예술품의 국제거래상 준거법 채택의 문제는 실제로 소송의 결과와 밀접한 관계가 있는데, 최근 들어 국제예술품시장의 허브인 뉴욕을 중심으로 점차 현대적 혼합법을 채택하고 있다. 예술품 국제거래의 준거법 지정은 해당 국가의 사법규정만으로는 결정되기 곤란하며, 해당 국가의 이익 및 공익과 관련된 경우 공법규정도 함께 고려되어야 한다. 섭외적 사안에 대해서 우리 국제사법은 공공질서이론을 수용하고 있으며, 국제사법 제7조에 따라 입법목적상 해당 사안에 적용 되어야 하는 우리 강행규정은 준거법 지정여부와는 무관하게 적용된다. 여기서 말하는 강행규정이란 당사자 합의로 그 적용배제가 불가능 하고 외국법이 준거법인 경우에도 적용이 배제되지 않는 '국제적 강행법규'를 의미하며, 특정 법률이 국제적 강행법규에 해당하는 지는 법규의 의미와 목적상 적용의지를 가지는가를 면밀히 분석 후 판단해야 한다. 거래목적물이 문화재라면 관련 공법규범 역시 검토가 필요한데, 예술품의 국제거래 대상이 문화재의 범주에 속하는 경우, 당해 법원은 법정지의 강행법규까지 고려해야 한다. 우리 민법은 문화재 보호법이 적용되지 않는 경우에는 원칙적으로 문화재에 대한 선의취득을 인정하는데, 점유이탈 예술품 역시 선의취득의 대상이지만 도난 혹은 분실물인 경우 원소유자는 민법 제250조에 의해 도난, 분실 후 2년 내에 그 작품의 반환을 요구할 권리가 있고 매수인은 원소유자에게 반환하여야 한다. 나아가, 매수인이 전문 경매회사나 화랑, 갤러리 등 전문 업자에게 구입한 경우 원소유자에게 구입대금의 배상을 요구할 수 있고, 사적 거래로 구입한 경우에는 원소유자에게 구입가를 배상받지 못하고 작품을 반환해야 하는데, 이 경우 매수인은 매도인에 대하여 민법 제570조에 기한 책임을 물을 수 있다. 유니드로와(Unidroit) 협약 발효 이전에 도난 및 반출된 문화재에 대한 소급효의 부정과 미국의 조항 유보행사와 관련해서는 외교적 논의가 필요하며, 현재로서는 미국 연방도품법 활용 등 우회적 노력이 차선책이다.
이 글은 대학박물관에서 행해지고 있는 사회교육의 역사를 일별하고 사회교육프로그램의 내용을 분석한 뒤, 사회교육의 발전방향을 논한 글이다. 대학박물관 중에서 사회교육을 시행하고 있는 곳은 서울대학교, 이화여자대학교, 충북대학교, 영남대학교 박물관을 비롯한 20개 기관인데, 영남대학교 박물관이 1990년에 시작한 것을 비롯하여 20년이 되지 않는 짧은 역사를 가지고 있다. 박물관대학, 박물관교실, 교양강좌, 문화강좌 등의 명칭으로 시작한 사회교육은 주제나 교육방식 등이 점차 다양해져가고 있다. 사회교육프로그램의 내용을 분석한 결과, 교육프로그램은 고고학, 미술사, 민속학, 불교사, 역사학, 인류학, 현대미술 등 분야에 대한 강의실 강의와 현장강의, 답사로 이루어졌음이 밝혀졌고 강사는 대학교수가 주종을 이루고 수강생은 4, 50대의 여성이 대부분이었다. 교육프로그램에 대한 자체평가나 수강생의 평가가 미흡한 것으로 나타났고 수요자중심의 프로그램개발이 필요하다고 생각되므로 가칭 교육프로그램 개설위원회의 설치가 필수적이라 할 수 있다. 사회교육의 발전방향으로 대학박물관협회에 사회교육분과를 설치하여 지속적인 연구가 절실하고 사회교육의 청년화와 자녀와 함께 하는 토요박물관에서의 강좌수강도 권유해볼만한 사항이라 여겨진다.

This study introduces how to estimate the monetary value of intellectual capital of a public research institute by incorporating a non-market valuation technique, the choice experiments(CE). CE is a survey-based environmental valuation technique that has increasingly been popular over the last decade. The members of institute E, a typical type of public research institutes in Korea, were surveyed, before the data were fit to the conditional logit and mixed logit models. The total value of the institute's intellectual capital was estimated at approximately W3,377 billion for the year 2003. The institute's human, structural and relational capitals that comprise the intellectual capital were estimated at W18.7 billion, W10.7 billion and W4.4 billion respectively, for each of the components' index values improving by 1%. The human capital was placed a higher value than the other two. The study also shows that CE is a flexible technique that enables the researcher to estimate the monetary value of the intellectual capital whatever the index values of the component capitals and to interpret model estimation results more in depth by incorporating the mixed logit, a state-of-the-art discrete choice model, than the conventional conditional logic.
