한·중 FTA와 한국 농식품의 중국 수출확대 방안 (The Korea·China FTA and the Export Promotion Strategies for Korean Agri-Food to China)

  • The Korea China FTA was signed on June 1 2015. It includes some concessions regarding major export items in the manufacturing sector for the protection of primary industries and preferential tariffs for a number of products produced in the Kaesong Industrial Complex. Primary industries are what the Korean government paid the greatest attention to. Rice was excluded from the negotiations from the get go, and was joined by 548 other food items including pork, apples, pears, beef, chili, garlic etc. These foodstuffs account for about one-third of the agricultural and livestock products that Korea produces, and are not going to be subject to tariff elimination. The results of the study are as follows: Korean government policy is to maintain of agri-food export support system, eliminate of agri-food non-tariff barriers, foster of agri-food export SMEs and expand of investment of foreign agri-food company. Korean firms strategy is to establish of regional marketing strategy, ensure of high quality agri-food and develop of food packaging technologies, establish of agri-food export logistics center and take advantage of the FTA preferential tariff.

한.중 FTA 추진에 따른 농산물교역의 과제와 대응방안 (Prospect of FTA and Trade of Agricultural Products between Korea and China)

  • The global financial crisis, the instability of the global economy since the beginning of the growing economic interests of the countries to adjust to establish a new economic system was set up on occasion. Meanwhile, standing in the international trade environment, multilateral system of international trade for the country as the cumulative fatigue of open markets and trade liberalization as an alternative to lead the free trade agreements between countries. Currently in Korea and China, in addition to the geographical proximity in all areas, including economic exchanges and mutually dependent relationship that is deepening the world's No. 1 exporter in China and overseas investors have become partners. FTA with China by promoting the growth of emerging economies in the Chinese market by securing a stable economic growth of China as a driver of economic growth in the country to utilize the plan is being promoted from. This study is currently being promoted, in a discussion of the FTA's agricultural trade measures to address the challenges and poems. Agricultural trade with other goods to be different from the specificity of the discussion of market opening and liberalization of trade has been recognized in the main essentially nothing. We promote an FTA, according to one review and discuss the background and trends of the agricultural trade in a market, through the analysis of the status and trends and present problems for future bilateral trade negotiations with Korea for agricultural markets and propose countermeasures for. Agricultural trade, during a discussion of the FTA is essentially nothing in the review is expected to expand the bilateral trade in agricultural products, while protecting its agricultural markets to be trying to policy implications.

중국의 친환경농업 분석과 한.중 비교 (An Analysis on Environmentally Friendly Agriculture of China)

  • The trend towards forming economic blocs coupled with global economic arrangements such as DDA and FTA increase pressure on the liberalization of the agricultural sector. South Korea is taking part in the DDA negotiations. Once the DDA negotiations are implemented, the extent of liberation of the agricultural market is expected to be wider and timing of market opening is sooner than those effects of the UR agricultural agreement. A reduction in tariff rates and the government subsidy will follow, accordingly. However, many analysts in the agricultural sector express deep concern over a negative development in local agricultural market as demonstrated in China where the local market was dominated by imported agricultural products. This study aimed to investigate progress that China made in favor of the agricultural industry, including environment-friendly agricultural policy, and suggest ideas to drive the development of the agricultural industry in a better direction in Korea by comparing the two countries.

한·중 FTA 원산지기준의 「최적 합의안」도출을 위한 양국 기존 FTA협정의 원산지부문 비교연구 (Comparative Research on the Rule of Origin of the Each Previous FTA Agreements for Driving 'Optimum Consensus' on the Rule of Origin within Korea-China FTA Negotiation)

