The Establishment of Conservation Area and Conservation Strategy in Ulleung Island (I) -Flora- (울릉도의 보전지역 설정 및 보전전략(I) - 울릉도 지역의 식물상 -)

  • The flora of Ulleung island was summarized as 975 taxa with 122 families, 465 genus, 762 species, 5 sub-species, 178 varieties, 21 forms, and 9 hybrids. This extent of plant diversity of the island ecosystem was modified from the field surveys by the authors adding the number of 627 taxa; 109 families, 355 genus, 526 species, 2 sub-species, 89 varieties and 10 forms, and Considering the aspects of geographical distribution of the island, the flora showed much closer to the Korean penninsula than that of the Japanese Archipelago. An action plan including intensive conservation and management both for habitat and plant to conserve the island ecosystem should be prepared. The naturalized plants is expanding gradually due to the increase of the tourist. The Ulleung island ecosystem should be conserved as the Protected Area, which is enlarged habitat compared with the present legal conservation actions.

Birds in the Baekdudaegan from Jirisan to Deokyusan : A Review (백두대간 지리산-덕유산 구간의 조류상에 관한 문헌연구)

  • Some literatures for the avifauna of Baekdudaegan from Jirisan to Deokusan were reviewed. A total of 136 species belong to 45 families, 15 orders was listed. Of which, 132 species were recorded in Jirisan National Park, 63 species were in Hamyang area,46 species were Jangsu area, and 63 species were in Deokyusan National Park. Status of migrants of these birds were classified as follows: 42 species of residents,40 species of summer visitors,31 species of winter visitors, and 23 species of passage migrants. Legal protected birds were listed 23 species including 15 protected species and 14 natural monument species. Of them, only three species, Accipiter soloensis, A. nisus, Falco tinnunculus were widely distributed. And the others, Aix gatericuzata, Perms apivorus, Accipiter gentilis, A. gularis, Buteo logopus, B. buteo, Circus cyaneus, Falco columbarius, Grus vipio, Bubo bubo, Asio otus, Otus scops,0. bakkamoenu, Ninox scutuznta, Strix aluco, Dryocopus martius, Dendrocopos nanus , Pitta brachyura, Galerida cristnta, Terpsiphone atyocauduta were showed restricted distribution. Therefore, it is considered that careful consideration should be given to these conservation measures.

A Case Study on Selecting Sites for Wetland Restoration - Focusing on the Research Survey of National Inland Wetlands Monitoring in 2016 - (복원대상습지 선정 사례 연구 - 2016년 전국내륙습지 모니터링 결과를 중심으로 -)

  • This study aims to provide basic data for the decision-making process in selecting sites for wetland restoration projects. To this end, the current list of demaged wetlands was identified based on the findings from the nationwide monitoring project in 2016 targeted at wetlands in inland areas. Then, to determine the necessity of restoration for these demaged sites, the cause of demage was investigated, and their conservation value was examined from an ecological and legal perspective. The 2016 monitoring project identified a total of 20 demaged wetlands, of which one site was deemed to have high conservation value through analysis of its ecological and legal values and on-site reviews. The results of this study are expected to support policymakers' decision-making in selecting wetlands for restoration projects since it identifies priority sites among demaged wetlands that require immediate restoration efforts. It should also be pointed out that wetlands in South Korea cannot benefit from legal protection despite their high conservation value unless they have a designated status as protected areas.

A Study on the Evaluation of Bird Habitat Environment in Gyeongchun Line Forest Road (경춘선 숲길의 조류 서식환경 평가 연구)

  • The purpose of this study is to prepare a plan for improving the bird habitat environment of Linear Park. To this end, after grasping the status of bird habitats on the Gyeongchun Line Forest Road, a representative linear park in Seoul, the habitat environment was evaluated and the correlation with the bird habitat was analyzed to derive a plan to improve the habitat environment. The results for correlation between diversity of birds and habitat environment were as follows. For the habitat environment inside the park, the order of positive correlation was in the order of park area (0.92), number of insect species (0.87), green area ratio (0.77), average width of linear park (0.74), Biotope area ratio (0.73), Immigration planted species (0.57). Also, for habitat environment outside the park, the bird diversity was influenced in the order of area outside the park (0.88), green area ratio of the park (0.76). Thus, in order to enhance the diversity of birds found in the park, the bird habitat environment inside the park needs to expand the park area, secure insect diversity, enhance green area ratio and ecological area ratio, expand the width of linear park, and lower the impermeable layer. For the bird habitat environment outside the park, wider area, green area ratio, and forest area of the park influenced on better bird habitation while lower ratio of road space and building-to-land ratio influenced on higher bird diversity. It is necessary to create an environment inhabitable for various species of birds and to make a healthy and pleasant city urban system for co-existence of human and living creatures.

