종교계 대학에 있어서 교직원 채용의 자유와 제한 (Free Employment and Qualification of Faculty in Religious University)

  • 최근(2008. 4. 14) 국가인권위원회의 종교계 대학들에 대한 권고 결정이 종교계 학교들의 채용관행에 대한 논쟁을 불러 일으켰다. 종교계 학교는 특정종교의 진리와 정신을 건학이념으로 설립된 학교이다. 비교법적으로 검토해 보면 학교 기타 교육기관이 전체 또는 중요한 부분에서 특정 종교 또는 종교 법인, 협회, 단체에 의해 소유, 지원, 통제 또는 관리되는 경우 또는 그러한 기관의 교과가 특정 종교의 전파를 목적으로 하는 경우에, 그러한 학교나 기타 교육기관 또는 교습 기관이 특정한 종교를 가진 피고용인을 고용 또는 채용하는 것이 허용되고 있다. 따라서 학교의 역사, 사명, 교직원과 학생들의 종교, 학생들의 종교활동, 그리고 커리큘럼에 대한 종교적 관점 등을 검토하여 종교계 학교로 판단되면 특정 종교인에 대한 채용의 자유를 부정하기 어렵다고 판단된다. 이 글은 종교계 학교의 교직원 채용 시 지원자가 특정 종교인일 것을 조건으로 하는 것이 우리 법제상 위법인가에 대하여 주로 노동법적 차원에서 비교법적으로 검토해 보았다.

  • R&D 투자로 인한 기술의 축적, 경제적 성과 및 파급효과에 대한 분석이 거시적인 측면과 타 부문에서는 다양하게 이루어지고 있으나 철도산업에 대한 분석은 미흡한 실정이다. 본 연구에서 성과목표 설정에 대해서는 선행연구에 대한 조사분석을 통하여 과학기술적 성과에 대한 공통지표로 지식재산권, 특허, 논문을 설정하고 성공적으로 종료된 철도 R&D 11개 사업의 과학기술적 성과에 대한 적정성을 검증하였다. 선행연구에서 투입요소로 투자금액에 의한 성과목표를 설정하였으나 정확도를 향상시키기 위해 투입요소로, 투자금액(RI), 자본적 투자금액(RCI), 인당 내부인건비(LCPM)를 적용하였으며 철도 R&D 11개 사업에 대한 횡단면 분석과 잔차 분석을 통하여 성과목표 모형을 설정하고 타 과제 분석을 통하여 실증분석과 타당성을 검증하였다.

Detection of Meat Origin (Species) Using Polymerase Chain Reaction

  • A quick and reliable method for identifying meat origin is developed to ensure species origin of livestock products for consumers. The present study examined the identification of meat sources (duck, chicken, goat, deer, pig, cattle, sheep, and horse) using PCR by exploiting the mitochondrial 12S rRNA and mitochondrial cytochrome b genes. Species-specific primers were designed for some or all mitochondrial 12S rRNA nucleotide sequences to identify meat samples from duck, chicken, goat, and deer. Mitochondrial cytochrome b genes from pig, cattle, sheep, and horse were used to construct species-specific primers, which were used to amplify DNA from different meat samples. Primer sets developed in this study were found to be superior for detecting meat origin when compared to other available methods, for which the discrimination of meat origin was not equally applicable in some cases. Our new development of species-specific primer sets could be multiplexed in a single PCR reaction to significantly reduce the time and labor required for determining meat samples of unknown origin from the 8 species. Therefore, the technique developed in this study can be used efficiently to trace the meat origin in a commercial venture and help consumers to preserve their rights knowing origin of meat products for social, religious or health consciousness.

근무 양상(주간과 야간)이 근로자 건강에 미치는 영향에 관한 연구 동향 (Literature review of effect of work pattern (day shift and night shift) on worker's health)

  • Based on a literature review regarding shift work, it is recognized that it has an adverse effect on workers' health. Especially, the night shift rather than the day shift imposes severe disorders on workers, which are indicated to dyssomnia, maladaptation to social life, and health problems such as gastroenteric trouble, cardiovascular diseases and depression. As the shift work can be explainable by using workers' labor ability necessarily to maintain company business consistently, it does not consider biorhythm, active mass and health condition of workers Actually duration of shit work would deprive workers of fundamental life rights by causing physical and mental effects. As a result of reviewing previous case studies related to effect of work pattern (day shift and night shift) on workers' health, an incidence of physical diseases like dyssomnia, gastroenteric trouble, cardiovascular diseases and premature delivery was higher in shift workers than normal workers. Additionally the incidence of mental disorders such as busy brain, social isolation, depression and work stress was also higher in shift workers than normal workers. These adverse physical and mental problems were intensified to night shift workers compared to day shift workers. Considering current various reports and study results, it is recommended that the shift work, especially the night work pattern, should not apply to contemporary work situation for sustaining workers' health condition constantly.

