It is very important to salvage the vessel and seafarer rapidly and efficiently when maritime accident occurred, as maritime accident has a bad effect on vessel, seafarer and shipping industry as well as the whole community itself. Especially, marine salvage in relation to the accident involving huge marine pollution and loss of life will be regarded as a more important process because the accident would result more severe damages. However, domestic marine salvage forces are weaker than other country's, and private marine salvage company has poor technical and commercial base even though the Korea Coast Guard and Navy have relatively more modernized equipments and squad. Thus, it is very important to promote marine salvage operation capacity because it is related with the national security as well as the national economy. In this regard, this study examines the promoting method of marine salvage including its public and private section from the perspectives of law and systemic revision.

Since marine accidents cause large-scale damage to human lives and the marine environment, prompt response measures are crucial including salvage operations for ships and cargoes along with lifesaving operations. In Korea, marine salvage operations are mainly dependent on global salvage companies in case of large-scale marine accidents due to lack of national capacity for marine salvage. The purpose of this study was to suggest public measures for the promotion of the private salvage industry by identifying the current situation and problems in the domestic marine salvage industry. As a result of the study, the measures of setting up a dedicated agency to support the domestic salvage industry and the function of the dedicated agency were identified and presented. In addition, the main points of the bill of "Law on the Promotion of the Domestic Salvage Industry" were presented to support and promote the salvage industry. To prepare the draft bill of law, relevant domestic laws and international conventions were examined to define the terms and regulations. Based on the legislation enacted as a result of this study, relevant ministries should focus on the legislative process. Legislation can be pursued by competent ministries in cooperation with the private sector and academia. It is expected that this study will help in the development of the domestic marine salvage industry and enhance the national response capacity for marine accidents in Korea.

Although our country depends on a foreign technique when a large marine accidents occur, insufficiency of facilities and technique. With these problems, because of the damage of accidents expands due to not taking proper actions, Accordingly, in case of marine accidents, this paper will suggest a various scheme of infrastructure in salvage & oil spills response system in order for quick and effective salvage & oil spills response, investment of facilities, technical development of salvage & oil spills response, and improvement of ability etc

The amount of Sea Casualty is increased by heavy sea traffic, increasing sea-borne cargoes, and superannuated vessels. This study analyzed the circumstance of ship salvage in Korean Salvage Units and management of Salvage Divers in Korea and other countries in order to make establishment of Ship Salvage Divers. This paper reputed the object, the necessity and the character of Ship Salvage Divers. For the purpose of study two parts are considered in order to analyze the environment of salvage divers(the circumstance of Sea Casulties and Ship Salvage). Under the present circumstance in Korea this development planning study may be restricted, but the effective planning to activate Korean Ship Salvage Diver is abstracted as follows; First, the political assistance of concerned government authority is needed. Second, establishment of new course, grade, certificate and licence for Salvage Diver is a Pre-requisite factor for the successful enactment. Third, establishment of Korean Ship Salvage Diving Center or School is strongly required.

Sea casualties may happen in ship, cargo and the others concerned with sea transportation. : the shipo-wer, marine insurer and salvage company have been endeavored to compensate salvage award with some rule and regulation such as Marine Insurance Act, York Antwerp Rules and Average adjustment rules. Once sea casualties happened, the salvage contract is established between the owners, marine insurance and salvage company, the contract are divided into so many kinds of them. In this paper, we have an analysis on the character of the salvage contract whether the characteristic contents of them are in benefit to any party or not. In this connection with these positive or negative character of the contract, it is worthwhile to compare the actual salvage expenses contract with no cure no pay contract. LOF 1990 has been revised recently, which is based on no cure no pay, expecially, the special compensation, safety net clause of LOF 1990 could be understood in the view of the prevention of sea pollution and the preservation of sea circumstances in the world. Salvage has the complicated and quality, because the adjustment of almost salvage charges have been treated through the other sea casualties which is accompanied by and mixed with. Besides of the importance of salvage contracts, we are in need to understand that what the diversified character of salvage charges are. Furthermore the owners should carefully select the insured conditions on Hull Insurance according to the type of his company, operating ocean route, loading cargo and etc. In this paper, we would try to analyze the character of the salvage award such as General Average, Sue and Labour Charges and Particular charges. We would like to propose that the uniformed system of the salvage award. Compensation should be built up for the effective and efficient salvage operation and for reducing the claims and conflicts from the concerned parties. To this end, we could expect that the uniformed system for salvage award compensation will come to be the benefit of all owners, insurers, salvage company.

Marine casuality causes not only loss of lives and ships, but also severs damages to marine environment and related economic activities such as fishing industry, sea farming, and tourist industry. Basically, the great effort should be made to prevent the occurrence of maritime accidents by any means. However, once accident has occurred, the salvage works should be done rapidly and properly based on theoretical and technical informations, which could minimize the risk during salvage operation and the overall damage from the maritime accidents. Generally, to calculate accurate hydrostatics of a stranded ship, a large amount of input data is needed. But, an availability and a reliability of input data cannot be guaranteed in most situations, and the adequate time required for preparing all input data is not allowed to perform the timely operations of salvage. In this paper, the development process of simple computer program for salvage operation using limited input data is introduced and its application example is presented. This program was developed to provide technical support for planning salvage operations in the grounding accident.

This paper reviewed the general definition and role of salvage duty, and performed competency analysis based on the present state of ROK Navy's and Korean civilian's salvage operation. Also, to enhance the national salvage ability, the salvage system of advanced maritime nations such as America, Great Britain were studied. Putting these information together, it is concluded that for the expansion and development of Korean salvage system, the nationally combined salvage assets must be utilized for civilian salvage operations and internationally recognized diving certification system should be introduced and joint organization of civilian-government-Navy should be established to enable the execution of such plans.

Marine casualties of dangerous cargo carriers lead to not only the loss of human life and properties, but also marine pollution caused by spilled oil and hazardous cargo. So the prevention of marine casualties and emergence response to minimize pollution are very important problems to be settled. But until now, most of salvage assistance jobs have been done based on rule of thumb without any technical support. It is not easy to cope with the incidents safely and rapidly under the current situation. The purpose of this paper is to develop a systematic and engineering salvage assistance tool available in the casualty sites. This paper contains the construction of salvage system, classification of technical items, and prototype system for the safety assessment. The developed system enable a salvage engineer in his/her salvaging jobs to perform safely and promptly.
