Review of 2013 Major Medical Decisions (2013년 주요 의료 판결 분석)

  • The court handed down meaningful rulings related to medical sectors in 2013. This paper presents the ruling that the care workers could be the performance assistants of the care-giving service although the duties of care worker are not included in the liability stipulated in the medical contract signed with the hospital for reason of clear distinction of duties between care workers and nurses within the hospital in connection with the contract which was entered into between the hospital and patients. In relation to negligence and causal relationship, the court recognized medical negligence associated with the failure to detect the brain tumor due to the negligent interpretation of MRI findings while rejecting the causal relationship with consequential cerebral hemorrhage. The court also recognized negligence based on the observation on the grounds of inadequate medical records in a case involving the hypoxic brain damage caused during the cosmetic surgery. In terms of the scope of compensation for damages, this paper presents the ruling that the compensation should be estimated based on causal relationship only in case the breach of the 'obligation of explanation' is recognized, however rejecting the reparation for de factor property damages in the form of compensation, and the ruling that the lawsuit could be instituted in case that the damages exceeded the agreed scope despite the agreement that the hospital would not be held responsible for any aftereffects of surgery from the standpoint of lawsuit, along with the ruling that recognized the daily net income by reflecting the unique circumstances faced by individual students of Korean National Police University and artists of Western painting. Many rulings were handed down with respect to medical certificate, prescription, etc., in 2013. This paper introduced the ruling which mentioned the scope of medical certificate, the ruling that related to whether the diagnosis over the phone at the issuance of prescription could constitute the direct diagnosis of patient, along with the ruling that required the medical certificate to be generated in the name of doctor who diagnosed the patients, and the ruling which proclaimed that it would constitute the breach of Medical Act if the prescription was issued to the patients who were not diagnosed. Moreover, this paper also introduced the ruling that related to whether the National Health Insurance Service could make claim to the hospitals for the reimbursement of the health insurance money paid to pharmacies based on the prescription in the event that the hospitals provided prescription of drugs to outpatients in violation of the laws and regulations.

Whitening and anti-wrinkle effect of Spirodela polyrhiza extracts (부평초 추출물의 미백 및 항주름 효과)

  • The antioxidant, whitening, and anti-wrinkle activity of Spirodela polyrhiza extracts and fractions were evaluated to determine its efficacy as a functional cosmetic material. 1,1-diphenyl-2-picrylhydrazyl and 2,2'-azinobis-3-ethylbenzothiazoline-6-sulfonic acid radical scavenging activities were 44.2 and 74.3%, respectively, at 100 ㎍/mL of SE-E (the ethyl acetate fraction of 70% ethanol extract). To measure anti-wrinkle effects, procollagen biosynthesis and matrix metalloproteinase-1 (MMP-1) inhibition activity were determined. At 25 ㎍/mL of SE (70% ethanol extract), the biosynthesis activity was 48.5%, and SE-E showed the best activity (57.8%) at the same concentration. MMP-1 inhibition activity of SE and SE-E was 13.4 and 28.5%, respectively, at 25 ig/mL. Finally, the inhibition of cellular melanin synthesis and cellular tyrosinase were measured to determine the whitening effect; at 25 ㎍/mL, the inhibition activities of SE were 9.6 and 13.8%, respectively, and those for SE-E were 15.4 and 22.0%, respectively. Our results confirmed the possibility of SE and SE-E as effective functional materials. Further research investigating the antimicrobial, anti-inflammatory, and anticancer activities of S. polyrhiza is necessary to confirm its potential use in the food, cosmetics, and drug industries.

Anti-osteoporotic Activity of Mixed Herbal Extract Involving Platycodon Grandiflorum Root in Osteoblastic MC3T3-E1 and Osteoclastic RAW 264.7 Cells (MC3T3-E1 조골세포주와 RAW 264.7 파골세포주에서 길경을 함유한 한약재 추출물의 항골다공증 효과)

  • Objectives: Osteoporosis is considered a serious human disease. We developed an extract of mixed herbs containing root of Platycodon grandiflorum (ExMH-PGR), which is expected to be effective in preventing or treating osteoporosis. The aim of this study was to investigate the anti-osteoporotic effect of ExMH-PGR in osteoblastic MC3T3-E1 cells and osteoclastic RAW 264.7 cells. Methods: To examine the anti-osteoporotic effect of ExMH-PGR, osteoblast and osteoclast differentiation were induced and cultured with various concentrations of ExMH-PGR. Alkaline phosphatase (ALP) activity, collagen synthesis, osteocalcin production, and mineralization in MC3T3-E1 cells were analyzed. Tartrate-resistant acid phosphatase (TRAP) activity and the formation of actin ring in RAW 264.7 cells were analyzed. Results: ExMH-PGR at concentration up to $25{\mu}g/mL$ significantly increased ALP activity, collagen synthesis, osteocalcin production, and mineralization in MC3T3-E1 cells. ExMH-PGR at 50 to $200{\mu}g/mL$ significantly inhibited TRAP activity and the formation of actin ring in RAW 264.7 cells. Conclusions: These results demonstrate that ExMH-PGR stimulates osteoblastic activities and inhibits osteoclastic activities in in vitro systems, suggesting that ExMH-PGR might be considered as an anti-osteoporotic candidate for treatment of osteoporosis disease.

