Review on the Justifiable Grounds for Withdrawal of Meaningless Life-sustaining Treatment -Based on a case of Supreme Court's Sentence No. 2009DA17417 (May 21, 2009)- (무의미한 연명치료 중단 등의 기준에 관한 재고 - 대법원 2009.5.21 선고 2009다17417사건 판결을 중심으로 -)

  • According to a case of Supreme Court's Sentence No. 2009DA17417 (May 21, 2009), the Supreme Court judges that 'the right to life is the ultimate one of basic human rights stipulated in the Constitution, so it is required to very limitedly and conservatively determine whether to discontinue any medical practice on which patient's life depends directly.' In addition, the Supreme Court admits that 'only if a patient who comes to a fatal phase before death due to attack of any irreversible disease may execute his or her right of self-determination based on human respect and values and human right to pursue happiness, it is permissible to discontinue life-sustaining treatment for him or her, unless there is any special circumstance.' Furthermore, the Supreme Court finds that 'if a patient who is attacked by any irreversible disease informs medical personnel of his or her intention to agree on the refusal or discontinuance of life-sustaining treatment in advance of his or her potential irreversible loss of consciousness, it is justifiable that he or she already executes the right of self-determination according to prior medical instructions, unless there is any special circumstance where it is reasonably concluded that his or her physician is changed after prior medical instructions for him or her.' The Supreme Court also finds that 'if a patient remains at irreversible loss of consciousness without any prior medical instruction, he or she cannot express his or her intentions at all, so it is rational and complying with social norms to admit possibility of estimating his or her own intentions on withdrawal of life-sustaining treatment, provided that such a withdrawal of life-sustaining treatment meets his or her interests in view of his or her usual sense of values or beliefs and it is reasonably concluded that he or she could likely choose to discontinue life-sustaining treatment, even if he or she were given any chance to execute his or her right of self-determination.' This judgment is very significant in a sense that it suggests the reasonable orientation of solutions for issues posed concerning withdrawal of meaningless life-sustaining medical efforts. The issues concerning removal of medical instruments for meaningless life-sustaining treatment and discontinuance of such treatment in regard to medical treatment for terminal cases don't seem to be so much big deal when a patient has clear consciousness enough to express his or her intentions, but it counts that there is any issue regarding a patient who comes to irreversible loss of consciousness and cannot express his or her intentions. Therefore, it is required to develop an institutional instrument that allows relevant authority to estimate the scope of physician's medical duties for terminal patients as well as a patient's intentions to withdraw any meaningless treatment during his or her terminal phase involving loss of consciousness. However, Korean judicial authority has yet to clarify detailed cases where it is permissible to discontinue any life-sustaining treatment for a patient in accordance with his or her right of self-determination. In this context, it is inevitable and challenging to make better legislation to improve relevant systems concerning withdrawal of life-sustaining treatment. The State must assure the human basic rights for its citizens and needs to prepare a system to assure such basic rights through legislative efforts. In this sense, simply entrusting physician, patient or his or her family with any critical issue like the withdrawal of meaningless life-sustaining treatment, even without any reasonable standard established for such entrustment, means the neglect of official duties by the State. Nevertheless, this issue is not a matter that can be resolved simply by legislative efforts. In order for our society to accept judicial system for withdrawal of life-sustaining treatment, it is important to form a social consensus about this issue and also make proactive discussions on it from a variety of standpoints.

Mencius Thoughts on Social Welfare (맹자사상의 사회복지적 함의)

