A Review on Limit of Liabilities of Multimodal Transport Operator in Korea (복합운송인의 책임제한 방식과 한도액)

  • The purpose of this paper is to introduce the limitation of liabilities of multimodal transport operators(MTO) in Korea. Also, this paper reviews the revised draft of Korean Commercial Code in 2015. This paper analyzes Korean multimodal transport systemand the limitation of liabilities of MTO by analyzing articles, regulations and practices of Korean Commercial Code and it's the draft in 2015. The paper, also, studies multimodal transport rules by comparing specifically international treaty, rules, or practices. In Korea, Article 816 of Commercial Code treats multimodal transportation adopting the network liability regime. The Article describes only the case of the multimodal transportation where the maritime carriage is engaged. Korea proposed the draft of multimodal transport regulation of Commercial Code in 2015 because present law could not apply for the multimodal transportation involved in the air or land carriage. This paper support the draft of Korean Commercial Code in 2015 because it is necessary to make a predictable legal system of multimodal transport and the limitation of liability reflecting practices or customs.

A Network Capacity Model for Multimodal Freight Transportation Systems

  • This paper presents a network capacity model that can be used as an analytical tool for strategic planning and resource allocation for multimodal transportation systems. In the context of freight transportation, the multimodal network capacity problem (MNCP) is formulated as a mathematical model of nonlinear bi-level optimization problem. Given network configuration and freight demand for multiple origin-destination pairs, the MNCP model is designed to determine the maximum flow that the network can accommodate. To solve the MNCP, a heuristic solution algorithm is developed on the basis of a linear approximation method. A hypothetical exercise shows that the MNCP model and solution algorithm can be successfully implemented and applied to not only estimate the capacity of multimodal network, but also to identify the capacity gaps over all individual facilities in the network, including intermodal facilities. Transportation agencies and planners would benefit from the MNCP model in identifying investment priorities and thus developing sustainable transportation systems in a manner that considers all feasible modes as well as low-cost capacity improvements.

A Study on the Selection of Means of Transportation in International Logistics

  • Purpose - This study is a study to investigate the problem of the selection of means of transportation in international logistics by studying the basics of logistics activities, selection factors of transportation methods, and multimodal transportation. Research design, data, methodology - This study is composed of 5 chapters through literature study. Chapter 1 describes the functions and transportation system of international logistics, Chapter 2 selects transportation, Chapter 3 deals with maritime transportation and multimodal transportation, Chapter 4 describes multimodal transportation in terms of customer service, Chapter 5 addresses the implications and conclusions. Results - When looking at the problem of selecting a means of transportation, it is important that the parties involved in the transportation choose which means of transportation for their convenience and profit during the transportation process. Here, there will be factors to consider, including transportation cost, when selecting a means of transportation, and each means of transportation may have characteristics or advantages and disadvantages. Considering all these points, the adoption of multimodal transportation from a customer service point of view may be the answer. Conclusions - This study pays attention to the academic understanding related to the selection of means of transportation and to how usefully this thesis can be used in the selection of transportation related persons, especially shippers, from a practical level.

  • The transport a administration in Korea is meeting demands of developing international multimodal transport system. In the past, as Korea transport policy has been emphasizing on the passenger traffic, the physical distribution sector is far behind international trend. Regarding the urging necessities of reducting costs in transport in order to upgrade the competitive edge of industries, Korea has to develop the most efficient transport system so called international multimodal transport system. The existing transport system is inefficient because each transport mode is separate, so this system is aiming at reducing cost and time and developing freight transport. The scope and scheme of this thesis should be as following. Chapter 2.   • Today, the logistics industry has played a critical role in national economy activities. The low cost and high efficiency of the logistics industry are meaningful in the improvement of national competitiveness and the logistics industry. However, efficiency of logistics is lower than that of the United States and Japan since most quantities are processed in road transportation in Korea. With regard to this, existing studies expected a saving of social and environmental costs due to a decrease of road transportation as well as improvement of logistics productivity due to bulk transportation through activation of rail and costal transport. For the expectation, the existing multimodal transport systems should be improved first. Therefore it aimed to develop scenario-based simulation models of multimodal transport systems for decision makers in charge of improvement in the logistics area. For model development, this study utilized Thinking Process and System Dynamics(TP-SD) methodology.