  • 적극적인 FTA정책의 추진으로 한·중 양국의 FTA 체결국은 급증하고 있으며, 한·중 FTA도 가까운 시기에 협상에 임하게 될 것이다. 본 연구의 목적은 가까운 미래에 착수될 한·중 정부간 FTA 협상에서 가장 핵심적인 쟁점사항이 될 원산지기준의 원만한 타결을 위해 바람직한 합의안을 도출하는 것이다. 이러한 바람직한 합의안을 도출하기 위해 저자들은 한국과 중국이 각각 제3국·지역과 체결한 9개의 FTA 관련 협정문을 토대로, 9개의 서로 상이한 원산지 협정문에서의 구체적 원산지 적용기준을 살펴보고, 이들의 특징에 대하여 비교 분석하였으며, 이 분석을 통하여 유사점과 차이점을 찾아내 바람직한 하나의 합의안을 도출하였다. 연구결과, 한·중 FTA에서 실질적 변형기준에 있어서는 아시아에서 활용이 가장 많은 4단위의 세번변경기준과 역내 부가가치 40% 이상의 부가가치기준 중에서 택일하는 기준이 채택되어야 한다는 결론에 도달하였다. 아울러 부가가치 비율을 계산함에 있어서는 계산방법·가격기준 등을 단순화·표준화해야 하며, 따라서 객관적인 공제법 사용을 위주로 하고, 가격기준은 명확한 기준이 되는 CIF나 FOB를 적용하여야 한다는 결론을 얻었다.

가격차 모형에 기초한 한국과 중국간 기술무역장벽(TBT) 추정에 관한 연구 (A Study on TBT Estimation between Korea and China based on Price Wedge Approach)

  • 본 논문은 한 중간 FTA 협상 타결을 앞두고 중요한 의제로 등장하고 있는 기술무역장벽의 규모 추정을 위하여 전통적인 가격차(Price Wedge) 모형을 응용하여 한 중간 TBT 규모를 실증적으로 추정하였다. 본 연구에서는 World Bank의 9개국 HS 코드와 JETRO의 AIO 코드를 결합하여 TBT 추정에 활용한 바, 개별 국가나 개별 산업분석의 틀을 넘어 주요 9개국 제조업 전산업으로 분석의 대상 범위를 확장하여 실증분석에 활용하였다는 점에서 연구의 가치가 높다고 하겠다. 실증분석 결과 중국의 수출품에 대한 한국의 TBT 상당액 상위 품목과 무역비중 상위품목이 유사하다는 점에서 TBT의 중요성을 확인할 수 있었다. 또한 한국과 중국 양국이 서로에게 공통적으로 큰 TBT를 부과하는 품목들의 경우 중국이 한국에 부과하는 TBT가 한국이 중국에 부과하는 TBT에 비해 규모가 매우 크다는 점에서 향후 중국과의 FTA 협상에서 TBT에 대한 적극적 대응 필요성을 시사한다고 하겠다.

Investment Treaty Arbitration Policy in Australia, New Zealand and Korea?

  • As in some developing countries and more recently some developed countries worldwide and in the Asian region, Australia has faced significant internal opposition and public debate especially over treaty-based investor-state dispute settlement (ISDS). As outlined in Part II(1), concerns have re-emerged and escalated since the first-ever claim was brought against Australia regarding its tobacco plain packaging legislation, in 2011 by Philip Morris Asia under an old BIT with Hong Kong. However, Australia signed bilateral FTAs with Korea in 2014 and with China in 2015, including ISDS protections, prompting several sets of parliamentary inquiries (Part II(2)). Australia's close trading partner, New Zealand, had already concluded an FTA with China in 2008 that included more expansive ISDS-backed investor protections. In 2015, the New Zealand Parliament has been debating ratification of its own FTA with Korea, with ISDS also now attracting growing scrutiny, as elaborated in Part III below. In both bilateral FTA negotiations, the present Korean government seems to have reverted to a strong preference for concluding investment agreements with extensive ISDS protections, despite public and parliamentary debate around 2011 in the context of ratifying its FTA with the United States. As mentioned briefly in the concluding Part IV, Korea's stance has significant implications for the future trajectory of treaty-based ISDS - and indeed international arbitration more generally - in the Asia-Pacific region, and perhaps even globally.

Agricultural cooperation among the North-East Asian countries

  • The following four aspects should be examined in detail to revitalize North-East Asian agricultural cooperation specialized with Korea, Japan, and China. First, quality and safety standards of agricultural food should be unified. Secondly, it is necessary to build a food security cooperative system in North-East Asia. If three countries build the system, they can overcome a problem such as unstable supply and demand due to natural disaster, and also they can cope with food crisis. Thirdly, to establish North-East Asian Agro-valley is needed. After forming food production belt that connects Korea, Hokkaido in Japan, and the three north-eastern provinces in China, it is possible to realize high value-added agriculture with producing and processing of complementary food for partner country. Lastly, trilateral FTA negotiations should be managed carefully with operating the agricultural special zone and exclusion or prolong period of removal of tariff on sensitive items.

