Review of the Law for Healthcare Workers in Kindergartens (유치원의 보건의료 인력 관련 법령 검토)

  • Purpose: This study aimed to identify the problems and improvement areas by reviewing the laws related to kindergarden healthcare workers. Methods: The laws were searched at the Korean law information center (https://www.law.go.kr/). We reviewed the 「Early Childhood Education Act」, 「School Health Act」, 「Medical Service Act」, 「Elementary and Secondary Education Act」and their enforcement decrees and rules. Results: The legal role of health teachers as school healthcare professionals was comprehensively specified by the 「School Health Act. However, the qualifications for and roles of health teachers were not fully described in 「Early Childhood Education Act], indicating a unclear legal basis for the qualifications for and roles of kindergarten health teachers. To support healthcare workers in kindergartens, it is necessary to amend the 「Early Childhood Education Act」 that provides the guidelines for qualifications for kindergarten health teachers in elementary, secondary, and special schools who have completed necessary continuing education. A health hub kindergarten could be a step-by-step option for all kindergartens to have healthcare workers. Conclusion: This review demonstrated the importance of amending the laws on kindergarten health teachers and health hub kindergartens for child health and safety. These findings could be used to support policies related to kindergarten healthcare workers.

Development of School Health System and Projects in Korea from 1945 to 2010 (우리나라의 학교보건제도와 학교보건사업의 발달: 1945~2010년)

  • Purpose: The purpose of this study was to review the academic development of school health system and projects implemented in Korea since 1945. Methods: This study analyzed and reviewed literatures to find out the process of the development of school health system and projects implemented in Korea. Results: The history of school health in Korea since 1945 could be divided into three periods according to the development of school health system and projects; countermeasure period (1945-1969), support period (1970-1999), and innovation period (2000~). The major school health system and projects were focused on the health screening and prevention, health management and support, and health promotion for each period. Conclusion: School health system in Korea has been set successfully due to school health law(1967) and school meal law(1981), and various countermeasure, support, and innovation projects had implemented during last 60 years.

Prevention in the United States Affordable Care Act

  • The Affordable Care Act (ACA) was signed into law on March 23, 2010 and will fundamentally alter health care in the United States for years to come. The US is currently one of the only industrialized countries without universal health insurance. The new law expands existing public insurance for the poor. It also provides financial credits to low income individuals and some small businesses to purchase health insurance. By government estimates, the law will bring insurance to 30 million people. The law also provides for a significant new investment in prevention and wellness. It appropriates an unprecedented $15 billion in a prevention and public health fund, to be disbursed over 10 years, as well as creates a national prevention council to oversee the government's prevention efforts. This paper discusses 3 major prevention provisions in the legislation: 1) the waiving of cost-sharing for clinical preventive services, 2) new funding for community preventive services, and 3) new funding for workplace wellness programs. The paper examines the scientific evidence behind these provisions as well as provides examples of some model programs. Taken together, these provisions represent a significant advancement for prevention in the US health care system, including a shift towards healthier environments. However, in this turbulent economic and political environment, there is a real threat that much of the law, including the prevention provisions, will not receive adequate funding.

  • Article 347 of criminal law provides the act of deceiving another, thereby taking property or obtaining pecuniary advantage from another. On the other hand, the concepts of fraud and abuse are confused upon interpretation since the definition in National Healthcare Insurance Law is unclear, and it affects closely to the administrative measures such as surcharge levy by the period of inspection, therefore, the disputes continue in the forms of formal objection, administrative ruling and administrative litigation. This study aims to look over the legal problems on application of criminal fraud toward the abuse of 'Paid Medical Expenses(Article 57, Sections 1 and 4 of the National Health Insurance Act)'. The main issues are concept of abuse(Article 57, Sections 1 and 4 of the National Health Insurance Act), the problems of Directions of Health-Welfare Ministry on aspect of 'Nullum crimen sine lege' Principles, the proper sentenc-ing guidelines of fraud.

Current Systems of National and Regional Nutrition Surveys and Future Direction

  • The National Nutrition Survey in Japan (NNS-J) started in 1945 and has provided information on dietary intake and health status of Japanese citizens to the public and policymakers for more than half a century. We summarized several relevant issues on the survey in this report : the current framework of the NNS-J in accordance with the Nutrition Improvement Law, utilization of the survey for nutrition and health policy in Japan, the Health Promotion Law recently enacted in 2003, the national plan for health promotion and disease prevention (Health Japan 21), and possible measures to improve the survey systems under the new law. We also mentioned implementation structures of regional health and nutrition surveys, because the Health Promotion Law designates an active role of local governments on promoting health for their citizens, which will enhance the needs for appropriate assessment of health and nutrition conditions in each community as well as the monitoring at the national level. A Study on Law Consciousness of Nurses (간호사의 법의식에 관한 연구)

  • The Purpose of this paper was to get grasp the law consciousness of nurse in order to estimate a degree of law cognition, confidence consciousness toward law, consciousness of right and law-abiding spirit that nurses have. This paper made a survey of 566 nurses who were employed in general hospital. health center, school and health-clinic of chonju-city, Questionniare were composed 29 items through four dimension. The result of this survey showed that the role of university and hospital was insignificant for nurses in recognizing law. Consequently, not only hospital but also university ought to insert law in education curriculum or training course. Main contents of this paper are as follows; 1. Improvement of School Health program in Korea (학교보건사업(學校保健事業)의 효율화(效率化)를 위(爲)한 개선방안(改善方案)에 관(關)한 연구(硏究))