  • Since the Hwang scandal, the South Korean state has expressed often-conflicting interests of encouraging stem cell research and the IVF industry to save the country and introducing the ethical regulation in conformity with "Global Standard." As the tightening ethical regulation of stem cell research has enervated the field of human Embryonic stem cell(hESC) research, somatic stem cells (re-)emerged as an alternative savior that could rescue the future of research communities, bio-industry, practicing doctors, patients and the nation itself from the crisis. The recent literature on Korean biotechnology, however, mainly focus on hESC and relatively little attention has been given to the rapidly growing field of research on somatic stem cells like hematopoietic stem cells(HSCs) or Adipose derived stem cells(ASCs). While the hESC therapy is often regarded as experimental and ethically controversial, the HSCs or Mesenchymal stem cell(MSC) therapies have already made their ways into people's everyday life through market without much public discussion. Many ordinary people in South Korea are familiar with the story of patients who survived leukemia with the HSCs treatment; the number of doctors who are actively marketing the ASCs therapies is on the rapid increase; the concept of cosmetic products made from ASCs is gaining popularity among consumers. In this context, this article argues that the current ethical debates solely focusing on hESC or on the state policy and research regulation are too limiting to fully illuminate the politics of stem cell technologies in South Korea.

The Antimicrobial Activity of Fermented Extracts from Korean Dendropanax morbifera (국내 황칠나무 발효 추출물의 항균력 평가)

  • We investigated the fermentation conditions for extracts of leave/branches and sap from Korean Dendropanax morbifera (D. morbifera) using Lactobacillus plantarum (L. plantarum) ilchiwhangchil 1785 and L. plantarum ilchiwhangchil 2020. Log growth phase cultured L. plantarum ilchiwhangchil 1785 and L. plantarum ilchiwhangchil 2020 were used for fermentation. The pH and growth of the microorganisms in broth were monitored during the fermentation period. The results revealed that the optimum fermentation conditions for 20 wt% of leave/branches extracts and 1 wt% of sap extract was 2 days incubation at $37^{\circ}C$. The minimum inhibitory concentration (MIC) method and a disk diffusion assay were used to evaluate the antimicrobial activity of the fermented extracts of the leave/branches and sap against Escherichia coli, Staphylococcus aureus, and Pseudomonas aeruginosa. The antimicrobial activity increased in all three strains grown on the medium containing fermented extracts of the leave/branches and sap as compared with that of the strains grown on medium containing non fermented extracts. Furthermore, the antimicrobial activity increased in proportion to the contents of the fermented extracts. Our data suggest that fermented extracts of leave/branches and sap of D. morbifera have applications as natural bio functional materials, such as preservatives, cosmetic materials, and natural packaging materials.

Hair Growth Effect of TS-SCLF from Schisandra chinensis Extract Fermented with Lactobacillus plantarum

  • This study investigated the hair growth effect of Schisandra chinensis extract (TS-SC) and TS-SC fermented by Lactobacillus plantarum (TS-SCLF) on human dermal papilla cells (hDPCs). The production of vascular endothelial growth factor (VEGF), insulin-like growth factor 1 (IGF-1), keratinocyte growth factor/fibroblast growth factor 7 (KGF/FGF-7) and hepatocyte growth factor (HGF), transforming growth factor beta 1 (TGF-β1) were examined. The secretion rates of VEGF and KGF/FGF-7 were high in TS-SC, and the secretion rates of IGF-1 and HGF were high in TS-SCLF. TGF-β1 was inhibited in a concentration-dependent manner in all samples. Gene expression of VEGF, IGF-1, KGF, HGF and alkaline phosphatase, relevant to hair growth, were examined. The data revealed that TS-SC and TS-SCLF successfully promoted hair growth in hDPCs. The IGF-1 gene was expressed in a dose-dependent manner in TS-SCLF. These results indicate that TS-SC and TS-SCLF fermented extract effectively promoted hair growth and gene expression relevant to hair growth in hDPCs. Used in clinical trials the test substance 'CMK-LPF01' showed a statistically significant increase in the number of hairs at 8 weeks, 16 weeks, and 24 weeks compared to before product use, and a change in hair growth, a secondary efficacy evaluation variable. Through additional research in the future, it is expected that "CMK-LPF01" can be developed as a functional material that can help alleviate symptoms of hair loss.