디지털 통상의 국제규범화 현황과 쟁점: 국경 간 데이터 이동 및 데이터 보호를 중심으로 (Current Status and Issues in Digital Trade Agreements: Focusing on Cross-border Data Flows and Data Protection)

  • Korea's FTA e-commerce regulations are evolving into a standardized norm. However, "location of computing facilities", which was not covered by Korea's existing FTA, was newly established in Korea's first Mega FTA, RCEP. China, a member of RCEP, restricts data movement and requires data localization through its Cybersecurity law. These facts have led to start this study with interest in data-related regulations. It examined country-specific and regulatory characteristics in the process of forming digital trade norms, using the TAPED established by Burri et al. (2020). It also analyzed the current status of introducing norms related to 'data flow', 'data localization' and 'data protection' of the EU, USA and China, which are leading the formation of e-commerce trade norms. Finally, the legal review was conducted to compare the exact meaning of the wording expressed in each agreement for the six recently enacted Mega FTAs and Digital Economic Agreements. These findings are meaningful in that they provided implications for the effectiveness of RCEP and the direction of negotiations on Korea's digital trade norms.

FTA체제 하(下)에서의 한국의 무역구제제도 및 한·중FTA 무역구제 협상 (A Study on The Korean Trade Remedy System under the FTA and the Negotiation of Trade Remedy in Korea-China FTA)

  • 최근에는 WTO의 다자주의 체제에 대비되어 지역주의 또는 양자주의를 표방하는 FTA의 체결이 급격히 증가하고 있다. FTA 체제하에서 무역구제제도는 존립 필요성 및 내용과 관련된 다양한 이슈를 가지고 있다. FTA체제 하에서 무역구제제도의 존립근거는 GATT 제24조에서 찾아 볼 수 있는데, 공식적인 무역구제제도는 반덤핑, 상계, 세이프가드가 있고 본 연구는 이러한 협의의 무역구제제도 개념에 국한하여 이루어졌다. FTA체결 시에는 한국의 경제상황과 국내산업 보호 필요성을 충분히 고려하고 FTA협상 상대국 별로 다른 무역구제제도를 도입하는 것이 필요하다. 현재, 한국의 기 체결된 FTA에서 무역구제제도는 대체로 WTO협정의 권리와 의무를 유지하고, 일부 FTA 무역구제분야에서 상황에 따라 협정의 일부를 변경하고 있다. 본 연구는 위의 분석결과를 실제 한 중 FTA의 무역구제 협상에 적용하였는데 즉, 중국과의 산업전반 및 주요 교역품목에 관한 경쟁력 우열관계를 고려하여 무역구제제도가 결정되어야 할 것이다. 따라서 FTA의 체결 목적을 충분히 고려하고, 예상치 못한 경제상황 변화에 대비한다는 취지에서 무역구제조치의 발동 근거를 마련할 필요가 있다. 또한 민감품목에 대해서는 추가로 특별세이프가드 규정을 도입해야할 것으로 생각된다.

한ㆍ싱가포르 FTA 체결에 따른 수산부문의 영향분석 (Economic Effects of Korea-Singapore Free Trade Agreement on the Fisheries Sector)

  • According to this study, overall economic impacts of the FTA between Korea and Singapore upon fish and fishery products of our country were likely to be very small and insignificant. When the tariff on fish and fishery products between the two borders were completely eliminated, if no roundabout exports from other ASEAN countries were practicing, then this study calculated that the increase of imports from Singapore in the 12 chief items was estimated to be only about 250,000kg, which comes to the amount of 1.1 billion won. The 12 items used here account for over 90% imports of fish and fishery products from Singapore. This study also revealed that imports of fish and fishery products from Singapore would be substituted for domestic products more than 100,000kg in the 7 items produced domestically. The substitution effect represents fishermen's demage by replacing domestic products by imports in terms of income which comes to the amount of 438 million won. As the results of the study shows, establishing an FTA between the two countries will not exert so much adverse effects on our fisheries because relative importance of fish and fishery products in both countries are very small. But the contents of the agreement on fish and fishery products between the two countries are very important, as concluding the negotiation and signing the agreement between Korea and Singapore would be a precedent in future negotiations with other asian countries, especially with China and ASEAN countries.
