A Study on CIETAC Case about Acceptance with Different Terms - Focus on CISG - (변경을 가한 승낙에 관한 CIETAC 사례 연구 - CISG를 중심으로 -)

  • The wording of Article 18 shows that a statement made by or other conduct of the offeree indicating assent to an offer is an acceptance. Meanwhile, Article 19 states that this reply with different terms is a rejection of the offer and constitutes a counteroffer. For example, additional or different terms relating, among other things, to the price, payment, quality and quantity of the goods, place and time of delivery, extent of one party's liability to the other, or the settlement of disputes are considered to alter the terms of the offer materially. However, this reply with different terms which do not materially alter the terms of the offer constitutes an acceptance unless the offer or, without undue delay, objects orally to the discrepancy or dispatches a notice to that effect. As a result, the acceptance depends on whether different terms are material or not. CIETEC holds that the deletion of contract violation liability clause is not equal to an alteration to the extent of one party's liability to the other as stipulated in Article 19(3) of the CISG. In addition, CIETAC recognizes that one party had orally accepted the modifications made to the sales confirmation, with even China declaring against an oral contract. Lastly, CIETAC holds that the sales confirmation has been established when both parties signed on the sales confirmation instead of the acceptance being effective. Korean companies should, thus, note these issues when they solve disputes at CIETAC.

A Study on Factors Affecting the Continued Usage Intention of Ubiquitous Services (유비쿼터스 서비스의 지속적 이용의도에 영향을 미치는 요인에 관한 연구: 유비쿼터스 시스템적 특성과 서비스 품질 요인을 중심으로)

  • Ubiquitous computing is enhancing computer use by making many computers available throughout the physical environment without being noticed to the users. To facilitate successful adoption and diffusion of ubiquitous systems, it is important to find out the factors affecting their uses. Although researches related to ubiquitous computing have been vigorously conducted from the aspect of system and service provider, there have been very few studies that focus on the user's perspective. This study attempts to find out major factors which are dedicated to the development of ubiquitous systems and services and the relationships between these factors and user satisfaction factors. This study derived the specific factors that characterize ubiquitous services, such as ubiquity, contextual offer, user affinity, privacy, reliability, responsiveness, assurance, and empathy. We also considered service quality factors of ubiquitous services. Then these factors were combined with the Expectation Confirmation Theory (ECT) model and the path analysis was applied to find out the factors affecting user satisfaction and the intention to use the systems. The research findings indicate that ubiquity, contextual offer, privacy, reliability, and responsiveness affect the perceived usefulness. The perceived ease of use and confirmation were found to affect the perceived usefulness. The perceived usefulness, perceived ease of use, and confirmation fumed out to influence the satisfaction. It turned out that the result of this study on the relationship between the perceived usefulness and user satisfaction was identical with the findings in previous related ECT researches. We think this study makes two significant contributions to the development of ubiquitous services. First, this study provides basic implications for better ubiquitous services by considering important characteristics of ubiquitous systems as services. Second, this study also suggests important factors that need to be considered when ubiquitous service providers develop new ubiquitous services to improve user satisfaction and the intention to use the services.

A Study on Factors Affecting Intention to Continuous Use Metaverse Platform Service (메타버스 플랫폼 서비스의 지속사용의도에 영향을 미치는 요인에 관한 연구)

  • Purpose: The purpose of this study is to examine the factors affecting the intention to continue using the metaverse platform service from the user's point of view. Methods: The study conducted a survey of experienced people using Zepeto, Ifland, Gather Town, Zep, Roblox, Fortnite, and Minecraft, which are virtual world types among metaverse types, and valid 415 data were analyzed by SPSS (ver 22.0) and R (ver 4.1.0) program packages. Results: As a result of empirical analysis, it was found that interactivity and social presence among the characteristics of metaverse affected expectation confirmation, and sensory affordance and functional affordance affected expectation confirmation as affordance factors. In addition, all four characteristics of metaverse, reliability, playfulness, interactivity, and social presence, were found to have the greatest affect on perceived usefulness, and it was analyzed that playfulness, social presence, and reliability were influenced in order. The affordance factor was also found to have a positive effect on physical affordance, sensory affordance, and functional affordance. This study was found that it had a positive effect on the relationship between expectation confirmation and satisfaction and the relationship between perceived usefulness and satisfaction. satisfaction was analyzed to lead to continuance intention. Conclusion: This study is meaningful in that it examines the perspective of users who can be called customers of metaverse platform services. Based on the results of this study, it is expected to have a significant effect on the development of metaverse platform services not only on platform operators that provide metaverse platform services but also on providers who plan events and education using metaverse platform services.