Y의료원의 물류 공급체계 중앙화 관리에 대한 연구 (A Study of an effective centralization of medical supply system. In Y University Medical Center)

  • Since the late 1980s, there have been radical changes in the managerial environment of Y University Medical Center(YUMC). Externally, the competition among hospitals has intensified due to the establishment of universal health insurance in 1939 and the entrance of large enterprises into the health care industry in the early 1990s. In addition, government regulation of medical institution is becoming stricter. Also, consumer groups have continued to demand the respect for patient rights and improvement of the quality of medical services. Internally, the financial condition of YUMC has worsened, not only because weak control and poor mediation in its large-scale structure have made its operation inefficient, but also because the rates of increase in the prices of goods and labor have grown faster than any increases in revenues. This study on materials management at YUMC presents a way for YUMC to reduce costs and increase its productivity, thereby overcoming its financial difficulties and dealing with external pressures. This study utilized the case studies of the materials purchasing and medical supply management in the United States and the comparative analysis of management to suggest short-term and long-term alternatives for innovation in YUMC. The goals of the short-term alternatives for innovation are to centralize the purchasing and supply departments and to simplify the decision-making processes. Through these attempts, it is estimated that YUMC's costs could be reduced by $600,000 per year. In the long-term, it is necessary to consider introducing a Supply Processing Distribution(SPD) system and setting up a centralized electronic system for supply and inventory management, although it is difficult to estimate the effect of cost-cutting because of the lack of analysis data. Thus, YUMC should thoroughly analyze initial investment costs and economical efficiency generated from long-term alternatives.

배달앱을 활용한 전통시장 배송 모형에 관한 실증분석 (An Empirical Analysis on the Compromised Delivery Model of Traditional Market Using Delivery Application)

  • Purpose - The purpose of this study was to propose a win-win development plan for not only suppliers of delivery applications but also traditional market vendor companies and delivery riders by analyzing existing delivery models and presenting a new delivery model to enhance competitiveness of the traditional market using delivery apps. Research desgin, data, and methodology - Specifically, small retailers, such as traditional markets and supermarkets, presented a compromised delivery model that utilizes the platform of specialized delivery app service providers for order reception, and that the delivery is delivered by delivery systems jointly hired by Vendor companies, such as franchising companies. To validate the significance of the trade-off delivery model, a cost-benefit analysis was conducted by those involved in the delivery application. Results - From the perspective of suppliers of specialized delivery applications, it is analyzed that the use of specialized delivery applications in traditional markets will be a new market opportunity for service providers to achieve increased sales. It is expected that consumer choice and satisfaction will be increased as convenience and accessibility of traditional market businesses that were available only through direct visit from the user side of the delivery application will be expanded. From the standpoint of delivery application franchises, it is analyzed that they can seek to increase sales and increase customer service as well as ease labor cost burden due to joint employment of delivery riders. The delivery rider will be able to seek to improve customer service due to job security, wage stability, risk reduction and overheated competition due to direct employment. Conclusion - In conclusion, the compromised delivery model solved the problems raised in the preceding study conducted on delivery application suppliers, users, franchises, and riders to establish that it could be a strategic alternative to increasing sales and expanding detailed rights for the self-employed in the traditional market, which are experiencing difficulties in management. However, the adoption of a compromise delivery model requires social consensus from those involved in the delivery application and requires legal, institutional and policy support, which will require continued follow-up research on the delivery model in the future.

장애인복지관 전문인력의 임파워먼트와 조직몰입의 관계에서 직무만족의 매개효과 (The Mediating Effect of the Job Satisfaction between the Relationship of Empowerment and Organizational Immersion of Professionals in Community Rehabilitation Facilities)

  • 본 연구는 장애인복지관 전문인력의 임파워먼트와 조직몰입의 관계와 직무만족의 매개효과를 검증하였다. D광역시와 C도 지역의 14개 장애인복지관의 전문인력 348명을 대상으로 설문조사를 진행하였다. 분석결과, 장애인복지관 전문인력의 임파워먼트가 조직몰입에 미치는 영향과 직무만족의 매개효과가 검증되었다. 임파워먼트의 조직몰입에 대한 직접효과에 비해 직무만족을 매개한 간접효과가 더 큰 것으로 분석되었다. 분석결과를 기초로 장애인복지관 전문인력의 조직몰입을 증진시키기 위해 임파워먼트와 직무만족을 향상시킬 수 있는 대책을 제안하였다. 임파워먼트를 높이기 위해 의사결정권, 전문성향상을 위한 연수기회, 적합한 슈퍼비전 등이 제공될 필요가 있다. 직무만족을 향상시키기 위해 전문적 윤리의식의 교육, 사례발표의 진행, 감정노동의 적절한 관리 등이 바람직하다.

