  • It is well observed in the satellite telecommunication policy of several States that legal constraints imposed upon the service coverage of satellite telecommunication as well as broadcasting are to be relaxed in a progressive way. Major aspects of such policy change lie in the adoption of policy refusing traditional concept of national frontier. In the case of direct broadcasting satellite service, while a debate upon the legal issues regarding the spill-over effect of that service is no more major concern of the States, many multinational enterprises are looking for strategic alliance for regional or global DBS project. On the other hand, an implementation plan for connecting the world through global mobile personal communication satellite system is being pursued by several joint effort of multinational firms. Legal issues arise regarding the regulatory competence of each State, Especially, a controversial issue is concerning the sovereign right well recognized upon the regulation of telecommunication. This study is focusing upon the evolution of such policy change for the purpose of allowing us to expect future develpment of worldwide satellite telecommunication policy environment.

  • 본 연구에서는 블록체인 및 분산원장 기술에 기반한 새로운 상품인 토큰 증권에 대한 사업화와 관련하여 시장 및 법제도화의 불확실성이 높은 상황에서 활용 가능한 리걸 디자인 기법을 통해 우선순위 과제를 도출하는 과정을 제안하였다. 토큰 증권의 발행 및 유통을 위해 혁신금융서비스 (금융규제 샌드박스)를 신청한 참여자들을 대상으로 리걸 디자인 워크샵을 진행하여 각자의 이해관계를 조율하고 법적, 기술적 측면을 감안한 준비 사항들을 논의하여 향후 추진 과제들에 대한 우선순위 도출이 가능한지 검증하였다. 리걸 디자인 기법은 불확실한 환경에서 이해관계자들이 상호간 이해증진에 기반하여 입장 차이와 이견을 확인하고 조정하여 최대한 합의된 방향을 도출하게 해주는데 주요 단계들로는 상호 공감 과정인 'Family Therapy', 문제 정의를 위한 'N whys', 그리고 문제 해결을 위한 발상 단계인 'Speculative Scenario Design'으로 구성되고 이는 사용자 중심의 사고방식에 기반한 디자인 씽킹과 구별되는 특징이다. 리걸 디자인 기법 특성상 다양한 이해관계자들이 참여하고 상호간 대립 의견에 대한 조율이 필요할 수 있는데 리걸 디자인 워크샵 준비 및 진행에 있어서 퍼실리테이터 (Facilitator)의 역할이 중요한 대목이다.

Revision of Biotechnology Support Act for Accelerating the Bioeconomy

  • The Biotechnology Support Act has provided a legal basis for promoting the biotechnology field as the highest legal authority in the biosciences since its enactment in 1983, and has contributed to enhancing Korea's biotechnology research and development (R&D) capabilities and to revitalizing bioscience ecosystems by establishing policies for supporting biotechnology, expanding the government research and development, and promoting industrial applications. The revised bill of the Biotechnology Support Act is the law that reflects changes in the technological and social environment and that provides a legal basis for practical support of government policies such as total periodic research support, commercialization empowerment, and creation of an innovative research environment, and it will come into effect in November, 2020 after a six-month grace period. The main contents of the revised bill are 1) increasing status as a general norm in the biotechnology field, 2) establishing data evidence-based policies, 3) inducing biotechnology innovation, and 4) promoting regulatory science, especially research and development. This revision has been reorganized in a timely manner in accordance with the current technological advancements, changes in society and environment, and both quantitative and qualitative growth of the domestic bioscience ecosystems and its competitiveness are expected by systematic supports and promotions of the government during the whole period in terms of research and development (R&D) as well as business and industrialization.

ADR기본법의 입법론에 관한 연구 (Research on the Legislation theory of the Fundamental ADR Act)