  • This study aims at attempting to make a new interpretation of Mencius from the point of social welfare. The thoughts of social welfare, found from Mencius, are temporal and humanistic and near to those in nowadays. Social welfare began under the name of philanthropic work, relief work, charitable work or social work from the Industrial Revolution in the 18th century on. Welfare means the whole social activities such as satisfying the fundamental desires of the social members, ensuring the conditions of their lives, and ultimately achieving social integration and stability. It means the conditions of their lives and wellbeing. Wellbeing means the minimal physical desires and psychological stability. The realization of the economic system through concept of steady livelihood and steady mind, tax system and well-field system, proposed by Mencius, can be ensured by the whole social activities such as ensuring the stable lives of the social members, enriching and satisfying their happiness and ultimately achieving social integration and stability. The thoughts of Mencius include people-as-root idea, which regards people as most important and tries to solve the instability and inequality that are the structural vulnerabilities in modern capitalist society. His concept of Way of the king means promoting people's sense of happiness through education of morality, based upon the people-as-root idea and filial and fraternal responsibilities. The main ideas of social welfare include living like a human being, ensuring minimal physical and psychological stabilities through social welfare system and welfare policy, enriching human dignity and freedom and enhancing the quality of lives. The thoughts of Mencius include all the above ideas. In particular, he desired to establish ethically and morally stable society by economically implementing the well-field system in Zhou dynasty, based upon politically benevolent governance of the politicians. That society was the people-as-root society, the realization of which was the ideal society Mencius desired to establish, and the goal of his thoughts on social welfare. This study, among the thoughts of Mencius, investigated his ideas on social welfare and the practical ethics for applying them to real society. In addition, to understand his ideas on social welfare, not only the social and economic backgrounds and conditions but also the political ideas at that time were also investigated. This will provide the opportunity to make more in-depth research of the elements of social welfare intrinsically contained in his thoughts.

What is Mind? -A Definition of Mind in Relation to Mind Humanities ('마음'의 한 정의, -마음인문학과의 관계에서)

  • In this paper I undertake to define what is mind, as a partial project of the philosophical foundation of the Mind Humanities. To this end I ask myself, where can be found the field, to which the various or whole psychological concepts and discourses generally relate, and then I identify the correct field to be the field of existential activities of human beings as being-in-the-world. When human beings as being-in-the-world live their lives, her life is built up out of the internal biological activities, the worlds of space and time, and actions. While the various scenes of individual life of man produced by a dynamic coordination of those worldly components, the basis of the mechanism of that coordination is explained by a biological model of self-sufficiency system that I developed here. On the basis of this model, I show step by step, how and through which (logical) way organisms configures their living, as it is. With respect to those steps of the life-construction of the organism, or in light of each step corresponding to each configuration, I construct different types of mind, i.e. impulsive mind, manipulative mind, meta-mind, collective consciousness/mind and finally personality, while every mind is further subdivided. Finally, I define mind, in light of its function in human life and with respect to the generalized sense of the whole processes as outlined above, as an organ which weaves (above mentioned) worldly components to Dasein, and sublimates and expands it to a better living.

A positive interpretation of Louis Lavelle for the Presence of Evil and Pain, and its Limitations - Focusing on evil and suffering - (루이 라벨의 '악의 현존과 고통'에 대한 긍정적인 해석 그리고 그 한계 - 『악과 고통들』을 중심으로 -)

  • In the philosophy of Louis Labelle, the subject of "good and evil", which is rarely discussed in modern philosophy, emerges as a very important concept. In his reasoning, the notion of evil starts from a passive stipulation of the Scholastic philosophy of "the lack of being", but he defined the evil, which actually exists in the world with more positive sense as a willing force destroying "life and values". In his reasoning that defines "the presence of evil" as "le scandale du monde", all humans have the possibility of evil as an attitude of will, and the presence of evil in the world and in human society is inevitable. On the other hand, because the outcome of evil appears as physical and mental "pain", the human's attitude toward pain, which attempts to deny suffering, induces a moral will to overcome this evil. The moral anguish, which is the "internal suffering" that we have in front of the presence of evil, makes us conscious of becoming a "moral being", and people become self-satisfied here. Although painful, self-satisfaction and happiness about becoming a moral being is the only occasion and motive for man to overcome this by opposing the presence of evil. In other words, Lavelle's thoughts for good and evil are based on "moral psychologism", and the "coherence of psychological horizons and ethical horizons" between rejection of suffering and moral agony enables "ethical optimism" that man constantly overcomes evil and produces good. This is clearly an advanced modern application of scholasticism on the concept of evil.

