기관 652명의 실무자들을 대상으로 중대시민재해 관련 실무상의 애로사항과 중대재해처벌법의 개정방향에 대하여 설문조사를 실시하였다. 그 결과 다양한 애로사항의 상당부분은 관련 기준이 부재하여 발생하고 있었으며, 중대재해처벌법 개정방향도 높은 비율로 의무사항을 준수하기 위한 구제적인 기준 제시가 필요한 것으로 조사되었다. 그러므로 구체적인 기준제시를 위하여 시행령 개정과 함께 관계부처가 발간한 중대재해처벌법 해설서를 개정 및 보완할 필요가 있다.

  • Aging of the fire organizations, typical disaster response agencies also will be in serious problems with aging society. It is expected that the ratio of more than fifties will reach 31~40% after 10~15 years in Seoul fire organization. This Aging of firefighters can bring about a serious problem in disaster and safety management, since firefighters require robust fitness and healthy bodies in disaster situations. In this study, after the analysis of aging status and trend of firefighters in Seoul, I have an empirical analysis about the impact this aging has on organization effectiveness and QA. As a result, the increase of the elderly reduced organization effectiveness and QA. In addition, in the group consisting of less than 50, it is expected to increase the organization's effectiveness and QA activities through field activity to improve the professional skills with age, but could not be confirmed. In the group consisting of more than fifties, it was found that aging had a significant negative impact on organizational effectiveness and QA activities as factors, including physical deterioration by aging.

  • 중대재해처벌법(이하 "동법" 병기) 시행 전후로 동법에 대응하기 위한 정부 지원과 학계 연구는 많이 진행되어 왔으나, 대부분은 사전 예방에 치중되어 재해 발생 이후 기업 운영상의 리스크 관리나 피해경감 등을 위한 연구가 부족하였다. 중대재해를 줄이기 위해서는 사전 예방이 우선이지만 재발방지 및 추가 피해 최소화 노력도 뒤따라야 한다. 따라서, 본 논문에서는 재난 및 업무중단성 사고에 대하여 예방, 대비, 대응 및 복구활동에 필요한 문서화된 관리체계를 규정하고 있는 재해경감활동관리체계(이하 "동 체계" 병기)를 활용하여 중대재해처벌법을 준수할 수 있는 방안을 연구하였다.

  • Purpose and Method: The purpose of this study is to understand the current status of safety management following the enforcement of the Serious Accidents Punishment Act. In-depth interviews were conducted with the general managers of critical disaster work at a total of 4,555 facilities managed by 11 city-affiliated organizations under the Seoul Metropolitan Government. Through this, work-related matters are analyzed and structural causes of accidents and disasters are derived. And we would like to take improvement directions and countermeasures. Result: There is a limit to the recognition and prevention of serious accidents punishment, and improvement is needed in work overload and avoidance, communication, information management and utilization. Conclusion: As the burden of work is high, it is necessary to prohibit other tasks and concurrent positions, hire safety management experts, grant authority in line with the work, require an incentive system for safety work, and develop educational materials suitable for the ability to perform safety work.

  • Purpose: This study propose efficient and practical measures to comply with the duty to secure safety and health of the Serious Accidents Punishment Act at small businesses. Method: Based on literature review and previous studies, a plan to comply with the Serious Accidents Punishment Act was reviewed by the link with the safety and health management system and using the process approach method, etc. Result: It was confirmed that if the safety and health management system is faithfully implemented, it is possible to comply with the duty to secure safety and health under the Serious Accidents Punishment Act. In addition, a methodology for fulfilling and inspecting the duty to secure safety and health was presented. Conclusion: If the safety and health management system is operated actively by utilizing the process approach and implementation inspection checklist, it is judged that it will be possible to comply with the Serious Accidents Punishment Act as well as to continuously improve the safety and health management system.