  • Currently major countries, including the USA, have developed and contrived to activate ADR(Alternative Dispute Resolution) in order to both choose effective means for dispute resolution and establish the reformation of the judicial system; thus meeting people's revamped expectations due to the rapid increase of, and diversification in, civil disputes. This is why there has been some haste in many countries to organize systems for this, so called, 'the Fundamental ADR Act' which regulates the essential structure to accelerate the use of ADR and strengthen the links with trial procedures. For example, in 1999 Germany revised it Civil Procedure Act, to allow for a pre-conciliation process in cases involving only small sums of money. Whilst, with regard to the Civil Procedure Act in France, new regulations have been introduced with regard to actions before either a suit or return to conciliation. In the United Kingdom, as far back as 1988, additions to the legal structure allowed for expansion of regulations applying to ADR. By 1999 the new ADR regulations were part of the legal structure of the UK Civil Procedure Act. The USA passed the federal law for ADR in 1998. Since then the world has tried to enact this model in UNCITRAL on international conciliation. When we consider this recent trend by the world's major countries, it is desirable that the fundamental law on ADR should be enacted in Korea also. This paper traces the object, and the regulatory content required, for the fundamental ADR law to be enacted in Korea's future. Firstly, the purpose of the fundamental ADR law is limited only to the private sector, including administrative and excluding judicial sector and arbitration, because in Korea the Judicial Conciliation of the Civil Disputes Act, the Family Disputes Act and the Arbitration Act already exist. Secondly I will I examine the regulatory content of the basic ADR Act, dividing it into: 1)regulations on the basic ideology of ADR, 2)those on the transition to trial procedures of ADR, and 3)those on the transition to ADR from trial procedures. In addition I will research the regulatory limitations of ADR.

A Legal and Policy Analysis of KRW Internationalization from the Perspective of Offshore Circulation

  • Purpose - Recently, the Korean government is seeking to internationalize KRW and reduce its heavy reliance on the U.S. dollar and better cope with risks from external turbulence. However, there has been too little study on this subject in comparision with its importance. The main objective of the paper is to distinguish the descrete stages of the KRW internationalization and recognize the costs and benefits of each stage. Research design, data, methodology - In order to achieve its goal, this study accomplishes a formal policy analysis based on potential factors of currency internationalization and an examination of legal practices in relation to Foreign Exchange Transaction Regulation (the Regulation). Results - This study found that securing monetary policy may not be easy under liberalized capital account for a small open economy like Korea in view of the trillema. In addition, the inherent ambiguity of the Regulation may increase the costs of KRW internationalization. Conclusions-This study revealed the negative system for the control of foreign exchange of the Korean government. The excessive regulatory restrictions on foreign exchange may hinder the process of KRW internationalization. Some legal and policy reforms are needed to improve related regulation and infrastructure.

보건의료 빅데이터의 연구목적 사용에 대한 법제 개선방안 (Improving Legislation on the use of Healthcare Data for Research Purposes)

  • 빅데이터 처리기술의 발전과 함께 보건의료 빅데이터의 잠재적 가치도 크게 주목받고 있다. 그리고 이러한 잠재적 가치를 현실화하기 위해서는 보건의료 빅데이터를 이용한 다양한 연구가 필수적이다. 하지만 개인정보보호법을 중심으로 한 빅데이터 규제체계는 경제재로서의 빅데이터의 측면을 고려하지 못하고 있어, 이를 연구목적으로 활용하는데 많은 장애를 발생시키고 있다. 환자의 치료라는 1차적 목적을 중심으로 한 보건의료정보의 규제체계를 기술의 발전에 부합하며 공익적 활용이 용이한 형태로 개선시켜야 한다. 이를 위해서 개인정보의 보호와 활용의 균형에 대한 고민이 반영된 해외의 법제 동향을 살펴볼 필요가 있다. 해외 법제의 시사점을 바탕으로 우리 법제에서 다음과 같은 방향의 개선점을 도출할 수 있다. 우선 보건의료정보에 특화되고 보호와 활용을 아우르는 법제가 필요하다. 개인정보의 비식별화도 개인정보보호법의 적용이 배제되는 수준을 명확하게 규정해야 한다. 보건의료 빅데이터를 연계할 수 있는 법적 기반의 구축을 통해 관련 연구에 시너지 효과를 창출해야 한다. 외국에서의 논의에 대한 검토와 사회적 합의를 바탕으로 옵트아웃 제도의 도입도 고려해야 한다. 하지만 무엇보다 중요한 것은 이러한 시스템에 대한 국민의 신뢰일 것이다.