Anti-inflammatory activities of carrot(Daucus carota) leaf Fermented by Weizmannia coagulans KK7 (김치에서 분리한 Weizmannia coagulans KK7으로 발효한 당근 잎 추출물의 함염증 활성 연구)

  • In this study, the extracts of carrot (Daucus carota var. sativa) leaf fermented with Weizmannia coagulans KK7 strain were investigated for the anti-inflammatory activities and component changes. The KK7 strain was isolated from kimchi, a Korean fermented vegetable. The high-performance liquid chromatography was performed to analyze the changes in the components of the carrot leaf extracts before and after fermentation. It was confirmed that the content of luteolin, a kind of flavonoid, was significantly increased after fermentation. The anti-inflammatory activities of the carrot leaf extracts and the fermented carrot leaf extracts were evaluated by the inhibition of NO (nitric oxide) production in LPS-induced RAW 264.7 cells. The NO scavenging ability of the fermented carrot leaf extracts was higher than the other extracts. The protein expression of iNOS, an enzyme responsible for the NO production was significantly reduced in a concentration-dependent manner by treatment with the fermented carrot leaf extracts. In conclusion, we found that the anti-inflammatory effect of carrot leaf was increased by microbial fermentation, suggesting that carrot leaf generally discarded could be used as new food and cosmetic materials through fermentation.

Biological Activities of Ethanol Extracts from Hericium erinaceus Mycelium on Angelica keiskei and Angelica keiskei Pomace (신선초와 신선초박에 배양한 노루궁뎅이버섯 균사체 에탄올 추출물의 생리활성 효과)

  • The purpose of this study was to investigate the antioxidant, nitrite scavenging, angiotensin-converting enzyme (ACE), and tyrosinase inhibition activities of ethanol extracts from Hericium erinaceus (HE) cultured in Angelica keiskei (AK) and Angelica keiskei pomace (AKP). Antioxidant activities of the HE, AK, AKP, HE+AK, and HE+AKP extracts were higher than that of control, but lower than those of BHT and Vit C. Tyrosinase inhibition activity was the highest in AKP+HE extract (90%), whereas those of HE, AK, AKP, and AK+HE extracts were about 57, 61, 82, and 78%, respectively. Nitrite scavenging abilities of various samples were above 80% at pH 1.2, and there was no significant difference between the HE, AK, AK+HE, and AKP+HE extracts at pH 3.0, excepting the AKP extract. ACE inhibition activity was the highest in AKP extract (60%), whereas those of HE, AK, AK+HE and AKP+HE extracts were about 42%, 50%, 35% and 40%, respectively. These results suggest that H. erinaceus cultured in AK and AKP may be used as a raw material for functional foods, and food additives, as well as in the cosmetic industry as a natural source of bioactive compound after further investigation in vivo.

Analysis Method of Parabens in Human Breast Milk by LC-MS/MS System (LC-MS/MS 시스템을 이용한 모유 중 파라벤류 분석법 확립)

  • Parabens were commonly used for preventing the growth of microorganisms as preservatives in the pharmaceutical, cosmetic and food industry. Also, parabens are known endocrine disruptors because of their estrogenic effects on human. Parabens affect the endocrine system and show adverse effect such as, genital malformations, precocious puberty and testicular cancer in young children, infants and fetuses. In this study, we developed analytical method for four parabens (methyl paraben, ethyl paraben, propyl paraben, butyl paraben) in human breast milk which frequently consumed by newborn baby. The analytes were extracted using liquid-liquid extraction (LLE) after enzyme hydrolysis with protease and lipase, then quantitative analysis was performed by liquid chromatography tandem mass spectrometry (LC-MS/MS). The method validation results were as follows; the linearity of calibration curves were excellent with coefficient of determinations (r2) higher than 0.999, the limit of detections (LODs) were 0.019~0.044 ng/mL, the accuracies were 85.3~105.9% and the precisions were lower than 10%. The average concentration ± standard deviation of parabens in ten human breast milk sample were MP 0.660 ± 0.519 ng/mL, EP 1.631 ± 2.081 ng/mL and PP 0.326 ± 0.320 ng/mL, and BP was not detected.

Metal Oxide Thin Film Transistor with Porous Silver Nanowire Top Gate Electrode for Label-Free Bio-Relevant Molecules Detection

  • Chemical sensors have attracted much attention due to their various applications such as agriculture product, cosmetic and pharmaceutical components and clinical control. A conventional chemical and biological sensor is consists of fluorescent dye, optical light sources, and photodetector to quantify the extent of concentration. Such complicated system leads to rising cost and slow response time. Until now, the most contemporary thin film transistors (TFTs) are used in the field of flat panel display technology for switching device. Some papers have reported that an interesting alternative to flat panel display technology is chemical sensor technology. Recent advances in chemical detection study for using TFTs, benefits from overwhelming progress made in organic thin film transistors (OTFTs) electronic, have been studied alternative to current optical detection system. However numerous problems still remain especially the long-term stability and lack of reliability. On the other hand, the utilization of metal oxide transistor technology in chemical sensors is substantially promising owing to many advantages such as outstanding electrical performance, flexible device, and transparency. The top-gate structure transistor indicated long-term atmosphere stability and reliability because insulator layer is deposited on the top of semiconductor layer, as an effective mechanical and chemical protection. We report on the fabrication of InGaZnO TFTs with silver nanowire as the top gate electrode for the aim of chemical materials detection by monitoring change of electrical properties. We demonstrated that the improved sensitivity characteristics are related to the employment of a unique combination of nano materials. The silver nanowire top-gate InGaZnO TFTs used in this study features the following advantages: i) high sensitivity, ii) long-term stability in atmosphere and buffer solution iii) no necessary additional electrode and iv) simple fabrication process by spray.
