건설업 재해율 조사의 정량적 산업재해 감소효과 (The Quantitative Assessment of Occupational Accident Reduction by the Injury Ratio Survey Regulations)

  • Injury Ratio Survey Regulations(IRS) was introduced to the construction industry in the Republic of Korea since 1992 and brought positive effect on occupational accidents reduction. There were tremendous decrease of injury ratios and enforcing of contractors' safety organizations from the beginning of IRS. In spite of these positive results, there were some negative effects such as contractors' shrinking injury reports to keep good injury ratios since these figures had a great impact on pre-qualification stage of bidding when general contractors were competing for new construction projects. Thus, this study aims to devote on lessening construction injury and elimination of above negative impacts through the quantitative statistic analysis of the effectiveness on the occupational accidents prevention of IRS. According to this assessment, there were decrease of from 6.37% to 44.34% in the accident ratios compared to those of non-IRS groups and decrease of from 3.32% to 83.51 % in the accident ratios compared to those of general industry including the unreported accidents.

유니버설 디자인의 원리와 지침에 의한 노인복지시설 기준 분석: 법률 규정을 중심으로 (Analysis of Facility Standard for Elderly Welfare Facility by Universal Design Principle and Guideline: Focusing on Legal Regulations)

  • The purpose of this study is to analyze the facility standards of the elderly welfare facilities applying the seven principles of the universal design. The facility standards of the elderly welfare facilities were limited to the provisions of the "Enforcement Regulation of the Elderly Welfare Act". There are few legal regulations applying the universal design in the construction of the elderly welfare facilities. The facility standards are set only with the minimum requirements such as securing the safety of the user, securing the space area, functional convenience, and risk prevention. However, the contents of the regulations are limited to the minimum standards for functional convenience and safety required for living. In conclusion, in the elderly welfare facilities, the notion of universal design, which considers not only the elderly, but also service providers, employees, and general visitors, should be considered.

  • 특별한 지하자원이 없는 한국에서의 석유화학산업은 전자 자동차 등의 업종에 기초소재를 공급하는 핵심 산업으로 위치하고 있으나 유해 위험물질을 다루는 공정상 화재나 폭발 등 위험이 상존해 있고 이로부터 현장의 인적 물적 안전보호를 위해 규제위주로 재해예방활동을 하고 있다. 하지만 개별법에 따라 정형화된 안전규제가 필요한 만큼 이행되지 않는다면, 당초 의도한 안전규제의 합목적성과 안정성이 훼손될 뿐만 아니라 공적 및 사적행정력의 낭비를 초래하여 전체 석유화학산업의 경쟁력을 떨어뜨리는 요소로 작용하게 된다. 이에 따라 본 연구는 석유화학플랜트에 적용하고 있는 대표적인 안전규제 항목들이 안전을 위해 필요한지와 이들이 규정대로 이행되고 있는지 규명하였으며, 연구결과에 따르면, 일부 규제의 필요성과 이행수준면에서 신뢰도가 낮은 것으로 나타났다.

제조업에서 지게차에 대한 안전보건 기준에 관한 규칙 개정 방안 (Proposed Revision of Standard on Articles for Forklift Trucks in Manufacturing Industries)

  • A forklift truck, commonly used for transporting heavy materials in manufacturing industries, etc., is a useful machine. However accidents occur frequently during the operation of the machine. In order to prevent accidents it is necessary to examine the current safety regulations on a forklift truck. Because the regulations have not revised for a long time, they do not reflect the rapidly changing environment of industries. Proposed revision of standard on articles for forklift trucks was presented after analysing the causes of occurred injuries, comparing domestic standards with international standards and examining the survey results. We analyzed the safety regulation articles and the injuries according to the type of work conducted with forklift. The major differences in safety regulations between Korea and the major foreign countries were investigated. The opinions of field workers on the safety regulations were surveyed using e-mail or interview. As a result, it was found that preventing workers from contacting with the forklift is very important. To prevent accident due to movement of a stopped forklift, actions are necessary to prevent slip of a forklift. Also supervision is required to make workers fasten safety belt and to prohibit workers from using a forklift for undesignated purpose.

Occupational Injury Prevention Research in NIOSH

  • This paper provided a brief summary of the current strategic goals, activities, and impacts of the NIOSH (National Institute for Occupational Safety and Health) occupational injury research program. Three primary drivers (injury database, stakeholder input, and staff capacity) were used to define NIOSH research focuses to maximize relevance and impact of the NIOSH injury-prevention-research program. Injury data, strategic goals, program activities, and research impacts were presented with a focus on prevention of four leading causes of workplace injury and death in the US: motor vehicle incidents, falls, workplace violence, and machine and industrial vehicle incidents. This paper showcased selected priority goals, activities, and impacts of the NIOSH injury prevention program. The NIOSH contribution to the overall decrease in fatalities and injuries is reinforced by decreases in specific goal areas. There were also many intermediate outcomes that are on a direct path to preventing injuries, such as new safety regulations and standards, safer technology and products, and improved worker safety training. The outcomes serve as an excellent foundation to stimulate further research and worldwide partnership to address global workplace injury problems.

