  • 수용자가 지니는 기본권 중에서 도서관을 설치$\cdot$운영함으로써 그들의 권리 보호에 커다란 영향을 줄 수 있는 기본권 영역 즉 알권리와 정보 접근권, 형사피고인과 형사피의자의 권리, 교육을 받을 권리 등을 중심으로 이들 기본권의 내용에 대해 법령과 판례를 근거로 분석하고, 기본권 보장을 위해 도서관을 설치해야 할 필요성에 대해 검토하였으며, 제도화를 위한 방향을 제시하였다.

환자의 알권리 - 의약품의 처방 및 조제와 관련하여 - (Patients' Right to Know about the Physicians' Prescription and the Pharmacists' Compounding of Medicines)

  • This paper is relating to the debates upon the physicians' duty to issue the prescription documents to their patients. The duty should be approached in light of the patients' right to know about the prescription and pharmacy. The Korean Constitution is construed to protect the citizens' right to know as a fundamental right. The Constitution article 10 reads as follows: "All citizens shall be assured of human dignity and worth and have the right to pursue happiness. It is the duty of the State to confirm and guarantee the fundamental and inviolable human rights of individuals." The rights confirmed and guarantee by this article include the patients' right to know about what happens to their body, that is the treatments taken for them and so on. One of the treatments is the prescription and pharmacy. The information is necessary for them to establish their action for the damages in case of their harm resulted in by the negligence in prescription and pharmacy. Now that the prescription is written about by a physician and then the pharmacists compound the prescribed medicines, the patients need to get the documents signed by the pharmacists about the pharmacy. It should be noted that the patients right to know is the right to know and remember. Therefore the patients, who are laymen about the pharmacy, need two prescription documents one of which should be kept by them even after they take the prescribed and compounded medicines for the potential trial.

  • According to newly revised Korean Commercial Law, 1991, several amendments on the maritime liens as a special legislative rights duly performed so as to make an equity with mortgates of the ship. Consequently, it is also noteworthy that claimants of the maritime lien should know how to secure their legal rights on the ship. Such a legal practice is performing in accordance with the doctrine and principles of the law of forciable excution without court order. This paper, therefore, intends to study specific legal practice for exercising legal rights on the ship by due process of law.

방사선 및 원자력 관련 법제가 반영하는 기본권 (Fundamental Rights Reflected by the Legislation Regarding Radiation and Nuclear Power)

  • 연구배경: 방사선이용 및 원자력발전의 외향적 성장에 비해 국민이 우려하는 건강권, 환경권, 안전권, 알권리, 발전권, 생존권 등 기본권과의 관계 분석은 전무한 상태이다. 재료 및 방법: 방사선 및 원자력 관련 실정법 내용을 가능한 높은 수준의 권리보장이라는 최대주의적 관점에서 다수의 기본권 분석을 통해 삶의 질 향상을 위한 법률적 보완 방안을 도출하였다. 결과 및 논의: 한국 헌법에 방사선 및 원자력발전과 직접 관계된 기본권 내용은 최소한 12개 조항으로 다수의 권리와 관계된다. 방사선 및 원자력관련 실정법 14종에 헌법적 기본권이 다양한 조항으로 모두 반영되어 있다. 다수의 기본권이 함께 적용된 방사선 및 원자력 관련 실정법은 인간 삶의 질 향상 목적에서 생존권을 우선으로 한 건강권, 환경권, 알권리, 안전권이 작동되어야 하는 것인지, 생존권, 건강권, 환경권, 알권리, 안전권이 같은 크기로 작동되어야 하는 것인지에 대한 상대적 우위에 대해서는 신중한 결정이 필요하고, 인간영역에서 단시간에 평가하기에는 어려운 문제이다. 결론: 원자력, 방사선의 이용증진 측면과 위험 리스크 발생방지 측면 두 가지 목표를 동시에 조화롭게 추구해야 하는 정책은 우리나라 입장에서는 중요한 일이고, 권리 간 조화를 위해 올바른 가치판단이 필요하다.

복지권의 구성과 성격 (The Construction and Characters of the Welfare Rights)

  • 본 연구는 권리의 개념과 유형을 살펴보고, 인권 및 시민권 논의를 통해 복지권의 구성내용과 성격을 분석하였다. 분석 결과, 복지권의 구성 내용으로는 (1) 사회적 권리로서 사회보장권, 사회복지서비스권, 건강권, 교육권, 주거권을 (2) 경제적 권리로서 노동권, 노동시장 개입권 및 직업안정권, 자본통제권을 (3) 문화적 환경적 권리로서 문화권, 환경권을 포함한다. 그리고 복지권은 현대 시민사회에서 시민, 그리고 더 나아가서는 인간에게 부여되는 당연한 권리로서 자유권, 정치권 등 다른 권리와 동등한 가치를 지니며, 객관적으로 존재한다기보다는 구축되는 것으로 보아야 한다. 또한 복지권에는 동시에 의무도 수반되지만 그 의무는 비조건적인 성격이 강하며, 복지권에 따른 복지의 수준은 사회성원으로서 완전한 참여와 통합을 지향하는 목표로서 불평등의 지속성을 방지할 수 있는 적정수준이어야 한다.