  • This paper reviewed present status of school health program in Korea to seek. The improvement of health of school children. The results are summarized from reviewing publications of school health and survey data from trainees for principals of primary and middle school at Korea National University of Education during Jun. 17 to Aug. 13, 1987. The major recommandations for the improvement of school health program in Korea of this study are as follow: 1. Reformation of School Health Organization It is hard to activate effective school health program without reformation of school health organization in the Ministry of Education. School health section in MOE should be reorganized for the planning, operation and evaluation of school health program. School health committee in MOE and Provincial Board of Education should be established by the health and education professions. 2. Appointment of school physician and recruitment of school nurse: School health center in Office of City/Gun Education should be established for increasing the utilization of school physician, and school nurse should be appointed for 3 - 4 schools in same area. 3. Improvement of school health education: 1) Curricula of physical education of teachers College/University should be rearrangement for school health education. 2) Role of school nurse as a health educator in school should be extented. 3) In-service training for health education should be done for teachers of physical education. 4) Professional health teacher should be trained independently from physical education in College of Education and Teachers College. 4. Revision of school health law and regulations: Present school health law and regulations should be revised by the recommendations of experts on school health.

Transition of Occupational Health Nursing Education in Korea (한국 산업간호교육의 변화추세 분석)

  • In December 1990, Occupational Safety and Health Law was amended to reinforce employer's responsibilities on employees' health and safety. Among the amended law it was important to expand the role of an occupational health nurse to the role of an occupational health manager. An occupational health manager should take charge of coordinating periodic health examination and environmental hazard evaluation, providing primary care, monitoring employees' health status, giving the workplace walk-through, selecting safe protection equipment, providing health information, counseling and health education, independently. This position of occupational health nurse is equivalent to the role of doctors or occupational hygienists. In 1991, government made a master plan to prevent occupational disease and injury. Under the plan, Korea Industrial Nursing Association (KINA) was established in 1994 with the purpose of improving health services and upgrading career opportunities for members. Therefore, this study was designed to analyze the transition of occupational health nursing education with the changes of law and policy in Korea between 1991 and 1996. In details, it was to analyze the rate of school providing occupational health nursing practice based lecture, lecture hours, lecture contents in undergraduate curriculum, program contents of graduate school, kinds of continuing education, etc. For this purpose, we conducted survey two times. In February 1991, baseline study was conducted with all nursing programs in Korea (19 BSN programs and 43 nursing departments of junior college). From April to May in 1996, the second survey was conducted with all nursing programs (38 BSN programs and 69 junior colleges). The first response rate was 66.1% and the second was 40.6%. Structured questionnaires were mailed to the deans or the community health nursing faculties. In the case of graduate school, telephone survey was conducted with 10 school of public health or environmental health area. Data from the yearbook of Industrial Safety Training Institute (ISTI), the history of Korea Industrial Health Association, and the journals of KINA were also included in the analysis. As the results, we found that there were remarkable improvement in undergraduate and graduate programs, obligatory as well as voluntary continuing education in terms of occupational health nursing expertise between 1991 and 1996. 1) The number of school providing occupational health nursing practice-based lecture was increased with the rate from 7.3% to 25.6%. The rate of school giving over 15 class-hours was increased from 33.3% to 46.6%. 2) Content areas were composed of introduction of occupational health, occupational epidemiology, industrial hygiene, occupational disease and injury, law and policy, health education, concept of occupational health nursing, role of occupational health nurse, occupational health nursing process, etc. Of content areas, occupational health nursing process was more emphasized with the increased rate from 43.9% to 88.4%. 3) In the case of graduate school, occupational health programs were increased from 4 to 10. One of them has developed occupational health nursing program as an independent course since 1991. 4) The law increased educational hours from 28 hours to 36 hours for introductory course at the time of appointment, and from 14 hours to 24 hours every 2 years for continuing education. Course contents were Occupational safety and health law, introduction of occupational health, health education methodology, planning and evaluation, periodic health exam, occupational disease care, primary care, emergency care, management, industrial environment evaluation, etc. In 1996, Korea Industrial Nursing Association has begun to provide continuing education after Industrial Safety Training Institute. 5) Various educational programs in voluntary base were developed such as monthly seminar, CE articles, annual academic symposium, etc. It was shown that changes of law and policy led rapid growth of occupational health nursing education in various levels. From this trend, it is expected that occupational health nurse expertise be continuously to be enhanced in Korea. Legal and political supports should proceed for the development of occupational health nursing in early stage.

An Analysis of School Health Law in Korea (학교 보건 관계법령 분석)

  • One of the first constitutional challenes to congressional legislation the area of school health came in 1967. The action of Ministry of Education for the school health progrom is within school health act constitued 20 Articles and ir\ts regulation of 14 Articles.This study was reviewed the school health act and its regulation for the developement of school healh program. The data were collected y 14 Boards of Education from November 1986 to Januar, 1987. The results of this sudy were identified the the articles with regard to health education activity, physical assessment activity, criteria of school health environment, control of communicable disease, First-Aid and clinic management by school nurses.
