International Safety Management(ISM) Code and Duty of Due Diligence of Ocean Carrier (국제안전관리규약(國際安全管理規約)(ISM Code)과 해상운송인(海上運送人)의 주의의무(注意義務))

  • "International Safety Management(ISM) Code" means the International Management Code for the Safe Operation of Ships and for Pollution Prevention as adopted by the Assembly, as may be amended by the International Maritime Organization. This Code have brought into force internationally since 1th July, 1998 by incorporated to the new Chapter Ⅸ in the SOLAS Convention. Accordingly those States which give effect to the SOLAS Convention will have to ensure that rules giving effect to the Code are introduced into their domestic legislation. The purpose of this Code is to provide an international standard for the safe management and operation of ships and for pollution prevention, by this to reduce the maritime casualty which could caused by neglect of person. To achieve this purpose the ISM Code specifies a number of broad 'safety management objectives' for owning or operation companies, and it requires that such companies should establish, implementing and maintain a written Safety Management System(SMS) covering a whole range of safety environmental and related matters. These requirements of the Code could effect on the carrier in some points such as duty of due diligence to care for cargo, due diligence to make the vessel seaworthy and burden of proof etc. In this respect, We should know that the ISM Code could effect on the carrier advantageously or disadvantageously subject to whether the carrier observed the requirement of the ISM Code. Although it does not add cause of liability or increase limitation of liability imposed to the carrier.

The Accuracy of the ICD-10 Code for Trauma Patients Visiting on Emergency Department and the Error in the ICISS (응급센터에 내원한 외상 환자에 있어 ICD-10 (International Classification of Disease-10)입력의 정확성과 ICISS (International Classification of Disease Based Injury Severity Score)점수의 오류)

  • Purpose: We designed a retrospective study to measure the accuracy of the ICD-10 (International Classification of Disease-10) code for trauma patients. We also analyzed the error of the ICISS (International Classification of Disease based Injury Severity Score) due to a missing or an incorrect ICD-10 code. Methods: For the measuring the accuracy of the ICD-10 code for trauma patients in a tertiary teaching hospital's emergency department, two board certified emergency physician performed a retrospective chart review. The ICD-10 code was classified as a main code or a sub-code. The main code was defined as the code of the main department of treatment, and the sub-code was defined as a code other than the main code. We calculated and compared two ICISS for each patient one by using both the existing code and the other by using a corrected code. We compared the proportions of severe trauma (defined as an ICISS less than 0.9) between when the existing code and the corrected code was used respectively. Results: We reviewed the records of 4287 trauma patients who had been treated from July 2008 to November 2008. The accuracy of the main code, the sub-code of emergency department, main-code, the sub-code of hospitalized patients were 97.1%, 59.8%, 98.2% and 57.0%, respectively. Total accuracy of the main and sub-code of emergency department and of hospitalized patients were 91.4% and 58.6%. The number of severe trauma patients increased from 33 to 49 when the corrected code was used in emergency department and increased from 35 to 60 in hospitalized patients. Conclusion: The accuracy of the sub-code was lower than that of the main code. A missing or incorrect subcode could cause an error in the ICISS and in the number of patients with severe trauma.

  • Owing to WTO/TBT, Many countries are trying to accord their own various national codes and standards with international standards. Also Korean electric power code is being made consistent with the new standards which include the international standards. The new code will affect the many aspects of building construction. In order to cope with the change of the electric power code, this paper analyzed the trend of the international standard(IEC 60364, IEC 61024) and we think this study will help engineers to understand the international electrical standards.

  • The International Ship and Port Facility Security (ISPS) Code which was developed as the main response of the shipping sector to the miserable event of 11 September 2001 came into effect on 1 July 2004. The ISPS Code designed to detect and eliminate security threats affecting ships and port facilities used in international trade will significantly impact not only on the management and operation of the shipping industry but also on maritime law despite the fact that it is the regulatory framework of public law. It is expected that implementing the ISPS Code will contribute to reinforcement of maritime security on the one hand. However, on the other hand, more intensified security inspection and control measures of port states will also cause delay and additional costs which cause uncertainty in allocating security risk and cost between the contracting parties. Therefore, it is desire to insert new security clause dealing with main security issues or adapt existing clauses to new shipping environments to minimize disputes.