A Study on the Selection Attributes of Convenience Store PB Lunch Box using IPA (IPA를 이용한 편의점 PB 도시락의 선택속성에 관한 연구)

  • This study compared and analyzed the importance-satisfaction regarding the selection attributes of the convenience store focusing on PB lunch box for consumers of 20s and 30s. According to the research results, the importance of factors such as easy purchase, time reduction, convenient intake were found to be high among the selection attributes of the convenience store PB lunchbox and those of factors such as confirmation of food ingredients, nutrition, and new taste were found to be relatively low. In addition, factors with high satisfaction included easy purchase, convenient intake, time reduction, while factors with low satisfaction were confirmation of food ingredients, nutrition and hygiene. The results of the IPA analysis were as follows: The $1^{st}$ quadrant (Keep up the good work) included convenience, time reduction, easy purchase, convenient intake, convenient cooking method, and convenient packing container Etc. $2^{nd}$ quadrant (possible overkill) includes origin labeling and the 3rd quadrant (low priority) includes packing container design, convenient storage, consistency of quality and taste, good taste, moderate amount, new taste, one meal, moderate quantity and quality, inexpensive intake, and hygiene Etc. $4^{th}$ quadrant was found to include no corresponding factors.

Development of a Multi-Item Scale for Measuring Theme Park Service Quality (주제공원 서비스질의 측정 척도 개발에 관한 연구)

  • Service quality is defined as the perceived difference between performed service and expected service. In this paper, theme park service quality is conceptualized in relation to consumer's total satisfaction on theme park visitation. A 20-item scale was constructed to measure Theme Park Service Quality. The following four steps were employed in developing the service quality measure: 1)identification of service quality dimensions, 2)development of scales from a set of items describing the dimensions, 3)empirical verification of the scale's construct validity which refers to dimensionality, convergent validity, and nomological validity, and 4)confirmation of the utility. The scale was found to be an empirically valid and reliable evaluation tool for service quality enhancement. In addition, the scale would be an useful criterion for market segmentation and positioning.

  • Often arrangement for effective product assessment and audit have not been completely satisfactory. The underlying reasons are: (a) The lack of early evidence of new unit quality. (b) The collection and processing of data. (c) Ineffective data analysis techniques. (d) The variability of information on which decision making is based. Because of the nature of the product the essential outputs from an affective QA organization would be: (a) Confirmation of new unit quality. (b) Detection of failures which are either epidemic or slowly degradatory. (c) Identification of failure cases. (d) Provision of management information at the right time to effect the necessary corrective action. The heart of an effective QA scheme is the acquisition and processing of data. With the advent of data processing for quality monitoring becomes feasible in an automotive testing environment. This paper shows how the method enables us to use Automotive Testing data for the cost benefits of QA management.

BIM Clash Quality Control by Expert System (전문가시스템을 활용한 BIM 물리적 품질 검토방법에 관한 기초연구)

  • As BIM in the construction industry has been activated, the building information reliability - design quality is getting important. Meanwhile, it is still difficult to reflect the quality control experience to the modelling since the current methods are strongly rely on a certain BIM tools or systems with formal logics and limited information for quality checking. Therefore, the checking results may contain a lot of issues unrelated or unnecessary to the BIM qualities. In order to overcome this problem, we firstly performed clash check using a conventional checking tool and secondly interpret the results by an Expert System to filter out more meaningful results. We found this study gave a confirmation that it is possible to improve clash quality control when we link the expert experience to the rule-based automatic checking system.

The Optimal Parameter Design of CD-R Substrate

  • In recent years, high-speed recording CD-R has already become the mainstream of CD-R market. Therefore, to promote the efficiency of recording CD-R is of significant importance. This study uses Taguchi's parameter design to improve the yield rate for the process of CD-R substrate. We have found 13 three-level controllable factors from the fishbone diagram, repeated 10 times the experiment with the L27(313) orthogonal array, and measured seven quality characteristics. We employ four general methods to find the optimal parameter conditions individually. Then, we perform the confirmation experiment and compare the results. Finally, we obtain the optimal parameter conditions. According to the analysis of benefits, the optimal parameter conditions can reduce the quality loss of CD-R substrate to about 21%. In the future, the results can be extended to other research of DVD-R substrate.

  • This study explores the factors influencing user satisfaction of mobile IPTV and their relationship. We formulate the research model based on characteristics of mobile device and IPTV. Responsiveness, contents satisfaction, price satisfaction, aesthetic simplicity, network quality are proposed as essential antecedents of mobile IPTV satisfaction. We also suggest network quality and gender as moderators. Our data analysis with 297 mobile IPTV users shows contents and price have significant positive effect on mobile IPTV satisfaction. Network quality shows positive moderation effect on the relationship between responsiveness and satisfaction.