  • 이 논문은 건설일용직 노동자들의 사회안전망 강화를 위한 주요 조건으로서 일용직 건설노동자들의 4대 사회보험 의무가입 시행을 위한 기금확충 규모를 분석하고, 이를 추진하기 위한 정책적 과제를 탐색하는데 그 목적이 있다. 건설업은 오랫동안 국내경제에 중요한 기여를 해온 중추적 산업부문임에도 불구하고, 전체노동자의 절반이 일용직 형태의 비정규 노동자 일만큼 산업내 비정규 비율이 매우 높은 대표적 산업이다. 이러한 현실은 건설산업구조의 고유한 특성과 고용구조에서 기인한다. 본 연구에서는 건설업 내의 불안정 노동자들의 사회안전망을 강화하고 건설업의 경쟁력을 강화하는 방안으로 건설노동자들의 사회보험 의무가입이 절대적으로 필요하다는 인식아래 사회보험 의무가입을 위한 기금확충 규모를 분석하고 이를 실현하기 위해 사회보험 가입조건 완화를 비롯하여 적정임금 도입, 직접시공과 같은 구체적인 정책적 과제를 탐색한다.

이주배경 아동·청소년 정책에 대한 비판적 분석과 대안 모색 : 가족과 교육 아젠다를 중심으로 (Critical analysis of policies for children with immigration background in Korea : Focusing on agenda of family and education)

  • 이 연구는 2006년 이후 급속하게 전개되어 온 한국사회 이주배경 아동 청소년 정책의 가시적. 비가시적 아젠다를 비판적으로 분석하여 새로운 정책 패러다임을 모색하려는 목적에서 이루어졌다. 그동안 다양한 차원에서 이루어져 온 이주배경 아동 청소년 정책은 한국사회의 변화를 촉발시키며 다문화사회의 저변을 구축하는 긍정적인 기능을 수행해왔다. 그럼에도 불구하고, 이주배경 아동 청소년에 대한 낙인과 부정적인 이미지의 확산 등 정책의 역효과 문제, 이들에 대한 집중지원으로 인한 일반 소외계층 아동 청소년에 대한 역차별 문제 등으로 많은 비판의 대상이 되어 왔다. 이 연구는 이러한 현실을 염두에 두고 성장기인 이주배경 아동 청소년에 직접적인 영향을 미치는 가족과 교육 정책 아젠다를 분석하여 그 의의와 한계 그리고 시사점과 향후 방향성을 제시하였다.

중소 패션기업의 업무영역별 비즈니스 윤리 요소 도출 (Identifying business ethics components according to business area for small and medium-sized fashion companies)

  • The purpose of the present study was to generate a list of business ethics components according to business area for small and medium-sized fashion companies. Based on the literature review, 21 components of business ethics components were identified within five business areas. Ten CEOs(Chief Executive Officers) each participated in an in-depth interview, sharing ethical and unethical cases from their own businesses. Constant comparative analysis was used to generate important business ethics components from those cases. In results, important business ethics components for each business area are: 1) using human-friendly materials, strengthening sustainable technologies, using vegan materials, concerning safe process, and reducing waste in the material production and sourcing area, 2) enhancing an efficiency in design, developing recycle/reuse designs, avoiding to copy designs, and using messages for public interest in the product design area, 3) concerning fair-trade, reducing harmful substance, saving energy, and using ethical supply channels in the distribution and logistics area, 4) acquiring certifications, promoting consumer protection, avoiding exaggerative/false advertisements, and promoting social contributions in the management and marketing area, and 5) promoting workers' rights, complying with the law, and investing on employee educations in the labor management area. All of the ethical and unethical cases of the ten companies have involved aspects of the 21 components, thereby enhancing understandings on how each issue is being seriously considered and/or handled in the small and medium-sized fashion companies. Study findings may provide a basis for development of a research model for quantitative studies and/or educational programs related to business ethics in the fashion industry.