핀테크 활성화를 위한 규제 샌드박스의 도입 방안 연구 (Legal Research on FinTech Regulatory Sandbox Fostering Financial Innovations in Korea)

  • 핀테크 장벽 중 가장 두터운 것은 규제적 장벽인데, 이는 많은 기술 혁신가들이 줄곧 경험해 온 문제이다. 비록 기술적 솔루션들이 보다 저렴하고 안전한 금융서비스를 약속하지만, 핀테크 산업 내에서의 혁신을 가능하도록 하는 규제를 창설하는 것이 큰 과제이다. 특히, 핀테크 관련 사업자는 어느 특정한 규제보다는 관련 규제를 둘러싼 모호함과 혼란을 더큰 쟁점으로 받아들일 수 있다. 다수의 핀테크 모델들이 금융서비스 공급을 위해 새롭고 혁신적인 방식들을 지속적으로 도입하고 있기 때문에, 기존의 규제 및 법원칙을 적용함에 있어 상당한 혼란이 야기될 수 있으며, 또한, 대규모의 금융회사에 적용되는 복잡한 규제적 준법 모델들을 소규모의 신생 기업들(start-ups)에 적용시키는 것이 적정한지 여부도 문제이다. 이는 다수의 기존 규제와 원칙이 모바일 장치, 전자상거래, 인터넷 등을 고려하지 않고 수립 도입되었기 때문이기도 하다. 이에 핀테크 사업의 성장을 위해 규제 정보에 신속하고 저비용으로 접근할 수 있는 방안이 반드시 마련되어야 한다. 이러한 문제들에 대한 적절한 해답을 찾기위하여, 규제 기관, 기술 개발자, 그리고 금융소비자들의 상호 협력해야만한다. 다수의 금융당국들이 서비스 공급자들에게는 그들의 혁신을 테스트해볼 수 있는 기회를 제공하고 동시에 규제기관에게는 상품의 리스크를 파악할 수 있는 시간을 제공하는 규제 샌드박스(Regulatory Sandbox) 제도를도입하고 있다. 그러나, 자체적인 한계를 가진 규제 샌드박스의 도입만으로는 핀테크 혁신을 실질적으로 이루어지기에 충분한 환경을 창설하여주지는 못한다. 따라서 금융당국은 샌드박스에만 의존하기 보다는 핀테크생태계의 지원을 위하여 보다 포괄적이고 다면적인 노력을 하여야 한다.

불건전(不健全)한 인터넷 자원(資源)으로부터의 청소년(靑少年) 보호방안(保護方案)에 관한 연구(硏究) (A Study on the Protection Methods for Students from Inappropriate Internet Sites)

  • With the advent of internet, the modern society is enjoying the benefits of the information age. As one of undesirable side effects of utilization of internet, however, it is often mentioned that young students are helplessly exposed to inappropriate and unqualified information. Therefore, in this paper, we will clarify the nature of inappropriate information to the younger generation and will argue for the needs of protecting the youth from inappropriate information. Especially the merits and limits of often motioned five different protective and regulatory measures are presented and analyzed, those are, establishment of acceptable use policy, active utilization of supervisory organization, promotion of Internet rating system, installation of filtering software, and legal and regulatory protection. As a fundamental means of resolving the problems, however, enforcement of systematic information literacy education, promotion of active utilization of sound information, development of search engines for the youth, design of diverse filtering softwares which can be selected by users, and increased attention by parents and teachers are suggested.

주파수 공동사용 제도 분석 및 국내 도입 방안 (Analysis of Spectrum Sharing Systems and Some Plans for the Adoption in Korea)

  • As mobile traffic is growing, the demand for spectrum is increasing but the deficiency of spectrum becomes serious as the supply is restricted essentially. For resolving the issue, spectrum sharing system is discussed from the technical and regulatory point of view, where multiple radio users occupy same frequency. In this paper, the policies and adoptions of spectrum sharing system in some countries are analyzed with a focus on TV white space and licensed shared access, which are based on unlicensed and licensed spectrum usage respectively. Some legal and regulatory plans to adopt and activate spectrum sharing in the Radio Waves Act system of Korea are proposed as well.

선진국과 한국의 소음저감정책 비교 (Comparison of Noise Abatement Policies in Advanced Countries and Korea)

  • One of the main objectives of noise control act is to define and ensure application and respect of noise exposure limits. Most advanced countries have prepared a legal framework for noise limits either by national laws, ordinances or municipal by-laws. A large number of advaced countries have adopted the Leq index for the main sources of noise(road, railway, industry). The exception is aircraft noise for which regulatory practice is highly disparate. These differences in the indices adopted, the periods and areas to which regulations apply, definitions of measurement conditions and ways in which noise levels are calculated make it difficult to compare the current advanced countries standards. This study presents the current noise abatement policy of the advanced countries and proposes the improvement of the current noise abatement policy of Korea to catch up with it of the advanced countries.