  • International Trade has led to the increase of the demand of international transport, and also the development of international transport not only incurs claims concerning transportation but also establishes various international rules to settle the claims between the shippers and carriers incurred in the course of transport. With a view to settling the claims successfully, the men who are concerned in the transport have to know the principle and scopes of carrier's liability. In this paper, I would like to find out the scopes of liability of multimodal carriers based on the principles of liability. In order to perform the purpose of this study, I classify the liability principle of the international carrier under the UNs Convention on International Multimodal Transport of Good(1980) and UNCTDAD/ICC Rules(1991) in three system-Network Liability System, Uniform Liability System and Modified Liability System. And that I show the results-the scopes of multimodal carriers' liability based on the UN's Multimodal Convention(1980) and the ICC/UNCTAD Rules(1991), and transport vehicles.

Empirical Study of Multimodal Transport Route Choice Model in Freight Transport between Mongolia and Korea

  • According to the globalization of world economy on distribution and sales, logistics and transportation parts are playing an important role. Especially, they have to decide what is the key factor of route choice model and how to choose the right transport route in multimodal transport system. By considering the key factors in rote choice model for freight forwarders between Mongolia and Korea, this paper propose 4 main factors: Cost, Delivery time, Freight and Logistics service with 13 sub factors. The importance of factors is surveyed base on AHP through interview with freight forwarders. In results, the empirical insights about current status of Mongolian forwarders are provided with different factors between transportation modes. Expecially, the Time factor is a role factor to choose transport route for air transportation forwarders.

A Methodology of Multimodal Public Transportation Network Building and Path Searching Using Transportation Card Data (교통카드 기반자료를 활용한 복합대중교통망 구축 및 경로탐색 방안 연구)

  • Recognition for the importance and roles of public transportation is increasing because of traffic problems in many cities. In spite of this paradigm change, previous researches related with public transportation trip assignment have limits in some aspects. Especially, in case of multimodal public transportation networks, many characters should be considered such as transfers. operational time schedules, waiting time and travel cost. After metropolitan integrated transfer discount system was carried out, transfer trips are increasing among traffic modes and this takes the variation of users' route choices. Moreover, the advent of high-technology public transportation card called smart card, public transportation users' travel information can be recorded automatically and this gives many researchers new analytical methodology for multimodal public transportation networks. In this paper, it is suggested that the methodology for establishment of brand new multimodal public transportation networks based on computer programming methods using transportation card data. First, we propose the building method of integrated transportation networks based on bus and urban railroad stations in order to make full use of travel information from transportation card data. Second, it is offered how to connect the broken transfer links by computer-based programming techniques. This is very helpful to solve the transfer problems that existing transportation networks have. Lastly, we give the methodology for users' paths finding and network establishment among multi-modes in multimodal public transportation networks. By using proposed methodology in this research, it becomes easy to build multimodal public transportation networks with existing bus and urban railroad station coordinates. Also, without extra works including transfer links connection, it is possible to make large-scaled multimodal public transportation networks. In the end, this study can contribute to solve users' paths finding problem among multi-modes which is regarded as an unsolved issue in existing transportation networks.

  • According to globalization of world economy by extension of production, sales and distribution all around the world and international transportation system changed into a transport system that puts great importance on speediness and value-added services, international transport system is changing into a Multimodal Transport Routing centered system that systematically connects marine, air and rail transports. Due to such changes production, sales and distribution must be provided in time and Multimodal Transport Routing, which can provide multi-dimensional logistics services to customers of global network, is needed but information connection for international transport and connection system between transport modes are insufficient and can not be activated. Especially in Korea, selection standard of 3rd party logistics companies and transport companies is presented, but logistics exclusive companies, which plan and execute the transportation, can't present a systematic evaluation standard for international Multimodal Transport Routing, selection. Thus, this research surveys important previous studies about Multimodal Transport Routing, selection, derives an evaluation standard for Multimodal Transport Routing, selection through interview with company officials, and presents a theoretical basis for Multimodal Transport Routing, selection through systematic analysis of Multimodal Transport Routing, selection using Analytical Hierarchy Process (AHP).

A Study on Concealed Damage through Car-Ferry International Multimodal Transport between Korea and Japan (한일간 카-훼리 국제복합운송에 따른 부명손해(不明損害)에 관한 연구)

  • The recent increase in international car-ferry lines between Korea and Japan as well as China brings needs for proper transportations of special cargo, such as machinery and luxury yacht, etc. International multimodal transport, especially international car ferry through truck-sea-truck system enables to fulfill shippers' needs for "Door to Door Service", of such special goods. However, this international multimodal transport of bulk cargo will cause a possible claim for concealed damages during such transportation. For this reason, this study aims to examine the liability system of the multimodal transport operator as well as to investigate liability for concealed damages theoretically and finally to seek proper measures for them. Futhermore, this paper intends to verify the claims for concealed damages to further the international multimodal transport by car ferries between Korea and Japan.
