The security law and security industry of Japan have a great impact on Korea. In a modern sense, there are little large disparities between the two nations in the history and development of private security. However, the way they look at private security is not the same in large part. In Japan, private security companies are highly regarded by Japanese people as organizations that guarantee their safety, owing to the efforts of private security companies themselves, the National Security Association and civic groups. Private security has especially been approved and supported since it was decided in the anticrime cabinet council in December, 2003, in line with the action plan for the realization of anticrime society to boost private security as an industry to ensure people's safety in daily routine life by curbing crimes that might pose a threat to peaceful life. Afterwards, there has been a dynamic collaboration between the Japanese police and private security in terms of education, crime prevention, disaster prevention/restoration and everyday life safety. As for Korea, the necessity of cooperation between private security and the police is increasingly stressed, and it's required to strengthen their partnership to ensure successful crime prevention in consideration of Japanese partnership cases. In Japan, the police, civic groups, the security association and security companies make every effort to satisfy Japanese people's safety needs in diverse ways and take disaster-prevention measures as well.
As the demand for national security and national safety is gradually increasing in accordance with the trend of the times and social environment, and the use of private areas for effective prevention and supply required for the demand for safety services, this paper analyzed the Japanese private security testing system for the introduction of the Korea security certification system as a way to secure expertise in the private security industry and drew the following conclusion. First, certificate segmentation should be carried out according to the clearly divided field and scope of the expense operation. Second, it is necessary to distinguish the qualification of the private security qualification according to the level. Third, it is necessary to utilize the combined evaluation method through the departmental and practical tests. Fourth, an assessment should be made through the link between departments and practical subjects. Fifth, the diversity of the acquisition methods should be placed to ensure the gainer's accessibility. The purpose of this study is to suggest legalization of private investigation system by giving an example of Japanese detective investigation on people who have been missing for a long time. To accomplish the research purpose, this study reviewed literature and used preceding researches on Japanese detective system to complete theoretical background. This study also identified the missing people in Korea and Japan to accomplish the research purpose. Conclusion: In Japan, about 80,000 people are reported to be missing every year. Although most of them are found on that day or within a week, some of them are not found for more than a week. There even a case where the person was missing for more than 3 years. In such case, the Japanese citizens requests detectives to find the missing person instead of depending on the police. When Japanese detectives are paid by their client, they provide the security service requested by the client. Japanese detectives receive about 100,000 yen to 700,000 yen for finding missing person and they find the missing person through investigation on voluntary or involuntary missing person. Such activities of Japanese detectives point out the necessity of introducing private investigation system in Korea. Currently, most missing people are not found in Korea. Introduction of private investigation system will help in finding the missing person, reducing the excessive workload of police, and creating jobs.
Japan came to result in enacting and enforcing the law on rationalization of service pertinent to the Private Detective Service Law in order to rationalize the illegal service realities of private detective service dealers and detective agencies, which were flooded in 2006. Since the enactment of the law, the problems are still taking place in relation to Japanese private detective service as of 2012. However, Japan's regulatory agencies can be known to revise the corresponding statute and to make effort to improve consciousness of agencies in order to improve these problems. Accordingly, it can be considered to be great in implication as for our country's introduction of private investigation service in the future. Arranging these contents, they are as follows. First, it is improvement in problems related to other statutes according to performance of private detective service. Second, it is reinforcement in management of private detective service violators. Third, it is propulsion of rationalization in cost according to a contract of private detective service. Accordingly, it can be considered to be necessary for being newly legislated at the 19th National Assembly from the perspective dubbed development and social right f unction in private investigation industry, by further supplementing Japan's these problems and arranging improvement plans so that the corresponding service called private detective service can do more public function in society.
Korean security industry has history of more than half a century, and it is growing fast. Private security industry contributes not only to livelihood safety, but also to national security. The area of the industry is being expanded. Security Act is closely related to the security industry, and has contributed to the growth of private security industry sector. Security Act of Korea, which was established in 1976, was originally made after Japanese Security Act. But nowadays, Korean Security Act is as systematic as the Japanese act. However, for 10 years, Security Act of Korea has been stagnant, not able to reflect security industries' demand. The writer has contributed to the development of Security Act. In 1995, the writer wrote the basic framework of Security Instructor Qualifications System and drafted Security Act in 2002. There are currently many problems in existing Security Act, but there are four representative problems. (1) No more establishment of new security sector, (2) excessively slack qualification criteria, (3) the education system for guards, (4) the security Instructor examination system. This paper derives problems of current Security Act, and suggests solutions for them. Not only the academic world, but all of us should pay attention to the revision of Security Act.