A Study on Youth Career Education through Analysis of Social Economic Perception of Young People: Using Photovoice Methodology (청년들의 사회적 경제 인식 분석을 통한 청년 진로교육에 관한 연구: 포토보이스 (Photovoice) 방법론 활용)

  • The purpose of this study was to investigate how college students perceive social economics as a young age, This study was conducted three times at intervals of two weeks with five college students who are engaged in SEN club activities in Seoul, Korea. To achieve the purpose of the study, a participatory practice research technique called Photovoice qualitative research method was used. Participants in the main topic of social economy were selected by the participants as 'Social economy is', 'SEN for me' and 'My future career'. Respectively. The results of the study are as follows. First, the research students of the study group have taken pictures of the social economy in terms of 'diversity', 'consideration', 'cooperation', 'cooperation', 'help' and 'conflict of interest'. Second, the students participating in the research semantics mean the pictures taken with 'enjoyment', 'happiness', 'hope', 'community', 'sense of belonging' and 'affection'. Third, the college students who participated in the study have taken the meaning of the pictures taken in the future, such as 'clumsiness', 'what they want to do', 'career towards the public'. Finally, in-depth interviews on the career paths of graduates reveal that it is not easy to advance into a social economic organization. The results of this study provide the practical guidelines where the curriculums needed for the entrepreneurship education at graduate schools by suggesting consistency for the systematic and comprehensive curriculum design. It was reflected the survey result from the graduate students taking the entrepreneurship subjects. Therefore, it will contribute the foundation of the present curriculum of Entrepreneurial Graduate School.

A Study on the Acceptance of Buddhist Idea in Industrial Design (산업디자인에 있어서 불교사상의 수용에 관한 연구)

  • Recently, the West's interest on Buddhism has been uprising. If the interest on Buddhism is especially from Western intellectuals, it will surely be the motive to change, the future of Western society. Actually, while the West has been interested in the material civilization on the basis of Christianity, the East has been pursuing after the spiritual culture on the basis of Buddhism. However, what does it mean that many of civilized westerners have come to dislike the manner of scientific pursuit and strict rationality which made them wealthy materially\ulcorner It means that they have felt their ideologies which is based on the Christian culture, has met an end or at least they have started to get interested in the Eastern ideology, 'Buddhism'. Particularly, if we agree that industrial design is a field of basis on the stringent rationality, and is a field of applied science on the basis of technology and production, it surely must have rather been influenced by Christian culture than Buddhism. But regardless of material richness by Christian culture, some Western intellectuals'secession from christianity means that their pursuit of material civilization doesn't help much in chasing after human original happiness. Instead, they are charmed by the fact that their mental illness problem, which is the result of the incessant pursuit of materialism, can be salved more 'scientifically'rather by Buddhism than Christianity. Compared with the westerners'spiritual unhappiness by the strong pursuit of material, Buddhism lowers their passion for material and help to lead their lives happily with least'pursuit of materialism. In this sense, I insist that we need to study'Design'from a viewpoint of Buddhist idea.

The Implications of Heidegger's 'Da-Sein' for Establishment of School Educational Objective (Heidegger의 '현존재(Da-Sein)'가 학교교육목표 설정에 주는 함의)

  • This research aimed at investigating the implications of the view of human beings of Heidegger's 'Da-Sein' on the establishment of the school educational objective. The traditional western view of human beings is a rational human one. Hume criticized such a rational human view already through his unique (naturalistic) view, which is a treatise of passion. However, Hume's emotional human view still remained a functional human view, which is essentially the same as the rational human view. Nevertheless, Heidegger intended to depart from the functional human view through his existential human view, suggesting a new concept of 'Da-Sein'. 'Da-Sein' is an alternative term that Heidegger created to replace the term, human, in order to dissolve the prejudice, 'animal rationale', inherent in this term. 'Da-Sein' has three characteristics, i.e. Existenzialit, Jemeinigkeit, and 'In-der-Welt-sein'. These three characteristics of 'Da-Sein' have the following implications for the establishment of the school educational objective First, the school educational objective should be stated in terms that have significance for the students and help them to continuously develop their self. Second, the school educational objective should be realized by the students in various ways. Third, the school educational objective should include a sense of universality that can be shared by the students. The current change of the school educational objective in some schools which is based on the students' happiness has an aspect related to the significance of 'Da-Sein'. The establishment of the school educational objective based on Heidegger's 'Da-Sein' could open the way to education that considers the true existence characteristics of human beings.