Arbitration is the system of resolving disputes not by the adjudication of a national court but by the award of an arbitrator or arbitrators. To settle disputes by arbitration, it should be concluded that the arbitration agreement which is implied that the parties agree to submit to the arbitral award about all or certain disputes which have arisen or which may arise between them in respect of defined legal relationships. It is a matter for debate that which types of dispute may be resolved by arbitration. This problem is concerning the arbitrability of the subject-matter of a dispute. National laws establish the domain of arbitration. Each state decides which matters may or may not be resolved by arbitration in accordance with its own political, social and economic policy. According to Korean Arbitration Act Art. 3 (1), any dispute in private laws would be the object of arbitral proceedings. Therefore, the parties may agree to arbitrate disputes relating to the rights that they freely dispose of. Besides, they may have the freedom to choose arbitration as the form of a dispute resolution. Because arbitration is a private proceeding with public consequences that some types of dispute are reserved for national courts, whose proceedings are generally in the public domain. It is this sense that they may not be the object of arbitration. After all, it could be the object of arbitral proceedings that disputes which are capable of a settlement by arbitration.
This study examines Korea's international development volunteer program as a citizen diplomacy initiative. Informed by a cultural perspective of transmission and relational models of public diplomacy, I examine the ways in which volunteer training incorporates cultural-learning into its program. The study finds that volunteer training is largely based on an instrumentalist approach to culture that places emphasis on learning the "explicit" side of culture, such as Korean traditional dance, art, and food as a strategy to promote the country's national image. In contrast, much less covered in the training program is a relational approach to culture-learning that is guided by a reflexive understanding of the "implicit" side of culture, or the values and beliefs that guide the worldviews and behavior of both volunteers and host constituents. Whereas the value of the volunteer program as a citizen diplomacy initiative is in its potential to build relationships based on two-way engagement, its conception of culture is mostly guided by that of the transmission model of public diplomacy. Based on the findings, this study calls for an integrated approach to culture-learning in volunteer training program to move the citizen diplomacy initiative forward.
This study looks into the change of the concept of museum and the programs as well from sociocultural point of view Since the very beginning in history, the museum has been a place to educate people with diverse evidences regarding on the human history by preserving legacies of the past. Throughout the long history, the concept of museum and its programs have been revised in accordance with social changes. Consequently, these changes brought the transformation of museums' roles nowadays. The reason is the public in diverse society are so accustomed to stimulus and dynamic cultural changes has induced those change in some senses. The study points that the variation of museum programs are to be developed and museum marketing strategies including global management of art museums should seriously be considered. It also brings new form of museum architecture. The concept of revitalizing museum can expand the band of public and provide them opportunities a place for various cultural activities which can lead a new trend in this society.
Tea flavonoids and polyphenols are well known for their extraordinary antioxidant activity which is considered important for anti-aging processes in animals. This study evaluated the anti-wrinkle effects of three different kinds of tea (Camellia sinensis) water extracts (CSWEs) including green, white, and black teas using a photoaged hairless mouse model. Data showed that the CSWE-treatment greatly improved skin conditions of mice suffering from UVB-induced photoaging, based on the parameters including the skin erythema index, moisture capacity, and transepidermal water loss. In addition, the wrinkle measurement and image analysis of skin replicas indicated that CSWEs remarkably inhibited wrinkle formation. In histological examination, the CSWE-treated mice exhibited diminished epidermal thickness and increased collagen and elastic fiber content, key signatures for skin restoration. Furthermore, the reduced expression of MMP-3, a collagen-degradative enzyme, was observed in the skin of CSWE-treated animals. Interestingly, comparative data between green, white, and black tea indicated that the anti-wrinkle activity of white tea and black tea is equally greater than that of green tea. Taken together, these data clearly demonstrated that CSWEs could be used as an effective anti-wrinkle agent in photoaged animal skin, implying their extended uses in therapeutics.
This study analyzed purchasing characteristics of local agricultural products and processed products as well as evaluated operation programs for Changnyeon festival participants. The purchasing rates of local agricultural products and processed products at this festival were 63.6% and 49.1%, respectively, and the main purchased crops were onion (42.6%) and garlic (20.7%). Drinks (43.6%) were highly purchased processed products. The recognition (95.3%) and preferences (98.4%) for Changyeong local agricultural products were high at this festival. Subjects (72.5%) responded that public relations were effective for sale at this festival, and evaluation of the operation program for the festival was $3.51{\pm}0.74$ (total score 5 points). Satisfaction with the experience event (37.7%) and exhibition event (33.6%) were high at this festival program, whereas participants gave low rates for art exhibition and sale events of local agricultural products (16.2%), cooking education (14.7%), direct education program (12.9%), and games (12.1%). This festival was an effective means of public relations, although purchase effects were not significant. This result suggests that the festival is necessary for planning a program to increase purchasing.
Civil college is a public educational institute for theoretical and practical learning. This study examines the social context behind France's civil college and how it is being operated. Many studies have been conducted in Korea to examine Germany in terms of lifelong learning or adult learning, but there is almost no study on France. Therefore, this study was conducted to analyze the history and operation of civil college, the "college outside college," in France and what Korea should learn from it. The civil college of France can be discussed in two contexts: first, it is AUPF, which stands for the French association of civil colleges, and it was mostly influenced by Northern Europe and Germany. Second, it is Caen Civil College, which was established by M. Onfray based his philosophical collaboration. The European civil college opened almost 1,000 courses in 2010-2011 for a variety of subjects, including Foreign Languages, Mother Tongue, the Dialects of Alsace, Philosophy, Cosmology, History, Art History, Psychology, Sociology, Astronomy, Botany, and Natural Science. Courses in Fine Arts include drawing, painting, sculpture, photography, music, and theater. For another form of civil college, Philosopher M. Onfray has been operating Caen Civil College since 2002 for general education and cultural education. It is not acknowledged by conventional philosophers, but it is contributing to the popularization of philosophy. In conclusion, the civil college in France has brought in-depth philosophical discussions out of the lecture rooms in an effort to popularize learning, making lifelong learning more accessible to the general public.