Currently, the security operations in nation's key foundations in Korea are performed by private police and special security guard in accordance with the Private Police Act and Security Business Act, respectively. In 1960s, The Korean Government introduced the private police system in terms of the national security issues, but it was just a hurriedly-set plan on the basis of Japanese Sunsa system as by that time there was no such system revitalized. However, the special security guards could offer wider range of security services including those of the private police with the enactment and revision of the Security Business Act 1976 and April 2001, respectively. Moreover, the expectations and interests rose over the special security guards in nation's key foundations after 9.11Terror Event in the U. S. 2001. However, as we investigated the current education/training system for the special security guard, we found that such education/training which is not activating the specialty of special security guard will not respond to the social demands. Special security guard owns its own characteristics other than those of general security guard as they are in service in nation's key foundations. Thus, the effcient management and training for the special security guard is the most important matter for the safety and security of nation's key foundations. Therefore, the well-educated special security guard through the reorganized and specialized education/training for the protection of nation's key foundations is expected to offer qualitatively improved security services.
Nowadays, national criminal policy focuses on "specialization", "advancement", and "choice and concentration" to enhance the efficiency and effectiveness of public peace services. Consequently, the space that a nation manages diminishes and there appears vacant space of security. For that reason, in most developed countries including South Korea, there has been a significant expansion in the size and role of Private Security(PS). From this point of view, the Japanese government has adopted the PFI(Private Finance Initiative) system in private prisons. These cases clearly show the role and significance of "PS". By applying know-how of the private sector, these PFI prisons make efficient use of installation by the united efforts of government and people. Criteria such as solution for risk baring, regional coexistence, preservation of public security, response management and operating skills are considered important particularly in Kitsuregawa and Harima prisons. Thus, this study examines the implications and applicability for the expansion of PS in South Korea.
The purpose of this study is to investigate about security service history as enlightenment period from the provisional government to 1920s. This study used materials by historical facts for the regulations and books in provisional government, newspapers in 1920s. There are four parts conclusion of this study: police department of provisional government, security service agency in the provisional government, security service agents of an independence movement, the general society of Korea. Firstly, Kim Gu, a prominent Korean nationalist leader, was understand of security service which was to protect provisional government from the enemy. So, Kim Gu participated in training of security service agents in the police department of provisional government. Secondly, there was security service agency in the provisional government. In 1920s, security service agency and agents appeared for the first time in regulations of the provisional government. At the beginning of the security service agency's appearance was influenced on background and circumstances for Korean independence activist who helped the independence of Korea from Japan. Thirdly, security service agents leaded an active for independence movement of the private organizations in 1920s. They carried on an independence movement in defiance of Japanese coercion as nationalist in Korea history. Fourthly, security service came out the general society of Korea in 1920s. The security service was not just for safety, but also for its security system and peace of mind, which were influenced by the political situation, social environment in 1920s. For the this reason, now security service has safety perception in Korea despite the historical progress.
In modern society, citizen's expectation about policing levels have been rising over time and it limited resources of the police to deal with the security services are insufficient. Until now, the state monopoly of the police activity was changing to subject of a variety in cooperation with public security system. The citizens considers community not the destination to police enforce the law but space for effective policing partners. Japanese police focus on cooperation oriented policing to strengthen the police and local residents with crime prevention for a long time. Using a comprehensive sample of convertible security offerings by Korean firms from 1981 to 1999, we examine the effect of convertible bond issues on firm value. We find that the announcement of convertible bond issues has a positive effect on firm value. However, the announcement of private convertible bond issues by chaebol firms has a significant negative effect on their market values. This result is different from that in Japan, suggesting that the efficiency of the financing decision by Korean chaebol is different from that by Japanese keiretsu. In addition, we find that the announcement effect of private convertible bond issues by chaebol firms has a significant relation with the corporate governance variables such as ownership structure, bank relationship. These results indicate that convertible bond issues can be used as a mechanism for chaebol owner-manager to give rise agency problems at the expense of the wealth of minority shareholders.