Conflicts between Protected Franchise Territory and Unrestricted Delivery Trading Area

  • Propose: The expansion of the delivery market in franchise business is a positive means of advertising and promotion for franchisees and contributes to substantial sales growth for stores. However, unrestricted and uncontrolled delivery sales and business activity of franchisee directly lead to encroachment of business territory between franchisees, resulting in increased operating costs of franchisees and conflicts between franchisees over rights and interests on franchise business. Moreover, in relation to the restrictions on the opening of competitors, it is incapacitating the law intent of prohibiting unfair encroachment of business territory, in the issue of the Fair Franchise Act in regard to guarantee of exclusive sales and business activity rights of franchisee. This study aims to point out major problems arising out of franchisee's infinite competition on delivery sales and business activity that are not restricted or controlled and then suggest legal supplements, policy tasks, and practical implications for improvement on the issues. Literature Review: In franchising business transactions, vertical restraints are associated with the exclusive territory establishment, control of transaction area, restriction of intangible sales and business activity of franchisee. Therefore, in the franchise business, it is necessary to take positive interpretation and application on e-commerce, the area of e-commerce, and delivery trading area and find proper and practical ways, by virtue of constructive attitude of each actor, to reduce the encroachment of business territory and various conflicts caused by unrestricted delivery trading area. Conclusion and suggestion: The finding shows that unrestricted or uncontrolled delivery sales and business activity of franchisees cause encroachment of business territory and many conflicts among franchisees. And this matters also weaken the legislation of the law on the protection of the business territory and can be negative factors that disrupt the protection of identity and sound development of the franchise industry in the long run. Therefore, in the franchise business, it is necessary to take positive interpretation and application on e-commerce, the area of e-commerce, and delivery trading area and find proper and practical ways, by virtue of constructive attitude of each actor, to reduce the encroachment of business territory and various conflicts caused by unrestricted delivery trading area.

Key Recommendations for MPA Management in Korea (우리나라 해양보호구역의 효과적 관리를 위한 정책 제안)

  • The purpose of this paper is to overview Korean MPA, to figure out the problems of current system and to give policy suggestions for effective management for Korean MPAs. Results show that different types of MPAs are established based on different legislations but there is no effective control system for integrated management. In addition, Korean government can not use the function of MPAs due to the insufficient regulation for harmful activities within MPAs. Finally, this paper recommends four policy suggestions for effective management of Korean MPAs; legal requirements of MPA designation, establishment of national authority for MPA management, application of no-take MPAs for fisheries management and establishment of MPA network.

Reviewing the Candidate Types for Other Effective Area-based Conservation Measures for Post-2020 Management Related to National Protected Areas System (Post-2020 국가 보호지역 시스템 관리를 위한 기타 효과적인 지역 기반 보전 수단(OECMs) 후보지역 유형 검토)

  • This study aims to systematically review the candidate types for OECMs suitable for domestic conditions in areas related to the Korea Forest Service in order to achieve the goal of establishing the protected areas and OECMs system required by Post-2020 GBF, and to provide basic data for the establishment of the national protected areas system. As a result of the study, the selection criteria for OECMs were presented, and it was found that arboretums·botanical gardens, Natural Recreation Forests, and air holes may correspond to the Candidate Types for OECMs. As a result of evaluating the possible areas for OECMs based on the OECMs selection criteria, in the case of arboretums·botanical gardens, it is judged that only conservation areas can be designated as OECMs, except for areas mainly used by visitors of arboretums·botanical gardens that fall under the BGCI conservation type among national and public arboretums·botanical gardens. However, private and school arboretums·botanical gardens have personal property ownership, so it was judged to have no effective measures to control activities that may adversely affect biodiversity, which showed limitations in designation of OECMs. Natural Recreation Forests was found to meet the OECMs selection criteria. However, private forests have personal property ownership, which limits the designation of OECMs. Therefore, it is necessary to strengthen the function of in-situ conservation in order to meet the OECMs for private and school arboretums·botanical gardens, and private forests that have personal property ownership. To this end, effective measures are needed to achieve biodiversity conservation outcomes, and it is judged that legal control and corresponding support policies (incentives) are needed. In the case of air holes, for sustainable conservation, the management boundary of air holes should be clearly defined based on the preparation of laws and guidelines related to air holes. In addition, it is judged that it is desirable to designate the competent local forest office as the management authority and conduct periodic detailed surveys of air holes, establish and implement the conservation plans based on those.