알권리 시대, 정부3.0의 위험과 과제 (A Study on Government 3.0 in the Era of the Right to Know)

  • 본 연구는 알권리제도의 패러다임 변화를 이론적으로 고찰하고, 박근혜정부의 정부3.0이 당면한 과제들을 비판적으로 분석하는 데 목적이 있다. 이에 알권리와 정보공개제도에 관한 선행연구를 살피고, 이를 바탕으로 알권리의 개념을 협의와 광의로 구분하여 정의한다. 또한, 18세기부터 오늘에 이르는 알권리제도의 연혁을 고전적 자유주의 기반의 알권리 시대, 청구에 의한 수동적 정보공개시대, 적극적 정보공유의 시대로 구분하여 분석한다. 알권리제도의 연장선상에서 우리나라 정부3.0의 성과와 한계를 논하고, 결론에 갈음하여 정부3.0의 위험과 과제를 공공정보의 '품질', '수집과 활용을 통한 통제와 감시', '보안'이라는 3가지 측면에서 고찰한다.

국제라이선스계약상 경쟁제한조항에 관한 연구 (A Study on Competition Limitation Clause of International License Contract)

  • The object of International License Contract is technology. Technology is means to produce visible goods, which are human's intellectual creations such as Intellectual Property Right - patent, design, trademark- and Know-how. Unlike visible goods which decrease as being used, these technologies are possible to be produced expansively and develop additionally. Therefore, the way to make a contract of goods is a sales contract which transfers ownership while technology follows license contract which gives approval of use for a certain period. International license contract means that licensor has right to possess, allows licensee to use licensed technology for a fixed period and takes royalty. So there are various matters such as selection of the duration of a contract, confirmation of technology range, competition limitation, technique guidance and support, calculation of royalty, withholding tax between parties. This study examines licensor's grant of license and competition limitation. Intellectual property rights fundamentally give exclusive rights to the creator so the licensor use or dispose of his or her intellectual property rights at will. Technology transfer is possible through license contract because of this right. But licensor must exercise his or her intellectual property rights within a reasonable limit. It means, when licensor makes an unreasonable demand abusing his or her position, it is regarded as competition limitation clause and the deal itself may become null. Therefore, restraint on competition needs to be examined in detail as it influences on contract validity. Each country has their own competition laws for establishing a fair market order and inspection guide and guideline for judging whether there is any unfair act related to intellectual property rights. Judgment on intellectual property rights is subject the technology-introduced country's domestic laws and thus, contracting parties each need to precede opposite nation's domestic laws system.

Effective Patent Strategies for the Protection of Research Results

  • Objective: This study provides strategies of how to effectively convert an invention, created at universities or government-funded research institutes, into a strong patent with the clear understanding of its unique technological characteristics. Background: Regardless of the amount of research funds available in our country and the decent number of intellectual property rights created using the funds, there was a deficit of more than KRW 6 trillion in the technology trade balance related with intellectual property rights in the year of 2014. One of the reasons was that the vast number of patents that were being produced by universities or by government-funded research institutes were merely performance-based patents, namely, so called "patents for patents". Another reason is that developed technology from research and development could not be transformed into a strong patent right properly due to the lack of related knowledge. Method: After reviewing various references mentioned on the patent strategies, the definition of a strong patent and the strategies of producing a strong patent for an invention drawn out from research performance will be supplied. Results: To produce a strong patent right at universities or government funded research institutes, one should use strategies for strong specifications, strategies of product patents and method patents, strategies of patent portfolios, strategies of know-how, strategies of inventions defined by numerical limitation and strategies of parameter inventions for a more strategic approach. Conclusion: Strong patent rights will be produced with the use of effective patent strategies provided in this study. Application: It is estimated that the results of this study will aid the establishment of strong patents for inventions developed by research performance at universities or government-funded research institutions.

환자의 소비자로서 권리 (The Rights of Patients as Consumers)

  • The legal relationship between patient and physician is legally equal relationship. But, in times past, patients be compelled to sign an unequal contract, substantially. Because of the imbalance between supply and demand in the health care market. Today, the law of supply and demand in the health care market is running well. And as the cognition of citizens' rights grows, the relationship between patient and physician can also get a lot of changes. Patients have the right to know the information about medical care, and to decide whether or not to get treatment including invasions against their own bodies. In other words, Doctors have an obligation to explain to their patients. If doctors did not provide patients sufficient explanation or information, it violates the right of patients. This is a tort, or a breach of contract. To improve the remedy for violation of patient's right, patient is able to be protected by status as consumer. If patient is a kind of consumer in terms of medical consumption, he/she as consumer can enjoy supplementally the consumer's right. The patient as a consumer can exercise now a consumer's right as a constitutional right. In addition, with respect to consumer's rights, Framework Act on Consumers was enacted. This Act is based on constitutional provisions of Article 124 and the Act can be seen as a law that embodies consumer right because the provision of the constitutional law delegates specific contents. In the health care field, patients need to win recognition the statue of the consumer to hold the sovereignty of the consumer. In particular, if patients are consumers, they may be able to make good use of the quickly and efficiently collective dispute resolution and association lawsuit to rescue their damage, the Alternative Dispute Resolution(ADR) of Framework Act on Consumers.

응급구조사 선서 및 윤리강령의 제안 (Proposed oath and ethics code for emergency medical technicians)

  • Purpose: The purpose of our study was to introduce an oath and ethics code for emergency medical technicians (EMTs). Methods: The proposed oath and ethics code for the EMTs was evaluated using a modified Delphi technique. This oath and ethics code was presented at Korean association of emergency medical technician conference and was revised by experts in emergency medical services. Results: We examined the ethics codes for other allied healthcare professionals regarding the topics of human rights, health promotion, acting as an advocate, ethics, cooperation, observance, human rights, right to know, self-determination, confidentiality, and professionalism. These elements are reflected in our proposed oath and ethics code for EMTs. Conclusion: The proposed oath and ethics code would raise the professional status of EMTs.