The Transformation of Norms and Social Problems: Focusing on the COVID-19 Pandemic (규범의 전환과 사회문제: 코로나를 중심으로)

  • This study was conducted to examining the socio-cultural impact of the COVID-19 pandemic that swept the world around 2020, and the transformation of norms and social problems due to COVID-19. For this, the characteristics of changes in the socio-cultural norms of the 14th century European Black Death, a representative example of the pandemic, were derived, and based on this, the COVID-19 pandemic was analyzed. The Black Death served as an opportunity to change social norms based on the existing religious authority and the power of the feudal system to the Enlightenment. The population declination and labor shortage also promoted commercialization and mechanization. Printing, which spread during this period, led to the popularization of knowledge, which raised the level of thinking and led to epochal scientific development. This became the foundation of the Industrial Revolution. Like the recent Black Death, COVID-19 has triggered changes in social norms. The technological environment of metaverse, a mixture of virtual and reality, has changed the norm of a consistent identity into free and open identities exerting various potentials through alternate characters. In addition, meme, which are about people being friendly to those with the same worldview as him on the metaverse, weakened the sense of isolation in non-face-to-face situations. Artificial intelligence (AI), which developed during the COVID-19 pandemic, has entered the stage of being used for creative activities beyond the function of assisting humans. Discussions were held on what new social problems would be created by the social norms changed due to the COVID-19 pandemic.

Characteristics of Social Security Contained in Mecius's People-Care Theory(保民論) (맹자의 보민론(保民論)이 지닌 사회보장적 성격)

  • This paper aims to define Mecius's people-care theory(保民論), and aims to recognize the characteristics of social security contained in Mecius's people-care theory. Mecius considered to the public relief as King's obligation. So to speak, the King protects to the property of the people. Especially his people-care theory implicate to continuity of safety life, a relief fund on the property, protection of disaster damage. Continuity of safety life means to enabling the people procurable food, clothing and bury dead persons without difficulties. It's may be said that implicated to the theory and system of modern social-welfare. It is reason for his opinion that a state should construct in the minimum social safety network by taking responsibility for basis needs of life. He was a humanist so much. He thought about the pursuit of the human happiness and the improvement in quality of life. Therefore his idea nearly means to the social security system in a modern sense. His thought is not only an ideal background on the public assistance and a social relief security in the contemporary but also a relief activity system such as Jindaebup called historical prototype of social welfare. It is an important fact that his people-care theory implicate to social security system.

A Phenomenological Study on the Self-care of Middle-aged One-person Households (중년 1인 가구의 자기돌봄에 대한 현상학적 연구)

  • The purpose of this study is to understand and explore the essence of the self-care experiences of middle-aged one-person households considering their individual circumstances and situational context. In this study, 10 middle-aged people in one-person households were interviewed. The interview data were analyzed using the phenomenological analysis. In result, middle-aged one-person households considered self-care as 'means to protect themselves', 'preparation for their single life in late adulthood', and 'behavior to feel gratitude and happiness in the present.' Their motives for self-care were 'being aware of their physical aging and possibility of illnesse', 'feeling threatened about their safety', 'sensing that their daily livings may be at a risk', 'absence of a caregiven person who can take care of them', 'maintaining of their psychological health', 'being burned out from busy working schedules', and 'to lessen their own and their family's worries and anxiety.' Their specific ways of self-care were 'physical health care', 'private activities for emotional care', and 'meeting people.' Consequently, the self-care of middle-aged people had a positive impact on their work and relationships, lessened their sense of isolation, and brought comfort to their lives. Based on the results of the study, this study proposed the implications, limitations, and suggestions for further research.