  • In view of the increased threat arising terrorism, the International Maritime Organization(IMO) adopted the International Ship and Port Facility Security Code (ISPS Code) which attached to the SOLAS Convention. The ISPS Code requires a comprehensive set of measures to enhance the security of ships and port facilities. For example, a shipowner must obtain the International Ship Security Certificate(ISSC). If the carrying vessel has not ISSC, the ship may be detained by the contracting governments. The Joint Cargo Committee(JCC) in London adopted the Cargo ISPS Endorsement, in which the assured who knowingly ships the cargoes on a non-ISPS Code compliant vessel will have no cover. However, where there is no the Cargo ISPS Endorsement in a Marine Cargo Insurance Policy and the cargo is carried by a non-ISPS Code certified vessel, the legal problem is whether or not it would constitute a breach of an implied warranty of seaworthiness and/or an implied warranty of legality. The purpose of this article is to analyze the potential legal issue on the relations between non-ISPS Code compliant vessel and two implied warranties under Marine Insurance Act(1906) in U.K.

  • In 1994, the International Maritime Organization (IMO) adopted the International Safety Management Code (ISM Code) as SOLAS convention to ensure the safe operation of ships and to protect marine environment from pollution In December 2002, the IMO adopted the International Ship and Port Facility Security Code (ISPS Code) in the Chapter XI-1 of SOLAS to ensure the security of ships, crew, cargo and port facility. With 1 July 2004 being the coming into effective date of ISPS Code, there is a sense of urgency among the shipping companies and port authorities to accomodate the ISPS Code. Although both the ISM Code and the ISPS Code are based on the management system concept introduced in the ISO 9001, two Codes pursue different objective. Accordingly, it is meaningful to compare and analyze the requirements of three standards. In this article, the backgrounds, principles and requirements of three standards are analyzed and presented to offer several suggestions on the establishment and implementation of security measures in compliance with the ISPS Code to the shipping industry in time.

In the last few years, several articles have been devoted to the study of ISPS Code(International Code for the Security of Ships and of Port Facilities). The Diplomatic Conference on Maritime Security held in London in December 2002 adopted new provisions in the International Convention for the Safety of Life at Sea, 1974 and this ISPS Code to enhance maritime security. These new requirements form the international framework through which ships and port facilities can co-operate to detect and deter acts which threaten security in the maritime transport sector. Accordingly, the purpose of this paper is to suggest an introduction of Maritime Security System and understanding of ISPS Code.

  • The application of all regulations during building phase, plus constant vigilance in operation is essential to reducing the risk of fire aboard. A Safety by design approach is increasingly important. Fire safety regulation can solve problems which are hard to be solved by HSC code(International Code of Safety for High Speed Craft). Recently HSC code is applied for ship design development or guidance to the designer and demonstrates many advantages. In this pages, ship fire Safety are realistically modeled as ship design and the shipboard fires & muster stations are analyzed using HSC Code.

A Study on the Legislation Types and Prescriptions of American Earth Building Codes (미국 흙건축 법규의 법제화 유형 및 규제내용 분석)

  • The purpose of this study is to analyze the legislation types and prescriptions of American earth building codes. The process of this study is as follows: (1) To understand the legislation background of American earth building codes, this study investigated the history and present state of earth building techniques which is used in USA. (2) To understand the legislation method and procedure of American earth building codes, this study investigated the legislation system of American building codes and the process of model building codes development and adoption. (3) To provide basic data for the legislation of Korean earth building codes or guidelines, this study analyzed American earth building codes about adobe, compressed earth block and rammed earth. The result of this study is as follows: (1) To meet need of a single coordinated set of national model building codes in the United States, the nation's three model code groups decided to form the International Code Council and the first edition of the International Building Code was published in 1997. In the International Building Code there are prescriptions on adobe construction. (2) There are three legislation types of earth building codes in USA. First is to use prescriptions of International Building Code on adobe construction. Second is that State governments establish and issue a separate document under its own title. The last is that local jurisdictions adopt International Building Code with amendments or additional rules. (3) On the base of analysis of American earth building codes, this study proposed the legislation process and direction of Korean earth building codes and guidelines.