Site Selection and Potential Analysis using the Frame for Assessing Environmental-friendly Wind Power Plant (환경친화적 풍력단지 평가체계 구축을 통한 입지선정 및 잠재량 분석)

  • Wind power which is one of renewable energies is higher economical efficiency and technical maturity than other renewable energies. Recently, the government of ROK announced to increase the proportion of renewable energy through the National Energy Plan. Also, industry required to deregulate for large-scale wind power as Renewable Portfolio Standard (RPS) is introduced. Wind power whereas the eco-friendly energy, is a serious level of damage of the natural environment and topography when the wind power is located. Therefore, the study selected the indicators required for site selection of wind power and proposed the feasible area for wind power based on wind resource map. We selected the 15 indicators including 12 legal protected area, Ecology and Nature Map, rarity, and connectivity (National Ecological Network). After site selection, we should be considered slope and altitude at the stage of design for wind farm to mitigate the environmental impact. Results of analysis showed that 22.3% of wind resource map is available to locate wind power in real. Through the field survey we had verified the accuracy of the results was significantly correct.

System and Prospects of Social Welfare Law (사회복지법의 규범체계와 과제)

  • The social welfare law concerning the children, the elderly and the disabled has been sufficiently in the center of the discussion in the academic as well as practical arena. One can find however rarely academic proposals about the way of understanding, spheres affiliated with this legal system, and systematic characteristics. So these problems stay now vague. This article aims to approach to these points of issue. First, it tries to reveal the physical, psychological and psychic characteristics of these group of people. These situation are not to be effectively protected by norms and measures provided by other instruments of social security, i.e. social insurances and social assistances. Second, based upon these functional limits inherent to these instruments of social security the own system of the social welfare law is explored in this article. The discussing points are as follows; 1. the concept of social welfare law, 2. as core principles; realization of the personality and freedom based upon self-determination right, universalism and equality. 3. rearrangements of the legal provisions to bring harmony with the legal purpose and function of social welfare law. Finally, it is pointed that the evaluation of the relevant legislation is essential, since in this area the difference between the norm purpose and the reality could be immense.

Application of ECVAM as a Indicator for Monitoring National Environment in Korea (국토환경 모니터링 지표로서의 국토환경성평가지도 활용방안)

  • Objectives of the Korean Environmental Conservation Value Assessment Map (ECVAM) is to evaluate environmental value used in comprehensive environmental information in order to encourage eco-friendly land use and management. The first research was conducted in 2001 to establish the evaluation items and the criteria of the ECVAM, and the first nationwide map was established in the period of 2003 to 2005. The maps are updated annually to reflect environmental changes of land. The evaluation items and the criteria have been modified based on feasibility studies to improve the accuracy of the maps. This study re-evaluated the ECVAMs from 2005 to 2010 with criteria used in current environment and analyzed the changes in the area of the maps in 6 years. This is also an investigation on the maps whether they are appropriate as an index for sustainable environmental monitoring. The result shows that the 1st grade level of the ECVAM area with the highest conservation value had been expanding since 2005. These changes were analyzed in terms of updating the 4th Forest Map (2008) produced once every 10 years, reflecting the new legal protected areas such as Baekdudaegan Protected Area(2010), and the environmental/ecological assessment items such as the National Ecological Network (2009). This mean the ECVAM are a monitoring index that integrates individual environmental indexes including the increase of forest age and diameter due to sustainable management of forest areas, and the change of conservation areas. Therefore, ECVAM can be used as a new index integrating national environmental indicators for monitoring changes of national environment and policy. In order to utilize the ECVAM, improving accuracy and reducing renewal cycle time of thematic maps are required.