건설공사 공기단축으로 인한 추가비용의 산정규정에 관한 연구 (A Study of the Regulations for Calculation of Acceleration Costs on Construction Work)

  • 본 연구는 건설 공사도중 계약상대자의 책임 없는 사유로 인하여 공사기간이 단축되는 경우 발생하는 추가비용과 관련하여 계약 당사자 사이에 발생하는 분쟁을 예방하는 방안의 연구를 목적으로 하였다. 공기단축으로 인한 추가비용에 대한 클레임 사례 및 법원의 판결 사례등을 검토한 결과 추가비용 산정에 대한 규정의 미비가 대표적인 문제점으로 나타났다. 이러한 문제점에 대한 연구의 결과로 1단계에서 추가비용을 처리하는 절차를 제시하였고, 절차 중 공기단축 계획 및 승인과정을 거치도록 하여 계약 당사자 사이의 추가비용에 대한 다툼을 예방하도록 하였다. 2단계로 추가비용 산정과 관련된 현행 규정의 미비한 문제점을 해소하는 규정의 제정 및 개정 방안을 제시하였다. 본 연구에서 제시한 절차 및 규정의 제 개정 방안을 통하여 공기단축과 관련한 현행 규정이 미비한 문제점을 해소하고 분쟁을 예방하며 이로 인한 손실 등을 방지하는 등 선진화된 계약관리의 기초가 되도록 하고자 한다.

아크 검출기 관련 규정 마련에 관한 연구 (A study on working out arc detector related regulations)

  • 국내에서 전기 화재의 70% 이상이 아크로 인하여 발생하고 있다. 본 논문에서는 이를 예방하기 위한 방안을 마련하기 위하여 기존의 누전 차단기에 관한 기술기준 및 규정을 분석하였으며, 아크 검출기에 관한 기술기준 및 규정은 아크의 특성을 고려하여 기존의 누전 차단기에 관한 기술기준 및 규정과는 별도로 제정되어야 한다는 결론을 얻었다. 따라서 본 논문에서는 아크 검출기 관련 규정은 기존 누전 차단기의 관련 규정에 추가 되거나 이것과 별개인 규정으로 제정되어야 한다고 제안하였다. 특히 아크로 인한 화재를 예방하기 위해서는 아크 검출기의 신속한 보급이 필요하고 그 설치를 의무화하는 것이 바람직하다. 따라서 이 같은 여건을 고려했을 때 기존 누전차단기 규정에 아크 검출기 관련 사항들을 추가할 것을 제안하였다. 아크 검출기의 기술 기준에는 아크의 판단 규격과 차단 임계치, 그리고 차단기가 반응하지 말아야 할 불요신호의 범위 등이 반드시 반영되어야 한다.

위험작업 도급에 관한 법규제의 비교법적 고찰 (A Comparative Study of the Legal Regulations on Contracting for Dangerous Work)

  • Objectives: South Korea's occupational safety and health legislation appears on the surface to have stronger regulations than any other country, but it is criticized for having many problems when viewed from the perspective of the effectiveness and universality of these regulations. Therefore, it is necessary to consider the validity of the regulatory content and the methods for contract work in South Korea. Methods: The main issues in contract work are compared and analyzed in terms of the occupational safety and health laws systems in South Korea and other developed countries. Based on this, problems related to contract regulation are derived from the perspective of legal policy studies. In addition, effective improvement measures for the derived problems will be proposed. Results: Other developed countries impose obligations suitable for the status and role of persons who entrust work in consideration of the fact that they do not directly manage risks and in terms of the effectiveness of industrial accident prevention. These countries generally impose obligations such as management of facilities and machinery, cooperation and coordination with subcontractors, cooperation and coordination obligations between subcontractors, and guidance obligations on a person who entrusts a work. Conclusions: It is difficult to achieve effectiveness in preventing accidents with based on unreasonable regulations that do not conform to safety principles or legal theory. Regulations on contract work need to be converted to rational cogent regulations based on science and rationality, not ideology and emotion. To this end, the legal system for contract work must have international universality.

발파 관련 산업안전보건규칙 개선을 위한 연구 (Study on Improvement of Safety Standards for Blasting Operation)

  • 본 연구는 발파 및 터널작업의 산재예방에 관한 안전기준을 규정하고 있는 안전보건규칙의 실효적 작동을 위한 개선사항을 제안하기 위한 연구이다. 발파 및 터널작업의 산재예방에 관한 안전기준이 규정되어 있으나, 오랫동안 개정이 이루어지지 않아 현실을 반영하지 못하는 규정이 일부 있으며, 필요한 안전기준이 미비하여 사업장에서 해당 규정을 이행하는데 어려움이 있는 것으로 파악되고 있다. 이에 그동안 기술·환경의 변화로 현실에 맞지 않는 불합리한 규정을 개선하고, 작동성이 낮은 규정들을 국내 작업현장 여건에 맞도록 수정·보완하기 위한 것이다. 이를 위하여 국내외에서 제정되어있는 법령, 정책, 제도의 통합적인 비교·검토를 수행하였으며, 이를 통해 국내 안전보건규칙에 개선이 필요한 부분을 도출하고자 하였다.

산업안전보건교육 실효성 제고방안에 관한 연구 (Promoting Effectiveness of Occupational Health and Safely Education Program)

  • Immediate responsibilities for occupational health and safety (OHS) management reside in business proprietors and supervisors whose voluntary participation in OHS educational programs, not legal sanctions, may thus lead to safe and pleasant work environments. This study investigates how to promote the effectiveness of OHS educational programs to draw voluntary participations in such programs in Korea To this end, drawbacks of current practices in OHS education are first analyzed, and then OHS related policies in advanced countries in the area of disaster prevention such as United States and Germany, are also scrutinized. Based on the preliminary investigations, the following propositions are made to lay out the foundation for promoting effective OHS educational programs in Korea: improvement of government regulations, revitalizing job training initiatives, on-site OHS education, compensation and incentive programs for OHS education. These propositions may also facilitate the deployment of disaster prevention activities across the organization and prevent various occupational disorders (for example, musculoskeletal disorders). This study emphasizes that monolithic OHS education systems led by regulatory agencies may not be efficient to ensure healthy and safe work environments. Globally competitive OHS educational systems may be established only when they are based on the health and safety requirements specified by proprietors and workers.
